Treat a GST notice about an e-way bill discrepancy as a deadline-driven evidence exercise. First confirm the issuing authority, jurisdiction, statutory section, notice form, alleged field error, proposed amount, detention status and exact response deadline. Then preserve the complete shipment record, reconcile every allegation with the invoice, e-way bill and actual movement, and file a paragraph-by-paragraph reply through the channel named in the notice. Ask for a hearing where the facts or consequences warrant one. If an adverse order is issued, obtain it immediately and check the section 107 appeal deadline and pre-deposit requirements.
This is general process guidance for Indian consignors, consignees and transporters. The notice, movement date, state or Union Territory, service method and law in force for that movement control the result.

What to do in the first 24 hours
- Secure the notice and deadline. Save the PDF or paper notice, the envelope, email headers or portal service record, and any detention or inspection document. Write down the officer, office, jurisdiction, date and method of service, section cited, form number, consignment and vehicle details, amount proposed, release conditions and the last date and filing method stated in the notice. A deadline from another case is not a safe substitute.
- Find out what is actually alleged. Is the complaint a spelling or digit error, a missing e-way bill, an expired validity period, a wrong vehicle, a wrong value or tax detail, an identity problem, or a document that was not carried? Also establish whether the goods or vehicle remain detained and whether the notice proposes tax, penalty, or both.
- Prevent record loss. Download the e-way bill and its available history, invoice or bill of supply, delivery challan, transport receipt, inspection report, detention order and all communications. Preserve portal screenshots with dates and retain the original business records.
- Notify the relevant people. A consignor, consignee and transporter may hold different parts of the evidence. Coordinate one factual chronology instead of sending inconsistent explanations.
The official CBIC e-way bill rules generally require prescribed information before movement of covered consignments above ₹50,000, subject to the rules and their exceptions. The same rules identify the invoice, bill of supply or delivery challan and the e-way bill or its number as carriage documents.
Identify the legal route before writing
A transit discrepancy is commonly handled under section 129 of the CGST Act and corresponding State or Union Territory provisions, but the notice itself controls the allegation and procedure. Do not describe every notice as a “minor error” case or assume that a penalty will be dropped.

Common procedural forms
In a frequently used detention sequence, FORM GST MOV-06 records detention, MOV-07 proposes the amount, and MOV-09 records the order after the response is considered. CBIC’s interception procedure also describes inspection reporting and release when inspection finds no discrepancy. These are common procedural markers, not a guaranteed sequence for every state, date or statutory route. See CBIC Circular 41/15/2020-GST and verify the forms actually served on you.
Do not borrow a deadline from a reported case
The Supreme Court’s judgment of 31 October 2023 recounts a particular matter in which a MOV-07 notice gave seven days from receipt to show cause, followed by a reply and a MOV-09 order. That seven-day period belonged to that notice. It is not a universal response period. Use the deadline and service terms in your own notice and the law applicable to the movement date. The judgment is available at the Supreme Court website.
Build the evidence file
The core question is whether the documents identify a genuine movement of identifiable goods and whether the particular discrepancy has legal significance. Assemble an indexed file containing, as applicable:
- The complete show-cause notice, service proof, detention order, inspection report and any release communication.
- Invoice, bill of supply or delivery challan; e-way bill number and downloaded bill; and the lorry or transport receipt.
- Actual vehicle registration, driver and transporter details, plus records of any vehicle change, trans-shipment or breakdown.
- Purchase order, dispatch register, delivery instructions, goods description, quantity, value, GSTINs, HSN and route records.
- Evidence of exceptional delay, such as an accident report, route interruption, natural event, toll or GPS record, or trans-shipment document.
- A dated chronology and a paragraph-by-paragraph response index.
The exact bundle should match the allegation. For example, a vehicle-number allegation needs the actual vehicle and changeover records; a validity allegation needs dispatch, stoppage and delay evidence; a name or HSN allegation needs the invoice, GSTIN and product classification.
Preserve a chain of custody for electronic records
Download files directly from the portal rather than relying only on a screenshot. Keep the generation time, validity period, cancellation or extension history and the person who generated or updated the bill. Save email correspondence with the transporter, repair invoices, toll records and GPS extracts in their original format, then make a readable PDF copy for the indexed reply. Note who supplied each record and when. If the portal history is unavailable, state that limitation and attach the contemporaneous business record that proves the same fact.

