File a written request with the county office that holds the investigation, describe existing records precisely, ask for all reasonably segregable nonexempt portions, and require the county to identify the statute for every withholding. County records are controlled by the state public-records law—not the federal FOIA—and the result depends on your state, whether the case is active or closed, and which office possesses each record.
Start with the right records custodian
A county misconduct matter can generate records in several offices. Sending one request to the wrong department can delay a response or produce an incomplete search. Begin with the county’s official public-records page or request portal, then identify every office likely to possess responsive records.

- County clerk or central public-records officer: Use this as the starting point when the county’s structure is unclear or its portal routes requests centrally.
- The department named in the allegation: A department may hold the original complaint, assignment, evidence, interview notes, policy records and disciplinary decision.
- Human resources or employee relations: These offices commonly hold personnel-related findings, corrective-action decisions, grievances and appeal records, although privacy exemptions may apply.
- Inspector general, internal-affairs or equivalent investigative unit: Request records directly if that unit conducted or supervised the inquiry.
- Sheriff, police or other law-enforcement agency: Use the law-enforcement custodian if an agency conducted the investigation or supplied records.
- District attorney or county counsel: These offices may possess referral records, litigation files or confidential legal advice, which can be subject to different exemptions.
If more than one office may hold records, name each office or custodian in the same request and ask the receiving records officer to forward or coordinate it. Keep proof of submission, including the date, portal confirmation, attached file and the exact text you sent.

Public-records laws generally require access to existing records; they do not require the county to create a new narrative, spreadsheet or explanation. Ask for documents, databases, emails, logs and other recorded material that already exist. A focused request is easier to search and less likely to be treated as an indefinite demand.

Core investigation records
Ask for each category that fits your matter:
- Complaint, allegation, intake form and assigned case or tracking number.
- Investigation assignment, scope, plan, authorization and investigator designation.
- Interview notices, interview recordings or transcripts, interview summaries and evidence or exhibit logs.
- Investigative report, factual findings, credibility assessments and recommendations.
- Final disposition, disciplinary or corrective-action decision and notice of outcome.
- Appeal, grievance, hearing or review filings and the resulting decision.
- Policies, procedures, codes of conduct and collective-bargaining provisions in effect during the relevant period.
- Communications or activity logs that are reasonably identifiable and directly concern the investigation.
Do not ask the county to “tell me what happened” or to prepare a summary. Instead, request the final report, disposition and other recorded materials from which you can draw your own conclusions.
Give the search terms staff can use
Include enough detail for a records employee to locate the material without guessing. Supply the employee’s full name, job title, department, allegation or conduct at issue, incident location, date range, investigator, case number and relevant keywords. If you know likely custodians, list them. County guidance commonly emphasizes dates, departments, record locations and keywords because these details narrow electronic and paper searches.
For example, identify both the incident date and the date range for the investigation. If the employee used a shortened name, former surname, badge number or employee identification number, include those variants. Add terms appearing in the complaint, such as “use of force,” “timekeeping,” “procurement,” or “harassment,” but avoid an unlimited request for every record mentioning a broad topic.

Use a request that preserves access while accepting lawful redactions
State that you want electronic copies and will accept inspection if electronic production is not available. Ask for all reasonably segregable nonexempt portions. This tells the county that a protected name, medical detail or other exempt passage should be redacted rather than used to withhold an entire document.

Agree in advance that legally protected personal identifiers may be redacted, while making clear that you are not consenting to unexplained withholding. Ask the agency to describe each withheld record category and cite the exact statutory exemption supporting the redaction or denial.
A practical request should also ask for an estimated completion date, installment production for a large file and a fee estimate before chargeable search, copying or data-extraction work begins. “Electronic copies” can reduce copying costs, but a county may still charge lawful search, duplication or special-format fees under its state statute.

There is no single national rule for county misconduct files. State law, the record’s location, the investigation’s status and the document’s purpose all matter. A county may release one portion, redact another and withhold a third.

