Use the agency that matches the conduct. Report suspected fraud or abuse in an immigration benefit through the USCIS Secure Tip Form. Report an H-1B employer’s alleged wage, Labor Condition Application (LCA), working-condition, recordkeeping, fee, or retaliation violation to the U.S. Department of Labor’s Wage and Hour Division (WHD) with Form WH-4. For certain visa-related hiring or employment discrimination issues, review the Department of Justice Immigrant and Employee Rights Section (IER) guidance. An allegation is not a finding; the receiving agency decides whether it has jurisdiction and what action, if any, to take.

Choose the right reporting route

The same employer can raise more than one issue, but immigration-benefit fraud and employment-law violations are handled through different channels. Start by identifying what you observed rather than trying to assign a legal conclusion.

Reporting suspected immigration-benefit fraud to USCIS

USCIS’s Secure Tip Form is intended for suspected fraud or abuse connected to an immigration benefit. USCIS says, “Please include as many details as possible,” on its Secure Tip Evidence Upload page. Detailed, verifiable facts help an agency evaluate a report, but you should not invent information to fill a field.

What the USCIS form asks you to do

  1. Open the Secure Tip Form. Use the official portal at tips.uscis.gov, rather than sending sensitive allegations to an unofficial website.
  2. Choose the closest activity category. Select the option that best describes the suspected immigration-benefit fraud or abuse. If the exact label is not obvious, choose the closest factual category and explain the details in the narrative.
  3. Identify who is involved. The portal asks whether the report concerns an individual, a business, or both. Enter names, addresses, case identifiers, employers, preparers, or other identifying information when you know it.
  4. Write a factual summary. State what happened, when and where it happened, which filing or benefit appears connected, and how you learned it. Separate what you personally saw from documents or statements supplied by another person.
  5. Attach relevant evidence. Upload records that support the description and that you are authorized to possess and share. Do not alter originals; retain an unchanged copy of every file submitted.
  6. Review and submit. Check names, dates, contact information, and attachments for accuracy before sending. Save the confirmation or other submission record if the portal provides one.

USCIS upload limits can change

When the portal was checked for this guide, it displayed a maximum of five files and a 10 MB limit per file. These are technical intake limits, not a permanent policy promise. Verify the limits on the portal immediately before filing. If the evidence exceeds the limit, do not omit the central facts; describe the additional material in the narrative and follow any current USCIS instructions for submitting it.

What USCIS is—and is not—the right channel for

Use the tip form for suspected abuse of an immigration benefit. USCIS directs people to an appropriate agency or local law enforcement for other criminal acts and for imminent safety or national-security threats. A tip does not itself establish that fraud occurred, and USCIS does not promise an investigation or a particular result.

Filing a DOL WH-4 complaint about an H-1B employer

WHD enforces specified H-1B employer obligations, including requirements associated with the employer’s Labor Condition Application. The agency’s Instructions for Form WH-4 identify the form as the H-1B Nonimmigrant Information form for alleged violations and direct the filer to the WHD office serving the employer’s physical location.

Step 1: Confirm that the issue is an H-1B labor-condition matter

Examples of subjects described in DOL’s H-1B guidance include pay and benefits, certain prohibited fee or cost deductions, working conditions, required records, and retaliation connected with reporting or cooperating about an H-1B violation. A disagreement about immigration paperwork alone may belong with USCIS instead; describe the conduct and let the agency determine jurisdiction.

Step 2: Check the filing window

The DOL H-1B Advisor states that allegations in a WHD complaint must have occurred within the 12 months immediately before DOL receives the complaint. It also says an aggrieved party or a credible source can file. If the conduct is older, continuing, or difficult to date, contact WHD promptly to ask about the applicable procedure rather than assuming the matter is automatically accepted or rejected.

Step 3: Complete Form WH-4 as fully as possible

  1. Identify the employer. Provide the legal or commonly used business name, physical location, worksites, and contact details requested on the form.
  2. Identify the worker or other affected people. Include your information and the names of other people involved when known. If you are reporting as a credible source rather than the affected worker, state how you obtained the information.
  3. Describe the alleged violation. Give dates, job duties, locations, pay rates, hours, deductions, benefits, working conditions, records, and retaliation events that relate to the allegation.
  4. Attach or identify supporting records. Include documents you are authorized to share, such as pay statements, schedules, employment documents, communications, or time records. Keep your own copy.
  5. Send it to the correct WHD office. The WH-4 page directs submission to the office with jurisdiction over the employer’s physical location. Do not route it solely by the worker’s home address if that differs from the employer’s location.
  6. Remain available. WHD may contact the filer for additional information. Keep the submitted form, attachments, delivery confirmation, and a chronology together.

What WHD can investigate

DOL explains that WHD’s H-1B enforcement authority is tied to specified statutory grounds, including a complaint from an aggrieved person or organization and particular credible information from a reliable source in the circumstances described by law. WHD does not automatically investigate every allegation. Filing a complete form gives the agency information to assess whether the matter falls within its authority.

Understanding wages, fees, conditions, and records

DOL states that the required wage generally is the higher of two figures: the actual wage paid to similarly employed workers with comparable experience and qualifications, or the local prevailing wage for the occupation and intended employment area. Gather the pay and job facts that allow WHD to understand which comparison may apply; do not rely only on a conclusion that the employer “underpaid” you.

