Start with the public agency that operated the camera, not the camera vendor. Ask that agency’s records custodian for existing records within a precise time and location window, request preservation if the data relates to a case, and use the agency’s privacy or complaint channel to challenge an inaccurate read. A deletion request must account for the agency’s retention schedule, evidence holds, and state exemptions; there is no nationwide right that guarantees access, correction, or erasure of an automated license plate reader (ALPR) record.
The route depends on where the camera operated and who controls the system. State and local public-records laws differ, and a private community, campus, parking operator, or business may follow a different process from a police or transportation agency.

What an ALPR record can contain
An automated license plate reader photographs vehicles and uses software to convert the plate image into a plate number. A record can include the plate text, an image of the vehicle, the capture time, and the camera’s location. Systems may retain both “hit” captures that match a watchlist and “non-hit” captures that do not.

Virginia Beach explains that a read generally does not identify the driver or passengers. The image can nevertheless show the vehicle and, depending on the camera view, part of the surrounding area. An alert is not proof that a vehicle is wanted or that the person driving it committed an offense; the agency’s procedures should require an officer to verify the plate and vehicle before taking enforcement action.

The record may also have associated audit information: who searched for it, when the search occurred, what purpose was recorded, and whether the image or alert was shared. Ask for those existing logs separately because they may be governed by a different retention period or exemption than the image itself.
Who controls the record?
For a camera on a public road, begin with the city or county police department, sheriff’s office, state police, transportation authority, or other public agency responsible for that location. The agency’s policy, contract, and local law determine who can release, correct, or delete the data. A vendor may host the database, but hosting does not necessarily make the vendor the legal records custodian.
Flock Safety’s policy, for example, states that customer agencies control their ALPR data. Its disclosure guidance is informational and does not create enforceable rights against the company. A request sent only to a vendor can therefore miss the agency’s public-records process and any appeal rights provided by state law.
When a private operator owns the camera
If the camera belongs to a gated community, apartment complex, university, parking operator, toll facility, or business, identify that operator and ask who receives the data, under what policy, and for how long it is retained. A public agency may later obtain or use the footage, but that does not automatically make every privately held copy a public record. Ask both entities whether they possess responsive records and which one controls the database.
Find the policy and records custodian
Search the responsible agency’s website for “ALPR,” “LPR,” “automated license plate reader,” “license plate recognition,” “surveillance technology,” or the vendor’s name. Look for four items:
- The public-use, privacy, or surveillance-technology policy.
- The public-records request portal, email address, or designated records custodian.
- A privacy officer, professional-standards unit, or complaint form for disputed information.
- The retention schedule, sharing rules, contract, and data-security provisions.
In California, Senate Bill 34 requires a public ALPR usage and privacy policy. The policy should describe authorized uses, access, sharing, safeguards, monitoring, retention, and the custodian responsible for the system. Other states may not use the same terminology or require the same publication, so absence of a webpage does not prove that no policy exists; ask the agency directly.

