The process depends on where the search happened: public-records laws, retention rules, exemptions, complaint channels, and possible remedies vary by jurisdiction. Start with the police or sheriff’s agency that contacted, stopped, cited, or investigated you, ask whether another agency or shared system was involved, and send a focused written records request. The steps below use California as an example, not a nationwide rule. An ALPR record may show a plate observation, time, place, and image; it does not by itself establish who was driving.
Start with the agency most likely to have the records
Contact the department or sheriff’s office connected to the stop, citation, investigation, or other contact. Ask whether its personnel searched an automated license plate reader (ALPR) system, and whether another agency, vendor, or shared system held or accessed the relevant records. The agency’s ALPR policy may identify a program contact or records custodian.

Make the inquiry specific: an ALPR search generally concerns a plate observation or query and related time, location, image, or alert information. A plate match is not, on its own, proof of the vehicle’s driver or of wrongdoing.

In California, direct the request to the records custodian
For a California agency, submit a California Public Records Act request to that agency’s records custodian. Identify the plate and issuing state, the approximate date and time range, the location, and any citation, incident, or case number. Ask for records tied to that scope rather than requesting every ALPR record the agency holds.

Ask for the underlying observation and the administrative trail
Request the categories that could show what happened and how the information was handled. An agency may not maintain every field, and California DOJ guidance says requests are assessed under applicable privileges and exemptions; release of a particular investigative hit is not guaranteed.
- ALPR access or query-log entries matching the plate and time window, including query terms, user or agency identity, stated purpose, and associated case number where retained and releasable.
- Related plate-read, image, alert, and case-association records.
- Available audit records or findings documenting access and use.
- Records of dissemination or interagency sharing, including the stated purpose where recorded.
- The applicable written ALPR usage and privacy policy, amendments, and retention schedule.
- Records describing a correction, review, or process for reporting a suspected misread, unauthorized access, or improper sharing.
- Whether responsive data still exists, if the agency can provide that information.
These are request categories, not a claim that every agency keeps every item or that every responsive record is public. California public-records law includes law-enforcement-record exceptions, and the agency must assess the applicable exemption framework.

Please provide records concerning any ALPR observation, query, alert, or access involving [plate number], issued by [state], for approximately [date and time range] near [location], related to [incident or case number, if known]. Please include available query/access log entries and query terms; the user or agency identity, stated purpose, and case association where recorded; related read, image, or alert records; available audit and sharing/dissemination records; the applicable usage and privacy policy and retention schedule; and any record of review or correction. If responsive records are held by another agency or system, please identify the appropriate contact if known. Please identify any withheld or redacted records and the basis for withholding them.
Do not include more personal or case-sensitive information than needed to identify the records. Keep a copy of the request and the agency’s response.
Ask for preservation if a dispute is active
If a complaint, investigation, or court case is ongoing, separately ask the agency in writing to preserve the relevant query, image, audit, and dissemination records for the specified time window while the matter is reviewed. Identify the records as precisely as you can. This is a practical request; it does not mean every record is automatically subject to a particular preservation duty under the California guidance discussed here.

Challenge a suspected error or improper use
Describe the specific issue and request a review
Write to the ALPR program custodian or the agency channel identified in its policy. Depending on the issue and local process, you may also ask a supervisor, internal affairs, or another named oversight office to review it. State what you believe went wrong and why—for example, a plate misread, a different vehicle, a query for an unauthorized purpose, or questionable sharing. Include dates and case identifiers, attach relevant documents, and ask for a written determination and any available correction process.
California’s policies address usage, access records, and audits, but the sources described here do not establish a universal California complaint form or a guaranteed individual right to amend an ALPR hit. An agency’s review process and the records it retains can differ.
Understand what the California audit rule does—and does not—show
The California DOJ model policy describes annual audits of access, use, and sharing and says audit information is retained for three years. That is a policy period for audit information, not a promise that every underlying image, query, or hit remains available for three years.

Know the limits of California’s example
California DOJ guidance says California law does not permit California law-enforcement agencies to share ALPR information with out-of-state or federal agencies under its interpretation of SB 34. In an announcement concerning alleged sharing by El Cajon, the DOJ described an active lawsuit and sought relief. Those allegations are not a final court ruling.
Rules outside California may differ. Before relying on the California example elsewhere, check the relevant jurisdiction’s rules and the policies of the agency or agencies that operated, accessed, or stored the data. The issues to verify include which agency or vendor holds the records, whether query logs and audits are required, retention and deletion practices, public-records exemptions, complaint and correction procedures, sharing restrictions, and any case-specific remedies.

Tell defense counsel promptly that you suspect an ALPR query. Preserve the citation or arrest papers, notices, warrant and discovery documents, your records request, and agency correspondence. Ask counsel to assess discovery and any case-specific challenge in light of the data’s source, accuracy, purpose, authorization, and handling. The California policies discussed here do not establish that every ALPR search requires a warrant or that a policy violation automatically leads to suppression of evidence.