Compare the risk profile of the discrepancy
| Situation | Questions to answer | Immediate focus |
|---|---|---|
| Listed minor typographical error | Is it one of the Circular 64/38/2018-GST categories, and were the invoice or equivalent and e-way bill carried? | Prove each condition and ask that section 129 proceedings not be initiated or be withdrawn. |
| Missing or unavailable document | Was an e-way bill or prescribed invoice actually generated and carried at the time of movement? | Explain the absence honestly; do not recast a missing document as a spelling mistake. |
| Material field discrepancy | Does the error change the identity of goods or parties, tax details, route or validity? | Provide transaction and movement evidence, and address the statutory allegation directly. |
| Expired validity | When was the bill generated, when did the delay occur and whether an extension was available? | Document the exceptional event and the transporter’s role at expiry. |
| Goods or vehicle still detained | Which release condition and amount are stated in the notice? | Request release expressly and obtain prompt professional review if exposure is material. |
| Order already issued | When was it communicated, and what are the tax, penalty and other components? | Calculate the section 107 deadline and statutory pre-deposit immediately. |
These comparisons organize the response; they do not predict the officer’s decision. Movement date, state jurisdiction, amendments and the exact statutory provision can alter the result.
Reconcile every allegation in a working table
Prepare this table for your own use and attach a concise version if it makes the explanation clearer:
Recommended Free Tools
| Notice allegation | Check against | Explanation to give | Useful evidence |
|---|---|---|---|
| Consignor or consignee name, GSTIN or address mismatch | E-way bill, invoice and registration details | State the exact characters that differ and whether GSTIN and the real parties remain identifiable | Invoice, GST registration particulars, purchase order and delivery instruction |
| Document number or HSN mismatch | Invoice or challan and e-way bill fields | Identify the digits or HSN level and explain whether tax rate, goods identity or value changes | Original document, product description, classification support and accounting record |
| Vehicle number or vehicle change | E-way bill, actual vehicle and transport log | Explain a typographical error, breakdown, trans-shipment or replacement vehicle with dates | Transporter statement, repair or breakdown record, gate or toll record and revised movement details |
| PIN code, route or address | E-way bill, invoice and actual route | Show whether the error changes destination, route or validity period | Correct address, route record, delivery proof and correspondence |
| Expired, absent or otherwise invalid e-way bill | Generation time, validity, dispatch and delay chronology | Separate an exceptional delay from a missing or materially inaccurate document; do not claim a typographical safe harbour | Portal history, dispatch record, accident or interruption evidence and transporter records |
Answer each paragraph of the notice in its order. For every denial or clarification, identify the attached document by number and page. If a fact is unknown, say what record is being obtained rather than making a categorical assertion.
When the 2018 minor-error circular may help
CBIC/GST Council Circular 64/38/2018-GST describes specified discrepancies for which section 129 proceedings may not be initiated when the consignment is accompanied by an invoice or other specified document and an e-way bill. The circular is conditional and narrow. It is not a general immunity for missing documents or materially wrong movement information.
| Specified discrepancy | Condition stated in the circular |
|---|---|
| Spelling mistake in consignor or consignee name | GSTIN, where applicable, is correct |
| PIN-code error | Consignor and consignee addresses are correct and the error does not increase e-way bill validity |
| Consignee address error | Locality and other address details are correct |
| Document-number error | Only one or two digits are wrong |
| HSN error | Error is at the four- or six-digit level, while the first two digits and tax rate are correct |
| Vehicle-number error | Only one or two digits or characters are wrong |
For those stated cases, the circular describes ₹500 under the CGST Act and ₹500 under the relevant State GST Act, or ₹1,000 under the IGST Act, through FORM GST DRC-07 for each consignment. Those are the circular’s figures and framing; confirm the legal basis and current applicability in the notice.

