An effective AI governance policy gives your company clear authority, risk-based approval rules, operating controls, and a way to monitor or stop systems throughout their life. Start by naming an accountable executive, inventorying every material AI use, assigning risk tiers, requiring evidence before approval, and scheduling reviews. Use the voluntary NIST AI Risk Management Framework (AI RMF) 1.0 as an organizing scaffold, then map the policy to the laws, contracts, sectors, and jurisdictions that actually apply to your company.
What an AI governance policy does
An AI governance policy is the company’s formal statement of who may use or approve AI, what safeguards are required, how decisions are documented, and when a system must be changed, paused, or retired. It should apply to more than a public chatbot. A useful policy covers models and applications the company builds, fine-tunes, buys, embeds in products, or uses internally, together with the data, vendors, hardware, and integrations those systems depend on.

The policy is not the governance program by itself. It establishes authority and expectations; procedures, registers, reviews, training, monitoring, and incident response make those expectations operational. Nor is a framework label a legal safe harbor. NIST AI RMF 1.0 is voluntary guidance released on January 26, 2023. Binding duties depend on your role, system, use, affected people, geography, industry, and the laws in force at the time.
Write the policy so it can absorb new rules without rewriting its basic structure. Define a process for tracking regulatory changes and obtaining advice from qualified counsel when a use may be regulated.

1. Set the mandate and scope
Get an executive decision
Have senior leadership approve the policy’s purpose, scope, risk appetite, and authority. The approval should state that the program can require testing, impose conditions, delay a launch, suspend a system, or escalate residual risk. Without that mandate, a central team may be asked to manage risks it cannot control.
Record the business reasons for using AI and the outcomes the company will not accept, such as decisions that cannot be explained to affected people or processing that violates a contractual, privacy, or sector restriction. Risk appetite should be specific enough to guide a reviewer deciding whether a proposed use needs more evidence or a different design.
Define what counts as AI
Use a functional definition rather than limiting the policy to a particular vendor or model type. Include generative systems, classification and prediction models, ranking and recommendation engines, computer-vision tools, speech systems, automated decision support, and AI features embedded in ordinary software. Include significant changes to an existing system, such as a new model, data source, deployment location, user group, or decision function.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Fix the driver behind crashes, sound loss and screen glitches3Clear out junk files and repair common Windows errorsCover the full company role
State whether the policy applies when the company is a provider, deployer, importer, distributor, purchaser, or merely an internal user. A company can have more than one role for the same system. Include third-party models and services, because a supplier’s system can still create privacy, security, fairness, intellectual-property, or operational exposure for your organization.
2. Assign owners and decision rights
Make accountability visible in the policy and in each system record. A typical structure includes the following responsibilities:
- Executive sponsor: owns the program’s authority, resources, and risk appetite.
- AI governance or risk lead: maintains the policy, intake process, inventory, tiering method, and reporting.
- Legal and compliance: tracks applicable laws, contracts, sector rules, notices, and required records.
- Security: reviews access control, threat exposure, model and data protection, resilience, and incident handling.
- Privacy and data governance: evaluates personal-data use, retention, purpose limitation, quality, and individual rights.
- Procurement: obtains supplier information, audit rights, service commitments, change notices, and exit support.
- Product or business owner: is accountable for the system’s purpose, users, affected people, performance, and day-to-day operation.
- Independent reviewers: test or challenge the owner’s evidence when the risk tier warrants separation of duties.
Specify who can approve a use, impose conditions, accept residual risk, pause deployment, and escalate an incident. Set alternate contacts and a route for employees, customers, and suppliers to raise concerns. NIST’s AI RMF emphasizes documented roles, lines of communication, and people who are empowered, responsible, and trained.

