Preserve the records you are allowed to keep, compare the decision with published criteria and comparable work, use an appropriate internal review channel, and track what happens afterward. Formal rights and deadlines depend on your country, state or province, employer and facts; the legal guidance cited here is primarily from the United States.
Start with a calm, documented response
A disappointing rating is not automatically discrimination, and a manager’s use of subjective language is not by itself proof of unlawful bias. The useful first objective is to create a reliable record and obtain enough detail to test whether the stated standards were applied consistently.

Preserve the decision and the context
Save the review, promotion or pay notice, the job description, written competency framework, goals, project results, prior feedback and messages that set or changed expectations. Record the dates of the review, calibration or promotion meeting; the names and roles of decision-makers and participants; and any change to duties, pay, seniority, access to opportunities or reporting lines.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Scan for outdated or missing drivers - takes under a minute3Repair Windows errors before they cause bigger problemsKeep two columns in your notes: what happened and why I think it happened. The first column should contain observable facts, such as a rating, quotation, missed promotion or changed assignment. The second can contain hypotheses about gender bias. This separation helps you ask testable questions without overstating what you know.

Keep only material you are authorized to access. Do not forward confidential peer reviews, customer data, trade secrets or restricted HR files to a personal account. If you need a record, ask for it through the organization’s process or consult a local adviser about lawful preservation.
Secure evidence before it disappears
- Download or print your own review and objective work records if company policy permits.
- Keep a dated log of meetings, follow-up requests and responses.
- Note who set each goal and whether the goal changed after the work began.
- Record concrete results: revenue, delivery dates, quality measures, customer outcomes, incident reductions or other measures used in your role.
- Preserve contemporaneous praise and criticism, including feedback from before the disputed decision.
The record should be accurate enough that another reviewer can reconstruct the decision without relying on memory.
Ask what standard was used and what evidence supports it
The U.S. Equal Employment Opportunity Commission (EEOC) advises employers to communicate performance standards, apply them consistently, explain whether they were met and include relevant facts in evaluations. Its employer guidance is available in “I’m conducting performance evaluations”.
Request a meeting or written clarification while the decision is recent. Keep the questions neutral and precise:
- Which written criteria determined each rating?
- What evidence supported the rating, and which examples show the gap?
- What experience, results or behaviors were required for the promotion?
- Which specific requirements did I not meet?
- When were those requirements communicated, and were they changed during the review period?
- Who applied or calibrated the standard, and was the same process used for other candidates?
Turn subjective labels into observable behavior
Words such as “executive presence,” “fit,” “gravitas” or “communication” can describe legitimate job requirements, but they are too broad to evaluate fairly without examples. Ask what the person did or did not do, when it occurred, why it mattered to the role and what successful performance would have looked like.
For example: “The review says I need more executive presence. Please identify the meetings or behaviors that led to that conclusion, the role requirement it relates to, and the observable behavior that would meet the standard.” Ask how the same definition was used for colleagues in comparable roles. This does not claim that a particular phrase proves discrimination; it makes the criterion reviewable.
Ask for the decision’s practical consequences
Clarify whether the rating affects compensation, bonus eligibility, promotion timing, performance-improvement plans, assignments, visibility or access to training. A decision that changes pay, seniority or duties warrants a faster, more formal review than a request for coaching alone.

