There is no universal number of days or years for keeping AI data. Set each retention period from the purpose, data type, jurisdiction, contractual duties and system lifecycle, then make deletion executable and auditable. A sound rule covers prompts, uploads, outputs, logs, feedback, training and evaluation data, derived features, backups, vendor copies and retired model artifacts—not just the database a user can see.
What a defensible AI retention rule contains
A retention rule answers seven questions for every data category:
As an Amazon Associate I earn from qualifying purchases.
- What is the artifact? For example, a prompt, uploaded file, generated answer, safety log, evaluation set, fine-tuning record, feature or model snapshot.
- Why is it processed? State the specific business, safety, security, research or legal purpose. “May be useful later” is not a purpose.
- How long may it remain? Use a fixed period where possible, or a review trigger with a named decision owner.
- What authority permits or requires retention? Record the privacy legal basis and any statutory, regulatory, contractual, litigation or investigation hold.
- Where is it stored? Identify applications, regions, subprocessors, backup systems and offline exports.
- How is it disposed of? Specify deletion, anonymisation or secure restriction, including propagation to derived data and backups.
- What proves completion? Keep a deletion event, scope, timestamp, operator or job identity, result and exception record.
The European Commission’s GDPR guidance says an organisation must ensure personal data is stored “for no longer than necessary for the purposes for which it was collected.” It advises setting time limits to erase or review data, while accounting for legal obligations. The Federal Trade Commission’s business guidance expresses the same discipline in plainer terms: “Keep sensitive data in your system only as long as you have a business reason to have it.” Neither statement creates one AI-wide schedule.

Start with an inventory of the complete AI lifecycle
Retention decisions fail when an organisation inventories only production prompts. Build an inventory for each system, model and provider and trace information from collection through retirement.

| Lifecycle stage | Artifacts to look for | Questions to record |
|---|---|---|
| Collection and ingestion | Web forms, connected repositories, uploaded files, source datasets, consent or notice records | Whose information is present? What source and purpose authorised collection? |
| Development and research | Training and evaluation sets, labeling instructions, experiment copies, notebooks and test prompts | Which version and purpose used the data? Are development copies controlled? |
| Production use | Prompts, attachments, outputs, conversation history, tool calls, safety and performance logs | Which fields are essential for service, security or support, and which are optional? |
| Improvement | Human feedback, preference labels, fine-tuning material, embeddings and derived features | Does a deletion of source data propagate to these artifacts? Can a person be identified? |
| Continuity and recovery | Backups, replicas, exports, caches and disaster-recovery media | When are copies overwritten, and how are restores prevented from resurrecting deleted data? |
| Retirement | Deprecated models, weights, checkpoints, documentation and migration archives | What must remain for an investigation, migration, reproducibility or legal duty? |
Use an AI inventory to record system documentation, data dictionaries, responsible actors and operational links. The inventory should identify the business owner, privacy or security owner, service provider, model version, processing locations and affected data subjects. Scope personal, sensitive, confidential and non-personal data separately; anonymised material may have different obligations, but do not assume a transformation is irreversible without evidence.
Map every category to purpose, legal basis and minimum hold
For each inventory item, write a short purpose statement that a person outside the engineering team can understand. Then identify the applicable privacy basis and any rule that imposes a minimum period. GDPR retention must be considered alongside national labour, tax, anti-fraud and other legal duties. A contract, insurance requirement, security investigation or litigation hold can also require preservation.
Separate minimum retention from maximum retention. A legal duty may require records to remain for a defined period, but it does not justify keeping unrelated fields longer. Conversely, a service team’s desire to retain all conversations for future model improvement is not automatically a lawful or necessary purpose.
Recommended Free Tools
Describe the duration or review rule in privacy notices and internal records. GDPR transparency information includes purposes, data categories, legal basis, recipients, storage duration and relevant rights. If a provider or product changes a purpose—such as using customer prompts for training—update the notice and obtain any consent the law requires before making the new use.

