There is no reliable way to guarantee that recorded bhajans will avoid a YouTube copyright claim. Indian copyright law includes a limited exception for certain uses during a bona fide religious ceremony, but it does not clearly settle whether a particular livestream or its archived replay qualifies. YouTube separately scans live streams for copyrighted matches and can interrupt a stream; an archived video can receive a claim afterward. The safest practical route is to get permission for the exact recording and online uses, ask the rights owner to allowlist your channel, and prepare for detection anyway.
Does India’s religious-ceremony exception cover a YouTube livestream?
Section 52(1)(za) of the Copyright Act, 1957 refers to the performance of a literary, dramatic or musical work, or communication to the public of such a work or sound recording, in the course of a bona fide religious ceremony. The Copyright Office’s official exceptions page, last updated 16 July 2026, sets out that statutory language: Exceptions to infringement under the Copyright Act, 1957.

The wording is not a blanket exemption for any devotional programme, every recording labelled a bhajan, or an online replay that remains available after an event. The official material does not resolve how the exception applies to a specific online transmission, an archived stream, or a programme that may not legally qualify as a bona fide religious ceremony. Do not assume that playing a recording during an event automatically makes its YouTube livestream claim-free.

Why YouTube may claim or interrupt a bhajan livestream
YouTube says all live streams are scanned for matches to third-party content, including another live broadcast. If it identifies third-party material, it may replace the stream with a placeholder image and warn the creator to stop using the content. If the material remains, the stream can be interrupted or terminated. A copyright strike can also end a stream. See YouTube Help: Copyright issues with live streams.
If you choose to archive the finished livestream, YouTube says Content ID claims are made after the live stream is complete. A stream that was not interrupted while live is therefore not cleared for its replay. YouTube’s broader guidance on permission, copyright exceptions, public-domain material, Creative Commons, and its music tools also cautions that none of those routes guarantees avoiding a claim or strike: YouTube Help: Copyright on YouTube.

Check the rights to the exact recording, not just the bhajan
A devotional song can involve more than one set of rights. YouTube explains that a song may engage rights in both the master recording and the underlying composition. Record labels commonly control master-use rights; publishers and collecting societies may handle composition rights and public-performance licensing. Before using a track, identify the precise recording and establish who can authorize each relevant right. Ask whether permission covers the online live transmission, the archived replay if you want one, the territories where viewers may watch, and how long the video may remain available. A licence for an in-person event or a different recording should not be assumed to cover those uses.

Safer ways to use recorded bhajans

Before you go live: a practical rights checklist
- Identify the track. Record the exact title, performer, version, label or publisher information, and source. Do not treat the age or devotional nature of a composition as proof that a particular recording is free to use.
- Confirm who controls the rights. Ask separately about the master recording and composition if different parties administer them. A performer’s consent may not cover a released recording or all composition rights.
- Get specific written permission. Make sure it names the recording and covers YouTube livestreaming. If you want the replay to remain available, ask for archive rights too; clarify territory and duration.
- Request Content ID allowlisting. Ask the relevant rights owner to add your YouTube channel before the event, and keep the permission and allowlist confirmation. YouTube says a licensed stream can still be interrupted without allowlisting.
- Prepare a fallback. Have an alternative track you have cleared or a way to stop playback promptly if YouTube detects third-party content. Do not rely on the stream continuing after a warning.
- Decide whether you need an archive. If you do not need a public replay, decide in advance whether to keep the livestream unarchived. If you do archive it, account for the possibility of a later Content ID claim.
For a specific disputed use or uncertainty about whether an event qualifies under Indian law, consult an India-qualified copyright lawyer. These practical steps lower risk; they do not establish a legal entitlement or guarantee a platform outcome.

If YouTube detects the music
- You receive a warning or the stream is replaced or interrupted: stop the detected material or switch to a track you have cleared. YouTube may terminate the stream if the content remains.
- The stream finishes but the archive is claimed: review the claim in YouTube Studio and compare it with your permission, including the exact recording and archive terms. A live stream that ran to completion is not proof that the replay is cleared.
- You have a licence but the stream is interrupted: check whether the rights owner actually allowlisted the channel. YouTube warns that a licence alone may not prevent live interruption.
- You believe a claim is mistaken: use YouTube’s dispute process only if you have a valid basis and supporting rights evidence. A claim is not itself a court decision, but disputing one does not guarantee the result you want.
