There is no single federal construction-project comment portal or universal deadline. To submit a useful comment, find the project’s lead agency and current public notice, confirm which review stage is open, follow that notice’s deadline and submission method, and write a specific, evidence-supported response. Save the document and your submission receipt.
What determines where and when you comment?
Federal construction projects can be reviewed by different agencies under different procedures. A highway, water facility, federal building, energy project, or other infrastructure proposal may have a National Environmental Policy Act (NEPA) review, a separate permitting proceeding, or both. The lead agency’s current project notice controls the comment period, deadline, docket or project number, accepted submission channels, attachment rules, and agency contact.

Do not assume that another project’s deadline, online form, or comment period applies. Even within one agency, procedures can differ by project type and document. A notice may invite comments by web form, email, mail, a public meeting, or several of these methods. Some proceedings also have a separate process for becoming a formal party or intervenor; filing a comment alone may not provide that status.

Start with the project’s official agency page and notices in the Federal Register. Search by the project name, location, applicant, facility type, and terms such as “notice of intent,” “scoping,” “draft environmental impact statement,” “DEIS,” “environmental assessment,” or “public comment.” The Environmental Protection Agency (EPA) explains that agencies may announce NEPA opportunities through Federal Register notices, agency websites, newspapers, and direct mail. EPA’s environmental impact statement listings can also help locate EIS documents that are open for comment.

Record the identifying information
Before reading the technical material, make a short project record containing:
- The lead agency and any cooperating agencies.
- The official project name and location.
- The docket, permit, application, or project number.
- The title and date of the notice.
- The agency contact listed for questions.
- The web address or mailing address specified for submissions.
Use the exact identifier from the notice in your subject line or online form. Agencies may handle several projects with similar names, and a comment sent to the wrong docket may not be associated with the proceeding you intend.
Step 2: Identify the open review stage
A comment opportunity is tied to a particular decision point. Read the notice to determine what the agency is asking the public to address and which document is part of the record.
Scoping or the start of an EIS
Scoping occurs near the beginning of an environmental impact statement (EIS) process. The agency seeks input on the range of issues, reasonable alternatives, affected resources, and studies that should be considered. An EIS notice of intent describes the proposed action, the scoping process, meetings, and ways to participate. At this stage, comments are most useful when they identify potentially affected resources or communities, explain why an issue deserves analysis, and suggest reasonable alternatives or methods of study.
Draft EIS review
After a draft EIS is published, the agency requests comments before preparing the final EIS. The 2024 edition of 40 CFR Part 1503 states that comments on an environmental impact statement or proposed action should be as specific as possible. A commenter may address the adequacy of the analysis, the merits of alternatives, or both. Where possible, identify the relevant EIS section or page, propose a specific change, and describe supporting data, sources, or methods.
Environmental assessment or another agency process
An environmental assessment (EA) does not automatically create the same public-comment sequence as an EIS. A February 2026 Department of the Interior rule explains that the amended NEPA statute expressly provides for public comment at the notice-of-intent stage for an EIS, while Interior procedures do not establish an additional general public-comment period for every EA; an Interior bureau may invite comments at its discretion. This is an agency-specific example, not a rule for every federal project. If an EA or another document is available, rely on that project’s notice for whether comments are accepted and what questions are in scope.

Separate permitting or regulatory proceedings
A construction project can have a proceeding that is not the NEPA comment period, such as a permit, certificate, or rate-related case. The notice may use different terms, deadlines, and participation requirements. In a 2026 Federal Energy Regulatory Commission (FERC) project notice, the agency expressly distinguished filing a comment from intervening. If you need rights associated with party status, look for a separate intervention or participation instruction rather than assuming a comment provides it.

Step 3: Read the notice for controlling instructions
Use the notice as your checklist. General citizen guidance can explain common practices, but the project notice determines what is accepted in this proceeding.
- Write down the closing date and time zone. Treat the stated deadline as controlling. Do not import a date from another project or from an older guide.
- Copy the project and docket identifiers. Keep the spelling and numbering exactly as shown.
- List every accepted method. The notice may allow an online docket, email, postal mail, a public meeting, or a combination.
- Check file and format limits. Note permitted file types, size limits, page limits, naming conventions, and whether attachments are allowed.
- Check accessibility instructions. The 2024 Part 1503 provisions call for electronic submission with reasonable accessibility measures. The notice may provide a particular accessible format, accommodation contact, or alternate method.
- Save the agency contact. Ask procedural questions before the deadline if the notice is unclear; do not send substantive arguments to an address that the notice does not designate for comments.
Some notices invite oral comments at a hearing or session and written comments afterward. Confirm whether an oral statement will be transcribed or otherwise placed in the administrative record, and whether a separate written submission is required.
Step 4: Review the document efficiently
Download or obtain the document named in the notice, then review it with the project decision in mind. You do not need to comment on every page. Focus on an issue that could affect the agency’s analysis, alternatives, mitigation, or decision.
Build an issue record
- Issue: What environmental effect, alternative, assumption, or omission concerns you?
- Location: Where does the document discuss it? Record the chapter, section, table, figure, or page.
- Importance: Who or what could be affected, and why could the effect matter?
- Evidence: What data, study, local observation, technical source, or method supports your concern?
- Requested response: What should the agency analyze, correct, disclose, compare, or change?
Pointing staff to an exact portion of a document makes the issue easier to evaluate. FERC explains that its natural-gas DEIS comment sessions are intended to help the public identify specific environmental concerns and that references to exact portions of the document direct staff to the issue. That is an example of agency practice, not a universal requirement.
Distinguish disagreement from a useful correction
A statement such as “I oppose this project” records your position but gives the agency little technical direction. A stronger comment explains the factual or analytical basis for the position. For example, identify an alternative route discussed in the document, explain a specific impact that the comparison understates, cite the relevant page, and ask the agency to analyze a defined alternative or mitigation measure. You may still state your overall position; add the reasoning that allows the agency to respond.