3. Build an AI system and use-case inventory
Require registration before deployment or a material change. The inventory can begin as a controlled spreadsheet and later move into a risk or asset-management system. It should be complete enough for a reviewer to understand what the system does, who controls it, and who might be affected.
Capture at least:
- System and use-case name, business purpose, owner, technical contact, and executive sponsor.
- Provider, model version, application version, hosting location, interfaces, plugins, and other dependencies.
- Whether the company builds, fine-tunes, purchases, embeds, deploys, or uses the system.
- Users, affected individuals or groups, decision points, human reviewers, and expected and foreseeable uses.
- Input and output data types, personal or sensitive data, training or retrieval sources, retention, and transfer locations.
- Geographies, business units, customer populations, and sectors in scope.
- System boundaries, connected systems, access permissions, fallback process, and service availability requirements.
- Risk tier, assessment date, approval status, required controls, open issues, and next review date.
- Supplier terms, data-use commitments, subcontractors, update practices, incident contacts, and exit plan.
Inventory mechanisms should be proportionate to risk. A low-impact drafting assistant may need a lightweight record, while a system that influences employment, credit, health, safety, access to services, or legal rights needs a detailed file and independent review. Make registration a prerequisite for production access so the inventory does not depend on voluntary reporting.
4. Triage and assess risk
Use a repeatable screening gate
At intake, ask what the system can change, who could be harmed, how severe and reversible the harm would be, and how much human control remains. Also ask whether the system processes personal or confidential information, creates security exposure, affects children or vulnerable people, or is covered by a contract or sector rule.
Record the answers and the rationale for the assigned tier. A practical four-level model is:
| Tier | Typical characteristics | Minimum decision |
|---|---|---|
| Low | Internal assistance with limited impact, no sensitive data, and a human checking the output before use | Owner approval, approved tool, basic usage and security guidance |
| Moderate | Customer-facing or operational use where inaccurate, biased, unavailable, or exposed output could cause meaningful loss | Documented assessment, privacy and security review, performance checks, user notice where appropriate, and scheduled monitoring |
| High | Use that can materially affect rights, safety, employment, access to essential services, finances, or vulnerable groups | Formal cross-functional approval, documented testing, human oversight, bias and privacy analysis, incident plan, and executive acceptance of residual risk |
| Prohibited or blocked | Use that violates law, contract, policy, or a stated red line, or whose risks cannot be controlled | Do not deploy; escalate for a redesign or legal determination |
These tiers are an internal control design, not a statement that a particular law uses the same labels. Adjust thresholds to your organization’s size, sector, risk tolerance, and jurisdictions. Reassess when the model, data, purpose, users, geography, or consequences change.

Document impact, not just model quality
Accuracy alone does not determine risk. Assess validity and reliability for the intended task; possible safety, security, privacy, and fairness harms; explainability needs; human review quality; accessibility; and the consequences of an outage or wrong output. Consider foreseeable misuse, automation bias, feedback loops, distribution shift, and whether people can challenge or correct an outcome.
5. Turn risk tiers into approval requirements
Write a control matrix that says what evidence each tier requires. The following controls can be tailored; they are not automatically mandatory for every use.
- Purpose and boundaries: documented intended use, prohibited uses, user groups, operating limits, and fallback process.
- Validity and reliability: representative evaluation data, task-specific success criteria, error analysis, and limits on claims about performance.
- Fairness and harmful-bias management: testing for relevant groups, review of proxy variables, mitigation steps, and a way to investigate complaints.
- Safety: misuse analysis, guardrails, human intervention, fail-safe behavior, and testing of edge cases.
- Security and resilience: least-privilege access, secrets protection, logging, adversarial testing appropriate to the system, backup and recovery, and supplier incident commitments.
- Privacy and data governance: lawful purpose, minimization, retention, quality checks, access rights, transfer controls, and restrictions on using confidential prompts or outputs.
- Transparency and communication: clear notices when people interact with or are materially affected by AI, documentation of limitations, and a route to reach a human.
- Explainability and interpretability: explanations suited to the audience and decision, with enough documentation for reviewers to understand inputs, outputs, and limitations.
- Accountability: named owner, approval record, version history, evidence retention, and independent challenge for higher tiers.
- Supplier controls: model and data documentation, change notifications, audit or assurance evidence, support contacts, subprocessors, and an exit path.
NIST identifies trustworthiness characteristics including validity and reliability; safety; security and resilience; accountability and transparency; explainability and interpretability; privacy; and fairness with harmful bias managed. Treat these as dimensions to consider when selecting controls, not as a checklist that removes the need for judgment.