Prepare a focused public-records request
Use the public-records law that applies to the agency and address the request to its records custodian. Request existing records rather than asking staff to perform a new investigation or create a report. A California public-records FAQ, for example, says an agency need not create a record or compile information it does not normally maintain. That is California guidance, not a universal rule for every state.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsInformation to include
- Plate: the complete plate number and issuing state or province.
- Time: a specific date range and, if possible, the narrowest practical time window.
- Place: likely camera locations, roadway, intersection, parking facility, or route.
- Record types: responsive plate reads and images; timestamps and locations; access or query logs; sharing logs; the ALPR policy; retention schedule; audit rules; vendor contract; and data-sharing agreements.
- Format: existing electronic records in their existing format, where the applicable law permits that request.
- Withholding: the exact statute, privilege, or policy relied on for each withheld portion, plus any reasonably segregable or redacted material.
Do not include an unnecessarily broad period or every vehicle associated with an address. A precise request is easier for the custodian to search and less likely to be rejected as vague, burdensome, or a demand for a new compilation.
Sample request language
Under the applicable public-records law, I request existing records concerning plate [PLATE], issued by [STATE/PROVINCE], captured between [START DATE/TIME] and [END DATE/TIME] near [LOCATION]. Please include the associated plate-read images, timestamps, camera locations, access or query logs, sharing logs, and any linked alert or disposition records.
You can add a second paragraph requesting the agency’s current ALPR policy, retention schedule, audit requirements, vendor contract, and data-sharing agreement. Ask the custodian to identify the legal basis for any denial and to release non-exempt portions after redaction.
Request preservation before the record disappears
ALPR data can be purged quickly. If the read relates to a criminal investigation, traffic or civil matter, insurance claim, complaint, or lawsuit, include a preservation request in the same submission and provide the case, citation, incident, or claim number when available.
Ask the agency to preserve the original image, metadata, audit trail, alert history, and any linked access or sharing records while it processes the request. Do not assume that filing a public-records request automatically pauses the normal deletion schedule. Preservation rules vary, and an evidence hold may require a separate notice or legal process.
Virginia provides a specific example. Its statute preserves information connected to an ongoing investigation, prosecution, or civil action through the relevant disposition points. That protection is a Virginia rule; another state may set different triggers or deadlines.

Challenge a wrong read or an action based on it
A correction request and a public-records request serve different purposes. The records request seeks copies or policies. The challenge asks the agency to review whether the read, annotation, alert, or resulting action is accurate and lawful.
Use the agency’s correction or complaint channel
- Send the challenge to the ALPR program custodian, agency privacy officer, professional-standards unit, or designated complaint office.
- Identify the specific capture by plate, date, approximate time, location, and any incident or citation number.
- State exactly what is wrong: a misread character, a different vehicle with a similar plate, an incorrect time or location, or an alert that was acted on without confirming the vehicle.
- Attach concise corroboration, such as a registration record, dated photograph, receipt, work record, toll statement, or case document. Remove unrelated personal information.
- Ask the agency to compare the original image with the plate and vehicle, review the audit trail, explain any enforcement action, correct annotations or linked records where legally permitted, and provide the result in writing.
Virginia law limits ALPR use to specified purposes, including certain criminal investigations, missing or endangered-person or trafficking investigations, and defined notifications. It also requires confirmation of an alert before a vehicle stop under the statute’s conditions. Those rules support a focused challenge to the underlying read or its use, but they do not establish a nationwide individual right to amend every ALPR database.
If the error caused a ticket, stop, arrest, or other action
Tell the agency that the disputed read affected a particular action and identify the deadline for contesting that action. A database correction does not automatically dismiss a citation or undo a court order. Use the citation appeal, criminal-defense, administrative-hearing, or civil-litigation process that applies in your jurisdiction, and preserve the ALPR request and response for that proceeding.
Ask for deletion without assuming a right to erasure
Send a deletion request to the agency that controls the system. Ask it to state:
- The retention period for the image, plate text, metadata, and audit trail.
- The routine purge date or schedule.
- Whether the record is subject to an investigation, prosecution, civil action, public-records hold, or litigation preservation notice.
- The legal or policy basis for keeping the record if it is outside the routine period.
- Whether inaccurate annotations, duplicate copies, or linked alerts can be removed even if the original evidence must be retained.
A deletion request cannot override a statutory retention duty or an evidence hold. Virginia’s statute illustrates the distinction: routine system data must be destroyed after 21 days and audit-trail data after two years, but information tied to a continuing investigation, prosecution, or civil action is retained through specified milestones. The statute says:
“System data shall be purged after 21 days of the date of its capture in such a manner that such data is destroyed and not recoverable by either the vendor or the law-enforcement agency.”

