Start with the agency that controls the records, not the camera vendor. Ask that agency for its current automated license plate reader (ALPR) policy, retention schedule, access and sharing records, and any specific scans or images you can identify by plate, date, time and location. The law is jurisdiction-specific: a request that works for a California city may not apply to a sheriff’s office in another state, and no source establishes a universal right to inspect every scan of your vehicle.
Use a public-records request for existing documents, a separate preservation request when deletion is a concern, and the appeal or court process provided by the law where the system operates. If a vehicle match appears wrong, document it immediately and ask the agency to review the underlying image, query history and report.

What ALPR records are, and why the custodian matters
An automated license plate reader combines a fixed or mobile camera with software that captures and records plate information. A system may also retain an image of the vehicle, location, date and time, an alert or match, and records showing who searched or accessed the data. The exact fields, retention period and disclosure rules depend on the system, the agency and the governing law.
Begin by identifying three things:
- Where the system operated: city, county, state or federal property.
- Who operates it: a police department, sheriff, transportation agency, corrections agency or a regional task force.
- Who holds the database: the operating agency, a shared government system or a contractor acting for an agency.
Send the request to the agency’s public-records, freedom-of-information or records unit. A private vendor may maintain equipment or software, but contacting the vendor alone does not replace a request to the government agency that controls the records.

There is no single nationwide disclosure rule established for ALPR data. State public-records statutes, exemptions, agency policies, court orders and the status of an investigation can all change the result. Treat the steps below as a practical framework, then verify the recipient, deadline, fee rules and appeal route for your jurisdiction.
Choose the record type before you write
Requests are easier to process when they identify existing records rather than asking an agency to create a new analysis or answer broad questions. Decide whether your purpose is oversight, information about one vehicle, or a challenge to a suspected misuse.
| Purpose | Records to name | Important limitation |
|---|---|---|
| Public-interest oversight | Use and privacy policy; system inventory; vendor contract; purchase and maintenance records; retention and deletion schedule; training materials; audit findings; complaint records; policy revisions; data-sharing agreements; access or query logs for a defined period. | These records may be easier to separate from investigative material, but exemptions and redactions still depend on local law. |
| Information about one vehicle | Plate scans, associated images, alerts, query history, access logs and sharing records for a specified plate, issuing state, dates, times and locations. | Specificity helps locate records; it does not itself establish a right to receive identifiable location or investigative data. |
| Possible misuse or unauthorized sharing | User-access logs, audit results, transfer or sharing records, written interagency requests, agreements and the policy in force when the access occurred. | An agency may withhold material tied to an active investigation or another legal exemption. |
| Potentially inaccurate match | The alert, source image, underlying scan, query and access logs, related incident or report, and any review or correction record. | Some agencies provide an internal review process; a general public correction right is not established everywhere. |
Step 1: identify the correct records holder
Check the department or sheriff’s website for a public-records portal, records custodian, clerk or designated freedom-of-information contact. If the system is regional, ask which agency is responsible for the database and which agencies can query it. Request records from each government holder when necessary.

A contract may identify a contractor that hosts or maintains the system, but the public agency remains the practical starting point. If a private company receives data on the agency’s behalf, ask for the contract and the provisions governing vendor access, security, retention and deletion.
Step 2: find the written policy and retention rules
Locate the current ALPR use and privacy policy before seeking individual scans. Also request or download the retention schedule, system inventory, vendor contract, data-sharing agreements, audit policy and public-meeting materials approving the system. These documents tell you what the agency says it collects, who may search it, how long it keeps it and when it may disclose it.
California provides a useful example, not a national rule. Under California Civil Code sections 1798.90.5 and following, covered public agencies must address ALPR use and privacy in a written policy, security safeguards and access records. California’s framework also requires an operating public agency to provide an opportunity for public comment at a regularly scheduled governing-body meeting before implementation. California DOJ guidance says agencies must have written policies. Other states and localities may have different requirements or none at all.
Step 3: define a narrow, usable request
Give the custodian enough information to search existing systems without asking staff to build a new report. Include:

