You can request federal body-camera footage through the Freedom of Information Act (FOIA), but a request does not guarantee that a recording exists or will be released. Send it to the agency or component that controls the record, identify the incident as precisely as you can, and expect possible fees, delay, redactions, or withholding where a FOIA exemption applies.
What a federal FOIA request can—and cannot—do
FOIA provides access to existing federal agency records. It does not require an agency to create a record, answer questions, conduct research, or analyze information. Your written request must reasonably describe the records you want. You may also specify a preferred format, such as electronic delivery. See FOIA.gov’s request guide and the FOIA FAQ.

This guide covers federal agencies. State and local police records are handled under separate state public-records laws and agency procedures.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Clear out junk files and repair common Windows errors3Scan for outdated or missing drivers - takes under a minuteIdentify the agency that holds the record
Federal agencies process their own records. If more than one federal agency took part in an operation, consider sending a separate request to each agency that may control relevant records. For records held by the Department of Justice (DOJ), a request directed to the likely component is generally the best route to a prompt response. DOJ’s request guidance says its Mail Referral Unit can forward a request when you are unsure which DOJ component has the record.

Start with the agency’s FOIA page and reading room to check whether the record is already available. FOIA.gov provides agency request information and links to public records resources. Verify the agency’s current portal and submission instructions before sending a request; portal steps can change.
Write a focused request
Give the agency enough detail to distinguish the incident and locate the records. The following details are useful drafting guidance, not a mandatory checklist for every request:
- Incident date and, if known, approximate time or time range.
- Location, including the city or facility and a specific site if known.
- Agency or DOJ component, involved operation, and officer names or identifiers if known.
- Case, incident, or other reference number, if available.
- The records sought—for example, body-worn-camera footage, an incident report, dispatch records, an evidence log, or a relevant policy.
- Your preferred delivery format, such as an electronic copy.
Ask for only related records you actually need: adding broad categories can make a search more complicated. FOIA does not require the agency to compile new information or answer questions, so describe records rather than asking for explanations. If you are requesting records about yourself, the agency may require identity verification. A request concerning another person may face privacy barriers; consent or proof of death may be needed in some circumstances. Avoid including unnecessary personal information about other people.

Editable request example
This is a drafting aid, not an official form or a promise of disclosure. Adapt it to the agency’s instructions:
I request existing records concerning the federal law-enforcement incident at [location] on [date] between approximately [time range], involving [agency or component and officer identifiers, if known; case number, if known]. Please search for body-worn-camera recordings and provide responsive records electronically. I also request [specific related records, if desired]. If you anticipate fees above [$ amount], please notify me before proceeding so I can narrow the request. [If applicable: Explain the factual basis for expedited processing and/or a public-interest fee waiver.]
Understand possible redactions and withholding
An agency reviews responsive records for information that FOIA permits or requires it to withhold. Law-enforcement information is not automatically exempt: FOIA Exemption 7 applies only when disclosure would cause a specified harm, such as interfering with enforcement proceedings, invading personal privacy, revealing a confidential source or investigative technique, or endangering someone. When a record contains both releasable and exempt information, the agency should release reasonably segregable nonexempt portions. See the DOJ explanation of Exemption 7 and the FOIA FAQ.

Footage may show bystanders, witnesses, confidential sources, investigative methods, or events connected to an active case. Depending on the circumstances, the agency may provide a redacted copy, withhold some or all of the video under an applicable exemption, or say it found no responsive record. A request for segregable portions can be useful when only some material appears sensitive.
Know how DOJ body-camera policies differ from FOIA
DOJ’s June 1, 2021 memorandum directed the Bureau of Alcohol, Tobacco, Firearms and Explosives, Drug Enforcement Administration, Federal Bureau of Investigation, and U.S. Marshals Service to develop body-worn-camera policies for planned arrests and search or seizure warrants. Those policies were to address matters including activation, storage, retention, access, dissemination, and expedited public release after serious bodily injury or death. The memorandum does not make every recording automatically public. Read the June 1, 2021 DOJ memorandum for its scope.
DOJ’s Justice Manual says recordings made by deputized task-force officers during federal task-force operations are DOJ federal records controlled by the sponsoring federal agency, even if a parent agency or third-party provider stores them. They generally cannot be disseminated without written DOJ permission. The manual describes an expedited public-release process for footage showing conduct solely by a task-force officer that results in another person’s serious bodily injury or death, subject to specific and compelling objections that cannot be resolved through redaction or other means. It also describes operational exceptions involving, for example, undercover personnel, confidential sources, sensitive techniques, and sensitive investigations.

These DOJ rules should not be assumed to apply across the federal government. Check the relevant agency’s current camera policy and FOIA instructions. For example, CBP’s common-request guidance identifies CBP SecureRelease and the FOIA.gov agency portal as submission paths; consult CBP’s records page for current instructions.

There is no fee to submit a FOIA request, but an agency may charge permitted search, review, or duplication fees. For many noncommercial requesters, the first two hours of search and first 100 pages of duplication are not charged; applicable fee categories and agency rules matter. State the maximum you are willing to pay and ask the agency to contact you before exceeding it, so you can decide whether to narrow the request. The FOIA FAQ and DOJ request guidance explain fees and waivers.

Ask for expedited processing only if the circumstances meet the agency’s stated standard, and include supporting facts or evidence. DOJ grounds include an imminent threat to life or physical safety and, for a person primarily engaged in disseminating information, an urgent need to inform the public about actual or alleged federal government activity. DOJ also identifies other grounds, including substantial due-process consequences and specified exceptional media interest. Follow the agency’s instructions for making and supporting an expedited-processing request.
Track the request and plan for delays
After submission, the agency generally acknowledges the request and may assign a tracking number. It then searches for responsive records, reviews them, and decides what can be released. In a narrow set of law-enforcement or national-security cases, FOIA exclusions may permit an agency not to acknowledge the existence of certain records.
The statute generally sets a 20-working-day period for an agency’s determination, subject to provisions for unusual circumstances and limited tolling. That is not a guarantee that you will receive a complete video within 20 working days. DOJ warns that backlog, complexity, and line-by-line review can extend processing. Check status using the agency’s tracking instructions, and respond promptly if it asks you to clarify or narrow the request.

Read the response letter carefully: it should explain the determination and provide the applicable appeal instructions and deadline. DOJ says an appeal from a component decision should be submitted to its Office of Information Policy within 90 calendar days. Identify the determination you are challenging and include the component name and request tracking number, following the letter’s instructions.
If you need help before appealing, FOIA.gov advises contacting the FOIA professional or public liaison. After the administrative appeal process, the Office of Government Information Services (OGIS) offers mediation. Federal-court review may also be available after applicable administrative steps. See DOJ appeal guidance and the FOIA FAQ.