A missing e-way bill, an expired bill, a wrong material field, a changed identity of the goods or parties, or a discrepancy that changes route or validity should not be presented as automatically covered. Explain instead why the movement was genuine, what document was carried, and what legal consequence the officer is being asked to withdraw.
Can an e-way bill be corrected after submission?
The official E-Way Bill System FAQ says a submitted e-way bill cannot be edited. Its described route is to cancel it and generate a correct bill, subject to the cancellation rule. The rules generally allow electronic cancellation within 24 hours of generation when the goods were not transported or were not transported as described, but cancellation is not permitted once the bill has been verified in transit. Do not cancel a document merely to erase an already-observed discrepancy; preserve the original history and take advice on the notice.
For an exceptional delay, the FAQ describes an extension with an explanation and updated movement details. It says the transporter carrying the consignment when validity expires is the party who may extend it. Keep the evidence for the delay and follow the live portal instructions, because portal functions and legal requirements can change.
Transit-state jurisdiction can affect the case
The Government of India’s FAQ on inspection, detention and seizure says that, ordinarily, an officer in a transit state where neither supplier nor recipient is located should allow the goods and vehicle to proceed and transmit information to the supplier’s or recipient’s jurisdiction. It describes an exception where no electronic consignment information has been furnished or prescribed documents are not carried. This is amendment-sensitive: check the movement date, state, documents and authority cited in the notice rather than asserting that a transit officer had no power to act. The FAQ is at PIB’s official site.
Write and file the reply
- Use the notice’s addressing and filing route. Follow the named portal, email, physical office or form instructions. A well-reasoned reply sent to the wrong channel may not protect the deadline.
- Open with a short factual summary. Identify the taxpayer, consignment, invoice, e-way bill, vehicle, movement date and relief requested.
- Respond paragraph by paragraph. Quote or accurately paraphrase each allegation, give the matching fact, and cite the numbered attachment.
- Separate admitted clerical errors from disputed facts. If a character was typed incorrectly, say so precisely and show the correct source document. Do not admit a legal conclusion merely because one field is wrong.
- Address the circular only if its conditions fit. Identify the exact listed error and show that the invoice or equivalent and e-way bill accompanied the consignment.
- State the relief. Depending on the facts, request dropping of the proposed action, release of the goods or vehicle where supported, and correction of the record.
- Request a hearing in writing. Ask for an opportunity to explain disputed facts or a serious proposed consequence. Section 129 determination includes an opportunity of hearing.
- Index and lodge the attachments. Number legible files, keep the submission receipt, acknowledgement number, sent email and portal screenshot, and note the date and time.
A useful reply is factual rather than argumentative: it connects the alleged field to the original document, the actual movement and the legal reason the proposed action should not follow.

A practical reply structure
- Heading and authority: reproduce the notice number, date, officer, jurisdiction and statutory section.
- Appearance and authority: identify the taxpayer, GSTIN and, where relevant, the authorized representative or transporter.
- Chronology: list invoice date, e-way bill generation, dispatch, any vehicle change or delay, interception and service of notice.
- Issue-wise response: use the notice’s paragraph numbers and place the document reference after each factual statement.
- Legal submission: rely on the minor-error circular only after proving its conditions; otherwise explain why the alleged discrepancy does not justify the proposed action on the facts.
- Prayer: request the precise relief, including release where supported, and ask for a personal hearing.
- Verification and attachments: sign through the permitted method and include an index with page numbers.
Do not overload the reply with unrelated returns, invoices or arguments. A short chronology, a clear reconciliation table and legible primary records are easier for the officer to test than a large unindexed bundle.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. If the officer issues an adverse order
Save the signed order and the date it was communicated. Under section 107, an appeal is generally due within three months, with a further month potentially available when sufficient cause is shown. The current CGST Act and Appeal Rules set the filing process and payment conditions.
Section 107 requires payment of admitted amounts and a statutory pre-deposit before the appeal is entertained. The calculation depends on the order’s tax and penalty components and the current statutory text, particularly where the order is penalty-only or follows detention. Obtain the complete order, classify each amount, calculate the requirement promptly and do not wait for the final days. A qualified Indian GST practitioner or tax-litigation lawyer is sensible when the goods remain detained, the amount is material, the allegation concerns identity or tax, or an appeal is needed.
What to check before paying or appealing
- Whether the order states tax, penalty, interest or another amount separately.
- Whether the order records consideration of your written reply and hearing request.
- Whether the communication date is documented for calculating the three-month period.
- Whether the proposed appeal challenges facts, jurisdiction, procedure, amount or all of these.
- Whether the statutory pre-deposit is calculated from the current law and the order’s components, rather than from an online example.
Payment or release arrangements do not eliminate the need to preserve the appeal record. Keep challans, acknowledgements, the order, correspondence and every document filed with the original reply together.

