Plan the charity fundraiser and the giveaway as two separate parts of one event. Before entries open, get the charity’s authorization, publish complete rules, make entry free, state the exact closing time and time zone, and explain where donations go. During the stream, use one visible clock, follow the rules without changing them, and select and notify the winner by the published method. This guidance is US-oriented; state and local rules can change what is allowed.
Can people enter by donating?
For a US sweepstakes-style giveaway with a random winner, do not require a donation or purchase to enter, and do not give donors extra chances or better odds. The Federal Trade Commission (FTC) says purchase-required sweepstakes are illegal in the United States. A free entry route should be genuine and explained just as clearly as the donation option.

A fundraiser and a prize promotion are related but distinct. A donation is support for the charity; it should not function as payment for entry or an advantage in a random drawing. If you are considering a raffle or another chance-based format tied to fundraising, get advice specific to the organizer’s and entrants’ jurisdictions before announcing it. The IRS notes that gaming, including raffles and lotteries, is normally regulated by state and local law.

Decide what kind of promotion it is
- Random drawing: The winner is selected by chance. Keep donations separate from eligibility and odds, and have the format reviewed for the places where you will solicit donations and accept entries.
- Skill contest: The winner is chosen based on a stated skill-based criterion. Describe the judging criteria and process in the rules; do not label a random drawing a skill contest.
The legal treatment can depend on the actual mechanics, charity status and authorization, prize, organizer’s location, and entrant locations. The federal guidance here does not settle state, local, or non-US requirements.

What rules do I need before we go live?
Publish the official rules before accepting entries, then administer the giveaway and award the prize exactly as written. For a YouTube contest, YouTube requires free entry, official rules, a privacy notice, applicable legal disclosures, a link to its Community Guidelines, an explanation that entries violating those guidelines may be disqualified, and a statement that YouTube is not a sponsor. The rules must not imply that YouTube is involved in or endorses the promotion.
Include these details in the rules
- Organizer and beneficiary: Name the organizer and the charity intended to benefit. State whether the charity has authorized the organizer to act on its behalf.
- Eligibility: Identify eligible locations, any age or other limits, and how eligibility will be checked.
- Prize: Describe it accurately, including any material restrictions and how it will be delivered.
- Entry method: Explain each free entry route, the opening and closing moments, and any entry limits. Do not make a donation necessary to enter or improve a random entrant’s odds.
- Timing: Give the start and end date, exact time, and time zone. Specify which clock or time reference governs if there is a discrepancy.
- Selection and contact: State how the winner will be selected, how and when they will be contacted, how long they have to respond, and what happens if they do not respond or cannot be verified as eligible.
- Privacy: Explain what entrant information you collect, why you need it, how it will be used, and whether it will be shared. Collect only information needed to administer the giveaway.
- Platform terms: For YouTube, include the required Community Guidelines link and disclosures, including that YouTube is not a sponsor. Follow applicable laws and platform rules.
Check charitable-solicitation requirements where you plan to ask for donations. The IRS says many states require charities to register before soliciting residents and may require periodic financial reports; local governments may also impose registration or reporting requirements. Which rules apply depends on the jurisdictions involved.

How do I verify the charity and donation route?
Confirm the charity’s identity and, where relevant, its qualified status. If you are fundraising as the charity’s agent, get clear authorization before promoting the event. The IRS explains that a qualified charity should conduct a fundraising event, or clearly authorize an outside organizer to act as its agent, for donors to document gifts at that event as contributions to a qualified charitable donee. Do not imply that a donation is tax-deductible unless that is accurate for the donor and the route used.

- Which charity is intended to benefit.
- Which organization or portal receives the payment first, if it is not the charity itself.
- What fees or percentages are withheld and, where known, the net amount expected to reach the charity.
- When the charity is expected to receive the funds and what happens if a transfer is delayed or fails.
- Whether donor information will be shared with the charity or anyone else, and what choices donors have.
Check the donation route’s recipient, intermediary, fee terms, payout schedule, and privacy settings rather than assuming that a page displaying a charity’s name pays it directly. When reporting the result, distinguish donations collected from fees deducted and funds still awaiting transfer.
How do I make the closing time fair?
Choose one time reference and use it in the rules, on-screen countdown, pinned message, and spoken announcements. A countdown is an operational aid, not a substitute for a precise written deadline.

- Set the window: Write down the opening and closing dates and times, including the time zone. If viewers may be in different regions, use an unambiguous time-zone label rather than an unexplained local time.
- Choose the clock: Decide which clock determines whether an entry arrived on time. Test the countdown or other display before the stream and keep the same reference throughout.
- Publish before entry opens: Put the deadline, entry method, and governing time reference in the official rules before accepting entries.
- Repeat the deadline consistently: Read the closing time and time zone aloud, and keep the same information visible in a pinned message or on-screen card.
- Close on schedule: Stop accepting entries at the stated moment. Do not extend the window for some viewers or change the selection method after entries have opened.
- Keep a record: Preserve the entry and selection record, including the time entries closed and the method used to select the winner.
Set the closing moment with your entry system in mind: if entries arrive through a form or platform, establish how its timestamps will be interpreted and what evidence you will retain. Explain that approach in the rules rather than deciding after the deadline has passed.
What should happen during and after the stream?
During the event
- At the beginning, identify the beneficiary and donation route, explain how to enter for free, and read the opening and closing times with the time zone.
- Keep the entry information and donation disclosures visible in a pinned message or on-screen card. Make sure the donation option is not presented as a condition for entering or as a way to improve random-drawing odds.
- Use the published clock and close entries when the rules say to. Select the winner using the disclosed method and do not change eligibility, prize, or procedure after entries open.
- Limit personal-data collection to what is needed, and handle it according to the privacy notice in the rules.
After the event
- Contact the selected entrant using the published process, verify eligibility, and arrange prize delivery within the stated schedule.
- Report the fundraiser total carefully. Separate amounts collected, fees withheld, and money not yet transferred to the charity.
- Keep the official rules, charity authorization, donation-route details, entry and selection record, and prize-fulfillment record so you can respond to questions or disputes.
What changes if the livestream is on Twitch?
Twitch’s branded-content guidance distinguishes independent charity fundraising from fundraising paid for by a charity or corporate partner. It says the branded-content tool is required for the latter, while independent charity fundraising does not require that tool. This is a platform disclosure distinction, not a general legal exemption. Check Twitch’s current guidance before the event.
