The only reliable comparison is the amount you will pay for the entire stay under the same dates, occupancy, room, cancellation terms, payment timing and included services. A low nightly figure can exclude a mandatory resort or facility fee, taxes, booking charges or a payment surcharge. Open the full price breakdown, identify every compulsory amount, and confirm the last payable total before you authorize payment.
This guide gives you a repeatable check for hotel websites, metasearch results and online travel agencies. It also explains what current U.S. rules require, why UK and EU guidance is not interchangeable with U.S. law, and how to treat discounts, “rooms left” messages and ranking labels as claims to verify rather than proof of a bargain.

What makes a hotel advertisement misleading?
A hotel ad becomes misleading when the prominent price or claim creates an inaccurate impression about the offer a traveler can actually book. The problem is often not a mathematically incorrect number; it is a headline that omits a charge, compares unlike rooms or dates, or presents a discount without the context needed to judge it.
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
For example, a listing may show a room at $199 per night while adding a $39 daily mandatory resort fee later. The $199 figure can be a real component of the price, but it is not the complete comparison for a guest who must pay both amounts. The Federal Trade Commission (FTC) uses this kind of $199-plus-$39 illustration as a hypothetical example, not as a market statistic.

Do not treat one warning sign as proof that a particular hotel or platform has broken the law. Fee and advertising rules depend on the country, the type of booking and the date. The practical test is simpler: can you identify the full compulsory cost for the exact room and terms before paying?
Headline rate versus bookable offer
A displayed rate should correspond to an offer that a consumer can actually reserve. Under the FTC compliance FAQ for covered U.S. lodging, a business may advertise the lowest available total price when that price is genuinely bookable and the surrounding information is not misleading. If the advertised rate applies only to different dates, one occupant, a different room, a nonrefundable condition or a room that disappears at checkout, it is not a fair comparison to your intended stay.
Why separated mandatory fees matter
The FTC’s economic analysis concluded that separating mandatory resort fees from room rates before showing the total raises search and cognitive costs. In practical terms, travelers must do extra arithmetic and keep more conditions in mind, making a list of apparently cheap rooms harder to compare. That conclusion is qualitative; it is not a current estimate of the dollar harm or the percentage of listings affected.

Use this short check each time you open a hotel offer. It prevents most headline-price surprises before you invest time entering traveler details.
- Set the exact search. Enter your destination, arrival and departure dates, number of adults and children, and rooms. Confirm that the property page still displays those same inputs.
- Open the price details. Expand links such as “price breakdown,” “fees,” “taxes,” “rate details” or “see all charges.” Do not rely on the number in a search card.
- Record the whole-stay total. Note the currency, number of nights and whether the figure covers all guests and rooms. A per-night amount is only an input to the calculation.
- Separate compulsory and optional amounts. Mark each line as mandatory, optional, a government charge, or not clearly explained. Ask who collects it and when it is charged.
- Check the conditions. Compare cancellation deadline, refundability, payment timing, included meals, parking, Wi-Fi and room occupancy with other offers.
- Advance to the final review screen. Before entering or confirming payment, verify the last displayed payable total, including selected extras and any amounts collected at the property.
- Save the breakdown. Keep the confirmation and itemized price for your records so you can identify what changed if the final charge differs.
If any amount is unexplained, pause and ask the hotel or booking platform for a written clarification. A fast answer is less valuable than a clear answer tied to your exact dates and room.
Which hotel fees must be included?
Under the U.S. FTC Rule on Unfair or Deceptive Fees, effective May 12, 2025, covered short-term lodging offers must include mandatory fees in the advertised total price. A business may still itemize those fees, but the itemization cannot overshadow the total. Online disclosures must be unavoidable, understandable and written in plain language; another statement cannot contradict them.
The rule does not prohibit a particular fee type or set a maximum amount. It governs how covered mandatory charges are presented. The FTC’s compliance FAQ says the final amount must be shown before payment, including charges excluded from the initial total and optional items the consumer selected.

Mandatory fees
A mandatory resort, destination, facility, amenity or service fee belongs in the total price when the guest cannot decline it. The label is not decisive. A charge called an “amenity fee” can still be compulsory if it is automatically imposed on every reservation or if the service is effectively unavoidable.
Ask four questions for every such line:
- Is payment required for this booking?
- Is it charged per night, per stay, per room or per guest?
- Is tax applied to the fee?
- Will the hotel collect it now, or will it be due at the property?
If the answer to the first question is yes, include the amount in your comparison even when the platform displays it in a separate box.
Government charges
The FTC FAQ identifies government charges as one category that may be excluded from the initial total under the U.S. Rule. The excluded amount and its purpose must be disclosed before payment, and it must appear in the final amount you are asked to pay. Do not assume that “taxes not included” means taxes are optional.
Booking, administrative and payment charges
Look for booking, service, administration, cleaning, destination and payment-processing lines. Their treatment can differ by jurisdiction and booking model, so do not generalize the U.S. Rule to every country. For your own comparison, the important question is whether the charge is compulsory and whether it is included in the amount shown immediately before payment.
Optional ancillary services
The FTC FAQ lists optional ancillary goods or services among the categories that may be excluded from the initial total. Examples include trip protection, breakfast, parking or an upgraded room when the guest can decline them. Once you select an optional item, its price must be included in the final amount before payment.
A box that is preselected, difficult to untick or presented as necessary when it is not may not function as a genuinely optional choice. Check the total after removing every extra you do not want, then add back only the services you deliberately selected.
How to compare two hotel offers fairly
Use a like-for-like comparison instead of choosing the smallest number in two search cards. The following axes expose most false bargains.

