How to Request Police Drone Footage and Understand Public-Records Exemptions

To request police drone footage, identify the agency that operated the drone or keeps the recording, then submit a request through that agency’s public-records process. Give the date, approximate time, location and any incident number, and specify whether you want video, flight logs, metadata or related policies. Whether you receive the material depends on the state or local law, the record’s investigative status, privacy concerns and the agency’s retention rules.

How do I request police drone footage?

There is no single nationwide request process for footage held by a city, county or state police department. Start with the public-records office or portal designated by the agency likely to hold the file. Search its official website for “public records,” “records request,” “UAS” or “drone.” If you are unsure which agency operated the drone, ask the records office which agency maintains the recording.

  1. Identify the likely record holder. The agency that responded to the event may not be the only possible custodian; a regional or state agency could have operated the drone or received the footage.
  2. Use the agency’s stated submission route. Follow its current instructions for the portal, form, mailing address or records officer. Do not assume an ordinary public-records form is the correct process for every category of recording.
  3. Describe the event precisely. Include the date, a bounded time range if the exact time is unknown, the location, an incident or case number if available, and a short neutral description.
  4. List each kind of record you want. Request the drone video or images separately from flight or deployment logs, date-and-location metadata, telemetry or flight-path information, and relevant policies or retention schedules.
  5. Ask for electronic copies and partial release. You can ask the agency to release any non-exempt portions with protected details redacted, where applicable law permits.
  6. Keep a record of the request. Save the submitted request, proof of delivery, correspondence, fee estimates and response; note any deadline the agency gives you.

Pennsylvania State Police illustrates why checking the process matters: its official service instructions say requests for covered PSP audio/video recordings use Act 22, rather than the ordinary Right-to-Know route described on that service page. Its requirements are specific to covered PSP recordings, not a national standard.

What should I ask the agency to search for?

“Drone footage” may not identify every record relevant to an event. Video, images, flight-path data and deployment records can be treated differently under a statute or agency policy. Name the material you seek rather than assuming a request for video also covers the records explaining when and where the drone flew.

  • Recording: video and still images from the flight, including any available associated audio.
  • Flight details: flight or deployment logs, date and time, location, flight path, metadata and telemetry, if maintained.
  • Policies: the drone-use policy and retention schedule applicable to the event.
  • Related handling records: records showing whether the material was treated as evidence or referred or transferred to another agency, when relevant.

Illinois provides an example of the distinction: an official Illinois General Assembly search excerpt describes information gathered by a law-enforcement drone as generally non-disclosable subject to exceptions, while records about drone use—including flight-path data, metadata or telemetry for specific flights, if available—may be disclosed under Illinois FOIA and applicable rules. Because the cited statutory page was not available for direct review, check the current statute and exact language before relying on that summary.

Can I get police drone video through a public-records request?

You can submit a request, but a request does not guarantee disclosure. The agency may release the recording, redact portions, release other responsive records while withholding the video, or deny some or all of the request. The controlling rules depend on the jurisdiction and the circumstances of the recording.

Potential issues include whether the footage is part of an active investigation, evidence in a criminal matter, or contains confidential, victim or otherwise protected information. Privacy interests and other exemptions may also matter. Some laws distinguish the recording itself from operational records such as flight logs or metadata; ask the agency to consider each requested category separately.

Florida’s drone statute is relevant background but is not, by itself, an answer to whether a particular recording must be disclosed under Florida public-records law. Florida Statutes § 934.50 generally restricts law-enforcement drone use to gather evidence or information except under listed circumstances, including a judge-signed warrant and specified urgent situations. For drone use to provide an aerial perspective of a crowd of 50 or more, the statute requires agency policies addressing use, storage, retention, release, safety and constitutional protections.

Why might an agency deny or redact a request?

