Start by identifying exactly what the notice alleges, which section it cites, the tax periods and calculation involved, and the deadline. A pre-notice intimation in FORM GST DRC-01A is answered in Part B of that form under rule 142(2A); a formal notice whose summary is uploaded in FORM GST DRC-01 is answered in FORM GST DRC-06 under rule 142(4). Reconcile every disputed credit to your returns, purchase register, invoices, supplier evidence and payment records, then explain each item as accepted, disputed, already reversed or paid, or covered by a statutory exception.
What to do first
Download the complete notice and every attachment from the GST portal. Do not rely only on the electronic DRC-01 summary: the detailed notice contains the allegations, legal basis, computation and documents that must be answered.

- Record the GSTIN, legal name, case or reference number, issuing officer and jurisdiction.
- Note the statutory provision cited, financial year, individual tax periods, tax amount, proposed interest and penalty.
- Write down the reply deadline, hearing date, portal status and the date you downloaded each document.
- Check whether a DRC-01A intimation preceded the notice and preserve any Part B submission.
- List every document or data source the department says supports the proposed demand.
The reply must deal with the department’s calculation, not merely state that your books are correct. If the notice contains several grounds, separate them and answer each one independently.

Choose the correct procedural route
The form depends on where the matter is in the process. Using DRC-06 for every GST communication, or treating DRC-01A as a final demand, can place a response in the wrong procedural stage.

| Before a formal notice | FORM GST DRC-01A, an intimation of ascertained liability under sections 73(5) or 74(5) |
Part B of DRC-01A under rule 142(2A) | Why the proposed ascertainment is wrong, incomplete or already discharged; attach the reconciliation and supporting records. |

| After an order | Reasoned adjudication order with summary in FORM GST DRC-07 |
Review the order and consider the statutory appeal route | Whether the order addressed your evidence and arguments, how the confirmed demand differs from the notice, and the applicable appeal deadline. |
Submit by the date stated in the communication and retain the portal acknowledgement. If the portal does not accept a filing or an attachment, preserve screenshots, error messages and contemporaneous correspondence while seeking a permitted filing route.
Make a notice-control sheet
A control sheet prevents a long notice from turning into a general, unsupported explanation. Use one row for each allegation or calculation line and keep a separate index of annexures.
- Identity: GSTIN, registered name, authorised signatory and contact details used in the registration.
- Case data: reference number, issuing officer, jurisdiction, notice date and communication date.
- Law: section and rule cited, including whether the notice invokes section 73 or section 74.
- Period: financial year, return period, invoice dates and the date on which credit was claimed.
- Money: disputed ITC, tax allegedly payable, interest computation and proposed penalty.
- Process: DRC-01A or DRC-01 status, reply deadline, hearing date and any earlier reply or payment.
- Evidence: every invoice, report, statement, return, ledger or departmental working paper referred to by the officer.
Compare the detailed notice with its DRC-01 summary. If figures, periods or allegations differ, identify the difference expressly and ask the officer to clarify or correct the record.

Reconcile excess ITC allegation by allegation
Build a period-wise reconciliation that a reviewing officer can follow without reconstructing your accounting system. Use one row per disputed invoice, debit note, credit note, return period or adjustment, depending on the allegation.
| Column | What to enter |
|---|---|
| Notice reference | The paragraph, table or serial number and the amount stated by the department. |
| Taxpayer records | Purchase-register line, invoice or debit-note number, date, supplier GSTIN and tax amount. |
| Return and ledger trail | Relevant GSTR-3B or other return period, electronic credit ledger entry and accounting-ledger posting. |
| Supplier evidence | Where relevant, matching details from supplier filings or correspondence, with an explanation of what the evidence proves. |
| Nature of dispute | Mismatch, blocked credit, attribution or reversal, duplicate claim, timing, payment condition or another specific ground. |
| Status | Accepted, disputed, partly accepted, already reversed, already paid or subject to a statutory exception. |
| Calculation | Taxable value, eligible tax, disputed tax, reversals and the resulting balance, with arithmetic that totals to the notice. |
| Annexure | The exact annexure number and page range supporting that row. |
Reconcile the grand total to the notice. If your total differs, show the mathematical reason rather than submitting unexplained spreadsheets. Do not send unrelated records: each attachment should be tied to a particular allegation and proposition.

