How to Transfer an H-1B to a New Employer After a Layoff

If your H-1B job ends in a layoff, a new employer can usually sponsor you without waiting for the old employer’s petition to be “transferred.” The prospective employer must obtain a labor condition application (LCA) and file its own, nonfrivolous Form I-129 petition. If you meet H-1B portability requirements, you may generally begin the new job when that petition is properly filed. The separate grace-period rule gives up to 60 consecutive days—or the remainder of your authorized validity period, whichever is shorter—to take action, but it does not itself authorize employment.

Your exact last day of employment, I-94 expiration, prior work history, filing timing and immigration status determine the result. Treat the dates as a legal calculation, not a guaranteed 60-day countdown, and have the prospective employer’s immigration counsel or a qualified U.S. immigration attorney review the case.

What happens to your H-1B after a layoff

An H-1B classification is tied to the employment described in an approved petition. When that employment stops, the old employer does not hand its petition to the next company. Instead, the new employer files a new petition for its own position.

Federal regulation 8 CFR 214.1(l)(2) protects certain workers from being treated as having failed to maintain status solely because employment ended. The protection lasts for up to 60 consecutive days after the cessation of employment, or until the end of the authorized validity period, whichever is shorter, once during each authorized validity period. The Department of Homeland Security may eliminate or shorten the period. The regulation also states that, unless separately authorized under 8 CFR 274a.12, the worker may not work during the grace period.

That creates two separate questions:

  • Can you remain in the United States while arranging the next step? Often, for the applicable grace period or the remaining authorized validity period.
  • Can you work for the new employer? Generally only after a qualifying portability filing is made, or under another independent employment authorization rule.

A pending filing that does not satisfy portability conditions is not a work permit.

Calculate the real deadline before doing anything else

Start with documents and dates rather than an assumed calendar period. The controlling deadline is the earlier of the applicable grace-period end and the end of your authorized stay. DHS can also shorten or eliminate the grace period in an individual case.

Date or fact Why it matters What to verify
Actual cessation of employment Starts the potential grace-period calculation. The final day you were employed, not necessarily the date you received notice. Review payroll, termination and employer records.
Authorized validity end Can cut the period shorter than 60 days. Check the most recent approval notice and the I-94 record. The earlier expiration controls the timing analysis.
Prior H-1B work and admission history Portability requires specific status and employment conditions. Collect approval notices, passport admission records, prior petitions and employment dates.
New employer’s filing date For an eligible worker, filing can trigger portability work authorization. Obtain the USCIS receipt and confirm that the petition was properly filed and is nonfrivolous.

Do not count a full 60 days automatically. For example, if employment ends while only 24 days remain in the authorized validity period, the practical period is limited by those 24 days. If the government has shortened or eliminated the grace period, a personal calculation based on 60 days will be wrong.

H-1B portability: the conditions that permit an early start

The portability statute allows a qualifying H-1B nonimmigrant to accept new employment when the prospective employer files a new petition, rather than waiting for approval. The rule is conditional. USCIS materials and the statutory language quoted in agency decisions identify requirements that include the following:

  • You were lawfully admitted to the United States in H-1B status, or were otherwise provided H-1B status.
  • The new employer files a nonfrivolous petition for new H-1B employment before your period of authorized stay expires.
  • You have not engaged in unauthorized employment after admission and before the new petition was filed.
  • The petition describes a qualifying H-1B position and meets ordinary petition requirements, including the required LCA.

“Nonfrivolous” means the filing has a genuine legal and factual basis; a filing made merely to create work authorization without a qualifying job can create serious problems. The employer and its counsel must also assess whether the offered role is a specialty occupation and whether your education and experience support it. A worker who does not meet the portability conditions should not begin work simply because an I-129 was submitted.

