Report the crime and protect clients on parallel tracks. Start the firm’s incident-response plan, preserve logs and forensic evidence, involve privacy counsel, and file with the FBI’s Internet Crime Complaint Center (IC3) as soon as a cyber-enabled crime is suspected. Use a local FBI field office or tips.fbi.gov for an ongoing crime, threat to life, or national-security concern. Client notices, regulator notices, and disclosures to investigators require a separate analysis of jurisdiction, data type, contracts, and professional-conduct rules.
What to do first
Activate incident response and preserve evidence
Open an incident record as soon as the firm suspects that an attacker stole client information. Record the detection time, affected systems, suspected entry and exit points, accounts used, files or databases involved, business interruption, and every containment or recovery action. Keep a contemporaneous timeline; it will help counsel, investigators, insurers, clients, and law enforcement reconcile what is known and what remains uncertain.

Use the technical response team to stop continuing access without destroying evidence. Isolate compromised hosts, disable exposed credentials, revoke tokens, and block malicious infrastructure according to a documented plan. Preserve authentication logs, endpoint data, cloud audit trails, email headers, firewall records, backups, malware samples, and relevant chat or ticket records. Do not “clean” a system before forensic images and volatile evidence have been captured.
Federal Trade Commission guidance recommends considering an independent forensic investigator to identify the source and scope, capture forensic images, analyze evidence, and recommend remediation. Independence can be important when the firm’s own managed-service provider, software supplier, or insurer may also be part of the fact pattern.

Engage counsel immediately
Notify the firm’s incident lead and counsel experienced in privacy and data security. Counsel can map state and federal notification rules, contractual obligations, insurance requirements, privilege questions, conflicts, and the limits on sharing client-matter information. Give the forensic team a clearly defined reporting line and preserve the distinction between technical findings and legal advice; privilege is not automatic merely because a lawyer receives a report.
Protect people and critical operations
If the attacker is still active, prioritize safety and continuity: protect court deadlines, prevent unauthorized wire transfers, secure trust-account access, and establish an out-of-band channel for incident communications. Do not negotiate, pay, or promise a payment until counsel, the insurer, and appropriate authorities have assessed sanctions, legal, and operational risks. A payment decision does not replace reporting or notification analysis.
Where a law firm should report the attack
Choose channels based on urgency, incident type, the agency’s remit, and what client-confidential information can lawfully be disclosed. More than one report may be appropriate.
| Situation | Primary channel | What it does | Important qualification |
|---|---|---|---|
| Cyber-enabled crime, fraud, intrusion, or data theft | FBI Internet Crime Complaint Center (IC3) | Creates the FBI’s public cybercrime report and routes information for investigation and intelligence. | The FBI says: “If you are the victim of a cyber-enabled crime or fraud, file a report with the Internet Crime Complaint Center (IC3) as soon as possible.” |
| Ongoing crime, threat to life, or national-security threat | Local FBI field office or tips.fbi.gov | Provides a direct route for urgent or active threats. | Use emergency services when there is an immediate physical danger; do not wait for an IC3 submission to address imminent harm. |
| Ransomware | CISA, the local FBI field office, IC3, and the U.S. Secret Service | Offers reporting and technical-assistance routes listed in CISA’s StopRansomware guidance. | Preserve ransom notes, wallet addresses, negotiation records, affected-system details, and recovery evidence. |
| Personal-information breach | State, federal, or sector regulators identified by the applicable law | Receives legally required breach notifications and, in some sectors, incident reports. | There is no single nationwide form or deadline for every law-firm incident. |
Filing with IC3
Prepare a factual chronology before submitting. Include the firm’s identifying information, attacker indicators, dates and times with time zone, affected systems, suspected data taken, financial loss, ransom demands, cryptocurrency addresses, domains and IP addresses, and the actions already taken. Distinguish confirmed facts from reasonable inferences. Preserve the submission confirmation and provide updates if the scope changes.
Do not upload stolen pleadings, privileged memoranda, medical records, or complete client files merely because a form permits attachments. Ask counsel what can be disclosed, whether redaction is adequate, and whether client consent or another exception to confidentiality is required. Investigators can often begin with indicators, timelines, and categories of data rather than the underlying matter file.

Contacting the FBI directly
For an attack that is still unfolding, extortion accompanied by a physical threat, or a national-security concern, contact the local FBI field office or use tips.fbi.gov. Tell the agent that the victim is a law firm, identify any immediate safety or court-deadline issue, and explain whether the attacker still has access. Coordinate through counsel so separate staff do not provide inconsistent accounts or disclose more client information than necessary.
Ransomware reporting through CISA
CISA’s StopRansomware guidance identifies CISA, the FBI field office, IC3, and the Secret Service as reporting and assistance options. A ransomware report should include the initial access method if known, encryption or exfiltration evidence, systems unavailable, backups affected, ransom communications, payment status, and indicators of compromise. Preserve the original ransom note and negotiation messages; screenshots alone may omit metadata useful to investigators.

