How to Report Suspected Attorney Misconduct to Your State Bar

Report the lawyer to the official disciplinary authority in the state where the lawyer is licensed or where the conduct falls under that state’s jurisdiction. Find that authority’s current grievance or complaint form, describe events in chronological, verifiable terms, attach copies of supporting records, and follow the state’s submission instructions. A disciplinary complaint can lead to investigation or sanctions, but it normally cannot act as your lawyer, undo a court result, order a refund, or award malpractice damages.

Find the agency that has jurisdiction

Every state uses its own intake system. The responsible office may be called disciplinary counsel, a chief trial counsel’s office, a grievance committee, or a state-bar attorney-discipline department. Start with the official bar or supreme-court website for the state in which the lawyer is licensed. If the lawyer is admitted in more than one state, or the events occurred elsewhere, identify every potentially relevant jurisdiction and ask each authority which one should receive the filing.

The American Bar Association’s Model Rule 11 describes the basic principle: “The disciplinary counsel shall evaluate all information coming to his or her attention by complaint or from other sources alleging lawyer misconduct or incapacity.” If the alleged facts, assuming they are true, would constitute misconduct and the lawyer is subject to that authority, disciplinary counsel investigates. When an office lacks jurisdiction, the matter should be referred to the appropriate jurisdiction rather than simply treated as a merits decision.

Use the current form, not a saved copy from an earlier year. Texas, for example, requires the form effective October 1, 2025; an incomplete or outdated form can be rejected. State portals, mailing addresses, attachment rules, signatures, and review deadlines differ, so read the instructions for the exact office before sending anything.

Decide what outcome you need before filing

A bar complaint addresses possible violations of professional-conduct rules. It is not a general customer-service channel or a substitute for every legal remedy. Write down the result you need and match it to the forum that can provide it.

Problem or objective Usually appropriate route What that route can generally do Important limitation
Possible dishonesty, abandonment, misuse of client funds, serious neglect, conflicts, or other rule violations State disciplinary authority Evaluate the information, investigate eligible allegations, and pursue discipline or an alternative-to-discipline disposition where authorized Does not normally represent you or award personal compensation
Disagreement over the amount of a bill or a fee that should be returned State-bar-certified fee-arbitration program, if available May provide a process for resolving a fee dispute Availability, deadlines, and binding effect vary by state; the cited guidance does not establish a nationwide rule
Financial loss caused by negligent legal work Independent malpractice lawyer Can evaluate a civil claim, damages, limitation periods, and litigation strategy A bar investigation does not extend a malpractice deadline unless applicable law says otherwise
Need to change a judgment, preserve an appeal, or undo a settlement Appellate or trial counsel in the underlying case Can assess motions, appeals, stays, or settlement remedies The disciplinary office cannot reverse a court decision or settlement
Qualifying theft from a client Client-security-fund program, if the state has one and the loss qualifies May provide limited reimbursement under that program’s rules Eligibility and deadlines are state-specific and not established by the cited guidance
Suspected criminal conduct Law enforcement, in addition to any bar report Can investigate possible crimes under its own authority A bar complaint is not a criminal investigation

California expressly says its bar cannot give legal advice or representation, reverse court decisions or settlements, order a fee refund, resolve fee disputes, or act as an advocate. Other states describe similar boundaries. You may pursue more than one route, but do not wait for a bar response if a court deadline, appeal period, eviction, deportation issue, limitation period, or safety concern is imminent.

Prepare a factual, chronological account

Start with the engagement

Identify the lawyer, firm, office location, your matter, and the date you hired the lawyer. State what you hired the lawyer to do, what fee or retainer arrangement applied, and whether the lawyer represented you in a court, agency, transaction, or negotiation. Include the case name and number when relevant, while keeping the narrative focused on conduct that the bar can evaluate.

Build a dated timeline

List each material event in date order. For every event, identify who acted, what was said or done, how you learned it, and what happened next. Include missed hearings, filing deadlines, promised actions that were not completed, unanswered communications, requests for your file, payments, settlement distributions, and notices from a court or opposing party. If you do not know an exact date, say that it is approximate rather than guessing.

Describe acts and omissions, not legal labels

California’s complaint guidance asks for what happened, including dates, names, and actions or omissions. “My lawyer committed malpractice” is a conclusion, not enough detail to investigate. Replace it with facts such as: “The court docket shows a response was due on March 4; I sent the lawyer the notice on February 10; the response was not filed; and the court entered an order on March 12.” Explain the practical consequence without asserting that the bar must reach a particular legal conclusion.