- the plate number and issuing state, if requesting vehicle-specific data;
- a start and end date, with approximate times when known;
- locations, routes or camera names, if known;
- the record types sought: scan, image, alert, query history, access log, sharing record or report;
- an incident, case or report number, if one exists;
- the electronic format in which the records are ordinarily maintained, when practical; and
- a request for reasonably separable, nonexempt portions if any category is withheld.
Keep proof of ownership or authorization available if the agency asks. That request may be an agency practice or a legal requirement in a particular setting; it is not evidence that every jurisdiction recognizes a general right to a vehicle’s scan history.
Sample oversight request
Subject: Public-records request — ALPR policy, retention, access and sharing records ([start date] to [end date])
Please provide existing records for the automated license plate reader system operated or controlled by [agency], including the current use and privacy policy; system inventory; retention and deletion schedule; vendor contract and amendments; training materials; audit findings; complaint records; policy revisions; data-sharing agreements; and user-access, query or transfer logs for [date range]. Please provide electronic copies in the format ordinarily maintained. If any portion is exempt, please identify the specific legal basis and release reasonably separable nonexempt portions.
Sample vehicle-specific request
Subject: Request for ALPR records — plate [plate number], [issuing state], [date range]
Please provide existing ALPR records for plate [plate number], issued by [state], for [start date and time] through [end date and time], including scans, associated images, alerts, query history, access logs and sharing or transfer records. Relevant locations are [locations]. Related incident or report number: [number]. If records are withheld, please identify the specific exemption for each category and release reasonably separable nonexempt portions.
Do not ask the agency to “tell me everywhere this plate has ever been” unless you understand that such wording may cover a large, indefinite search and trigger privacy or investigative exemptions. A defined period and location is more practical and more likely to produce a reviewable response.
Step 4: submit, track and preserve the request
Submit through the agency’s designated portal, email address or written-records process. Save the request, attachments, delivery confirmation, assigned tracking number and every response. Ask the custodian to identify any search terms, date limits or format issues that need clarification.
A disclosure request and a preservation request serve different purposes. The first seeks existing records. The second asks the agency not to delete relevant material while a complaint, review or case is pending. You can send both, but whether the agency must preserve records depends on applicable law and circumstances. State the precise records and date range you want preserved; do not assume a preservation request guarantees permanent storage.
Ask about estimated search time, duplication or media fees and any required deposit. Deadlines and fee rules vary. California DOJ’s public-records guidance emphasizes specific requests, legal exemptions and release of the remainder after redaction, but its procedures should not be assumed to govern every city, county or state agency.
What to do when the agency denies or narrows the request
Request a written explanation rather than accepting a conclusory “confidential” response. Ask the agency to identify the exemption or other legal basis for each withheld category, state whether the material is being withheld in full or in part, and release reasonably separable nonexempt portions.
Separate the categories in your follow-up. A policy, contract or retention schedule is not the same record as a plate scan linked to an investigation. An agency may be able to release oversight documents while withholding an identifiable location history, officer information or investigative record. A public-records request does not necessarily reveal the identity of officers or other people who queried a system.

Follow the administrative review, appeal or court procedure and deadline established by the applicable law. The correct remedy might be an internal review, a state records authority, mediation or a court petition. Do not rely on a deadline from another state or another agency’s policy. If the response does not state an appeal route, ask the records custodian or the relevant public-records authority where the local procedure is published.

Read the policy against the actual logs
Note which users, roles and agencies the policy authorizes to search ALPR data. Compare those permissions with access or query logs for the same period. Look for searches outside the stated purpose, unusual volume, access after an incident ended, or users whose role is not explained by the policy.
Check timestamps and identifiers
Record the camera identifier, plate text, image timestamp, time zone, alert type, query time, user or badge identifier and case number. A camera capture and a later database query may have different timestamps. Preserve the original files and metadata before converting them to another format.
Trace sharing and retention
Match each transfer or disclosure to a written agreement, request or approval. Compare the date of deletion or retention-category change with the published schedule. If a log references a record you did not receive, ask whether it was withheld, redacted, deleted under schedule or maintained by another agency.
Distinguish a plate read from an investigative conclusion
An ALPR event shows that a system captured a plate-like string at a particular time and place; it does not by itself prove who was driving, that the vehicle was involved in a crime, or that an alert was accurate. Image quality, plate angle, glare, similar characters and database errors can all affect a match.

What to do if an ALPR hit appears wrong
Act quickly if an alert contributed to a stop, search, citation or other enforcement action. Preserve the notice, report number, date, time, location, officer or agency name and any image or screenshot you received. Do not alter the original file.
- Write down exactly what is inaccurate: wrong plate characters, wrong state, wrong vehicle, incorrect date or location, or a mistaken association with a stolen-vehicle or wanted-person record.
- Ask the ALPR administrator or records custodian to review the underlying image, the original scan, the alert rule, query and access logs, and the related incident report.
- Ask the agency to preserve those records while the error is reviewed.
- Request written confirmation of the review, any correction made to the report or alert, and notice to agencies or users who received the erroneous information.
- Use any complaint, administrative review, court or records-appeal process available under local law if the agency does not address the issue.
California’s Department of Corrections and Rehabilitation policy illustrates one agency-specific safeguard: operators are expected to visually verify matches and report invalid matches internally. That policy is not a nationwide correction right and does not determine how a city police department must handle a disputed hit.