Vendor retention is not a universal limit
Flock Safety states a seven-day default retention period for LPR data. Its policy also allows a longer period when law or the customer agreement requires it and describes extended retention under specified customer approval. That seven-day figure is a vendor policy default, not a nationwide ALPR limit and not proof that an agency’s copy has been deleted.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. What to do when the agency withholds or ignores records
- Request the reason in writing. Ask for the exact statutory exemption, privilege, or policy provision supporting each withheld category.
- Ask for partial release. Request redaction and release of reasonably segregable portions rather than an all-or-nothing denial.
- Ask about review. Find the agency’s administrative appeal, ombuds, privacy-complaint, or public-records enforcement process and observe its deadline.
- Preserve the paper trail. Keep the original request, delivery confirmation, acknowledgment, response, appeal, and supporting documents.
- Use litigation procedures when appropriate. If a citation, prosecution, or lawsuit is pending, consult qualified local counsel about discovery, subpoena, protective-order, or court-review procedures. A general public-records request does not replace litigation deadlines.
California Department of Justice guidance tells agencies to evaluate privileges and exemptions when responding to ALPR requests and litigation process. It does not promise that a California resident can obtain an individual image or search record under the California Public Records Act. If an individual record is withheld, ask for the written exemption analysis and request policies, retention rules, contracts, aggregate reports, or sharing agreements that may still be disclosable.
Jurisdiction examples: Virginia and California
Virginia
Virginia Code § 2.2-5517 restricts law-enforcement ALPR use to specified investigative and notification purposes. Routine system data is purged after 21 days, while audit-trail data is purged after two years, subject to statutory exceptions for data connected to an ongoing investigation, prosecution, or civil action.
Virginia’s statute also states: “System data and audit trail data shall not be subject to disclosure under the Virginia Freedom of Information Act (§ 2.2-3700 et seq.).” That means a Virginia FOIA request is not a guaranteed route to the individual capture or search history. The statute allows specified disclosures, including certain criminal discovery and court orders, so the appropriate route may depend on the proceeding.

California
California Senate Bill 34 requires public agencies using ALPR to publish a usage and privacy policy and restricts sale, sharing, or transfer except as otherwise permitted by law. California Department of Justice guidance says the statute does not permit California law-enforcement agencies to share ALPR information with private entities or with out-of-state or federal agencies, while advising agencies to assess applicable privileges and exemptions when answering records requests or litigation process.
Request the agency’s policy, retention rules, custodian details, contract, sharing agreements, and other existing records. Do not promise that the California Public Records Act will produce your individual image or search history; ask the agency to explain the written basis if it withholds them.
Historical context should be labeled carefully. A California DOJ draft-report section, citing the California State Auditor, reported that 230 police and sheriff agencies were using ALPR and another 36 planned to begin. The same passage reported that roughly 84 percent of California agencies operating ALPR shared their images. The underlying survey year for the 84 percent figure is not stated there, so neither figure should be presented as a current statewide camera count.

Practical checklist before you submit
- Confirm the state, city, county, road authority, or private operator connected to the camera.
- Record the plate’s issuing jurisdiction and any alternate formatting that could cause a character misread.
- Limit the request to a defensible date, time, and location window.
- Separate requests for individual images, access logs, policies, contracts, and retention schedules.
- Ask for existing electronic records and segregable redacted portions.
- Include a preservation request when a case, citation, claim, complaint, or lawsuit is involved.
- Send a separate correction complaint with specific corroborating documents.
- Calendar the agency’s response and appeal deadlines.
- Keep every submission, attachment, acknowledgment, and response.
What this process can and cannot establish
You can identify the controlling agency, ask for existing records, obtain the governing policy, challenge a specific read, and learn why a record is being retained or withheld. You cannot assume that a vendor’s consumer privacy portal reaches law-enforcement data, that every ALPR capture is a public record, or that a deletion request overrides an evidence hold.
The strongest request is therefore factual and narrow: identify the plate, time, location, system, and legal issue; ask for the exact records and policy documents; request preservation promptly; and require the agency to state the rule supporting any denial, retention, correction decision, or deletion refusal.