Step-by-step: how the new employer files

1. Have the employer’s counsel review your immigration record

Give the prospective employer copies of your current and prior H-1B approval notices, passport biographic and admission pages, I-94 record, résumé, degree evidence, recent pay records and termination information. Counsel should reconcile the last day worked, the authorized validity end date, prior employers, previous filings and any periods that could be viewed as unauthorized employment.

This review is also where the employer evaluates the offered job, worksite locations, wage level and whether an amended or additional filing is needed for the facts of the position. Do not rely on a recruiter’s statement that a case is “portable” without this review.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

2. Obtain the labor condition application

The prospective employer generally obtains a new LCA for the offered H-1B employment. The LCA concerns the job’s occupation, wage and worksite attestations; it is associated with the new employer’s petition, not transferred from the former employer.

3. Prepare and file Form I-129

The employer submits its own Form I-129 petition to USCIS with the LCA and supporting evidence. The form asks about the proposed duties, the beneficiary’s occupation and experience, and other facts needed to establish eligibility. USCIS form editions and filing instructions change. A USCIS Form I-129 edition identified in older agency material was dated 04/01/24, but the employer must use the edition and filing address accepted on the date of filing.

The filing package normally explains the employer, position, wage, worksite, requested validity period and your qualifications. The employer—not the former employer—controls this petition and is responsible for the petition filing and required fees.

4. Preserve proof of the filing

Ask for a complete copy of the filing and the USCIS receipt notice. The receipt date is critical when portability is being used. Keep the delivery confirmation, receipt number, petition copy and evidence of the job’s start date with your immigration records.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

5. Start only when portability actually applies

An eligible worker may generally begin the new H-1B job when the qualifying petition is filed, without waiting for approval. The permission comes from the portability statute and the qualifying filing—not from the grace period. If counsel identifies a problem with admission, status maintenance, prior employment or the petition itself, wait for individualized advice instead of assuming that filing alone authorizes work.

6. Complete employment-verification steps

The new employer must complete its Form I-9 process and retain the documents required for employment verification. USCIS employer guidance discusses H-1B portability and I-9 handling, but employers should use the current Form I-9 instructions and current agency guidance at the time of hire.

When can you start the new job?

There are three distinct situations:

Situation Work for the new employer Reason
Qualifying portability petition properly filed while you remain within the applicable authorized period Generally yes, upon filing, subject to the statute and petition facts. The portability rule can authorize employment before approval.
You are only within the post-termination grace period and no qualifying work-authorizing filing has been made No. 8 CFR 214.1(l)(2) says the grace period does not itself authorize work.
A filing exists but portability conditions are not satisfied Do not assume authorization. A pending petition cannot cure every status or unauthorized-employment issue.

If USCIS later denies, revokes or otherwise takes adverse action on the petition, the consequences depend on the decision and your other immigration facts. Stop treating the job as automatically protected and obtain prompt counsel about work, status and departure options.

What if the new petition cannot be filed in time?

USCIS correspondence about post-termination options has described actions that may be available during the up-to-60-day period, including seeking another nonimmigrant status. It also notes that certain qualifying filings made within the period can permit a person to remain in the United States beyond it. These routes are not interchangeable with an H-1B portability filing.

Possible action What it seeks Work consequence while pending
New employer H-1B petition New H-1B employment and, when eligible, portability work authorization. May permit work upon filing if all portability conditions are met.
Change-of-status request to another nonimmigrant classification A different immigration status in the United States. Filing generally does not automatically authorize employment; authorization depends on the requested classification and separate rules.
Adjustment-of-status application Permanent-resident processing from inside the United States, if independently eligible. Work authorization is a separate benefit unless and until an applicable employment authorization rule or document permits work.
Other qualifying application or petition A benefit or status identified as suitable for the individual facts. Must be evaluated under that category’s rules; do not infer H-1B work permission.

The availability of any option depends on facts such as your status history, eligibility for the requested category, the filing date and the evidence. A stay-related filing can preserve authorized presence without preserving H-1B employment permission. USCIS’s historical options correspondence does not establish that every listed route is available to every laid-off H-1B worker, so use current USCIS instructions and individualized legal advice.