Pay and benefits

Useful details include the promised rate, the rate actually paid, pay periods, dates of missing or late payments, bonuses or deductions, and benefits offered to comparable workers. Preserve pay statements and written compensation terms. A single unexplained number is less useful than a dated sequence showing what was promised and what was received.

Fees and cost deductions

DOL’s H-1B worker guidance addresses certain prohibited fee or cost deductions. List each payment or deduction, its date, amount, purpose, who requested it, and whether it was taken from wages or paid separately. Attach receipts, payroll records, messages, or agreements when you are authorized to share them.

Working conditions and records

Describe the actual worksite or worksites, job duties, hours, scheduling, and conditions compared with what the employer represented. Note missing or inaccurate records and identify the record that would normally show the fact. A clear chronology helps WHD distinguish a one-time mistake from a recurring practice.

When DOJ’s IER guidance may fit

The Department of Justice reporting guidance covers certain visa-related hiring and employment discrimination or unfair treatment, including issues that can involve temporary visa holders. Read the examples and filing instructions there before submitting.

DOJ expressly distinguishes these matters from fraud in visa procurement: the Civil Rights Division says it does not enforce laws prohibiting that fraud. If the concern is a covered H-1B program requirement such as an employer’s labor-condition obligation, DOJ directs readers toward DOL WHD. If the facts involve both an employment practice and suspected false immigration information, describe each conduct separately and consider the corresponding agency routes rather than forcing everything into one report.

Build a report around facts, not legal labels

Agencies need enough detail to identify the people, employer, time period, location, and conduct. Before opening a form, organize the following information in a private chronology.

  • People and entities: employer or business name, physical address, worksites, immigration petitioner if different, and names or roles of people involved.
  • Dates and locations: filing or employment dates, each affected worksite, pay periods, meetings, messages, and the date the conduct ended or last occurred.
  • Job facts: title, duties, hours, schedule, work location, promised pay, actual pay, benefits, deductions, and changes over time.
  • What you know: mark each item as firsthand observation, a document you possess, or information reported by someone else.
  • Documents: preserve pay statements, schedules, employment agreements, LCA-related material, emails, text messages, time records, notices, and other relevant records that you are authorized to share.
  • Impact and response: describe what happened after you raised a concern, including threats, discharge, blacklisting, schedule changes, or other adverse treatment, with dates and witnesses where known.

This organization is practical guidance based on the agencies’ requests for detailed facts and evidence; it is not a substitute for the instructions on the current form or portal.

Preserve evidence responsibly

  1. Keep original files unchanged, including their names and metadata where practical.
  2. Make a working copy for highlighting or redaction; never edit the only original.
  3. Save a list of what you submitted, the date, and the agency route used.
  4. Remove unrelated personal information from a copy only when necessary and when doing so does not obscure the relevant facts.
  5. Do not obtain records through unauthorized access, impersonation, or a breach of another person’s account.

Confidentiality, anonymity, and retaliation

Can you report an H-1B employer anonymously?

Do not assume that a report is absolutely anonymous. USCIS asks for identifying information where known and does not state that every report can be filed without any identifying details. DOL’s H-1B Advisor says complainant identity is kept confidential to the maximum extent permitted by law—not without exception. The agency may still need to contact you or disclose information as required by law or process. Provide accurate contact information if you want the agency to be able to ask follow-up questions, and read the current privacy and submission notices before filing.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Protection against retaliation

DOL says an H-1B employer may not intimidate, threaten, blacklist, discharge, or otherwise discriminate against an employee, former employee, or applicant for disclosing information reasonably believed to show an H-1B violation or for cooperating in an investigation or proceeding. This is a general protection described in DOL’s guidance; it does not guarantee a particular job, immigration status, investigation, or case result. Record the date, wording, people involved, and employment consequence of any retaliatory act and include those facts in the WHD submission.

After you submit

Keep your confirmation, delivered form, attachments, and chronology together. If an agency asks questions, answer from your records and distinguish direct knowledge from inference. Do not exaggerate, speculate about another person’s immigration status, or submit altered documents; an allegation remains an allegation until the responsible agency makes its own determination.

If you later discover a material correction, use the agency’s current instructions to provide it and identify the original submission. For an urgent safety threat or other crime outside the immigration-benefit route, contact the appropriate law-enforcement agency rather than waiting for a USCIS tip response.

A quick decision checklist

  1. Is the concern about false or abusive use of an immigration benefit? Start with USCIS’s Secure Tip Form.
  2. Is it an H-1B employer issue involving pay, fees, conditions, records, or retaliation? Complete WH-4 and send it to the WHD office for the employer’s physical location.
  3. Is it a visa-related hiring or employment discrimination practice? Review DOJ IER’s reporting guidance.
  4. Is it another crime, immediate danger, or national-security threat? Use the appropriate agency or local law enforcement.
  5. Are the facts within the DOL period? WHD’s Advisor describes a 12-month period immediately before receipt; contact WHD promptly about older or continuing conduct.
  6. Can you support the account? Prepare a dated chronology, identify what is firsthand, preserve authorized records, and keep a copy of everything submitted.