A decision checklist before you submit
- Have you recorded the exact service date and deadline from this notice?
- Does your evidence show what goods moved, between which parties, on which vehicle and under which invoice?
- Have you matched every alleged field to the e-way bill, original document and actual movement?
- If relying on Circular 64/38/2018-GST, have you proved every listed condition and the accompanying-document requirement?
- Have you distinguished a clerical error from a missing bill, expired validity or material mismatch?
- Have you explained any vehicle change, trans-shipment, accident or route interruption with dated records?
- Have you requested a hearing where a factual dispute or detention consequence warrants it?
- Do you have filing proof and a system to monitor the order and appeal clock?
The official portal FAQ frames the practical problem plainly: “If there is a mistake or wrong entry in the e-way bill, what has to be done?” The answer is not to edit an already submitted bill; it is to preserve the original record, use the permitted cancellation or extension route when legally available, and answer the notice with evidence tied to the actual movement.

Frequently Asked Questions
What is the first thing to do after receiving an e-way bill discrepancy notice?
Record the issuing officer, section, notice form, alleged discrepancy, amount, detention status, service date and exact deadline. Download the notice and all shipment records, then coordinate the consignor, consignee and transporter before preparing a response.
Can I edit an e-way bill after it has been submitted?
No. The official portal FAQ says a submitted bill cannot be edited. Cancellation and generation of a correct bill may be available within the rule’s limits, generally within 24 hours and before transit verification. Preserve the original record and do not cancel simply to conceal an observed discrepancy.
Does the 2018 minor-error circular protect every typo?
No. It covers a defined list, such as limited name, PIN-code, address, document-number, HSN and vehicle-number errors, and requires that the prescribed document and e-way bill accompany the consignment. Missing documents, expired validity and material identity or movement discrepancies are not automatically covered.

Number every attachment and refer to it in the paragraph-by-paragraph response.
Is the seven-day MOV-07 response period universal?
No. The Supreme Court’s 31 October 2023 judgment describes seven days in a particular notice. Your own notice and applicable law control the deadline; never substitute the historic period without checking service and movement details.
What if the goods are detained in a state where neither party is located?
Government guidance says a transit-state officer ordinarily should allow movement and transmit information to the supplier’s or recipient’s jurisdiction, with exceptions where electronic consignment information or prescribed documents are absent. Because amendments and facts matter, address the authority and movement date stated in your notice rather than making an absolute claim.
How long do I have to appeal an adverse order?
Section 107 generally provides three months from communication of the order, with a possible further month for sufficient cause. Admitted amounts and the statutory pre-deposit must be addressed. Obtain the complete order and calculate the requirement under the current law immediately.

The Bottom Line
Read the exact notice, preserve the complete movement record and answer every allegation with the matching invoice, e-way bill, actual vehicle and dated evidence. Use Circular 64/38/2018-GST only when its narrow conditions fit; it is not a blanket excuse for missing or materially wrong documents. File through the stated channel, request a hearing where warranted, and start the section 107 appeal calculation as soon as an adverse order is communicated.
