First identify the prosecutor’s employer and jurisdiction. A disciplinary complaint is separate from asking a court to address a problem in an active case, and it should not be relied on to change a ruling or protect a deadline.
Identify the right oversight office
The prosecutor’s employer determines where a professional-conduct complaint belongs. DOJ OPR says it has no authority over state and local officials; state procedures vary, so use the official disciplinary authority for the relevant jurisdiction rather than assuming there is one national process.

How to submit a complaint about a DOJ attorney
OPR accepts written complaints from members of the public, including criminal defendants and civil litigants, about serious, non-frivolous allegations of professional misconduct by DOJ attorneys in the exercise of authority to investigate, litigate, or provide legal advice on behalf of the United States. What to include in a factual report
Follow the selected authority’s form and instructions. A concise, chronological account can help explain what happened without turning suspicion into an unsupported allegation. Keep a copy of the complaint and the records you submit.
- Identify the prosecutor and the case, including the court or jurisdiction if known.
- List relevant dates, events, participants, and what you personally observed.
- Explain which records support your account and attach copies if the authority permits or requests them.
- Separate direct knowledge from inference, and avoid claims you cannot substantiate.
- Check the authority’s privacy and confidentiality rules before submitting sensitive material.
California’s State Bar warns that anonymous complaints can be harder to investigate because staff cannot contact the complainant for follow-up. It also says facts under investigation and, in some circumstances, the complainant’s identity may be disclosed. Its complaint form requires a truth-and-correctness certification and warns against knowingly false and malicious reports. These are California-specific details, not rules to assume apply elsewhere. If the case is still active, address the court issue separately
A disciplinary complaint and a request for relief in a pending case serve different purposes. OPR says it refrains from investigating allegations submitted, or that could have been submitted, to a court during ongoing litigation. A complaint to a professional authority should not be treated as a way to reverse a ruling, dismiss charges, obtain a new trial, or pause a deadline.
If the conduct may affect an active case, preserve relevant records and promptly consult defense counsel or another lawyer authorized in that jurisdiction. Describe the specific event and ask whether a court procedure or deadline applies. The appropriate remedy depends on the court, jurisdiction, and posture of the case; a disciplinary agency is not a substitute for case-specific legal advice.

State and local complaints: California as one example
For a state or local prosecutor, find the official attorney discipline authority in the relevant jurisdiction and confirm its current filing procedure. California’s Office of Chief Trial Counsel reviews complaints about attorneys licensed in California, and the State Bar directs members of the public to its online complaint process. The Bar reports reviewing approximately 24,000 attorney-misconduct complaints annually; the reviewed page does not state a year for that figure, and it applies only to California. Is the state Attorney General the right office?
Do not assume a state Attorney General is a general complaint office for a local prosecutor. California’s Attorney General says it ordinarily would not enter a local criminal charging matter unless the district attorney has a conflict preventing a charging decision, and directs complaints about California attorneys to the State Bar. It also says the office cannot represent private individuals or provide legal advice. Other states may allocate authority differently. California Attorney General FAQ
What to expect after filing
OPR says it provides complainants information about resolution as appropriate and as permitted by law. It also says findings that implicate bar rules are referred to disciplinary authorities.