A denial should be read in the context of the law and the records at issue. For example, Hayward, California, says its drone video and photos are generally considered investigative records and generally are not available under the California Public Records Act or FOIA. That is Hayward’s stated position, not a rule for all California agencies. Pennsylvania State Police lists potential denial grounds for covered recordings that include potential evidence in a criminal matter, investigation-related information, confidential information and victim information.

If a response withholds material, read it for the specific legal exemption cited and the review route and deadline. You can ask the agency to identify the basis for withholding each record or portion and to release any reasonably separable, non-exempt parts. Use the administrative or judicial review process provided by the law that applies; deadlines and appeal bodies vary.

For covered PSP audio/video requests, Pennsylvania’s service page describes a judicial appeal within 30 days of denial and lists a $125 court filing fee. Those figures and procedures apply to that specific process; check the current official instructions and applicability to your recording.

How long does police keep drone footage?

Retention varies by agency, record category and whether the material is evidence or connected to an investigation. Request promptly, especially if the event may relate to a pending investigation, litigation or other proceeding. In the request, identify that connection when relevant and ask the agency to preserve responsive material if the applicable law allows or requires preservation. A request to preserve a record is not itself a guarantee that the agency must retain it.

Agency or rule What the stated rule says Scope and qualification
San Francisco Police Department Its order says non-evidentiary media may be deleted within 30 days; evidentiary media must be retained for a minimum of two years, subject to law. It also says “public footage” generally must not be retained longer than 30 days, absent specified approval for an open criminal investigation. These are categories and periods in the department’s order, not a California-wide retention schedule.
Hayward, California The city FAQ says video and photo evidence is stored with investigative evidence, ordinarily for one year or less unless categorized as evidence in a crime or formal investigation. This is Hayward’s stated practice and exception, not a rule for other agencies.
Ohio Revised Code § 4561.64 When effective, it requires law-enforcement agencies to document flight data for each surveillance flight and verify accuracy and completeness. Data relevant to an ongoing investigation, trial or litigation must be retained until no longer needed for that purpose. Enacted but not yet in effect as of October 4, 2026; the official text gives an effective date of October 6, 2026.

Ohio’s forthcoming provision also says covered retained flight and surveillance data is a public record under Ohio law unless an exemption applies. It should not be treated as already effective on October 4, 2026. The existence of a public-records designation does not remove the exemptions provided by the statute it references.

How do state and local procedures differ?

The examples below show why a requester must check the particular agency and current governing law. They are not interchangeable procedures or a complete statement of any state’s public-records law.

Jurisdiction or agency Submission or record rule Important limit
San Francisco Police Department The department’s order directs UAS public-records requests to its Legal Division. The retention categories are department-specific; they do not establish a statewide California rule.
Hayward, California The city directs requesters to its Public Records Act portal. Its general view that drone images are investigative records is Hayward’s position, not a statewide disclosure rule.
Pennsylvania State Police For covered audio/video recordings, the page requires a written request received within 60 days of the recording, delivered by certified mail or by hand to the Agency Open Records Officer. It requires the event date, time, location and requester’s relationship to the event. The page lists a $150 fee per granted recording. Verify current amounts and whether Act 22 applies to the record you seek; do not apply this process to other agencies automatically.
Illinois The official General Assembly search excerpt distinguishes information gathered by the drone from records about its use, such as available flight-path data, metadata or telemetry. The statutory page was not directly reviewed; verify the current section and exact language before relying on the excerpt.
Florida Section 934.50 limits law-enforcement drone evidence or information gathering to specified exceptions; a crowd-aerial-perspective provision applies to crowds of 50 or more. Those drone-use restrictions do not alone determine disclosure under Florida public-records law.
Ohio Section 4561.64 addresses flight and surveillance data and calls qualifying retained data a public record subject to exemptions. As of October 4, 2026, its effective date is October 6, 2026.

The exact rules can change, and other statutes, court decisions, local policies or retention schedules may apply. Check the agency’s current official request page and the law for the state where the record is held before relying on a deadline, fee, exemption or appeal route.