6. Organize the program with NIST’s four functions
The AI RMF 1.0 uses four functions. Govern cuts across the other three, and risk management continues throughout an AI system’s lifecycle rather than ending at launch.
| Function | How to use it in company operations |
|---|---|
| Govern | Set policies, roles, accountability, risk tolerance, workforce competence, communication, third-party expectations, and continual improvement. |
| Map | Define context, intended use, affected people, benefits, harms, dependencies, legal setting, and system boundaries before choosing controls. |
| Measure | Test and monitor performance, validity, reliability, fairness, privacy, security, safety, transparency, and other criteria relevant to the use. |
| Manage | Prioritize risks, apply mitigations, approve or reject use, respond to incidents, track residual risk, and retire systems safely. |
NIST’s companion Playbook offers suggested actions for achieving outcomes across these functions. It is guidance based on AI RMF 1.0, not a certification scheme. Use it to assign practical tasks while keeping your own approval thresholds and legal analysis explicit.

7. Operate controls across the lifecycle
Before development or purchase
Require an intake record, initial tier, data and privacy review, security architecture review, supplier due diligence, and a statement of intended and prohibited use. For a high-impact system, define evaluation criteria and human-oversight design before building so that testing is not retrofitted after launch.
Recommended Free Tools
Before production deployment
Collect the evidence required by the tier, resolve critical findings, document limitations, train users, configure access, and approve the fallback process. The approval record should identify conditions, residual risks, owner, review date, and the person authorized to stop the system.
During operation
Monitor performance and material errors, access events, drift, complaints, security signals, supplier changes, and override rates. Set trigger thresholds that require investigation rather than relying only on a calendar review. Preserve logs and decision records for the period required by law, contract, and your risk assessment.
When something changes
Treat a new model version, data source, prompt or retrieval design, integration, user population, geography, or decision purpose as a change-control event. Re-run the relevant assessment and testing; do not assume a supplier update is harmless. The change record should show what changed, why, who reviewed it, and whether approval conditions remain satisfied.
For incidents and complaints
Define an incident channel and severity levels. Examples include harmful or discriminatory output, privacy disclosure, compromised credentials, unsafe recommendations, unexplained performance deterioration, or a supplier outage. Give staff authority to pause use, preserve evidence, notify the owner and security or privacy teams, assess affected people, communicate appropriately, and document corrective action. Provide a complaint and correction route for people affected by a decision.

At retirement
Require a decommissioning plan before the system is replaced or discontinued. Revoke access, handle retained data, preserve records, notify dependent teams, migrate or close open cases, update customer and employee communications, and verify that connected automations no longer call the retired service. Safe decommissioning prevents an abandoned model, stale credentials, or missing records from becoming a new risk.