Compare like with like, without overclaiming
A fair comparison tests whether the organization used its stated standards consistently. It is not a demand that every employee receive the same result regardless of role, scope or evidence.
Build a side-by-side evidence table
| Decision element | Your evidence | Question for review |
|---|---|---|
| Published goal or competency | Deliverables, metrics, dates and feedback | Was this criterion applied as written? |
| Negative example in the review | Meeting notes, outcome, witnesses or follow-up | What fact supports the conclusion, and was context considered? |
| Promotion requirement | Role scope, results and documented experience | What requirement remained unmet, and when was it communicated? |
| Comparable employee or candidate | Information you lawfully know about role, scope and stated results | Were materially similar cases evaluated under the same standard? |
| Prior feedback | Earlier reviews, goals and coaching | When did the rationale change, and why? |
Compare employees in the same decision group or substantially similar roles where you have a legitimate basis to do so. Relevant differences can include job level, team size, account complexity, resources, opportunity to demonstrate a skill and the time period measured. Do not assume a small or incomplete sample proves a pattern; use it to identify questions for an impartial investigation.
Look for inconsistency, not just an unfavorable outcome
- An objective result is discounted for you but treated as sufficient for a comparable colleague.
- A standard appears only after the decision or was not in the published criteria.
- Your duties or resources made the comparison unfair, but the review ignores that context.
- Earlier feedback said you were meeting expectations, then a new, unexplained rationale is used to deny promotion.
- Similar conduct is described differently for people of different genders, or stereotyped expectations are added to the assessment.
These signs justify questions and review. They do not, without more evidence, establish an unlawful violation.
Choose the right channel for the stakes
There is no universal escalation ladder. Use your organization’s written policy, employee handbook or designated equal-employment, ethics or review channel. Consider the decision’s impact, the independence of the reviewer and the evidence that channel can access.
Recommended Free Tools
| Option | Best use | Strength | Limitation |
|---|---|---|---|
| Direct manager clarification | You need criteria, examples or a correction to an apparent factual error. | Fast and close to the decision. | The manager may be the decision-maker or unable to access broader records. |
| Written appeal or review process | The organization provides a formal rating or promotion appeal. | Creates a defined record and response path. | Deadlines, scope and remedy may be limited by policy. |
| HR, equal-employment or ethics channel | You allege inconsistent treatment, discriminatory rationale or a material pay, duty or promotion effect. | Can coordinate an impartial investigation and obtain authorized records. | Confidentiality and independence vary by employer. |
| Higher-level or designated reviewer | The direct manager is involved, has a conflict or controls the normal process. | May provide greater separation from the original decision. | Must follow the organization’s reporting rules to avoid bypassing a required process. |
| Outside employment-law or worker-rights advice | The internal process fails, retaliation is suspected or a filing deadline may be near. | Provides jurisdiction-specific options. | Deadlines and legal standards differ; an adviser needs the facts and documents. |
For a serious concern, a written submission to the designated channel is usually easier to track than an informal conversation alone. You can still request a meeting; the written summary preserves what you asked for.
Write a focused internal complaint
The EEOC’s guidance on handling internal complaints recommends identifying what the employee disputes and why they believe discrimination occurred, reviewing relevant records and comparable evaluations where appropriate, and determining whether standards and policies were applied consistently. See “Handling Internal Discrimination Complaints About Performance Evaluations”.
A useful complaint contains five parts:
- Decision: State the rating, promotion outcome, date and material consequence.
- Standard: Quote or attach the published criterion, goal or promotion requirement.
- Evidence: Give concise facts, results, dates and relevant prior feedback.
- Comparison or inconsistency: Identify a lawful, materially similar comparison or explain the changed or unexplained standard. Do not include speculation as fact.
- Requested action: Ask for a prompt, thorough and impartial review, the evidence and criteria considered, a written explanation of the conclusion, and correction of any unsupported rating or resulting pay, seniority or opportunity effect.
Example wording:
“I am requesting a review of my 2026 performance rating and the resulting promotion decision. The published criterion was [criterion]. My documented results were [facts and dates]. The review cites [exact language], but does not identify a specific example or explain how the criterion was applied. I also need clarification about [materially similar comparison or changed standard]. Please confirm the review process, the records that will be considered, who will handle it, and when I can expect a written explanation.”

What a fair internal review should examine
An effective review should not merely ask whether the manager intended to discriminate. It should examine how the decision was made and whether the process produced inconsistent treatment. The EEOC describes a “prompt, thorough and impartial investigation” as a way to resolve internal complaints and prevent recurrence. Its guidance says the employer should explain the steps taken, findings and basis for the outcome.
Records and participants
The reviewer may need to speak with you, the manager, decision-makers, calibration participants and other relevant witnesses. Relevant records can include goals, work products, review drafts, promotion criteria, decision notes and comparable evaluations, subject to privacy and access rules.
Standards and consistency
The review should test whether the organization communicated the standard, applied it consistently, considered relevant facts and informed employees of changes. It should examine whether sex-related or other protected characteristics affected the rating, opportunity or explanation, rather than treating a generalized disagreement as proof.
Remedy if discrimination is substantiated
The EEOC gives examples that include retracting an unjustified evaluation, issuing a replacement consistent with the standards and providing pay, seniority or benefits the employee would have received with fair treatment. A remedy should address the actual effect of the decision and steps needed to prevent recurrence.
Track retaliation separately
After you raise a concern, maintain a dated log of ratings, duties, schedules, access to projects, meetings, compensation, promotion opportunities and unusual scrutiny. Preserve messages and explain the sequence factually. Do not assume every negative event is retaliation, but do not let a pattern go undocumented.
U.S. EEOC retaliation guidance discusses protection for opposition based on a reasonable, good-faith belief that discrimination occurred, even if the underlying allegation is not ultimately established. Whether a particular action is unlawful depends on context, including what you reported, who knew, timing and the reason given. Read the agency’s Enforcement Guidance on Retaliation and Related Issues for the U.S. federal framework.