| Comparison axis | What to match | Why it changes the result |
|---|---|---|
| Stay dates | Identical arrival and departure dates, including time-zone or date changes | Weekend, holiday and event pricing can make a “discount” comparison irrelevant to your search. |
| Occupancy | Same adults, children, ages and number of rooms | A headline may apply to one guest while your reservation needs a larger room or an extra-bed charge. |
| Room category | Same bed type, view, size, accessibility features and occupancy limit | A standard room and a suite are different products even at the same property. |
| Cancellation | Same free-cancellation deadline and refund conditions | A lower nonrefundable rate trades away flexibility and is not directly comparable to a refundable rate. |
| Payment timing | Pay now, partial deposit, pay at property and currency-conversion terms | The amount due today and the amount due later can differ; exchange-rate or card charges may also matter. |
| Included services | Breakfast, parking, Wi-Fi, resort access, transfers and other stated inclusions | A cheaper room may require paid add-ons to provide the same stay. |
| Mandatory charges | All per-night and per-stay fees, taxes and compulsory services | The headline rate can hide the largest difference between otherwise similar offers. |
How to test a discount claim
Write down the total for the offer you are considering, then inspect what the “was” price represents. It should refer to the same property, room, dates, occupancy and booking conditions. The UK Competition and Markets Authority (CMA) examined whether hotel discount comparisons were fair and relevant to the customer’s search; comparing a higher weekend rate with a weekday room a shopper searched for is an example of a potentially irrelevant comparison.

Outbyte PC Repair FREEClear out junk files and repair common Windows errorsFree Scan →Outbyte Driver Updater FREEFix the driver behind crashes, sound loss and screen glitchesFind Drivers →In the European Union, general consumer guidance says sellers making price-reduction claims should indicate the lowest price applied during at least the preceding 30 days. That guidance applies within its EU legal context; it is not a universal rule for hotel advertising worldwide and does not replace checking the actual stay total.
How to read the checkout screen
The last review page is your most important evidence because it shows what the platform asks you to authorize. Move through the booking far enough to reveal all mandatory details, but do not click a final purchase or payment button until the amount and terms are clear.
Find the payable total
Look for language such as “total,” “amount due now,” “payable today,” “due at property” and “total including taxes and fees.” Add those amounts mentally or with a calculator if they are split across sections. A page that shows a room total plus a later property charge is not the same as a single all-in payment; record both parts.
Check what is excluded
Read notes beside taxes, city charges, resort fees and payment methods. Under the U.S. Rule, government charges, shipping charges and optional ancillary services may be excluded from the initial total, but excluded amounts and their purposes must be disclosed before payment. If the final screen still does not state an amount or explains it only in vague language, seek clarification before proceeding.

Inspect defaults and add-ons
Review travel protection, breakfast, parking, transfers, upgrades, late checkout and carbon-offset options. Remove preselected items you do not want and watch whether the total changes. Then select only the extras you intend to buy and confirm that their prices are included in the final figure.
Confirm currency and collection point
Make sure the currency symbol and decimal format are what you expect. Note whether the platform or hotel collects each charge and whether payment is immediate, at check-in or at check-out. A property-collected fee is still part of your trip budget even when it is not charged to your card during the online reservation.

Warning signs that deserve a closer look
These signals justify opening the details and checking the terms. None, by itself, proves that an advertisement is unlawful or false.
- A very low headline followed by “taxes and fees” later: calculate the complete stay total before ranking the offer.
- “Only one room left” or “someone is viewing this now”: verify that the statement applies to your exact room and dates, and note any stated time limit.
- A large percentage discount: identify the reference price, the comparison dates and the same cancellation and occupancy conditions.
- A countdown clock: check whether the room or rate remains available after the clock expires and whether the terms change.
- Prominent “from” pricing: test the advertised starting rate with your dates, party size and room requirements.
- Search-result ordering labeled “recommended” or “popular”: look for explanations of ranking factors, including whether commission or paid placement can affect order.
- A fee with a vague label: request the amount, calculation method, purpose and collection point in writing.
- A total that changes after traveler details: compare the before-and-after screens and check whether occupancy, nationality, membership status or payment method triggered the change.
The CMA’s hotel-booking work examined hidden charges, discount claims, scarcity messages and the role of commission in search-result ordering. Its case page records undertakings from six booking sites in February 2019 and sector-wide principles adopted by 25 more sites in September 2019. Those are dated enforcement developments, not a current measure of every site’s compliance.