Name witnesses and identify records

Give the names and contact information of people who directly observed the conduct, if you can do so lawfully. Identify the document, message, docket entry, or recording that supports each important event. Distinguish what you personally observed from what someone else told you. A clear source for each fact lets an intake lawyer evaluate the allegation without reconstructing your entire dispute.

Collect evidence and submit copies

Useful records commonly include:

  • Engagement letters, fee agreements, retainer statements, and termination letters.
  • Invoices, receipts, canceled checks, bank records, and proof of payments or settlement distributions.
  • Emails, text messages, letters, voicemail transcriptions, and communication logs showing requests and responses.
  • Pleadings, motions, orders, docket sheets, hearing notices, and other court documents.
  • Settlement agreements, closing statements, trust-account explanations, and correspondence about client money.
  • Documents showing a missed deadline, missed appearance, failure to return a file, or notice that the lawyer stopped acting.

Send copies and retain the originals. Texas and California both instruct complainants to keep originals. Organize the copies with descriptive filenames or exhibit numbers and refer to them in the timeline. Do not send an entire unindexed case file when a short, targeted set of records proves the point; excessive material can obscure the key facts.

California’s online complaint portal limits online attachments to 10 files, each no larger than 4 MB. If your evidence exceeds that limit, follow the portal’s instructions for additional delivery rather than repeatedly submitting the same form. Other states may impose different file-size, format, or mailing requirements; use the receiving office’s current instructions.

Understand privilege, confidentiality, and anonymity

Signing can waive attorney-client privilege

Texas states that signing a grievance waives attorney-client privilege that would otherwise protect communications. That means the disciplinary authority may need access to communications relevant to the allegations, and the lawyer may be able to respond to them. Before filing, separate facts necessary to explain the alleged misconduct from unrelated personal information and understand that a complaint is not a confidential conversation with your former lawyer’s opponent.

Your identity may be disclosed

California warns that anonymous filing can make investigation difficult. A client’s identity generally must be disclosed to establish a waiver of privilege, and the facts themselves may identify the complainant even if no name appears on the form. Read the state’s privacy and confidentiality statements before choosing how to identify yourself. Do not assume that an anonymous submission prevents the lawyer from inferring who filed it.

Confidentiality can change as a case advances

California says complaints are confidential during investigation and become public when disciplinary charges are filed. The state Supreme Court has final authority in suspension or disbarment cases. Other jurisdictions use different rules, so treat the receiving authority’s notice as controlling and remove irrelevant sensitive information from attachments.

Complete the form accurately

  1. Verify the lawyer’s identity. Use the exact name, firm, office, and bar number if known. Check spelling against the engagement letter, court docket, or state directory.
  2. Choose the correct matter and jurisdiction. Include the court, agency, transaction, or client account involved and explain why the selected state has authority.
  3. Answer every required question. If a question does not apply, write “not applicable” and briefly explain when useful; do not leave required fields blank.
  4. Paste or attach the timeline. Keep the narrative readable, use headings or numbered paragraphs, and connect each allegation to an exhibit.
  5. State the harm and urgency. Identify a missed deadline, loss of access to funds, inability to obtain your file, or other concrete effect. If a deadline is near, state its exact date.
  6. Sign only after reviewing the notices. Confirm privilege, confidentiality, identity, consent, and certification language before signing or submitting electronically.
  7. Save a complete copy. Retain the final form, every attachment, the submission confirmation, and proof of mailing or delivery.

Do not exaggerate, speculate about motive, threaten the lawyer, or include allegations you cannot support. A mistaken date can be corrected, but a narrative that mixes assumptions with facts makes the authority’s initial evaluation harder.

Choose online or mailed submission

Submission method Advantages Risks or limits What to preserve
Online portal Immediate electronic delivery and a confirmation screen or email when the portal provides one Attachment caps, file-size limits, required fields, browser or upload failures, and possible inability to save a draft PDF or printout of the submitted form, confirmation number, uploaded-file list, and confirmation email
Mail or other permitted physical delivery Useful when online files exceed limits or the state requires paper signatures Transit time, signature or notarization requirements, and risk of sending an outdated form or wrong address Signed copy, complete exhibit index, mailing receipt, tracking record, and delivery date

Cost, processing deadlines, and whether a particular method is mandatory are state-specific and not established in the cited guidance. Follow the current instructions for the jurisdiction rather than relying on another state’s practice.

What happens after you submit

Initial evaluation

Disciplinary counsel evaluates information from complaints and other sources. The office may ask for clarification, additional records, a response to the lawyer’s explanation, or proof that the lawyer is subject to that jurisdiction. Respond by the stated deadline and keep copies of what you send.