Choose a period or a review trigger
Choose the shortest period that satisfies the stated purpose and applicable obligations. A fixed end date works for predictable records. Where usefulness depends on an event, use a trigger such as account closure, completion of a support case, replacement of a model version or the end of an investigation. Assign a decision owner and a review date; “retain until no longer needed” is not executable without those details.
The European Commission’s example that a recruitment agency’s proposed ten-year CV retention appears disproportionate illustrates proportionality for that purpose. It is not a ten-year rule for AI systems, recruiting or any other category.
| Rule style | When it fits | Control that must accompany it |
|---|---|---|
| Fixed period | Logs needed for a defined security or support window | Automatic expiry and a documented reason for the selected duration |
| Event-based trigger | Records tied to account closure, project completion or model retirement | Reliable event capture, owner and fallback date if the event never arrives |
| Periodic review | Research or evaluation material whose value changes over time | Review cadence, decision criteria, approver and recorded outcome |
| Legal hold | Litigation, regulatory inquiry or unresolved security investigation | Written scope, authority, start date, review date and release process |
Design deletion, anonymisation and restricted retention
Define deletion at the level of each copy and derivative. Removing a row from an application does not necessarily remove a prompt from an analytics warehouse, a fine-tuning file, an embedding index, a vendor account, a cache or a backup. The schedule should state where deletion must propagate and what evidence is available from each system.
Permanent deletion
Use deletion when the purpose has ended and no exception applies. The process should cover primary storage, replicas, search indexes, derived features, exports and provider-held copies. Backups need a documented approach: overwrite on the normal backup cycle, prevent restoration into active systems, or apply equivalent deletion after a restore. Record failures for manual remediation rather than treating a successful database command as proof of completion.

Anonymisation
Anonymisation can support a continuing statistical or research purpose when people can no longer reasonably be identified. Document the transformation, re-identification assessment and remaining data uses. It is not automatically equivalent to satisfying every deletion request, especially when auxiliary data or model outputs could still identify someone.
Secure restriction when deletion is technically unavailable
The UK Information Commissioner’s Office (ICO) suggests placing information securely out of reach with access restricted, or anonymising it, when permanent deletion cannot be performed. Restriction is an exception, not a way to avoid engineering work: isolate the data, block normal processing, limit keys and users, record the reason and set a date to revisit the decision.
Make the schedule executable in systems
- Create a retention register. Give every category an owner, purpose, period or trigger, storage locations, deletion method, legal basis and evidence requirement.
- Tag data at ingestion. Carry source, purpose, sensitivity, subject or account identifier and expiry metadata into queues, object storage and indexes where technically feasible.
- Run recurring or rolling jobs. Schedule expiry for each system and alert on records past due. Test idempotence so a retry cannot create inconsistent results.
- Propagate subject requests. Search by stable identifiers across prompts, uploads, outputs, feedback, evaluation sets, embeddings, fine-tuning material and provider accounts. Document systems that cannot support exact lookup.
- Handle backups and restores. Set overwrite windows, restrict restore access and run a post-restore deletion reconciliation before data becomes available again.
- Capture evidence. Log the category, records or query scope, execution time, systems contacted, success or failure, exceptions and approving owner.
- Review exceptions. Prevent a legal hold or investigation flag from silently becoming permanent. Require a review and release date.
Test deletion with representative records and deliberately failed dependencies. Verify that search, exports, dashboards and model-development pipelines no longer expose the material. Keep audit trails and review the schedule regularly; the ICO recommends both.
Legal holds and other exceptions
A deletion rule is not an instruction to erase evidence needed for a lawsuit, regulator, fraud inquiry, security incident or statutory record. Build a documented approval path. Each exception should state its legal or operational reason, exact data scope, systems covered, approver, start date, review date and expiry or release condition. Preserve only what the hold requires, protect access and keep unrelated records on their normal schedule.

