First, check whether YouTube sent a copyright removal request or a Content ID claim: they are different processes, and a counter-notice is only an option after a removal takes effect and a copyright strike is applied. If a takedown is scheduled, you generally have seven days to act before the content is removed and the strike is applied. Preserve the notice and stream records, check the exact status in YouTube Studio, and choose a response that matches your rights and evidence.
Identify what YouTube did—and when
Read the email or notice and check YouTube Studio before responding. A copyright removal request is a legal request from a copyright owner or authorized representative. If YouTube considers it valid, it removes the content and applies a copyright strike. A Content ID claim is a separate system action and typically does not result in a strike. A Content ID dispute or appeal is not the same as responding to a takedown, and a counter-notice is not the next step for an ordinary claim.

| What you see | What it means | What to check next |
|---|---|---|
| Content ID claim | A claim through YouTube’s Content ID system; it typically does not give the channel a copyright strike. | Check the claim details and use the claim or dispute process if appropriate. Do not treat it as a takedown notice. |
| Scheduled copyright removal | YouTube says the removal is scheduled; the content has not yet been removed and the strike has not yet been applied. | Act within the seven-day window. The available steps differ from those after an effective removal. |
| Copyright removal completed and strike applied | The content has been removed and the channel has a copyright strike. | Review the post-strike options. A counter-notice may be considered only if you have a good-faith basis to say the removal was a mistake or misidentification. |
For an active live stream removed for copyright, YouTube says the channel receives a copyright strike and live-streaming access is restricted for seven days. That platform consequence does not establish whether the claimant is right or whether a legal defense applies. YouTube reported receiving copyright removal requests for over 16 million videos in 2022; that figure counts videos subject to requests, not requests proven valid or livestreams specifically.

Keep a copy of the email and any Studio notices before taking action. YouTube advises documenting communications and supporting evidence. For an always-on stream, a concise record can help you understand which material was identified and when the relevant action occurred.

- Save the notice, the claimant identity and contact information shown, and any messages exchanged with the claimant.
- Record the stream URL, the removal and strike status, the notice date, and relevant stream timestamps.
- Keep the stream archive if one is available, along with the claimed work and the timestamps YouTube identifies.
- Gather licenses, permissions, contracts, original files, and other evidence relevant to the disputed material.
In YouTube Studio, inspect the Copyright filter and the Restrictions or “See details” information for the affected content. Confirm whether the action is scheduled, completed with a strike, or a Content ID claim. Do not assume that deleting a video after a strike removes the strike.
Check every part of the stream’s rights
Before asking for a retraction or filing a counter-notice, inventory the whole stream—not only the main video. YouTube’s guidance tells uploaders to confirm that they have rights or permission for all elements, including background music.

- Say goodbye to batteries: Keep your remote powered for months on a single charge.
- Review the main video, music and other audio, game footage, overlays, guest contributions, and third-party clips.
- Match the claimant’s identification and timestamps against your archive and source files; note any specific evidence of mistaken identification.
- Check whether a license or permission covers the actual use in a continuous livestream, its territory, and its duration.
- Do not assume that material being online, credited, or used for a short time automatically makes it lawful to stream.
Fair use, fair dealing, public domain, permission, and ownership can all be relevant, but whether any applies depends on the facts and, in some cases, the jurisdiction. YouTube’s platform process does not decide the legal merits of your position.

YouTube says a scheduled removal gives the uploader seven days to take action. A counter-notice cannot be filed during this period: YouTube says it becomes available only after removal takes effect and the strike is applied.

