How to Request Deletion of Your Vehicle Data from a License Plate Reader System

To request deletion of vehicle data from an automated license plate reader (ALPR) system, contact the agency or organization that operates the system and ask what data it holds, which retention rule applies, and whether it accepts a deletion or correction request. There is no single nationwide process or guaranteed deletion right established by the official materials discussed here. The answer depends on the jurisdiction, operator, record type, and whether the data must be preserved for an investigation or legal matter.

Identify who operates the license plate reader system

Start with the place and approximate time your vehicle may have been scanned. The relevant holder could be a city or county police department, a state agency, or another covered operator. A private vendor may host or process records for an agency, but that does not necessarily make the vendor the right place to direct a request.

Search the likely agency’s official website for “ALPR,” “automated license plate reader,” “license plate reader,” “usage and privacy policy,” “retention,” and “records custodian.” Look for the policy’s scope, the records custodian or privacy contact, and any separate procedure for requesting correction or amendment. If you are unsure which agency operates readers in the area, begin with local law enforcement and relevant state transportation or enforcement agencies.

California Department of Justice guidance explains that covered California ALPR operators and end-users must post a written usage and privacy policy. California’s Department of Tax and Fee Administration (CDTFA) offers a different agency-specific example: its policy identifies custodians and directs amendment requests to its Disclosure Office. These examples illustrate why you should follow the particular operator’s published process rather than assume a universal form.

Ask what process and retention rule apply

Contact the listed records custodian or privacy officer and ask whether the agency accepts a request to delete ALPR information. Do not assume that a public-records request, a correction request, and a deletion request are interchangeable:

  • Deletion request: asks the operator to remove data, if its policy or applicable law allows or requires that action.
  • Correction or amendment request: asks the operator to fix information in a record. An agency may provide this process without offering a general deletion form.
  • Public-records request: asks for access to records. It does not itself require deletion, and some ALPR data may not be disclosable.

Ask the custodian what record types may exist, what routine retention schedule applies, when the data would ordinarily be deleted, and whether a legal or investigative exception or preservation request affects it. A captured plate image, associated ALPR information, and an access or audit log can have different rules. Also ask whether any vendor-hosted copy is controlled by the agency’s retention requirements.

  • Tool-free installation in minutes, compatible with standard US and Canada license plates (6" x 12"). Snug fit without blocking existing mounting holes.

Submit a focused request

  1. Use the agency’s listed contact. Follow the posted policy’s instructions for contacting the records custodian, privacy officer, or other designated office.
  2. Describe the possible record narrowly. Give only the information needed to search, such as the plate number, issuing state, and a bounded date range; include a location if known. These are practical search details, not a universal legal requirement.
  3. Ask how to send identifying information securely. Check before sending sensitive personal details or supporting documents by ordinary email.
  4. Ask specific questions. Request the applicable policy and retention schedule, whether responsive data remains, its ordinary deletion date or retention basis, and whether an exception or legal hold applies.
  5. Ask about next steps. If the operator does not accept deletion requests, ask whether a correction process, review channel, or other procedure is available.
  6. Keep the correspondence. Save your request and the response so you can follow up through the agency’s stated process.

I am asking whether your agency, or an ALPR service provider acting for it, holds automated license plate reader data associated with my vehicle for [plate jurisdiction and plate number] during [date range and, if known, location]. Please identify the applicable ALPR usage and privacy policy and retention schedule, whether responsive data remains in the system, the ordinary deletion date, and whether any legal or investigative preservation exception applies. If your agency accepts requests to delete or correct ALPR information, please provide the applicable procedure and a secure method for supplying any additional information needed. If the data is not held or has already been deleted, please let me know whether your process permits confirmation of that fact.

The following are examples from official state materials checked on October 4, 2026. They apply only within their stated scope; none is a nationwide retention rule. Read the cited law or policy for the agency, data type, and circumstances relevant to your request.

Jurisdiction and source Routine retention rule described Exceptions or other distinctions
Missouri — Governor’s Executive Order 26-18 Covered state entities and local law-enforcement entities receiving state funding must permanently delete captured license-plate and vehicle images within 30 days of collection. Retention beyond 30 days is permitted when data is directly linked to a specific active and ongoing criminal investigation, an active life-safety emergency, or is necessary to comply with a court order. The order says covered data remains agency property, limits vendors’ non-law-enforcement access and uses, and requires query records. The order describes minimum standards pending permanent legislative enactment; check for later law or policy relevant to your request.
Washington — RCW 10.130.040, 2026 codification Covered agency ALPR data generally may not be retained longer than 21 days. The statute separately provides for deletion of parking-enforcement data 12 hours after final disposition, traffic-study data for up to 30 days, and commercial-vehicle enforcement data for up to six months. The statute provides exceptions, including specified warrants, subpoenas, court orders, and evidentiary circumstances. Its deadlines apply to the covered data and contexts described in the statute; check the effective-date notes for a specific matter.
Virginia — Code § 2.2-5517 Covered system data must be purged after 21 days. Audit-trail data has a separate two-year retention period. System data may be retained when it is part of an ongoing investigation, prosecution, or civil action, through the specified disposition. The statute says system and audit-trail data are not subject to disclosure under Virginia FOIA and permits limited sharing exceptions.
Utah — Utah Department of Public Safety policy citing Utah Code § 41-6a-2004(1)(c) The policy describes a nine-month retention period under the cited statute. The policy describes purging subject to preservation requests, disclosure orders, or warrants, and directs non-law-enforcement requests for stored ALPR data to department records personnel for processing under Utah law. Confirm that the cited period and rule apply under the current statute to your particular data.
California — California DOJ guidance and CDTFA policy The DOJ guidance explains policy, security, sharing, and access-record requirements for covered operators; it does not establish a general deadline requiring deletion of every government ALPR record. CDTFA says its ALPR information is retained and destroyed under its confidential taxpayer/feepayer records schedule. CDTFA’s policy, last reviewed September 18, 2026, directs amendment requests under Civil Code section 1798.35 to its Disclosure Office at 916-445-2918. That is a correction/amendment contact, not a stated general deletion form. The treatment of other California agencies depends on their applicable policy and records schedule.

What to do if the agency says it cannot delete or disclose the data

Ask the agency to identify the policy or legal basis it can share, the applicable retention schedule, and whether the restriction concerns deletion, disclosure, or both. If it says the data is preserved for an investigation or legal proceeding, ask whether it can explain when that preservation will be reviewed or end. If the agency does not offer a direct deletion process, ask whether it has a correction or review channel and whether it can confirm that data has reached its scheduled deletion date.

Access rules can close off a public-records route without resolving a deletion request. For example, Virginia’s cited statute makes covered system and audit-trail data unavailable under Virginia FOIA, while setting separate purge periods for those record types. Follow the operator’s designated contact process rather than treating a request for access as a substitute for a request about retention.
