How to Screen Business Partners and Payments for Sanctions Risk

Screening for sanctions risk means checking more than a company name: identify which sanctions regimes apply, review relevant people and payment parties, investigate ownership and control, and resolve possible matches before proceeding. The right process depends on your business, jurisdictions, and transaction risks; no single list or screening tool covers every situation.

Which sanctions rules apply to your business?

Start by identifying the jurisdictions and sanctions programs that may govern your business and the transaction. Consider where your business operates, where staff and counterparties are located, the currencies and payment routes involved, the goods or services being supplied, and the banks or payment providers in the flow. Different regimes can have different rules, so do not treat one country’s list or ownership test as universal.

The UK Government’s UK sanctions guidance for non-UK businesses discusses checks relevant to UK sanctions; it is not a substitute for the rules that apply to your business elsewhere. For U.S. sanctions, the U.S. Treasury’s Office of Foreign Assets Control (OFAC) publishes explanations in its Consolidated FAQs. Check current official sources and applicable regulations for each relevant jurisdiction.

What should you screen, and when?

Consider screening prospective and existing business partners and customers, along with parties identified in relevant payment instructions. Depending on your role and the transaction, that can include the originator, beneficiary, intermediaries, and other named parties. A contracting company’s name alone may not reveal the full exposure.

Set screening points to fit your business’s risk and transaction pattern. Common points to consider are before onboarding or entering a relationship, when material identifying information changes, and before a payment when the risk or applicable requirements make that appropriate. The official materials cited here do not establish one mandatory screening cadence for every company.

OFAC’s guidance for instant payment systems is written for financial institutions, not as a universal business checklist. Its risk factors include a business’s geographic footprint, customer and counterparty locations and history, products and services, and transaction patterns. Use such factors to shape a proportionate assessment rather than assuming every business must review identical information in the same way.

How do you check whether a company is sanctioned?

Check the names of relevant parties against the authoritative sanctions information for each applicable regime, then compare the available identifying details with the list entry. Depending on the person and the information available, useful descriptors may include location, address, date of birth, nationality, registration details, or aliases. A similar name is a lead to investigate, not proof that the person or company is listed.

OFAC’s FAQ 42 explains that financial institutions should consider whether the person opening an account is the same person identified on the SDN List, including the descriptor information. The principle is useful when investigating a possible name match, but that FAQ’s example concerns financial institutions. Record the identifiers you compared and why you cleared or escalated the result. OFAC’s current explanations are available in its Consolidated FAQs.

Do you need to check a company’s owners and controllers?

A list search may not identify an entity that is exposed through its owners. Ask for reliable company and beneficial-ownership information appropriate to the risk, and trace relevant ownership relationships rather than stopping at the contracting entity’s name. Assess ownership and control separately: they are related but not interchangeable concepts, and the applicable test depends on the sanctions regime.

For U.S. sanctions, apply OFAC’s 50 Percent Rule

Under OFAC’s 50 Percent Rule, an entity is treated as blocked if one or more blocked persons own, directly or indirectly, 50 percent or more of it in aggregate, even if the entity is not separately named on the SDN List. OFAC says control without 50 percent ownership does not by itself cause an entity to be blocked under this rule. It nevertheless advises caution where a blocked person has a significant minority interest or exercises control by other means; that caution is not the same as automatic blocking under the 50 Percent Rule. See OFAC’s 50 Percent Rule FAQs and assess the specific facts under current rules.

For other regimes, use their own ownership and control tests

UK guidance separately recommends assessing ownership and control, and treating unavailable ownership information cautiously. Do not assume that the UK and U.S. tests are identical, or apply OFAC’s threshold as a global standard. If ownership information is incomplete or a control relationship is unclear, escalate the issue under the relevant jurisdiction’s rules before relying on a clean list search.

How should you review a payment?

Consider the parties and context visible in the payment information, in light of your role in the transaction and its risk. Relevant details may include the originator, beneficiary, intermediaries, locations, payment route, and whether the transaction fits the parties’ known activity. An unusual transaction pattern can warrant closer review under a risk-based approach; it is not, by itself, proof of a sanctions violation.

Do not assume an intermediary bank has the same duties as the business ordering or receiving a payment. OFAC FAQ 116 gives a narrow wire-intermediary example: a wire involving an entity may involve blocked property if that entity is at least 50 percent owned by a blocked person. The FAQ also describes circumstances in which OFAC would not expect an intermediary bank to research certain non-account parties that do not appear on the SDN List. That example is not a general exemption for account holders, payment processors, or other business roles. See the current OFAC FAQs and determine what applies to your role and transaction.

What should you do about a possible sanctions match?

  1. Pause routine processing. Do not treat a plausible match as cleared while key identity or ownership facts remain unresolved.
  2. Compare the evidence. Review the relevant list entry against available identifiers, payment details, and ownership or control information. Document the basis for clearing or escalating the case.
  3. Escalate under the applicable policy. Involve the people responsible for sanctions compliance and obtain qualified sanctions counsel for fact-specific or unresolved cases.
  4. Follow the relevant authority’s current requirements. Whether a transaction must be blocked or rejected, whether a license may be needed, and whether a report must be made depends on the regime, parties, property, transaction, and your role.

A name similarity alone does not establish a confirmed match. Equally, clearing the name does not resolve a separate ownership, control, or payment concern.

Should you screen manually or use software?

UK guidance says screening may be done manually or with commercial software. OFAC likewise says that a compliance solution should be tailored to the business: “There is no single compliance program or solution suitable for every circumstance.” A documented manual process may suit some lower-volume, less complex operations; more volume or complexity may make software worth evaluating. These are practical choices, not regulatory thresholds or guarantees that a particular approach is adequate.

Option When it may fit What to assess
Manual screening Lower transaction volume or simpler workflows where staff can reliably perform and document checks. Time required, consistency, list-update process, ownership information, match escalation, and the quality of the audit record.
Commercial software Higher volume, faster payment flows, or more complex parties and jurisdictions may justify evaluating automation. Jurisdiction and list coverage, update speed, ownership and control data, payment-screening functions, false-positive resolution, audit records, system integration, and data provenance.

This comparison is a practical decision framework, not an official scoring standard or endorsement of any vendor. Verify a product’s coverage and capabilities against your actual requirements rather than assuming that buying software satisfies them.
