How to Reply to a GST Notice in India and Meet the Response Deadline

To reply to a GST notice in India, first identify the section, notice form and deadline stated in the complete notice, then file the response in the form and through the channel that apply to that proceeding. There is no single response period for every GST notice. Preserve the notice and proof of filing, and get qualified help promptly if the case involves a large demand, a fraud-related allegation or an order already issued.

How do I reply to a GST notice?

Work from the complete notice and its attachments—not just an alert, portal summary or the words “GST notice.” Before drafting, record the GSTIN, issuing officer, case or reference number, tax period, cited legal provision, notice form, date and mode of service, proposed tax, interest or penalty, requested documents, hearing details and stated response date.

  1. Read every page and attachment. A portal summary may not contain all the allegations or supporting details. For a demand proceeding summarized in DRC-01, review the underlying notice as well as the summary.
  2. Identify the provision and form. Use these—not the generic label “GST notice”—to work out what kind of proceeding it is and which reply route applies.
  3. Mark the due date and set an earlier reminder. Note the service date as well as the response date printed in the notice. If the date is unclear, seek advice or contact the issuing office promptly rather than assuming a default period.
  4. Match each allegation to records. For every point, state whether you accept it, dispute it or need clarification. Explain why, reconcile the relevant amounts and label attachments so they correspond to the point being answered.
  5. File using the applicable form and current portal instructions. Save the submitted reply, its attachments and the portal acknowledgment or reference number.

The Central Goods and Services Tax Act, 2017 describes notices under sections 73 and 74 as requiring the person to “show cause” why the specified amount should not be paid with applicable interest and penalty. Treat the allegations as issues to answer with facts and records; do not make unsupported statements or casually admit liability.

What is the time limit to reply to a GST notice?

There is no universal number of days for replying to every GST notice. The applicable period depends on the proceeding and provision, and the complete notice may state the date by which a response is required. Check the current law and portal instructions for the specific case. Do not treat a payment option or a deadline in one type of proceeding as the response deadline for another.

For example, CBIC’s assessment-rules guidance describes a section 63 notice in ASMT-14 to an unregistered taxable person and specifies 15 days to respond before an ASMT-15 order may be passed. That is an example for this route, not a general GST-notice deadline. The exact due date in an individual case cannot be worked out without the notice, service details and applicable provision.

Which form do I use to reply to a GST notice?

Use the notice form and cited provision to identify the pathway. These examples from GSTN and CBIC materials cover only the routes described below; they are not a complete list of GST proceedings or form-and-deadline combinations.

Notice pathway Notice and response form What to check about timing Source and practical focus
Return scrutiny under section 61 GSTN identifies ASMT-10 as a discrepancy notice and ASMT-11 as the taxpayer’s reply form. Use the deadline in the notice and verify the current applicable requirements; the cited GSTN material does not establish one universal period for scrutiny replies. GSTN form guidance. Reconcile the discrepancy to the relevant return and supporting records.
Specified demand proceedings summarized electronically Rule 142 describes DRC-01 as an electronic summary accompanying specified notices and DRC-06 as the form for a reply or representation. Check the underlying notice and the applicable provision for the response date. Rule 142’s specified 30-day payment route is not a universal reply deadline. CGST Rules, rule 142. Compare the allegations with the underlying notice and relevant tax, payment or return records.
Assessment of an unregistered taxable person under section 63 CBIC’s guidance describes the notice in ASMT-14 and a possible ASMT-15 order. CBIC’s assessment-rules guidance specifies 15 days to respond to the ASMT-14 notice. Confirm the date and current requirements in the actual notice and law. CBIC assessment-rules guidance. Address the basis for the proposed assessment with relevant records.

Rule 142 also describes DRC-03 for intimating payment in specified circumstances and DRC-04 as an acknowledgment. Under the conditions set out for certain section 73 or 74 cases, payment within 30 days may be intimated in DRC-03, followed by DRC-05 concluding the proceedings. This is a rule-specific payment route, not an instruction to pay every notice or a substitute for checking the applicable response requirements.

What should I include in the reply?

Make it easy to see which allegation each part of your response answers. A clear reply can use a numbered response that follows the notice’s sequence.

  • Position: Say whether you accept, dispute or seek clarification on the allegation.
  • Explanation: Set out the relevant facts and explain the basis for your position without adding claims you cannot support.
  • Reconciliation: Show how the disputed or accepted figures relate to the relevant returns, invoices, payments or input-tax-credit records.
  • Attachments: Include relevant documents, label each one and refer to it beside the point it supports. Avoid an unindexed bulk upload that leaves the officer to guess what matters.
  • Request or next step: Address any hearing details or document request stated in the notice, and follow the prescribed response channel.

Keep a copy of the version actually filed, all attachments and the acknowledgment. Retain the full notice and any evidence showing when and how it was served, so you can refer to the same documents if the matter continues.

Where can I see a GST notice on the portal?

GSTN material describes notices and orders in the logged-in GST Portal’s additional notices/orders area, including DRC-01. Use the portal’s current navigation and the notice’s own instructions; older GSTN material and tutorials may use labels that have since changed. Save a copy of the notice and attachments you access, and do not rely on an alert or summary in place of the complete documents.

When should I get professional help?

Ask a qualified GST practitioner or tax lawyer to review the matter promptly if it involves substantial tax, interest or penalty exposure; an allegation of fraud, wilful misstatement or suppression; multiple tax periods or registrations; conflicting reconciliations; a personal hearing; a limitation issue; or an order that has already been issued. Sections 73 and 74 distinguish proceedings based on whether fraud, wilful misstatement or suppression is alleged, so classification can materially affect how the case should be handled.
