How to Request a Human Review of an AI-Assisted Insurance Decision

If you think an insurer used AI or automated analysis to deny a claim, end coverage, set a price, or make another consequential decision, appeal through the insurer’s stated process and ask for a substantive review by a qualified person who can change the result. Whether you have a legal right to human review depends on the decision, the insurance product, and the law that applies; AI involvement alone does not create a universal right.

Start with the insurer’s appeal process

For the question “How do I appeal an insurance company decision?”, begin with the decision notice and your policy. Find what the insurer decided, its stated reason, how to appeal, and the deadline. A notice may also explain whether you can request an urgent review or take the dispute to an independent reviewer. HealthCare.gov’s appeal guidance and the NAIC’s “Health Insurance Claim Denied? How to Appeal the Denial” describe health-insurance routes in the United States; procedures for other insurance products and locations can differ.

  1. Identify the decision and deadline. Note the decision date, claim or policy number, reason given, appeal address or portal, and any deadline stated in the notice. If the deadline is unclear, ask the insurer promptly and keep its answer.
  2. Explain the specific error. State what is inaccurate, missing, or misunderstood, and why the policy or coverage terms support a different outcome. Attach relevant records, such as medical notes, bills, repair estimates, or correspondence, as appropriate to the dispute.
  3. Ask about automated involvement. Ask whether AI, automated processing, or an algorithm materially informed the decision; what information and criteria were used; how to correct inaccurate information; and how to submit additional evidence.
  4. Request a meaningful human review. Ask for review by a qualified person with authority to change the decision, and ask that person to consider your evidence. This is a practical request; it does not establish that you have a legal entitlement in every case.
  5. Keep a record. Save the notice, relevant policy, appeal, attachments, delivery confirmation, and replies. For calls, record the date, the representative’s name and title, and what was discussed. If delay could cause urgent harm, ask whether expedited handling is available under the applicable process.
  6. Escalate if needed. If the internal appeal fails, check whether the decision qualifies for external review or whether you can complain to the insurance regulator for your jurisdiction. Eligibility, forms, deadlines, and the regulator depend on location and insurance product.

Sample wording for an appeal

Adapt this wording to the decision and the evidence you have. It is a request, not a guarantee of a particular review right:

Please confirm whether automated or AI-supported analysis materially informed this decision. I request a full review of the decision by a qualified person who can change it, including consideration of the attached information. Please identify the appeal deadline and any next stage of review, and explain how I can correct inaccurate information used in the decision.

What a human review can mean—and what it does not guarantee

Insurers may use AI in underwriting, pricing, customer service, claims handling, marketing, or fraud detection. The NAIC’s AI overview says insurers remain responsible for complying with applicable insurance laws and are subject to regulatory oversight. But AI may assist or inform an employee rather than make the decision by itself. Ask what role automation played instead of assuming the decision was fully automated.

There is no universal U.S. insurance entitlement to a human review simply because AI was involved. A human-review safeguard may apply under data-protection law to some decisions made solely by automated processing, subject to the law’s conditions and exceptions. A review that merely repeats the automated outcome may not be meaningful where such a safeguard applies: the reviewer’s role and authority matter.

U.S. health-insurance appeals: internal review and external review

For U.S. health coverage, a person whose insurer refuses a claim or ends coverage may be able to request an internal appeal and a “full and fair review.” Eligible cases may then proceed to an independent external review. The notice should explain the reason for the decision and how to dispute it. See HealthCare.gov’s appeal guidance.

Stage Who reviews What to check Timing and effect
Internal appeal The insurer reviews its own decision. Follow the insurer’s appeal instructions; explain the error and provide supporting records. NAIC consumer guidance gives typical health-appeal decision periods of 72 hours for urgent-care claim appeals, 30 days for treatment not yet received, and 60 days for treatment already received. These are examples, not deadlines for every plan or insurance dispute. See the NAIC guidance.
External review An independent reviewer considers an eligible dispute. Check the notice and applicable process for eligibility and how to request review. State processes may apply where they meet federal standards. HealthCare.gov says a request generally must be made in writing within four months after the insurer’s notice or final determination; the insurer is required to accept the reviewer’s decision. Urgent expedited external review may be available. See HealthCare.gov’s external-review guidance.

Deadlines and procedures can vary by state and plan. For example, the North Carolina Department of Insurance describes eligibility after completing the insurer’s appeal and a 120-day period for requesting external review. That state-specific period should not be applied elsewhere; check the North Carolina external-review guidance only if it is relevant to your case.

Preparing a health-insurance appeal

The NAIC advises gathering the policy, Summary of Benefits and Coverage, denial letter, evidence supporting the treatment, and a clinician’s support where relevant. Keep copies and notes of your contacts with the insurer. If the insurer is not cooperating, the NAIC advises contacting your state Department of Insurance. Verify the rules for your plan and state rather than treating the typical periods above as universal.

When data-protection law may support a human-review request

European Union: GDPR

Under the EU’s Your Europe GDPR guidance, people have a right not to be subject to a decision based solely on automated processing, subject to exceptions. The guidance says people should be informed about the automated decision, be able to request human review, and have an opportunity to contest it. Its summary says a response to a rights request is due without undue delay and, in any case, within one month. Whether these safeguards cover a particular insurance decision depends on territorial and substantive applicability, including whether the decision was solely automated and whether an exception applies.

United Kingdom: UK GDPR

The UK Information Commissioner’s Office says: “Human intervention should involve a review of the decision, which must be carried out by someone with the appropriate authority and capability to change that decision.” It also says the review should consider relevant data, including information supplied by the person. See the ICO’s individual-rights guidance. This UK guidance is not a substitute for determining which law applies to your case.

What to do if the insurer does not resolve the dispute

  • Read the final response and notice for any further appeal or external-review route, and record the applicable deadline.
  • Ask the relevant insurance regulator how to submit a complaint and whether it handles disputes involving your product and location. A regulator complaint is not necessarily a replacement for an appeal or a way to extend its deadline.
  • If you believe data about you was inaccurate, ask how to correct it and whether the correction can be considered in the review. Keep the correction request and response with your appeal record.