When a cyber incident becomes a client-notification issue
ABA Formal Opinion 483, discussed in a November 2020 ABA analysis, describes a data breach as an episode in which material client confidential information is misappropriated, destroyed, or otherwise compromised, or the lawyer’s ability to provide contracted legal services is significantly impaired. Not every cyber event requires notice. A material-information threshold and the facts of the compromise matter, and the governing state’s ethics opinions control.
Assess both confidentiality and availability. A file that was copied, exposed, altered, or deleted may create a different duty from an unsuccessful phishing attempt. A firm may also need to notify a client when an outage prevents it from meeting a material filing, discovery, or transaction obligation, even if investigators have not proved that data was exfiltrated.
New York example: Formal Opinion 2024-3
New York City Bar Formal Opinion 2024-3, dated July 18, 2024, says lawyers have an ethical obligation under New York Rule 1.4 to promptly notify current clients in certain circumstances when an incident compromises the confidentiality or availability of client information or the firm is likely unable to meet material obligations. The opinion is specific to New York professional rules; it is not a nationwide notification standard.

- [Dont Hesite to Order] 24 hours customer services and professional technology team are standing by
The same opinion explains that disclosure of client-confidential information to law enforcement or in a government investigation is permissible only when Rules 1.6, 1.9, or 1.18 allow it. It also advises considering the risks to clients from communicating with government officials. A report that identifies a client, matter, litigation strategy, or sensitive transaction can itself create harm, so counsel should limit the submission to what is necessary and authorized.

An incident can create a conflict if the firm’s conduct may expose it to a malpractice claim or if the firm must choose between its own defense and a client’s interests. The New York opinion notes that a conflict may prevent the firm from advising a client about the incident or may require withdrawal when a malpractice claim arises. Run a conflicts check early, appoint independent counsel where needed, and document who is authorized to speak for the firm and each affected client.
Build the notification map before sending notices
Identify every relationship in the data flow
List the firm’s role for each data set. The firm may be a business deciding about its own employees, a service provider holding a corporate client’s records, or a custodian of information belonging to an opposing party, expert, or third-party witness. Contracts may require notice to a client, insurer, cloud provider, or other business before a statutory notice is sent. Contractual notice does not replace a legal notice, and a contract cannot safely be assumed to override professional duties.
Determine whose information was exposed
- Current, former, and prospective clients.
- Employees, applicants, contractors, and dependents.
- Individuals whose information was collected during discovery, investigations, or transactions.
- Businesses whose personal information the firm stores or processes.
- Opposing parties, witnesses, experts, and other people represented in the files.
For each person, record residence or principal location, the data elements involved, whether the information was encrypted, and evidence of access or exfiltration. Residence commonly determines which state statute applies; the firm’s office location alone may not.
Apply state and federal breach laws
The FTC states that all 50 states, the District of Columbia, Puerto Rico, and the U.S. Virgin Islands have legislation requiring notification of security breaches involving personal information. Recipient, timing, content, safe-harbor, and regulator requirements vary with the jurisdiction and facts. Review the law for every affected person and every relevant data set instead of applying the state where the firm is headquartered to everyone.

Federal Trade Commission guidance recommends notifying affected businesses when the firm holds personal information for them and considering individual notice based on the nature of the compromise, the information taken, the likelihood of misuse, and potential harm. A legal duty may arise even when forensic work cannot prove misuse; reasonable suspicion and the statutory definition of “breach” must be evaluated under the applicable law.
Coordinate timing with investigators
Ask the law-enforcement contact whether notice timing could impede an investigation. Coordination should address when notices may be sent, what attacker details can be disclosed, and whether a delayed notice is legally permitted. Do not promise clients an immediate mailing date until counsel confirms the applicable rule and investigators have responded.
Write a useful individual notice
FTC guidance recommends naming a communications point person; describing what happened and when; identifying the information involved; explaining response and remediation; and telling recipients what they can do, with current contact and recovery information. Avoid speculation about the attacker or assurances that the data “cannot be misused” unless the evidence supports that conclusion.
When Social Security numbers are involved, explain available fraud alerts and credit freezes in the manner required by the relevant law. Provide a monitored phone number or web address that recipients can use without sending additional confidential matter details through an insecure channel.

