Start with the agency that controls the records and the public-records law that applies to it. Ask for policies, retention schedules, access and audit logs, sharing agreements, training records, complaints, and anonymized or aggregate scan data. If the agency refuses, preserve its notice, test each exemption claim, request segregable redacted records, and use the appeal or court-review process in that jurisdiction. A request for your own vehicle data follows the same jurisdiction-specific rules; there is no nationwide right to obtain an automated license plate reader (ALPR) history or a universal deadline for an appeal.
What ALPR records contain and why the request matters
Automated license plate readers photograph or read plates as vehicles pass a camera. A system can attach the plate to the date, time, and location of the scan and retain that record so an authorized user can search it later. A single scan may seem innocuous; a retained sequence can reveal where a vehicle is routinely parked, works, worships, receives medical care, or spends time.

“Requesting police access to ALPR data” can mean two different things:

- Challenge: You want to contest a denial of those records, or argue that a particular search, disclosure, or retention decision violated policy or law.
Use the first path to obtain evidence. Use the second only after identifying the exact record withheld or conduct you are challenging. Federal agencies answer under the Freedom of Information Act (FOIA); state, county, municipal, and regional agencies answer under the applicable state or local public-records statute. Those laws differ on exemptions, deadlines, fees, appeal forums, and individual-access rights.

Identify the right agency and law before writing
Map who may hold the records
Begin with the city police department, sheriff’s office, state police, regional task force, or federal agency that operates or can access the cameras. A department may use a system owned by another public body, and a regional group may keep its own logs. If a technology vendor hosts the database, request the records from the public agency that controls or uses them. Do not assume the vendor is subject to the same public-records statute as the agency.
Confirm the governing process
Find the agency’s public-records officer, submission portal or mailing address, and the statute’s rules for format, fees, response, extensions, and review. A city request cannot automatically use a state agency’s procedure, and a state deadline cannot be substituted for a federal FOIA deadline. Record the date and time of submission and keep proof of delivery.
Define a date range and geography
A request covering every scan ever collected is more likely to raise privacy, burden, and investigative-record objections. Specify the locations, systems, agencies, and dates that matter. For a policy review, ask for the current policy and prior versions during a defined period. For an incident, identify the vehicle or event only as precisely as safety and privacy allow.
What to request: a practical records checklist
Request categories separately so the agency must identify what it has and what it withholds. The following list tracks the documents most useful for understanding operation and accountability.
| Record category | What it can show | How to narrow it |
|---|---|---|
| Current ALPR policy and prior versions | Permitted search purposes, prohibited uses, approval rules, and retention instructions | Request versions in a stated date range and identify the issuing agency |
| Retention and deletion schedules | How long scans, images, hit data, and logs remain available | Separate ordinary scans from hit alerts, backups, and audit logs |
| Contracts, renewals, and data-sharing agreements | Who supplies or hosts the system, who receives data, and what terms govern access | Name the vendor or partner if known and request amendments |
| Authorized-user and agency lists | Which employees, departments, or outside agencies may search or receive data | Ask for role-based access lists and authorization dates |
| Access, search, and audit logs | Who searched, when, for what stated purpose, and whether data was exported or shared | Specify a plate, case number, user group, or date window; request redacted logs if needed |
| Training materials | Instructions given to users about searches, sharing, retention, and prohibited uses | Request course materials, acknowledgments, and update dates |
| Complaints, violation reports, and investigations | Alleged misuse and the agency’s response | Define the period and ask for closed and sustained matters separately |
| Aggregate scan and search statistics | System scale without exposing individual movements | Request totals by month, camera area, search type, or agency |
Ask for electronic copies when available. State that you will accept partial production and that the agency should identify each withheld category, cite the specific exemption, and release all reasonably segregable portions.

Use redaction and anonymization to make oversight possible
Raw plate, image, time, and location histories can expose a person’s movements. A request seeking oversight does not need every identifying detail. Ask for plate numbers, images, vehicle descriptions, and other distinguishing fields to be removed while leaving dates, generalized locations, user roles, search purposes, recipient agencies, and totals.
In ACLU Foundation of Southern California v. Superior Court (California Supreme Court, August 31, 2017), the court held that indiscriminate bulk scans were not categorically investigative records under the exemption argued in that case. It nevertheless concluded that the public interest favored withholding unaltered raw data under a separate balancing exemption and sent the matter back for analysis of anonymization or redaction. That decision interprets California’s statute and does not control agencies in other states.

