First identify the exact form, tax period, allegation, deadline and filing route stated in the communication. Then reconcile the disputed input tax credit (ITC) invoice by invoice against the relevant GSTR-2B and GSTR-3B data and your underlying records. Explain each difference with evidence and respond through the process specified for that notice. A difference between returns does not, by itself, establish that the credit is ineligible.
Identify which GST communication you received
“GST notice” can refer to different procedures. A system-generated FORM GST DRC-01C intimation, a show-cause notice under section 73, and an audit discrepancy communication do not necessarily use the same reply form or process. Read the full communication and its annexures rather than choosing a response route based only on the mismatch described.

- FORM GST DRC-01C: The GST Portal’s DRC-01C FAQ directs taxpayers to submit a response in Part B. It also warns that failure to respond to a previous-period DRC-01C may block filing of a subsequent GSTR-1 or IFF.
- Section 73 show-cause notice: Follow the notice’s stated procedure and deadline. Section 73 sets out a notice and pre-notice payment framework for matters within its scope, but whether that framework applies to a particular demand depends on the facts and the notice.
- Audit discrepancy: Rule 101 addresses a taxpayer’s reply to audit discrepancies before findings are finalised. Follow the communication and applicable audit process.

Random freezes, missing sound and display glitches usually trace back to one bad driver. Find and replace yours safely.Free scan · under a minuteDoes a GSTR-2A and GSTR-3B difference automatically make ITC ineligible?
No. A numerical difference calls for reconciliation; it is not, on its own, a decision on eligibility. The legal test depends on the tax period and the conditions that applied then. Under the current CBIC-hosted text, section 16(2)(aa) of the CGST Act makes the supplier’s furnishing of invoice or debit-note details, and their communication to the recipient, relevant. Rule 36 refers to the relevant details being communicated in FORM GSTR-2B and specifies documents for claiming credit.

Do not apply today’s wording or requirements retroactively without checking the law applicable to the period named in the notice. Older tax periods may be governed by different versions of the Act or rules and by period-specific circulars or relaxations. The official materials cited here do not establish one blanket numerical tolerance for every period.
GSTR-2A can change when suppliers file or amend returns. Preserve dated portal extracts and explain any later supplier filing or correction; a current screen alone may not show what was visible when credit was claimed. Assess the difference alongside the applicable period’s legal conditions and the taxpayer’s records.
How to reconcile the disputed ITC
Build a period-wise reconciliation with one row for each disputed invoice, debit note or other credit item. Compare the alleged amount with your return data and source documents, and identify the reason for each variance only where the records support it.

|---|---|
| Document | Supplier GSTIN, invoice or debit-note number and date, taxable value, and relevant tax heads. |
| Return periods | Period in which the supplier reported the item or it appeared in the relevant GSTR-2B, and period in which you claimed, reversed or corrected the ITC in GSTR-3B. |
| Amounts | Amount alleged, amount shown in your records, and variance, split by tax head where relevant. |
| Reason and evidence | Supported explanation for the difference and the exhibit or record that substantiates it. |
Possible explanations may include a timing difference or supplier filing, a clerical mismatch, a duplicate entry, an ineligible item, a reversal, import documentation, or another treatment. These are categories to investigate, not automatic defences. A portal mismatch and failure to meet a substantive eligibility condition are separate questions.
What evidence should you attach?
Match each attachment to a particular item in the reconciliation and to the allegation it answers. Depending on the case, relevant records may include:
- Tax invoices, debit notes and the purchase register.
- Dated GSTR-2B and GSTR-3B extracts for the periods in issue.
- Evidence that the goods or services were received, such as applicable delivery, receipt or service records.
- Accounting ledger entries and workings for a reversal or later correction.
- Supplier correspondence and evidence of a filing or correction, where supplier reporting is in question.
- Bill of entry and related import records, where the credit concerns imports.
- Payment records, if relevant to the allegation or the facts being explained.
Rule 36 specifies documents relevant to availing credit, while section 16 sets out eligibility conditions including receipt and supplier communication. There is no single attachment list that fits every mismatch notice: include the records that substantiate the particular explanation and conditions in issue.

How to write and file the reply
- Identify the proceeding. State the GSTIN, communication reference, form, date, tax period and deadline. Confirm which communication you are answering.
- Answer each discrepancy separately. For each item, state the amount alleged, your reconciled figure, the reason for the variance, the relevant period treatment and the supporting annexure.
- Separate accepted and disputed amounts. Explain the calculation for any amount accepted and identify any payment already made with its proof. Do not make a blanket admission or denial that your records cannot support.
- Explain the applicable facts and period-specific law. Address the documents, receipt, supplier reporting or communication, and other eligibility facts relevant to the allegation. Cite the tax-period treatment rather than assuming a rule applies across all years.
- Make a clear request. Ask that supported differences be considered and the corresponding allegation be dropped. Where the applicable procedure permits and the circumstances warrant it, request a personal hearing.
- Use the route stated for the communication. For DRC-01C, submit the response in Part B through the GST Portal. For a statutory notice or audit proceeding, use the process specified for that communication.
- Keep filing proof. Save the submitted reply, attachments and portal acknowledgement. Check that the uploaded files are readable and correspond to the annexure references in the reply.
This is a drafting framework, not a ready-to-file legal reply. Use only notice references, dates, calculations and defences supported by the taxpayer’s records.
Should you pay, dispute the demand or get advice?
Decide after the reconciliation. Do not treat payment as an automatic response to a mismatch if the records support the credit; equally, do not continue claiming credit that the applicable law and facts do not support. The GST Portal has listed an ITC-mismatch reason for FORM GST DRC-03 voluntary payment, but that payment facility does not determine whether a particular proposed demand is correct or whether payment is appropriate.
Consider review by a qualified Indian GST practitioner where the amount is material, the interpretation is disputed, several periods are involved, or the matter may proceed to adjudication or appeal. For a section 73 proceeding, obtain case-specific advice before deciding how any proposed payment, interest or penalty provisions apply.