Electronic health records and HIPAA
If the stolen files include electronic health records, determine whether the Health Breach Notification Rule or HIPAA applies. Depending on the firm’s role and coverage, reporting to the FTC or the Department of Health and Human Services, and possible media notice, may be required. A law firm that handles health information is not automatically a HIPAA covered entity; analyze whether it is acting for a covered entity or business associate and whether another rule applies.

Financial, employment, and other sensitive records
Bank details, tax identifiers, biometric information, children’s data, and employment records can trigger different definitions and notice content. Separate these categories in the incident inventory. A single compromised archive may contain records governed by several statutes, each with its own regulator, threshold, and timing rule.
Do not assume a 72-hour deadline applies
The 2024 U.S. Code text of 6 U.S.C. § 681b describes a 72-hour period after a covered entity reasonably believes a covered cyber incident occurred and a 24-hour period after a covered entity makes a ransomware payment. The statutory paragraphs state that they take effect on dates prescribed in a final rule.
Those figures are not a universal deadline for law firms. Before relying on them, confirm the current final rule, effective date, covered-entity scope, definitions, and any exception. A firm may have a different deadline under a state breach law, client contract, insurance policy, court order, or sector rule. Treat the 72-hour and 24-hour numbers as a regulatory question to verify, not as a shortcut for every incident.

A practical reporting workflow
- Open the incident record. Assign an incident number, preserve the first alert, and start the timeline.
- Contain carefully. Stop active access and protect critical operations while forensic personnel preserve images, logs, and volatile evidence.
- Engage counsel and the insurer. Confirm reporting lines, privilege strategy, panel requirements, conflicts, and contractual notices.
- Scope the data. Identify systems, clients, individuals, jurisdictions, data categories, and evidence of access or exfiltration.
- Report the crime. File with IC3 as soon as possible; contact the field office or tips.fbi.gov for an ongoing or urgent threat.
- Add ransomware channels when applicable. Use the CISA, FBI, IC3, and Secret Service routes identified in StopRansomware guidance.
- Build the legal matrix. Map each person and data category to state, federal, sector, contractual, and professional-conduct requirements.
- Resolve confidentiality and conflicts. Decide what can be shared with agencies and clients, whether consent is needed, and whether independent counsel must advise a client.
- Coordinate notice timing. Check with law enforcement, then send accurate notices through a named communications point person.
- Update and document. Preserve confirmations, amendments, regulator correspondence, client questions, remediation decisions, and the final scope determination.
Common mistakes that make an incident worse
- Waiting for perfect certainty. Early reporting can preserve investigative leads; label unknowns instead of delaying the initial report indefinitely.
- Sending the entire stolen file to an agency. Provide necessary indicators and facts while counsel determines what client-confidential material may be disclosed.
- Using one notice for every recipient. A corporate client, an employee, and a person whose data appeared in discovery may have different rights and instructions.
- Confusing a client notice with a crime report. Reporting to IC3 does not satisfy every state, contractual, or professional obligation, and notifying a client does not replace law-enforcement reporting.
- Ignoring conflicts. The firm may be unable to advise a client about a claim involving the firm’s own conduct.
- Destroying evidence during cleanup. Rebuilding systems before forensic capture can remove the very records needed to establish scope.
- Publishing an unsupported deadline. State and sector rules differ, and the federal 72-hour and 24-hour figures require confirmation of implementation and coverage.
- Using stale contact information. Verify current agency routes and the designated client-notice contact before sending a communication that cannot be recalled.
What a complete incident file should contain
Keep a controlled record that another lawyer or investigator can understand without relying on memory:
- Detection, containment, recovery, and reporting timestamps with time zones.
- System and account inventory, including cloud tenants, vendors, and backups.
- Forensic images, hash values, log exports, malware samples, and chain-of-custody records.
- Affected client and individual matrix showing location, data type, access evidence, and notice status.
- Copies of IC3, FBI, CISA, Secret Service, regulator, insurer, and contractual reports.
- Approvals for disclosures, redactions, client communications, and any decision to delay notice.
- Remediation actions, credential changes, monitoring, restoration tests, and lessons learned.
This record supports consistent answers when clients, regulators, insurers, courts, or investigators ask what happened. It also makes it easier to correct an early report without erasing the original account.
Bottom line for firm leaders
Use IC3 promptly for a suspected cyber-enabled crime, escalate active or dangerous situations to the FBI field office or tips.fbi.gov, and add CISA’s ransomware channels when encryption or extortion is involved. At the same time, preserve evidence, use independent forensics where appropriate, and involve privacy counsel. Decide client and regulator notices separately, applying each affected person’s location, data category, contract, and professional-conduct rules. The safest report is factual and timely without disclosing more client-confidential information than the law permits.
