How to Share Your Medical Records With a Second-Opinion Doctor

Start by asking the second-opinion clinic exactly which records it needs and how it accepts them. Then request the records from each relevant doctor, hospital, lab or imaging center—or ask a provider to send them directly to the clinic. Before you finish, confirm the clinic received the right files and can open them.

How do I arrange the transfer?

  1. Ask the second-opinion clinic what it needs. Check the date range, which records to include, whether it needs imaging reports, the actual image files, or both, and which formats it accepts. Get the correct clinician or department name and the precise delivery destination: portal, upload link, fax number, mailing address or another route. Ask whether the clinic can request records for you. Each office sets its own process. ONC’s patient guidance recommends asking how the clinic accepts records.
  2. Identify every source. Make a list of the primary-care office, specialists, hospitals, imaging centers and laboratories involved in your care. A provider may not have records created by another organization, so contact each relevant source. You can request records such as visit notes, diagnoses, test results, laboratory reports, X-rays and clinical notes; HHS explains patients’ access rights and their limits.
  3. Submit each provider’s request or release form. You can ask for copies for yourself or direct a covered provider to send information to a named person or organization. For a directed request under HIPAA’s access right, put the request in writing, sign it, and clearly identify the recipient and where to send the records. HHS says providers may accept an electronic copy of a signed request or an electronic request with an electronic signature through a secure portal.
  4. Choose a route both offices support. Ask the sending and receiving offices which methods they use, and whether the chosen route carries the complete records and image files in a usable format.
  5. Confirm delivery and readability. Follow up with the second-opinion clinic to check that the records arrived, belong to the right patient and cover the requested period. If imaging files were requested, ask whether they open correctly.

What records should I ask to send?

Let the receiving clinic define the packet when possible. Depending on the reason for the consultation, ask whether it needs recent visit notes, diagnoses, medication lists, laboratory or pathology reports, radiology reports and the original imaging files. A radiology report is not necessarily the same thing as the image itself, so clarify whether the clinician needs both.

HHS describes the access right as covering a broad range of records, including medical and billing records, laboratory test reports, X-rays and clinical notes. Psychotherapy notes kept separately are treated differently: HHS says patients do not have a general right of access to those notes.

Which delivery methods can I use?

Possible routes include secure messaging through a patient portal, direct upload into the receiving provider’s record system, personal email, a health app, fax, mail, in-person pickup, or a CD or USB drive. ONC lists these as possible ways to get or share health records; they are not guaranteed options at every clinic. An available health information exchange may also let providers share records electronically. Confirm the accepted route and formats with both offices rather than assuming one method will work.

Ask about any copying or mailing cost and the expected processing time.

Does HIPAA let doctors send records directly?

In many treatment situations, a patient does not have to act as the courier. The U.S. Department of Health and Human Services Office for Civil Rights says: “The Privacy Rule allows covered health care providers to share protected health information for treatment purposes without patient authorization, as long as they use reasonable safeguards when doing so.” HHS also says providers may communicate for treatment by fax, email, phone or other means. A provider’s ability and workflow for sending records can vary, so ask what it can do. Directing a transfer yourself can help specify the recipient and the material you want included.

How can I protect the records and avoid a failed transfer?

  • Use the destination supplied by the second-opinion clinic. If a fax number or address is unfamiliar, verify it with the clinic before sending; HHS gives confirmation of an unfamiliar fax number as an example of a reasonable safeguard.
  • For a portal, app or other digital service, check who can access the files and how access is controlled. ONC describes access controls, encryption and audit trails as security features used in health-record systems.
  • Keep a list of the providers contacted, the records requested and the date each request was submitted. Follow up with the receiving clinic to resolve missing documents or unreadable images.
  • Ask the provider for a cost estimate and turnaround time before making a large request. HHS says a provider cannot withhold a copy because you have not paid for services, though it may charge reasonable copying and mailing costs. It may not charge for searching for or retrieving the record. State law may provide additional rights.