8. Keep legal and regulatory tracking separate from framework language
Your policy should require a current legal assessment, not declare that NIST compliance satisfies the law. The European Union AI Act illustrates why. The European Commission’s official pages checked in October 2026 describe staged application dates and role- and system-specific duties.
| EU AI Act milestone | Application date reported by the European Commission | What a company must determine |
|---|---|---|
| Prohibitions and AI literacy provisions | February 2, 2025 | Whether prohibited practices or literacy duties apply to the company’s role and workforce |
| General-purpose AI and governance rules | August 2, 2025 | Whether the company develops, provides, integrates, or deploys systems covered by these provisions |
| Article 50 transparency requirements | August 2, 2026 | Whether the system falls within the transparency duties and which notices or disclosures are required |
| High-risk rules for specified Annex III areas | December 2, 2027 | Whether the use is a high-risk system in an Annex III area and which role the company holds |
| High-risk AI embedded in regulated products | August 2, 2028 | Whether the system is part of a regulated product and subject to the later high-risk date |
The Commission’s Article 50 FAQ describes a limited later date for certain marking and detection duties for systems placed on the market before August 2, 2026. The dates and classifications are volatile and fact-dependent. Maintain a legal watchlist, record the source and review date, and obtain qualified advice for a real deployment. Do not assume that an internal use, a supplier’s representation, or a single geographic location resolves scope.
9. Train people and publish usable guidance
Training should match the work. General staff need to know which tools are approved, what information they may enter, how to verify outputs, when human judgment is required, and how to report a concern. Developers and owners need instruction on evaluation, documentation, change control, security, privacy, and incident response. Reviewers need enough technical and domain knowledge to challenge evidence rather than merely sign a form.
Publish a short employee guide alongside the formal policy. Include the approved-tool list, prohibited inputs and uses, escalation contacts, intake link, review timelines, and examples relevant to daily work. Require acknowledgement where appropriate, but measure whether people can apply the rules through exercises, sampling, and incident trends.
10. Measure whether governance works
Choose indicators that show control effectiveness, not activity alone. Useful measures include the percentage of material systems registered before deployment, overdue reviews, completion of required tests, unresolved high-severity findings, incident response time, complaint resolution time, supplier evidence coverage, training completion, and the number of systems paused or retired after review. Interpret metrics by risk tier; a high count of low-risk registrations says little about oversight of a critical system.
Set review intervals by tier and trigger an earlier review after a material incident, legal change, model or data change, new affected population, or evidence that performance has drifted. At least annually, have the executive sponsor review the portfolio, risk acceptance, resources, exceptions, and whether the policy still reflects the company’s products and operations.
11. A practical implementation sequence
- Approve the mandate. Name the sponsor, define scope and risk appetite, and grant authority to condition, pause, or reject use.
- Publish intake rules. Make registration and an initial screen prerequisites for production access and material changes.
- Find the current estate. Combine procurement records, cloud and software inventories, security logs, product road maps, and employee reporting to identify unregistered use.
- Assign owners and tiers. Confirm accountable owners, affected groups, role in the AI supply chain, and documented risk rationale.
- Apply minimum controls. Start with access, data handling, human review, supplier terms, documentation, monitoring, and incident routes; add deeper testing for higher tiers.
- Review the highest-impact uses first. Resolve or pause systems with significant potential harm, weak evidence, unclear ownership, or no effective fallback.
- Connect the records. Link inventory entries to approvals, test results, contracts, incidents, changes, training, and retirement records.
- Set the calendar and triggers. Assign review dates, performance thresholds, regulatory watch ownership, and escalation paths.
- Report and improve. Give leadership a risk-based dashboard, record exceptions, and revise the policy after incidents, audits, regulatory updates, and lessons from users.
Common policy failures to avoid
- A one-page ban with no operating process: employees move to unapproved tools when the policy offers no workable route.
- Ownership by committee only: discussion does not replace one person who can make and enforce a decision.
- A static inventory: records become misleading when version, data, purpose, and supplier changes are not captured.
- Model-centric risk scoring: the same model can be low risk for drafting and high risk when it influences access to employment or services.
- Accuracy as the only test: a generally accurate system can still leak data, discriminate, fail unsafely, or be impossible to challenge.
- Vendor assurances without evidence: contract terms, technical documentation, change notices, and exit rights matter when the supplier controls the model.
- Human review as a rubber stamp: reviewers need time, authority, information, and a genuine ability to disagree or stop an outcome.
- Ignoring retirement: old credentials, retained data, and dependent automations can continue creating exposure after a project ends.
- Calling voluntary guidance a certification or legal defense: NIST provides a credible structure, but it does not replace a jurisdiction-specific legal assessment.
Final policy checklist
- Executive sponsor, accountable owner, decision rights, escalation contacts, and documented risk appetite.
- Scope covering built, fine-tuned, purchased, embedded, and internally used AI plus third-party dependencies.
- Mandatory inventory with purpose, model, data, users, affected people, geography, owner, tier, evidence, and review date.
- Repeatable impact screening and risk-tier rationale that is revisited after material change.
- Tier-specific requirements for validity, fairness, safety, security, privacy, transparency, explainability, documentation, and supplier oversight.
- Approval, change-control, monitoring, complaint, incident, suspension, and safe-decommissioning procedures.
- Training and clear employee guidance for approved tools, prohibited inputs, verification, and reporting.
- Regulatory watch process that distinguishes voluntary NIST guidance from binding duties such as staged EU AI Act requirements.
- Metrics, review intervals, evidence retention, exception handling, and leadership reporting.
The strongest policy is not the longest document. It is a living operating system for decisions: every material AI use has an owner, a documented purpose, a proportionate risk assessment, evidence-backed controls, a way to hear from affected people, and a defined point at which the company will intervene or stop.