Consider a qualified employment-law professional or government worker-rights agency when the decision affects significant pay, seniority, employment status or duties; the internal reviewer has a conflict; the employer refuses to explain the process; retaliation is suspected; or a filing deadline may be approaching.

What organizations can improve in their review systems
Employees often receive better answers when they ask for process improvements as well as an individual remedy. Employers can publish competencies and promotion requirements, train reviewers to use behavior-based evidence, document calibration decisions, tell employees when standards change and audit outcomes for inconsistent treatment.
UK government employer guidance says greater transparency in promotion, pay and reward processes can reduce inequalities and discusses calibration as a way to align decision standards. It also notes that evidence of calibration’s effect on outcomes for women is lacking and that further research is needed. Calibration or bias training should therefore be treated as a process tool, not a guaranteed fix. See How to improve gender equality in the workplace: actions for employers.
Vague feedback is worth scrutinizing because it can make a decision difficult to test. A Workplace Gender Equality Agency report, summarizing an analysis by Correll and Simard (2016) of more than 200 reviews at one large U.S. technology firm, reported vague feedback in 57% of reviews of female employees versus 43% of reviews of male employees. That is a finding from one organization and study, not a population-wide prevalence estimate; the report is available as Gender bias in promotion.
Common mistakes that weaken a challenge
- Arguing only from the outcome: A missed promotion is important, but the strongest challenge connects it to a criterion, evidence or inconsistency.
- Using labels without examples: Ask for dates, behaviors and role requirements instead of debating “fit” in the abstract.
- Taking unauthorized records: Preserve your own documents and use formal requests for restricted material.
- Comparing unlike roles: Account for scope, level, resources and opportunity before treating another employee as a comparator.
- Sending an accusatory mass email: Use the designated channel and keep the request factual and confidential.
- Missing an internal deadline: Check the handbook or appeal policy immediately, especially when pay or promotion timing is involved.
- Assuming an investigation guarantees a result: Ask what will be reviewed, who will decide and how findings will be communicated, but recognize that the process may not produce the outcome you seek.
A practical checklist
- Save the review, decision notice, criteria, goals, results and prior feedback.
- Write dates, participants, exact language and consequences.
- Separate observable facts from your interpretation.
- Ask for the standard, evidence, examples and promotion requirements.
- Translate subjective labels into specific behaviors and job-related expectations.
- Compare materially similar cases only with information you lawfully possess.
- Submit a focused request through the organization’s written review, HR, equal-employment or ethics channel.
- Request prompt, thorough, impartial handling and a written explanation.
- Track later changes to duties, ratings, access, pay and opportunities.
- Get jurisdiction-specific advice before an external deadline expires.
Frequently asked questions
Can vague feedback alone prove gender discrimination?
No. Vague language can make a decision difficult to evaluate and may justify a request for examples, but proof depends on the full facts, including standards, treatment of comparable employees and the decision’s effects.
Best Value
Should I confront my manager before contacting HR?
Use the channel that fits your policy and circumstances. A manager clarification can resolve a factual error quickly; if the manager made the decision, is involved in the concern or controls the normal process, use a designated independent review channel or ask HR how to proceed.
What if I do not have access to other employees’ reviews?
Do not obtain restricted records improperly. Describe the comparison you can lawfully make and ask the reviewer to examine authorized comparable evaluations and decision records.
Can I raise a concern if I am not certain bias occurred?
Yes. State what you observed, why the standard appears inconsistent and what clarification or review you request. Avoid presenting an unverified motive as a fact; a good-faith, specific concern gives the organization something it can investigate.

How long should I keep records after raising a concern?
Keep the review file, correspondence and dated timeline for as long as the internal process, any appeal and possible external advice require. Ask a local adviser about preservation periods that apply to your jurisdiction and claim.
What remedy can I request besides a higher rating?
Ask for correction of an unsupported evaluation and any resulting pay, seniority, promotion consideration, duties or benefits, plus a clear explanation of the process and steps to prevent recurrence.
The Bottom Line
Make the concern specific, evidence-based and traceable: preserve the record, ask for the standard and supporting examples, compare materially similar treatment, use an appropriate impartial review channel, and document what happens next. Obtain local legal or worker-rights advice when the stakes or deadlines require it.