NIST’s AI Risk Management Framework playbook recommends that decommissioning plans consider dependencies, legal and regulatory requirements, investigations, migration and necessary artifacts. NIST AI RMF 1.0 was released on January 26, 2023 and is voluntary; it is implementation guidance, not binding law.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Address model training, derived data and reproducibility
Deleting a source prompt or document is not technically the same as removing information that may have influenced model parameters. The authorities covered here do not define a universal method for unlearning or establish that parameter deletion is equivalent to source-record deletion. Your policy should therefore distinguish:
- Source-record deletion: removing the original prompt, upload, label or record from systems that store it.
- Derived-artifact handling: locating embeddings, features, labels, evaluation copies and fine-tuning datasets created from that source.
- Model-impact assessment: determining whether a model update, retraining, filtering or other technical response is required by law, contract or risk policy.
Before deleting original data used for reproducibility, document what can still be reproduced from permitted metadata, aggregated statistics or synthetic test material. The ICO specifically advises considering whether results can be reproduced after original data is deleted. Reproducibility is a reason to design carefully, not a blanket exemption from storage limitation.

Check providers, contracts and public promises
Review each AI provider’s contract, configuration and technical documentation for:
Best Value
- default prompt and output retention windows;
- abuse monitoring and human-review access;
- whether customer content is used for model training or service improvement;
- subprocessors, regions and international transfers;
- backup and disaster-recovery deletion;
- support-ticket and account-closure handling;
- deletion-request intake, completion evidence and response times.
Reconcile those terms with your own schedule. A policy promising immediate deletion is inaccurate if a provider retains abuse-monitoring copies or backups for a stated period. The FTC warns that AI providers must honor privacy commitments made in terms, promotions and marketplaces; changing or expanding a use without clear notice and affirmative express consent can create consumer-protection risk. Keep public statements, contract language and actual settings consistent.
Jurisdiction-specific cautions
European Union and GDPR
GDPR principles include purpose limitation, data minimisation, storage limitation, transparency and accountability. Retain personal data for the shortest period compatible with the purpose and legal duties, set erasure or review limits, and explain duration to people. The rule is purpose-specific rather than a fixed AI number.
United Kingdom
The ICO’s AI data-minimisation audit guidance recommends mapping personal information, documenting schedules, regular disposal and audit trails. The guidance states that it is under review following the Data (Use and Access) Act, so verify its current status and the applicable UK law before treating it as an authoritative compliance position.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsUnited States
The FTC material supports purpose-based business retention and warns against broken privacy promises or undisclosed secondary uses. It is not a comprehensive US AI-retention statute and does not supply one national schedule. Sector, state and contractual requirements may impose additional rules.
Other countries and regulated sectors
The authorities summarized here do not settle periods for every country or sector. Obtain jurisdiction- and data-category-specific legal advice where health, finance, employment, children’s data, government records, export controls or cross-border transfers affect the schedule.
Governance, metrics and change control
Assign accountability rather than leaving retention to the model team. The business owner defines purpose; privacy or legal teams interpret obligations; security owns access and incident controls; engineering implements expiry and propagation; records management maintains the schedule; and procurement verifies provider terms.
Monitor measurable controls: percentage of categories with an owner and expiry, deletion jobs completed on time, failed or orphaned deletion events, open exceptions past review, provider confirmations, restore tests and systems not covered by the inventory. Review after a new data source, purpose, model version, vendor, jurisdiction or legal obligation. Reapprove the schedule when system architecture changes.

A practical approval checklist
- Have all prompts, files, outputs, logs, feedback, training and evaluation data, derived features, backups and retired artifacts been inventoried?
- Is each category linked to a specific purpose and legal basis?
- Is the period the shortest one that meets the purpose and documented minimum holds?
- Does a fixed date or review trigger have a named owner?
- Does deletion cover replicas, indexes, derivatives, providers and backups?
- Are anonymisation and restricted-access alternatives defined with safeguards?
- Can legal holds, investigations and migrations pause deletion without hiding the exception?
- Do notices and contracts match actual training, monitoring and retention behavior?
- Can the organisation prove what was deleted, what failed and what remains?
- Has the rule been retested after the latest model, vendor or jurisdiction change?