California: separate system oversight from individual data
California DOJ Information Bulletin 2023-DLE-06 and General Order 2023-05 describe a framework for written policies, security, access records, auditing and sharing restrictions. A request for a policy, contract, audit or sharing agreement therefore raises different questions from a request for an identifiable vehicle’s location history or investigative file.
California DOJ guidance states that, under its interpretation of state law, local agencies may not share ALPR information with federal or out-of-state agencies, including law-enforcement agencies. The guidance also advises agencies to examine vendor access arrangements. This is a California position about California law, not a rule for every state.
On January 21, 2026, the California Attorney General announced ongoing litigation concerning the city of El Cajon’s ALPR sharing practices. The announcement describes the Attorney General’s allegations and requested relief; it is not a final court ruling. Treat any claim about that matter as position and litigation status, not as an adjudicated nationwide standard.
California DOJ’s public-records guidance says the department considers privileges and exemptions when responding to a California Public Records Act request or litigation process for ALPR information. It also states that nonexempt portions are generally released after redaction. The precise response deadline, fee and appeal route still must be checked with the particular California agency holding the records.
“While this technology may be a helpful investigative tool, Californians must be able to trust that their information is being kept safe.” — Rob Bonta, California Attorney General, October 30, 2023.
This is the Attorney General’s stated position, not proof that a particular ALPR system is secure. To evaluate security, request the policy, safeguards, audit findings and access records for the system you are examining.
Can the federal Privacy Act help?
The federal Privacy Act can provide an access or amendment route for records about an individual in a covered federal system of records, subject to statutory exceptions. The U.S. Department of Justice explains that a person may request access to records about themselves and seek amendment or correction when the Act applies.
Best Value
This is not a general route to local police records. First confirm that a federal agency holds the database, that the system is covered by the Privacy Act and that the requested records are about you within the statute’s definition. If a city, county or state agency operates the system, use the applicable state or local public-records and complaint procedures instead.
Practical safeguards for requesters
- Use a dedicated email folder and keep the original request, responses and downloaded files together.
- Redact unrelated personal information before publicly sharing records.
- Do not publish plate numbers, home addresses, travel patterns or other sensitive data unless there is a compelling lawful reason.
- Ask for electronic copies and preserve metadata, but keep a readable copy for review.
- Describe the records you seek neutrally; avoid accusing a particular employee before the logs establish what happened.
- If a criminal, traffic or civil case is pending, coordinate the records request with the applicable discovery, subpoena or court process rather than assuming public-records law will provide everything.
Frequently asked questions
Can I find out whether police scanned my license plate?
Possibly, but no universal individual access right is established. A narrowly defined request may locate scans, images or alerts, yet privacy, investigative and other exemptions can limit disclosure. The agency’s policy and the law where the camera operated control the result.
Can I see who searched or shared my plate data?
You can request access logs, query logs, transfer records and sharing agreements. The agency may redact names or withhold portions when another law protects officer, witness or investigative information. Ask for the legal basis for each redaction rather than assuming a complete user list must be released.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsHow long does police keep ALPR data?
There is no single retention period. Request the current schedule and any revisions, then compare it with the dates in the logs. A schedule may differ by record type, investigative hold or agency, and a preservation request does not automatically change the legal retention rule.
What if the agency says it has no responsive records?
Ask whether another agency controls the database, whether the search covered the correct plate format and issuing state, and whether the relevant dates fall within the system’s retention period. Request the agency’s written explanation and, where allowed, the search terms or systems checked.
Can I challenge a denial without hiring a lawyer?
Often you can begin with the agency’s administrative review or public-records appeal process, but the available remedy and filing deadline are jurisdiction-specific. A court petition, subpoena or case-related discovery may have different requirements, so verify the local procedure before the deadline expires.
Frequently Asked Questions
Can a public-records request force an agency to create a new ALPR report?
Usually, public-records laws concern existing records. Ask for the underlying logs, images, policies or agreements instead of demanding a new analysis; whether an agency must compile data depends on local law.
Should I request deletion of an inaccurate ALPR record?
Ask first for preservation and review. Deletion, correction and notice obligations vary, and deleting evidence before a review or proceeding can create additional problems.
Does a vendor have to answer my request directly?
Start with the government agency that operates or controls the system. The agency’s contract may govern vendor-held records and access, but a vendor is not automatically subject to the same public-records process.