Personnel privacy and personal information
Personnel records may receive special protection. Commonly protected material includes medical information, home addresses, personal telephone numbers, personal email addresses, family information and other identifiers. A privacy exemption does not automatically establish that every page of a personnel file is secret; the agency must apply the state standard to the particular record and, where required, release segregable material.
Active investigations
Active investigative records are often more restricted than closed-case records. Washington guidance, for example, states that some employment-law investigations may be exempt in full while active and may later be released with complainant, accuser and witness names redacted. That is a Washington-specific example, not a rule for every county.
Drafts, legal advice and litigation material
Draft reports, attorney-client or other confidential legal advice, and records prepared for litigation may be exempt under state law. Ask the county to identify the category and statutory basis rather than accepting a generic statement that “the file is confidential.” A final adopted finding may be treated differently from an investigator’s draft or counsel’s litigation memorandum.
Jurisdiction-specific investigation exceptions
California Department of Justice materials list personnel, investigative, litigation, draft and confidential-legal-advice exemptions among categories that may apply. Georgia describes a temporary exception for records obtained in investigations concerning suspension, firing or complaints against public officers or employees. Wisconsin’s June 2025 guide explains that misconduct and disciplinary records are not categorically excluded and that the applicable investigation exception depends on the statute and on when the investigation reaches disposition. These examples illustrate why you must identify the governing state law instead of assuming a nationwide exemption.

Law-enforcement and prosecutor-held records
If a sheriff, police agency or prosecutor conducted or received the investigation, law-enforcement or prosecutorial exemptions may apply in addition to personnel rules. Request the records from that custodian as well as the county department, and ask each office to identify the specific exemption it applies. A county department’s release does not guarantee that a prosecutor’s litigation file or confidential legal advice will be released.
Separate an active case from a closed case
Tell the custodian whether you believe the investigation is active, completed or under appeal. If the county has issued a final disposition or disciplinary decision, request those records specifically and ask for any remaining portions of the investigative file after closure. If the matter is still active, expect that investigative strategy, witness identities or evidence may be withheld temporarily where state law permits.
A closed investigation is not automatically public in full. Personnel privacy, medical information, protected contacts, legal advice, drafts and litigation-related material can remain exempt after disposition. Conversely, closure does not necessarily erase the county’s duty to release factual findings or final decisions when state law makes them public.
What to expect after submitting the request
Acknowledgment and clarification
The county may acknowledge receipt, ask you to clarify an overbroad request or identify a likely date for the first production. Respond in writing and preserve the original scope unless a narrower search is genuinely more useful. If the county proposes a very narrow interpretation, restate the records and custodians you intended.
Best Value
Installment production
Large investigations can contain emails, attachments, recordings and paper files. Ask for rolling or installment production rather than waiting for the entire matter. Request the complaint, final disposition and policy records first if those are immediately available, followed by the investigative report, interview material and communications.
Fees and format
Request an estimate before work that may generate charges. Specify electronic delivery and ask whether the county can provide native files, searchable PDFs or an inspection appointment. Do not assume electronic copies are free; fee authority and rates are state- and county-specific. If the estimate is unexpectedly high, ask which search, review, copying or special-format task creates the charge and whether a narrower date range or installment release would reduce it.
Partial release
Review every production for redaction markings and missing categories. A partial release should identify what was withheld and why. If a page is completely blacked out, ask whether nonexempt factual material can be segregated. Keep the produced files in their original order and record the page number, document title and redaction code for each challenge.