Sample request language
Adapt the wording to the agency’s required form and statute. Avoid asking for a legal conclusion; ask for identifiable records.
Under [applicable public-records law], please provide electronic copies of the following records held or controlled by [agency] for [date range] and [geography/system]:
1. Current and prior ALPR policies, procedures, retention schedules, and deletion rules.
2. Contracts, renewals, memoranda, and data-sharing or access agreements concerning ALPR data.
3. Lists of agencies, units, roles, and users authorized to access or receive ALPR data.
4. Search, access, export, and audit logs for [specified period, plate, case, user, or system].
5. Training materials and acknowledgments concerning ALPR searches, sharing, retention, and prohibited uses.
6. Complaints, violation reports, and completed investigations concerning ALPR use.
7. Aggregate monthly scan and search totals, with identifying plate, image, and vehicle fields removed.
If any record is withheld, please identify the record or category, cite the specific exemption, and release all reasonably segregable portions. I will accept redacted or anonymized records and partial production. Please advise of any fee before work begins and provide the applicable review or appeal instructions with your response.
Can you request your own license-plate-reader data?
Sometimes, but the answer depends on the state, agency policy, and the vehicle’s registration and use. The ACLU has recommended that states create a way for people to request data concerning vehicles registered to them. That is a policy recommendation, not a nationwide entitlement.

Check the agency’s policy for an individual-access process. Ask what proof of identity, registration, or authority it requires, and whether the process covers images, raw scans, hit records, and search logs or only a subset. If a vehicle is jointly registered, leased, shared with family, or regularly driven by someone else, consider whether disclosure could expose another person’s movements or create a safety risk. You may instead request aggregate information or a confirmation of the applicable retention rule.

Can you see who searched your plate?
Ask specifically for access, search, and audit logs tied to the plate, vehicle, case number, or date range. A useful log may show the user account, unit, timestamp, stated purpose, query type, export action, and recipient. Agencies may withhold some or all of this information under law-enforcement, privacy, security, or investigative exemptions, and a log may not exist in the form you want.
Request a redacted version that removes other people’s identifiers while preserving the user’s role, date, purpose, and action. Also request the policy defining how searches must be logged and how long those logs are retained. The existence of a policy does not establish that every search was logged or lawful.
Can police share ALPR data with another agency?
Sharing authority is controlled by the agency’s policy, contracts, agreements, and applicable law. To determine what happened, request the interagency agreements, authorized-recipient lists, sharing or export logs, and retention terms imposed on recipients. Ask whether outside agencies may conduct direct searches, receive bulk exports, or obtain only case-specific disclosures.
Compare the documented recipient and purpose with the written policy. A public statement that sharing is allowed for a particular purpose is evidence of what the agency says it permits, not proof that an individual disclosure complied with that rule.

What to do when an agency denies the request
1. Preserve the complete record
Save your request, attachments, proof of submission, every response, fee estimate, extension notice, and appeal instruction. Do not rely on a telephone explanation; ask the agency to put the reason in writing.
2. Parse the denial
List each withheld record or category and the exemption cited. A denial that simply says “investigative records” may not explain whether the exemption covers a policy, contract, audit log, or raw scan. Ask whether non-exempt portions can be separated and whether anonymization, redaction, or aggregate totals would permit release.
3. Use the specified administrative review
Many public-records systems provide an agency review, records ombudsperson, state public-access office, attorney-general process, or other administrative route. Follow the notice exactly and calendar the jurisdiction’s filing deadline. Do not copy another state’s deadline or appeal form.
4. Frame the legal issue narrowly
Explain why the particular exemption does not cover the record, why the agency must segregate non-exempt material, or why a redacted version protects privacy. Distinguish a policy or aggregate log from a targeted criminal-investigation file. The California Supreme Court’s ALPR decision is useful for that distinction, but it is not a nationwide rule.
5. Consider judicial review
If administrative review fails, the applicable statute may allow a court petition or action. Court procedure, filing deadlines, fee-shifting, and remedies vary. A lawyer or qualified public-records organization can assess the agency’s exemption claim and the safest way to describe the requested data.

