How to Review AI-Generated Marketing Emails for Accuracy, Tone, and Compliance

Before sending an AI-written marketing email, verify its claims against current evidence, check offers and disclosures against the actual campaign terms, assess the draft against your brand and audience, and complete the email-marketing checks that apply where you and your recipients are located. AI can draft the copy; it does not remove the need for an experienced human review or the sender’s responsibility.

Start by defining the campaign

Record the email’s purpose, intended recipients, sender location, recipient locations, and whether the message combines promotional material with transactional or account-related content. These details determine which checks matter; US federal and UK rules are not a universal checklist for every country, US state, industry, or recipient type.

For US campaigns, the Federal Trade Commission (FTC) says the message’s primary purpose determines whether CAN-SPAM applies. A mixed message can count as commercial depending on how a reasonable recipient would read its subject line and where transactional content appears. Assess the complete message, not just the body copy. See the FTC’s CAN-SPAM Act: A Compliance Guide for Business.

Verify every material claim and offer

Review statements about what a product does, its features and results, prices, discounts, availability, deadlines, and comparisons. Match each one to current, approved source material and preserve qualifications that change its meaning. If evidence supports a limited result, do not let the AI turn it into a guarantee or a universal outcome.

The FTC’s Advertising and Marketing guidance says: “Under the law, claims in advertisements must be truthful, cannot be deceptive or unfair, and must be evidence-based.” Fluent, confident wording is not proof. Consider the email’s overall impression as well as whether individual sentences are technically accurate.

For offers, compare the draft with the real campaign terms. Confirm that prices and unavoidable charges are accurately described, that discount conditions and deadlines are genuine, and that any paid endorsement is properly labelled. These are among the practical checks identified in UK government guidance on AI and marketing guidance for businesses. Apply the relevant local consumer-protection rules for your campaign.

Judge tone as an editorial question

Tone is not a universal compliance score. Use your documented brand voice and the audience’s expectations to assess clarity, respectfulness, inclusivity, and whether the message fits the recipient relationship. Flag inflated certainty, manipulative urgency, insensitive phrasing, or personalization that may surprise recipients.

Check whether urgency rests on a real deadline and whether confidence matches the evidence behind the claim. Separately, assess whether the message as a whole could mislead or obscure important information. UK government guidance recommends regular review of AI-generated marketing campaigns and public-facing customer statements by someone with appropriate experience; it does not establish a universal tone rubric.

Complete the jurisdiction-specific email checks

United States: commercial email

For a US commercial email, use the FTC guide to check that the From, To, Reply-To, and routing information are accurate; the subject line is not deceptive; advertising is identified clearly and conspicuously; a valid physical postal address is included; and recipients have a clear opt-out method. The FTC guide says opt-out requests must be honored within 10 business days and the mechanism must work for at least 30 days after sending. Check the current guide when preparing a campaign.

The FTC says transactional or relationship-message categories are narrow; a label alone does not determine whether a message qualifies. It also says a business cannot contract away its CAN-SPAM responsibility by hiring another company to handle email marketing. Review the specific message and any potentially misleading product or service claims rather than assuming an agency or platform assumes the sender’s obligations.

United Kingdom: electronic mail marketing

Under the Information Commissioner’s Office (ICO) guidance, organisations normally need consent before sending unsolicited electronic mail marketing to individual subscribers unless a permitted soft opt-in applies. Consent must be an active, specific, informed, and unambiguous indication: pre-ticked boxes, silence, and inactivity do not count. The recipient should be able to make a real choice about marketing from the identified organisation.

The soft opt-in is limited: it can apply to an organisation’s own previous customers and similar products or services, subject to conditions that include offering a simple opt-out when collecting details and in every message. It is not a general permission to email anyone who has bought from the organisation. The ICO’s electronic-mail guidance notes a change under the Data (Use and Access) Act 2025, including a charitable-purpose soft opt-in; check the current ICO electronic mail marketing guidance, especially for charitable campaigns.

Where personal information is used for electronic-mail marketing, the ICO says UK GDPR and the Data Protection Act 2018 also apply. Its guidance identifies fairness, lawfulness, and transparency among the relevant duties and says people have an absolute right to object to use of their personal information for direct marketing. See the ICO’s guidance on complying with the PECR electronic mail marketing rules.

Use a human approval and final-render check

Assign review to someone with suitable experience in the campaign, product, audience, and applicable requirements. Keep a record of material corrections and approvals in a way that fits your organisation’s process. UK government guidance calls for regular review of AI-generated marketing campaigns; using an AI system or an outside sending provider does not itself settle responsibility.

  1. Review the approved draft: confirm claims, offer terms, disclosures, audience, tone, and jurisdiction-specific requirements before scheduling.
  2. Inspect the rendered email: check the subject line against the body, test links, and confirm that disclaimers, qualifications, postal details, and opt-out information remain visible in the final layout.
  3. Resolve defects before sending: correct broken links, missing disclosures, dropped qualifications, or wording that no longer matches the approved offer; then review the updated rendered version.

The final visual check is a practical editorial control, not a quoted legal checklist. It helps catch problems introduced when approved copy is placed into an email template.