Texas classification example

The State Bar of Texas says its initial classification is generally made within 30 days. A matter that is ineligible or does not allege professional misconduct is classified as an inquiry and dismissed. An eligible grievance alleging professional misconduct becomes a complaint for investigation. This 30-day period is a Texas procedure, not a national processing-time promise.

Possible dispositions

Under Model Rule 11, an authority may dismiss the matter, refer it to an alternatives-to-discipline program, or pursue further proceedings when the facts support possible misconduct. The authority, not the complainant, decides whether a rule violation is established and what action is appropriate. A dismissal does not decide a separate malpractice, fee, appeal, or criminal claim.

California confidentiality and final authority

California states that complaints remain confidential during investigation and become public when disciplinary charges are filed. In suspension or disbarment matters, the California Supreme Court has final authority. Other states may use different stages, notices, and appeal or review rights; read each decision carefully for the applicable deadline and procedure.

Handle urgent harm separately

A bar office does not step into your case as counsel. If the lawyer has missed a filing deadline, failed to appear, abandoned you, or stopped protecting a legal right, contact an independent lawyer immediately. Bring the case docket, all deadline notices, the engagement agreement, and your communications log. Ask specifically about emergency filings, a stay, substitution or withdrawal, an appeal, and any limitation period.

For suspected theft, preserve bank and trust-account records and ask whether your state has a client-security fund. For suspected crimes, consider law enforcement. Filing a bar complaint can proceed in parallel, but it should not delay an action that protects your liberty, housing, immigration status, custody, finances, or ability to appeal.

Examples of conduct that may warrant a complaint

State guidance identifies conduct that can raise disciplinary concerns, while emphasizing that the authority decides whether a rule was violated. Examples include:

  • Repeated failure to return calls or provide the client file after reasonable requests.
  • Missing a court appearance or filing deadline without a documented explanation or corrective action.
  • Abandoning a matter or stopping work while a client’s legal rights are at risk.
  • Dishonesty, fraud, or reckless or intentional misrepresentation to a client, court, or another person.
  • Misuse of client money, failure to account for funds, or failure to pay a client’s share of a settlement.
  • A conflict of interest that was not properly addressed or disclosed.
  • Substance abuse that affects the lawyer’s ability to practice.

A disappointing result, an unfavorable ruling, or a fee you consider high does not by itself prove professional misconduct. Explain the underlying conduct and documents instead of asking the bar to decide whether the lawyer should have won your case.

Common filing mistakes and fixes

  • Using the wrong office: Verify the lawyer’s license and the state’s jurisdiction before completing the form.
  • Submitting an old form: Download the current version; Texas specifically identifies a form effective October 1, 2025.
  • Writing a brief full of conclusions: Replace labels with dates, quotations, actions, omissions, and document references.
  • Sending originals: Send copies and keep originals in a secure file.
  • Ignoring attachment limits: Check file count and size; California’s portal allows 10 files of up to 4 MB each.
  • Assuming the complaint pauses another deadline: Obtain independent advice about appeals, malpractice limitations, fee-arbitration deadlines, and court remedies.
  • Failing to monitor email: Check spam folders and answer requests for information completely and on time.
  • Expecting compensation from discipline: Use fee arbitration, malpractice counsel, a client-security fund, or law enforcement when those are the remedies your situation requires.

Final submission checklist

  • The receiving authority and jurisdiction are confirmed.
  • The current state form is complete, signed, and dated.
  • The narrative explains what you hired the lawyer to do and gives a chronological account with dates, names, and concrete acts or omissions.
  • Witnesses and supporting records are identified.
  • Copies, not originals, are attached within the state’s format and size limits.
  • You reviewed privilege, confidentiality, identity, and anonymity consequences.
  • Urgent court, safety, appeal, immigration, housing, custody, or financial deadlines are being handled separately by independent counsel or the appropriate agency.
  • You saved the submission, attachments, confirmation, and delivery proof.
  • You will monitor communications and meet every response deadline.

Key points to remember

Use the official disciplinary authority for the lawyer’s jurisdiction and its current form. Give a factual timeline, attach organized copies, and retain originals. Signing may waive privilege, and anonymity may be difficult in practice. The bar investigates possible rule violations; it generally cannot represent you, reverse your case, order a refund, resolve an ordinary fee dispute, or award malpractice damages. Protect urgent legal rights through the appropriate court, lawyer, fund, arbitration program, or law-enforcement channel while the disciplinary process runs on its own track.
