A useful workplace AI policy does more than ban a few tools or ask employees to use good judgment. It gives the organization a way to identify AI in use, assess risks before deployment, protect data, keep people accountable for consequential decisions, explain practices to workers, and revisit controls when systems or circumstances change.
Use the NIST AI Risk Management Framework’s four functions—Govern, Map, Measure, and Manage—as a voluntary organizing structure, not as a legal safe harbor or replacement for local legal review. The U.S. Department of Labor’s October 16, 2024 best-practices roadmap and regulator guidance in the UK and EU add considerations that depend on where workers are located and what a system does.

What should a workplace AI policy cover?
Make the policy part of a continuing governance process, connected to privacy, security, human resources, records management, and acceptable-use rules. Its scope should include both purpose-built AI products and AI features embedded in ordinary business software. Otherwise, tools introduced through routine software updates or departmental purchases can escape review.
At a minimum, the policy should establish who may approve AI use, which data may be entered into which tools, how workers are informed, when a person must review AI-assisted decisions, and how employees can report concerns or correct errors.

How do you identify AI use across the organization?
Start with an inventory rather than a list of tools IT has formally purchased. Ask departments to identify AI features in their existing products, pilots, browser extensions, and workflows, as well as systems used by vendors on the organization’s behalf.
For each use case, record:
- The business purpose and task the system performs.
- The system, supplier, and internal owner responsible for it.
- Which workers or other people are affected.
- The information supplied to the system and the information it produces.
- Whether its output informs or makes a decision, and how consequential that decision is.
- The review, approval, and escalation arrangements.
Keep a change history. A system’s purpose, model, data flows, or supplier can change after the initial approval. The EEOC’s 2024 compliance plan describes reviewing its software inventory, collecting use cases, and evaluating systems; its stated minimum review cadence of every two years applies to that agency’s process, not to employers generally.
How should you assess risk before approving a use case?
Assess the actual use, not just the product label. The same tool may pose very different risks when used to draft a meeting summary versus rank applicants or recommend discipline. Have the owner document the intended purpose, affected people, data sensitivity, expected reliability, security and privacy implications, potential fairness or rights impacts, and how outputs will be checked.

- Manage: prioritize risks, apply controls, and monitor them over the system’s lifecycle.
NIST’s Playbook suggests actions organizations can use to apply the framework; it is not a mandatory checklist. The framework is voluntary, and NIST has said version 1.0 is being revised. NIST released a Generative AI Profile on July 26, 2024. Check NIST’s current materials when adopting or updating your process.
Use the assessment to decide whether to approve the use, approve it with controls, require further evaluation, or reject it. Compare options by privacy impact and data sensitivity; effects on hiring, evaluation, pay, scheduling, discipline, or termination; accuracy and verifiability; human control and routes to challenge an outcome; security, retention, and vendor access; transparency to workers; and the laws that apply in each location.
How do you set privacy and data-handling rules?
Make data rules specific enough for employees to follow. Identify which information may not be entered into public or unapproved AI tools—for example, personal, confidential, customer, or regulated information—and name the approved environment for permitted work. Set access, retention, deletion, and incident-reporting requirements, and document why data is collected and how it flows through the system.
Do not promise that a provider does not retain submitted data or use it for training unless that claim has been verified against the provider’s current terms and the organization’s actual configuration. Review vendor processing, access, security, retention, deletion, and incident-response arrangements before approval and when they change.

Employee monitoring needs its own safeguards
If AI is used to monitor workers, define the purpose, scope, data collected, access, retention, and safeguards. Choose the least intrusive means that can meet the stated purpose, and tell affected workers what monitoring occurs before it begins. Do not treat a general AI notice as a substitute for a clear explanation of a particular monitoring practice.
For UK worker monitoring, the Information Commissioner’s Office (ICO) says employers must select a lawful basis, and consent is usually not appropriate in employment because of the power imbalance. A data protection impact assessment (DPIA) is required before processing likely to create high risk. The ICO identifies biometric processing and keystroke monitoring as examples of high-risk monitoring. Its guidance is under review following the Data (Use and Access) Act; check the current guidance and applicable law before implementation.
Where should human oversight be required?
Do not delegate significant employment decisions to AI alone. Identify which decisions require meaningful human oversight, such as decisions affecting hiring, evaluation, pay, scheduling, discipline, or termination. Name a qualified reviewer or responsible function, and make clear that the reviewer must examine the basis for an output rather than simply approve it.

Define what review entails: checking whether the system had suitable information, verifying important claims or recommendations, considering context the system may miss, and recording how the output affected the decision. Provide a route to escalate questionable results, correct errors, and challenge an outcome. The U.S. Department of Labor recommends meaningful human oversight for significant employment decisions; the EEOC’s AI evaluation plan identifies fairness, bias, reliability, privacy, and civil-rights considerations.

What should workers be told, and how can they raise concerns?
Explain in plain language what AI systems are used for, why they are used, what information they process, how their outputs affect people, and who is responsible for the process. Tell workers where they can ask questions, report a concern, or seek review of an outcome. Involve workers in policy design and deployment where practical; their input can surface errors, burdens, or effects that are not apparent to system owners.
The ICO says workers must be informed about monitoring before it begins. In the United States, the Department of Labor recommends transparency and worker input as best practices; that roadmap is guidance, not a statement that every recommendation is a universal statutory requirement.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. What should you ask AI vendors before purchase?
Procurement review should establish what service and model are involved, what data is processed, where it goes, who can access it, and what happens to it after use. Ask whether the vendor can support your evaluations and incident response, what privacy and security controls apply, and which commitments are in the contract. Confirm how updates or changes to the service will be communicated.

How should you train staff and keep the policy current?
Train employees and managers on approved tools, prohibited data, the limits of AI outputs, verification expectations, privacy safeguards, and how to report incidents or near misses. Train reviewers separately on their responsibility to assess outputs and handle challenges. The Department of Labor recommends worker training as part of its best-practices roadmap.
Review the policy and inventory when a new use case is proposed, a vendor or model changes, the purpose or data changes materially, an incident occurs, or applicable rules change. Set a regular review schedule as well, based on the organization’s risks; the EEOC’s two-year minimum is an example for that agency, not a general deadline for employers. Use incidents, complaints, and review findings to update controls and training.
Which jurisdiction-specific rules should you check?
United States
The Department of Labor’s October 16, 2024 roadmap recommends governance and review processes, meaningful human oversight for significant employment decisions, transparency, worker input, protection of worker data, and training. It is best-practice guidance, not a universal statement of statutory duties. Employers should separately assess applicable federal, state, and local requirements for their systems and locations.
United Kingdom
For worker monitoring, the ICO’s guidance emphasizes a lawful basis, a clear purpose, proportionality, transparency, and the least intrusive means. It calls for a DPIA before processing likely to pose high risk and says workers must be informed before monitoring starts. Because the ICO says this guidance is under review following the Data (Use and Access) Act, verify the current edition and legal position before relying on it.
European Union
The European Commission says the AI Act’s Article 50 transparency obligations apply from August 2, 2026. The obligations described by the Commission concern certain direct interactions with AI, emotion recognition and biometric categorisation, deepfakes, and certain public-interest text publications without human review or editorial control. Article 50 is not the whole AI Act, and its transparency duties should not be read as applying to every workplace AI tool. Determine whether a specific system and use fall within the relevant provisions.