- Decide whether to remove the content. YouTube says deleting it before the seven days end avoids the strike. This does not mean the underlying rights question has been resolved.
- Consider asking the claimant to retract the request. You may contact the claimant and ask for withdrawal, but the claimant is not required to agree.
- If the schedule followed a rejected Content ID appeal, check the specific appeal option. YouTube lists canceling the appeal during the scheduled period as an option in that particular path.
- Track the deadline and the Studio status. If you take no action, YouTube says the content is removed and a strike is applied when the scheduled period ends.
After removal: compare your options
Once removal has taken effect and the strike exists, YouTube lists three routes: complete Copyright School and wait for the strike to expire, seek a claimant retraction, or submit a counter-notice when you have a good-faith basis. These options are not interchangeable.
| Option | When it may fit | What to understand |
|---|---|---|
| Copyright School and wait | You do not plan to challenge the removal through a counter-notice. | YouTube says the strike expires after 90 days if you complete Copyright School. The removed video is not thereby reinstated. |
| Request a retraction | You want to ask the claimant to withdraw the removal request. | A retraction can resolve a strike, but the claimant decides whether to agree. |
| Counter-notice | You genuinely believe the removal resulted from a mistake or misidentification, potentially including an applicable copyright exception. | This is a legal request, not a routine appeal. It discloses personal information to the claimant and requires legal statements. |
Understand the consequences before filing a counter-notice
A counter-notice asks YouTube to restore removed content because you believe it was removed by mistake or misidentification. YouTube’s instructions require an explanation and legally significant statements; filing simply to regain access, without a good-faith basis, is not an appropriate use of the process.

YouTube’s instructions call for your full legal name (first and last, not a company or channel name), physical address, telephone number, a direct link to the removed content, and a concise explanation for the claimant. The filing also includes statements about consent to jurisdiction and acceptance of service, plus a sworn good-faith belief that the removal resulted from mistake or misidentification. You or an authorized representative must sign using a full legal name.
YouTube shares a counter-notice with the claimant, including the personal contact information it requires. Do not provide false details. If disclosure concerns you or the legal issues are complex, YouTube says an authorized representative, such as an attorney, may submit on your behalf; getting legal advice may help you assess the risks, but it does not guarantee a platform outcome.

Submit through YouTube’s current counter-notification process
YouTube’s instructions provide a YouTube Studio route for video content and also allow counter-notices by email, fax, or mail. Follow the current official instructions for the interface and delivery details; labels and procedures can change.
- Wait until removal is effective. Confirm in Studio that the video has been removed and the strike applied; a scheduled takedown is not yet eligible for a counter-notice.
- Prepare the required information. Have your legal name, physical address, phone number, direct link to the removed stream or video, concise explanation, required legal statements, and signature ready.
- Explain the specific mistake or misidentification. Connect your explanation to the actual content and evidence. Do not use a generic objection in place of a good-faith basis.
- Submit using one of YouTube’s current routes. Use the Studio process or the email, fax, or mail method detailed in YouTube’s official instructions.
- Check the counter-notice status in Studio. YouTube says it forwards valid counter-notices to the claimant; keep the submission and any status updates with your records.
Track the claimant’s response period
After YouTube forwards a valid counter-notice, the claimant has 10 U.S. business days to provide evidence of qualifying legal action under YouTube’s stated process. YouTube identifies a lawsuit, a court order, a Copyright Claims Board claim where the uploader is U.S.-based, or a CCB infringement determination as possible evidence. If qualifying action is pending, the content may remain down while it proceeds. If the claimant does not provide the required evidence within that period, YouTube says the content may be reinstated unless you deleted it; reinstatement is possible, not certain.
YouTube says it cannot decide who owns a work or mediate between the parties. As YouTube puts it in its copyright-removal guidance: “YouTube cannot determine ownership or mediate on behalf of content owners.”
Or let it run in the cloud
StreamNeo is separate from a copyright response: it does not decide claims, grant music or video rights, or prevent takedowns. Use it only for videos you have the rights or permission to stream. It is a YouTube-only cloud service for keeping an uploaded video or playlist live; it does not stream from a camera. To start, upload a recording or build a playlist, add your YouTube stream key once, and go live. Nothing has to stay on at home, and the uploaded video streams as made at any quality up to 4K 60fps for one flat price per slot. It automatically recovers if YouTube drops the stream. The first day is free with no card, one free day per account. Monthly pricing is $9.99 per month. Learn more at StreamNeo, or start the free day.