Step 5: Write a specific, supported comment
Organize each issue so a reviewer can locate it and understand the action you request. The following structure works for a scoping letter, draft-EIS comment, or many agency-specific comment periods:
- Identify the proceeding. Put the project name, docket or project number, document title, and comment-period name at the top.
- State the issue in one sentence. Name the resource, alternative, impact, or analysis you are addressing.
- Cite the document. Give the page, section, table, figure, or appendix whenever available.
- Explain the concern. Describe the factual problem, missing information, uncertainty, or consequence.
- Provide support. Include data, a source, a method, or a clearly identified local observation. Explain how the support relates to the project.
- Request a concrete response. Ask the agency to add an analysis, correct data, compare an alternative, revise an assumption, disclose an impact, or adopt a mitigation measure.
- Separate issues. Use a heading or numbered paragraph for each distinct concern.
Comments can address either the adequacy of the statement or the merits of the alternatives, and they can address both. Avoid treating a document’s conclusion as self-proving: explain which assumption, data set, model, or comparison you believe needs attention.

Please include this submission in the administrative record.Replace every bracketed field before sending. Keep the tone professional and direct. A concise comment with traceable support is more actionable than a long submission that repeats general objections.

Use only a channel the notice identifies for the open comment period. When multiple methods are available, select the one that reaches the correct docket, accepts your attachments, provides a receipt, meets accessibility needs, and records the submission as part of the proceeding.

The 2024 Part 1503 provisions emphasize electronic submission, but an agency may specify alternate methods or accommodations in its notice. Do not send duplicate versions through several channels unless the agency instructs you to do so; duplicate filings can create confusion about which version is final.
Protect sensitive information
Assume that a submitted comment may be posted publicly. EPA warns that personal information included in the body of a comment can be posted with it, subject to applicable exceptions. Avoid including unnecessary home addresses, telephone numbers, email addresses, financial details, medical information, or information about another person. If you must provide confidential business information or other sensitive material, follow the notice’s separate-handling instructions rather than placing it in an ordinary public comment. When the instructions are unclear, contact the listed agency representative before submitting.

Step 7: Keep proof and understand what happens next
Save the exact version you submitted, every attachment, the notice, and your confirmation. Record the date and method in a simple log. If the agency’s system shows a docket entry, verify that the project identifier and document title are correct.
After the comment period, the agency may summarize and respond to substantive comments in a final EIS, decision document, response-to-comments volume, or another proceeding record. The form and timing of a response depend on the agency and stage. A comment does not guarantee the agency will adopt the requested alternative; it places your issue and supporting material before the decision maker for consideration under the applicable process.
If you need to participate as a formal party, monitor the notice for intervention or other status requirements. The FERC example demonstrates why this distinction matters: a comment and an intervention filing can serve different legal purposes and have different deadlines.
Deadlines: why a generic number can mislead
EPA’s general citizen guide has described a 45-day minimum comment period for a draft EIS. That older general description should not be treated as a universal current deadline. Statutory amendments and agency-specific procedures can change how and when comments are invited. The February 2026 Interior rule illustrates this point by addressing comment at the notice-of-intent stage and the absence of an additional general comment period for every EA under Interior procedures. Always use the date and instructions in the current project notice.
If a notice appears to contain conflicting dates, contact the agency before filing and retain the written clarification. Do not wait until the final day when the notice requires receipt by a particular time or uses a mailing rule.
Common problems and fixes
There is no obvious comment button
Search the agency project page and Federal Register notice for “submit comments,” “public participation,” “docket,” “scoping,” or “draft EIS.” The accepted method may be an email or mailing address rather than a centralized form.
The document is large or difficult to navigate
Use the table of contents, search within the file for the resource or alternative that concerns you, and record page and section references as you go. If an attachment is too large, follow the notice’s file-limit or alternate-delivery instructions instead of splitting it arbitrarily.
You missed the stated deadline
Read the notice for any late-filing policy and contact the listed agency representative promptly. Do not label a late submission timely or assume it will be considered. If another comment period or related proceeding is open, verify that it concerns the same decision before redirecting your submission.
You need an accessibility accommodation
Use the accommodation contact or alternate method in the notice. Explain the format or access issue early enough for the agency to provide a workable channel, and keep a record of the request and response.

Do not put it in the ordinary public comment field. Follow the notice’s confidential-business-information or sensitive-material procedure and separate public material from material that requires restricted handling.
You want to speak at a meeting
Confirm whether registration is required, how much time is allotted, and whether oral remarks become part of the record. Bring a short written version if the notice recommends or permits a written submission, and use the same project identifier.
