How to Return Pension Payments Received After a Beneficiary Dies

Do not return a payment just because it arrived after the beneficiary died. First confirm which period it covers and the rules of the specific pension or benefit. The U.S. Social Security Administration (SSA), Canada’s federal Canada Pension Plan (CPP) and Old Age Security (OAS), and the UK Department for Work and Pensions (DWP) apply different rules. Report the death to the administrator, keep potentially repayable funds available, and ask the bank or paying authority for its return procedure.

What to do first

  1. Identify the scheme and report the death. Contact the administrator promptly and confirm whether the funeral director or another agency has already reported it. In the United States, USAGov says a funeral director may report a death to SSA using the deceased person’s Social Security number. Otherwise, contact SSA by phone or in person; SSA does not accept death reports by email or online. A death certificate may be needed later to complete a report made directly. USAGov’s Social Security guidance has current reporting instructions.
  2. Check the period the payment covers. The date money arrives does not by itself establish whether it is owed. Find out which month or payment period it represents and apply that scheme’s rule for the month of death.
  3. Ask how to return a potentially overpaid payment. For a direct deposit or cheque, contact both the bank and paying authority as appropriate. Keep the funds available until they confirm the amount and the correct return method; do not make an improvised transfer.
  4. If the estate receives a recovery demand, request the calculation. Preserve relevant account and estate records. If administration is under way, check whether the estate should retain funds until the amount is resolved.
  5. Handle survivor or death benefits separately. A benefit for a spouse, child, or other survivor has its own eligibility and application rules; it is not the same as a payment made to the deceased. USAGov, for example, directs spouses and minor children to a separate Social Security survivor-benefit process.

What rules apply in the United States?

Social Security payments

USAGov says, “The SSA cannot pay benefits for the month of a recipient’s death.” As a result, a payment received in the following month may represent the month of death and must be returned. For direct deposits, USAGov advises notifying the financial institution as soon as possible and asking it to return the death-month payment and any later payments. Follow the bank’s and SSA’s instructions for the specific deposit rather than assuming that every payment arriving after the date of death is treated alike.

Responsibility can depend on the person’s role. The SSA Handbook says an estate may be liable after an overpaid beneficiary or payee dies. It also says a representative payee who receives payments on the beneficiary’s behalf after death is solely responsible for repaying those payments. The handbook describes limited cases in which benefits due to other people on the same earnings record may be withheld. These are U.S. SSA rules, not general rules for other pensions or countries.

What an SSA audit does—and does not—show

In a release dated August 12, 2026, the SSA Office of the Inspector General reported that auditors found policy-compliant recovery actions in 66 of 125 sampled cases (53%); policy was not followed in the other 59 cases (47%). The OIG also estimated that SSA could potentially pursue approximately $106 million across 8,486 deceased beneficiaries by consistently applying recovery actions. These are audit findings about SSA recovery efforts, not the odds that an individual demand is wrong or an estimate of what any particular estate owes. Read the OIG release.

What rules apply in Canada?

Federal CPP and OAS

For federal CPP and OAS, the estate is entitled to payments for the month of death. Payments issued after that month must be returned. Service Canada’s instructions for cancelling CPP and OAS benefits ask people to notify it promptly.

For direct deposits, Service Canada says to ask the bank to return post-death deposits to the originator or send a cheque in Canadian funds to the responsible office. Cheques received after the month of death should be returned to the address specified in its guidance; include estate or representative contact details if known. For a Quebec Pension Plan benefit, contact Retraite Québec as well. Check the live Service Canada page for the current return address and reporting details.

When reporting by mail, Service Canada lists details to provide, including the deceased’s name, birth and death dates, place of death, marital status, SIN if known, and address at death, as well as contact information for the estate and reporter. It says proof of death is not needed unless requested and lists acceptable documents.

What if the estate is contacted by the UK DWP?

Benefit overpayments and estate recovery

DWP can recover benefit overpayments from a deceased person’s estate. After probate, it may contact the estate handler for information, including records about the deceased’s assets. DWP advises not distributing the estate until the amount to repay is known; its recovery letter explains the calculation, reason, and payment method. If the estate disputes the overpayment decision, it can request a mandatory reconsideration. Readers in Northern Ireland should contact the Department for Communities Debt Management service. See DWP’s guidance on repaying a benefit overpayment after someone dies.

Do not assume next of kin is personally liable

DWP staff guidance says initial recovery after death may be sought from the bank, the deceased’s representative, or next of kin. It says a bank that learns the holder of a sole account has died would normally return credits received after that date. This describes UK benefit-recovery practice; it is not a general rule for all pension payments, nor does it establish that every next of kin personally owes the money. The DWP staff guide to benefit-overpayment recovery provides the agency’s context.

Why the payment method and benefit period matter

A payment’s arrival date and the period it covers are separate facts. The rule may turn on the month of death, while a deposit or cheque arrives later. The return procedure can also differ by payment method: a bank may be asked to return a direct deposit, while a cheque may need to be sent to the paying authority. Before sending money, establish the scheme, covered period, and correct procedure with the administrator.

Keep records and challenge a demand if needed

  • Save statements or cheque details showing the payment date and amount, along with the administrator’s explanation of the period it covers.
  • Keep copies of death-report confirmations, correspondence, return instructions, and proof of any repayment.
  • If the estate receives a formal demand, ask for the decision basis and a breakdown of the calculation before paying an amount that appears incorrect.
  • Use the scheme’s stated review route if you disagree. For a UK DWP estate recovery decision, that route may include a mandatory reconsideration.

When the payment is from another pension scheme

The examples above are limited to U.S. Social Security, Canadian federal CPP and OAS, and UK DWP benefit-overpayment guidance. They do not establish the rules for private workplace pensions, personal pensions, or every public pension. Contact the specific scheme administrator to confirm whether a payment is due, who may be responsible for repayment, and how to return it.