Common mistakes that can damage a transfer

Assuming the grace period is guaranteed

The regulation says “up to” 60 consecutive days, not an automatic entitlement to the full period. The authorized validity end date can be earlier, and DHS may shorten or eliminate the period.

Working during the grace period

Looking for a job, interviewing and negotiating are different from performing services. The regulation expressly says the worker may not work during the grace period unless separately authorized. Wait for a qualifying portability filing or another independent work authorization.

Waiting for approval before filing

Waiting can consume the available period. The employer should plan the LCA and I-129 early enough to file while you remain within the applicable authorized period. Premium processing, if selected and available, does not replace the requirement to file an eligible petition; it affects processing speed, not the underlying conditions.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Filing after the authorized period has ended

A petition filed after the controlling period can face eligibility and status problems. Counsel should calculate the deadline from the actual cessation date and authorized validity end, then account for delivery and USCIS filing requirements.

Ignoring prior unauthorized employment

Portability conditions include a requirement concerning unauthorized employment after admission and before the new petition. Inform counsel about every employer, side job, unpaid work arrangement and gap rather than omitting an inconvenient fact.

Using an obsolete form or filing address

USCIS periodically changes form editions, fees, addresses and filing procedures. The employer should download current instructions immediately before dispatch and confirm that the filing location accepts the edition being used.

Treating “transfer” as a simple employer switch

The new company must prove its own position and comply with its own LCA and petition obligations. A copy of the former employer’s approval notice is useful evidence of history, but it is not a substitute for the new filing.

A practical document and communication checklist

  • Written record of the last day of employment and the reason employment ended.
  • Most recent H-1B approval notice and every relevant prior approval notice.
  • Current I-94 admission record and passport pages showing admission and expiration information.
  • Copies of prior H-1B petitions, LCAs and amendments, if available.
  • Recent pay statements and other evidence of the prior employment relationship.
  • Résumé, degree certificates, transcripts, credential evaluations and experience letters relevant to the new position.
  • New offer letter describing duties, salary, worksite and expected start date.
  • Contact details for the prospective employer’s immigration counsel and a calendar showing every filing deadline.

Tell counsel immediately about international travel plans, dependents, pending applications, previous status violations, periods without pay and any work performed outside the approved job. Those facts can affect strategy even when the basic portability rule appears to fit.

Questions to resolve with the prospective employer’s lawyer

  1. What is my legally supportable last day of employment, and what date controls the grace-period calculation?
  2. What is the end date of my current authorized stay, and which date is earlier?
  3. Do my admission and employment records satisfy the portability conditions?
  4. Has the new LCA been obtained for the actual job, wage and worksite?
  5. Which Form I-129 edition, filing address and fee schedule apply today?
  6. On what date will USCIS receive the petition, and how will receipt be documented?
  7. Do the facts permit me to start on filing, or must I wait for another event?
  8. What happens to my work authorization if USCIS issues a request for evidence, denial, revocation or other adverse notice?
  9. If filing the H-1B petition is not possible in time, which alternative status or benefit is genuinely available, and would it authorize work?
  10. How could travel outside the United States or the status of a spouse or children affect the plan?

Key legal boundary

The most important distinction is between authorized stay and employment authorization. The post-termination rule can prevent an immediate status failure for a limited period, while the portability statute can authorize a qualifying new H-1B job after filing. Neither rule guarantees a complete 60 days, and neither removes the need to satisfy the petition’s legal requirements.

As of October 8, 2026, the eCFR text of 8 CFR 214.1(l)(2) states: “DHS may eliminate or shorten this 60-day period as a matter of discretion.” It also states: “Unless otherwise authorized under 8 CFR 274a.12, the alien may not work during such a period.” Use those boundaries when planning, and have current USCIS instructions and case-specific counsel control the filing decision.