- Read the stated exemption. Note the statute, subsection and the record category the county says it covers. “Confidential personnel matter” without a legal citation is not an itemized explanation.
- Check the record’s status and purpose. Determine whether it is a draft, final finding, active investigative material, medical record, legal advice, litigation file or ordinary administrative communication.
- Ask for segregable portions. Request release of factual or administrative portions after protected names, identifiers or legal analysis are redacted.
- Ask for a privilege or withholding log when available. Request enough description to understand what was withheld without demanding disclosure of the protected content itself.
- Seek administrative review. Many states provide an internal review, public-records ombudsman or attorney-general review. Follow the county’s stated procedure and preserve the submission date.
- Use the state-law court remedy if necessary. Some statutes allow a petition or action to compel production and may shift attorney fees when the requester substantially prevails. Deadlines, exhaustion rules and fee-shifting standards vary by jurisdiction, so verify them in the applicable state statute or with qualified local counsel.
When challenging a denial, focus on the exact record and exemption. Explain why the record is final or no longer part of an active investigation, why the cited privacy interest can be protected by redaction, or why the agency has not shown that the exemption covers the entire document. Avoid arguing that all government records must be public; state laws contain exceptions and apply different tests.
State examples show why the law must be localized
| Jurisdiction or source | What the guidance illustrates | How to use it |
|---|---|---|
| Florida Statutes §119.01 (2026) | Florida states a broad policy that “all state, county, and municipal records are open for personal inspection and copying by any person,” subject to statutory exemptions. | Use the Florida statute and its specific exemptions for a Florida request; do not generalize the policy to another state. |
| Washington guidance | Some employment-law investigations may be exempt in full while active and later released with complainant, accuser and witness names redacted. | Identify whether the investigation is active and ask for post-closure release of segregable portions. |
| California Department of Justice | Personnel, investigative, litigation, draft and confidential-legal-advice exemptions may affect access. | Ask the agency to classify each withheld record and cite the precise California exemption. |
| Georgia guidance | A temporary exception may cover records obtained in investigations concerning suspension, firing or complaints against public officers or employees. | Ask whether the investigation has reached disposition and whether the temporary exception still applies. |
| Wisconsin guide, June 2025 | Misconduct and disciplinary records are not categorically excluded; the investigation exception depends on the statute and when the investigation reaches disposition. | Challenge blanket claims that every misconduct record is exempt and analyze the record’s timing and purpose. |
These examples are illustrations, not interchangeable legal advice. Before relying on a deadline, exemption, fee rule or appeal route, verify the county and state.
Common mistakes and how to fix them
- Using federal FOIA: The federal Freedom of Information Act is generally not the route for county records. Cite the state public-records statute and use the county’s process.
- Requesting the entire personnel file: This invites privacy objections and may obscure the records you actually need. Name the complaint, report, findings, disposition and disciplinary decision instead.
- Demanding an explanation: Ask for existing records, not a new summary or answer to a question.
- Leaving the date range open: A defined incident and investigation period makes searches faster and limits fees.
- Sending only one vague keyword: Include names, titles, department, location, case number and synonyms.
- Accepting a blanket “personnel exemption”: Request the exact statutory subsection, record description and segregable portions.
- Ignoring other custodians: HR, the investigative unit, law enforcement and the prosecutor may hold different records.
- Failing to ask for installments: Request the available final disposition and report first while the county processes a large email or evidence collection.
- Missing review deadlines: Calendar the date of the denial, any administrative-review deadline and the time limit for a court action under your state law.
A practical checklist before you send
- Confirm the county and state law that govern the records.
- Find the official public-records page, portal or custodian.
- List each likely department or records holder.
- Identify the employee, title, department, allegation, location and date range.
- Add case number, investigator and search terms if known.
- Request existing records by category rather than a new narrative.
- Ask for electronic copies, inspection as an alternative and installment production.
- Request all reasonably segregable nonexempt portions.
- Accept redaction of legally protected identifiers without accepting unexplained withholding.
- Request an itemized exemption citation, anticipated production date and fee estimate.
- Save the request, confirmation, correspondence and every production.
What a successful result may look like
You may receive a complaint and final disposition while the county withholds witness contact details, medical information and an active investigative memorandum. Or you may receive a closed-case report with names redacted, a disciplinary decision and the governing policy, while attorney notes remain withheld. Another office may separately deny prosecutor-held litigation material. These outcomes can all be lawful or unlawful depending on the state statute, timing and record purpose; the itemized exemption explanation is what lets you evaluate the decision.
The strongest request therefore does three things at once: it identifies searchable existing records, preserves access to nonexempt portions and creates a clear record for review if the county withholds material. That approach gives you the best chance of obtaining the factual findings and final decisions that can be disclosed without demanding records the law protects.