Common meanings of excess ITC
The phrase does not identify a single legal defect. The notice may concern one or several of these issues:
- Reconciliation or reporting mismatch: the department’s data differs from your purchase register, supplier reporting or return claim. Explain timing differences, amendments, credit notes and the precise documents that resolve the difference; do not assume a mismatch is automatically cancelled by a supplier explanation.
- Blocked or ineligible credit: the goods or services may fall within a statutory restriction or may not satisfy the conditions for credit. Address the exact provision and the business facts; a general statement that the purchase was for business is insufficient.
- Attribution and reversal: credit may require allocation between taxable, exempt or non-business use. Apply the relevant attribution and reversal mechanism to the periods in dispute and show the working.
- Duplicate claim: the same invoice, debit note or tax amount may appear more than once. Identify the duplicate entry, the valid claim and any reversal already posted.
- Timing: credit may be alleged to have been taken after the statutory cut-off. Check invoice dates, return dates, annual-return dates and any applicable exception before calculating the disputed amount.
- Payment or other conditions: if the notice alleges that a required condition was not met, provide the relevant payment, receipt, accounting and commercial records and explain the dates.
Address the section cited in the notice
Section 73
Section 73 covers tax not paid or short paid, erroneous refund, or wrongly availed or utilised ITC in cases not involving the fraud-related circumstances described in section 74. Your reply should still answer the eligibility and calculation issues in detail. Do not concede a larger amount simply because part of the demand is undisputed.
Section 74 and the fraud allegation
Section 74 applies where the department alleges that tax was not paid or was short paid, an erroneous refund was granted, or ITC was wrongly availed or utilised by reason of fraud, wilful misstatement or suppression of facts to evade tax. Section 74(1) states:
Where it appears to the proper officer that any tax has not been paid or short paid or erroneously refunded or where input tax credit has been wrongly availed or utilised by reason of fraud, or any wilful-misstatement or suppression of facts to evade tax, he shall serve notice on the person chargeable with tax…
Respond to both parts of the allegation: first, whether the credit was wrongly claimed and how the amount was calculated; second, what specific conduct, statement or omitted fact is said to establish fraud, wilful misstatement or suppression intended to evade tax. Distinguish an accounting error, data mismatch or interpretive dispute from an allegation of deliberate evasion. Do not make unsupported admissions about intent.

Section 75(2)
Section 75(2) addresses the situation in which the fraud-related charge is not established in specified appellate or court proceedings; the tax is then determined as if the notice were issued under section 73. It is not a reason to ignore a live section 74 notice. Address the section 74 allegation in the current proceedings and preserve the argument for the stage at which it is legally relevant.
Check the section 16 time-limit changes
When the dispute is solely about late availment, examine section 16(4) and the retrospective subsections (5) and (6) inserted by the Finance (No. 2) Act, 2024. Circular 237/31/2024-GST explains the change. Section 16(4), as reproduced in that circular, generally uses 30 November following the relevant financial year or the date of furnishing the relevant annual return, whichever is earlier, subject to statutory exceptions.
Match the invoice period and the exact basis of denial to the conditions in subsections (5) and (6). Do not describe the amendment as a blanket waiver for all excess-ITC disputes. It does not cure a blocked-credit, duplication, attribution, mismatch or other independent defect.
Circular 238/32/2024-GST clarifies that an amount can be deducted under subsections 16(5) or (6) only where the ITC was denied solely for contravention of section 16(4). If another ground also supports denial, the timing amendment does not eliminate that part of the demand. The circular also describes a targeted process involving FORM GST SPL-03 and an electronically filed FORM GST SPL-04 within one month after receipt of SPL-03 in the particular application-rejection situation covered by the circular. That process is distinct from replying to an ordinary live show-cause notice.
Draft the reply in a predictable sequence
For every allegation, use the same five-part sequence so the officer can connect your facts, law and evidence:

- State the allegation: quote or accurately paraphrase the notice paragraph, period and amount.
- State your position: accept, partly accept or dispute the allegation. If part is accepted, identify the exact amount and period.
- Explain the facts: describe the transaction, return entry, amendment, reversal, payment or other event in chronological order.
- Apply the law: cite the relevant section, rule, attribution formula or timing exception and explain why it fits these facts.
- Point to proof: name the annexure and page that establishes each factual proposition, then show the calculation of the remaining balance.
Use a summary table at the beginning showing the notice total, amount accepted, amount already reversed or paid, amount disputed and balance, followed by the detailed ground-by-ground analysis. Ask for a personal hearing when oral clarification would assist, and identify the issues that require explanation at the hearing.