How to challenge suspected misuse or unlawful access
- Get the governing documents. Obtain the current policy, prior versions, retention schedule, user-authority list, sharing agreements, training materials, and audit requirements.
- Obtain operational evidence. Request search and export logs, complaint files, investigation findings, and recipient records for the relevant period.
- Build a comparison table. For each event, record the user or unit, timestamp, stated purpose, data accessed, recipient, retention action, and the policy or law that supposedly authorizes it.
- Separate proof from assertion. A policy describes permitted conduct; it does not prove that actual conduct followed the policy. An unexplained log entry may justify a complaint or follow-up request but is not, by itself, a final legal finding.
- Use the designated complaint channel. Submit the complaint to the agency’s oversight office or the body named in local rules, attach the relevant records, and request a written disposition and preservation of logs.
New Jersey materials cited by the ACLU describe written policies, audits, and routing complaints to a county prosecutor or the state Division of Criminal Justice in that directive context. That report was submitted by an advocacy organization, not issued as a general U.S. Department of Justice policy, and its route should not be treated as a national procedure.
What agency policies should disclose
When comparing policies or proposed legislation, use the same questions for each jurisdiction:
- Search purposes: Which public-safety or investigative reasons are permitted, and which are prohibited?
- Access and sharing: Who may search, approve a search, receive exports, or connect from another agency?
- Retention and deletion: How long are scans, images, hit records, backups, and audit logs kept?
- Logging and review: Are searches automatically logged, periodically audited, and reviewed by an independent body?
- Transparency: Are policies, aggregate statistics, audit results, and sharing agreements public?
- Privacy controls: Can identifying fields be redacted, data anonymized, or individuals request records about their vehicles?
- Complaints and enforcement: Who investigates misuse, what remedies exist, and are violations documented?
The Los Angeles County Sheriff’s Department transparency page identifies an ALPR policy update dated April 22, 2026. It states public-safety purposes and says ALPR data may not be used for civil immigration enforcement. Those are LASD’s stated policy terms; the page does not, by itself, establish that every access complied with them.
Historical California figures: useful context, not current benchmarks
The 2017 California Supreme Court opinion described estimates in the case record of about 1.2 million vehicle scans per week for the Los Angeles Police Department and 1.7 to 1.8 million license plates per week for the Los Angeles County Sheriff’s Department. It described a five-year LAPD retention period and a two-year LASD retention period at that time. The opinion also recorded a petitioners’ assertion that about 0.2% of scans were connected to suspected crimes or vehicle registration. These figures concern the historical litigation record and should not be presented as current operations or as a national rate.
Privacy, safety, and practical limits
Oversight and privacy can point in opposite directions. Publishing an unredacted week of scans could expose thousands of innocent drivers, while publishing only a policy may hide how the system actually operates. A focused request usually produces better evidence with less harm: policies, contracts, user roles, audit results, sharing records, and aggregate totals, plus redacted logs that retain dates, purposes, and actions.
Ask the agency to preserve potentially relevant logs when you reasonably anticipate a dispute. Avoid placing a sensitive plate number, home address, or victim information in an unsecured email or a public filing. If the records could reveal stalking, domestic-abuse, immigration, or witness-safety risks, seek advice from a qualified privacy or public-records lawyer before requesting broad raw histories.
Pending proposals and changing rules
Legislatures continue to consider ALPR transparency and access rules. An advocacy page described Pennsylvania HB 2771 as having a committee hearing scheduled for September 28, 2026. Do not describe its proposed provisions as enacted law without checking the official legislative record. More broadly, verify current agency policies and statutes immediately before filing: retention periods, appeal routes, and individual-access rights can change.

- Confirm the federal, state, or local public-records law and its submission and review rules.
- Set a specific date range, geography, system, vehicle, case, or user group.
- Request policies, retention rules, contracts, authorized users, logs, sharing records, training, complaints, and aggregate data.
- Offer redaction, anonymization, and partial production to protect unrelated people’s privacy.
- Preserve the request and response, then list each exemption and missing category.
- Use the stated administrative review route; seek judicial review only under that jurisdiction’s procedure.
- For suspected misuse, compare actual logs and sharing records with the written policy and file a documented complaint.
The strongest challenge is specific: it identifies the agency, record, date, exemption, policy requirement, and requested remedy. It does not assume that a California ruling, a neighboring state’s deadline, or an advocacy proposal automatically governs the agency in front of you.