What the rules mean in different jurisdictions
There is no single worldwide hotel-pricing rule. Apply the law where the booking is offered and where the lodging is located, then use the same practical total-price check everywhere.
United States
The FTC Rule on Unfair or Deceptive Fees took effect on May 12, 2025 and covers specified short-term lodging as well as live-event ticketing. For covered lodging, mandatory fees must be included in the total price. Itemization is permitted if it does not obscure that total. The final amount, including excluded charges and selected optional items, must be shown before payment, with online disclosures that are unavoidable, understandable and not contradicted elsewhere.
The Rule does not ban resort fees or dictate their amount. It addresses disclosure and presentation. State laws, local taxes and other consumer-protection rules may impose additional requirements.
United Kingdom
The CMA’s hotel-booking case describes UK consumer-law concerns about hidden charges, discount comparisons, scarcity messages and ranking practices. The page was last updated September 13, 2019, so use it to understand the categories of concern and the undertakings reported at that time, not as evidence that every current listing complies.
European Union
European Commission coordinated actions have addressed price presentation on accommodation platforms, and general “Your Europe” guidance covers price supplements and price-reduction claims. The consumer page was last checked April 30, 2026. EU guidance on a lowest price during the preceding 30 days belongs to that legal context; it should not be presented as a rule that applies to hotels in every country.

Worked examples
Example 1: the cheapest nightly rate is not the cheapest stay
Suppose two four-night offers are for the same room and dates:
| Item | Offer A | Offer B |
|---|---|---|
| Advertised nightly rate | $199 | $215 |
| Room subtotal | $796 | $860 |
| Mandatory daily resort fee | $39 × 4 = $156 | Included |
| Other taxes and charges | Not stated in this illustration | Not stated in this illustration |
| Comparable amount before unstated items | $952 | $860 |
Offer A wins the headline comparison but loses this partial total. You still need the tax and payment details for both offers before declaring a final winner. The $39 figure above is the FTC’s illustrative hypothetical, not a published average.
Example 2: refundable versus nonrefundable
A nonrefundable room may be cheaper than a refundable room on the same dates. If your plans are uncertain, compare the cancellation deadline and refund amount first. Calling the nonrefundable rate a better deal without valuing the lost flexibility mixes two different products.
Example 3: an optional add-on
A booking page lists a room, then preselects breakfast and trip protection. Remove both options and note the lower total. If you want breakfast but not protection, select breakfast only and verify that the final amount includes exactly that choice. An option you can genuinely decline is different from a compulsory fee that appears under a different label.
What to save and what to do when the amount changes
Keep the confirmation email, final price breakdown, room description, cancellation terms and any message explaining a fee. A screenshot or downloaded confirmation is practical recordkeeping, not a legal requirement stated by the FTC sources. Save the currency and date as well as the amount, because a later exchange-rate conversion can otherwise make a comparison difficult.
If the price rises before payment
- Return to the room and rate conditions and confirm that dates, occupancy and room type did not change.
- Expand every new line item and identify whether it is a tax, mandatory fee, optional selection or payment charge.
- Check whether a promotional rate expired or was limited to a different inventory.
- Ask customer support to explain the change in writing, quoting the original displayed amount and the exact booking details.
- Do not authorize payment until you understand the revised total and cancellation terms.
If the amount charged differs after booking
Compare the receipt with the saved confirmation and distinguish a property-collected fee that was disclosed from an amount that was not shown. Contact the hotel and platform promptly, provide the itemized records and request a correction or explanation. If the response does not resolve a potentially deceptive charge, consult the consumer-protection authority in the relevant jurisdiction or your card issuer’s dispute process. The appropriate route depends on where the transaction occurred and the terms you accepted.
Questions to ask before you book
- What is the total for the entire stay in the displayed currency?
- Which amounts are mandatory, and are any collected at the property?
- Are taxes, booking charges and payment surcharges included or excluded?
- Can I decline every add-on, and are any boxes preselected?
- Does this rate match my dates, occupancy, room category and cancellation deadline?
- When is payment taken, and what happens if I cancel?
- What does the discount’s reference price represent?
- Can you send the fee explanation and final total in writing?
Bottom line: book the total, not the headline
Use the same destination, dates, occupancy, room and booking conditions when comparing offers. Treat every mandatory charge as part of the price, remove optional extras you do not want, and check the final payable amount immediately before payment. Discounts, scarcity messages and ranking labels may help you find an offer, but only the itemized total and its terms tell you what the stay will actually cost.