There is no universal annexure set; the grounds determine what is relevant. A typical evidence file may include:
- Notice, DRC-01 summary, DRC-01A intimation and any earlier correspondence.
- Period-wise purchase register, invoice and debit-note extracts, including amendments and credit notes.
- Relevant GSTR-3B or other return workings and electronic credit-ledger entries.
- General-ledger extracts and accounting entries showing the original claim and any reversal.
- Supplier GSTIN details and supplier-return or reconciliation evidence where the allegation concerns matching.
- Goods-receipt notes, service-completion records, contracts, purchase orders and transport or delivery documents where receipt or business use is questioned.
- Bank statements, payment vouchers and accounting evidence where payment conditions are relevant.
- Working papers for exempt or taxable attribution, common-credit allocation and reversals.
- Proof of any tax payment or voluntary reversal, including the relevant challan, return period and ledger entry.
- A signed authorisation or board or partner resolution where the signatory’s authority needs to be demonstrated.
Number annexures consistently and add an index. Redact personal information that is irrelevant to the proceeding, but do not remove figures or identifiers needed to verify the transaction.
File the response and preserve proof
- Convert the signed reply and annexures into portal-accepted files, keeping the index and page numbering intact.
- Complete Part B of DRC-01A for a pre-notice intimation, or file DRC-06 when the formal notice summary is in DRC-01.
- Enter the disputed, accepted or paid amounts exactly as explained in the reconciliation; inconsistent portal figures can undermine an otherwise clear submission.
- Submit before the stated deadline and download the acknowledgement, filed form and attachment list.
- Save the acknowledgement, submission timestamp, reference number, copies of every attachment and any hearing communication in a read-only case folder.
Keep the original accounting records and an auditable copy of the spreadsheet used for the reconciliation. If a document is unavailable, say what was searched, why it cannot presently be produced and what alternate evidence supports the point; do not silently omit a record the notice specifically requests.

Identify the accepted amount by tax period and explain whether it has been reversed or paid. Attach proof and ask that only the unaccepted balance remain for determination. A partial admission should not be worded as an admission of fraud, wilful misstatement or suppression unless the facts and legal advice justify that conclusion.
Best Value
Where the notice calculation includes amounts already discharged, show the original demand, payment or reversal date, ledger effect and resulting balance in the same table. This prevents an accepted amount from being counted twice.
Prepare for the hearing and next order
Bring the notice-control sheet, reconciliation, indexed annexures and a short list of unresolved questions. Be ready to open the exact invoice, return line and calculation for every material disputed item. After the hearing, preserve any written submissions requested by the officer and record the date and substance of the communication.
Rule 142 provides for an order summary in DRC-07. When an order arrives, compare its reasoning and figures with the notice and your reply. Check whether the officer dealt with each ground, adjusted accepted or paid amounts, calculated interest correctly and explained any penalty. An appeal is a distinct later stage: review the actual order, DRC-07 summary and applicable statutory timelines promptly rather than assuming the notice deadline controls the appeal.

Common mistakes that weaken a reply
- Filing DRC-06 for a DRC-01A intimation or treating DRC-01 as the complete notice.
- Providing a single total without an invoice-level or period-level reconciliation.
- Sending a purchase register without marking which row answers which allegation.
- Assuming a supplier mismatch disappears automatically because the purchase is genuine.
- Ignoring attribution, reversal, duplicate or blocked-credit grounds while arguing only about matching.
- Claiming that the 2024 section 16 changes erase every time-barred or excess-credit demand.
- Failing to distinguish a section 74 fraud allegation from an ordinary calculation dispute.
- Admitting intent or suppression casually, without analysing the facts and statutory language.
- Missing the deadline, omitting the hearing request or failing to save the acknowledgement.
- Repeating the same explanation in several sections while leaving one notice paragraph unanswered.
When professional review is sensible
A GST practitioner or chartered accountant can help when the notice covers multiple years, large common-credit reversals, section 74 allegations, complex supplier reconciliations, retrospective time-limit provisions or a proposed penalty. Give the adviser the complete notice, portal downloads, control sheet, reconciliations, returns, ledgers and evidence index. Professional review does not replace the taxpayer’s responsibility to verify the facts, deadline and filing acknowledgement.
The applicable law and portal process can change. The rules PDF commonly cited for rule 142 is dated 1 January 2022, while the relevant section 16 circulars are from 2024. Before filing, check for later notifications, amendments and portal instructions, and rely on the exact notice and order in your case.
