The safest way to lower a public agency’s credit-card costs is to reduce the agency’s own fee stack—not to add a surcharge at checkout. Start with the executed processing agreement and settlement reports, identify every interchange, network, processor, acquiring, gateway and platform charge, and reconcile those charges to the contract. Then evaluate pooled procurement, contract corrections, transaction routing and payment-channel changes under the agency’s procurement, accessibility and legal requirements.

No general percentage saving can be promised. Card costs depend on transaction type, channel, card mix, contract terms and jurisdiction. Fee-shifting rules also vary sharply: Utah state policy bars certain customer charges, while Florida, Louisiana and Illinois use different statutory or approval frameworks.

What a government card-processing fee actually includes

A statement labeled “processing fee” usually combines several charges. The U.S. Government Accountability Office describes three broad components in a typical Visa or Mastercard merchant-discount fee. Treat these as a diagnostic framework, not as a universal rate card.

Component What it pays for What an agency should verify
Interchange The merchant’s bank or acquirer pays the card issuer. Network-set rates generally combine a fixed amount with a percentage of the transaction and are adjusted semiannually. Card type, transaction category, authorization method, amount, and whether the billed rate matches the applicable network and contract terms.
Network fees Generally fixed per-transaction fees set by the payment network. Per-item charges, assessment or access fees, network pass-through language, and any volume tiers in the agreement.
Processor or acquirer charges Services such as routing transactions to networks and issuers, authorization, settlement and account support. Markup, monthly or minimum fees, gateway charges, support fees, chargeback terms, and other contracted services.

An agency may also pay for an electronic-government platform, gateway, terminal, hosted checkout, reporting module or other channel-specific service. Those costs can be easy to miss when a platform presents one blended percentage.

Why a headline percentage is not enough

Two agencies with the same nominal rate can have different effective costs because one processes many small online payments while the other handles larger in-person transactions. Fixed per-transaction charges have a greater effect on small payments. Card-not-present transactions may have different qualification and security costs than in-person transactions. A valid comparison therefore uses the agency’s own statements, contract, transaction mix and settlement data.

Build an agency fee inventory before changing anything

Do not begin by asking a vendor for a lower rate. First establish what the agency is actually paying and which charges it is legally and contractually allowed to change.

  1. Collect the source records. Gather the executed processor and acquiring agreement, amendments, cooperative-contract terms, monthly statements, gateway or government-platform invoices, settlement reports, chargeback reports and accounting entries for at least a representative period. Include online, in-person, telephone, recurring and mobile channels if the agency uses them.
  2. Normalize the charges. Create a line-by-line schedule with the transaction date, channel, card or payment category when available, gross amount, interchange, network fee, processor markup, gateway or platform fee, monthly fee, adjustment and settlement amount. Separate fixed charges from percentage charges.
  3. Map each charge to authority. For every line, record the contract section, rate sheet, amendment or published rule that permits it. Mark charges that are pass-through network costs, negotiated processor charges, optional services or unexplained adjustments.
  4. Recalculate a sample. Select transactions from each channel and recompute the expected charge from the contract. Check rounding, minimums, tier thresholds, refunds, reversals and chargebacks. A discrepancy is a contract-compliance issue to resolve, not automatically a reason to impose a customer fee.
  5. Reconcile to the ledger. Confirm that settlements, fees, refunds and monthly entries agree with the agency’s accounting records. Investigate timing differences and unmatched deposits before drawing a cost conclusion.
  6. Document the baseline. Report total fees, fees per transaction, fees as a percentage of processed value, channel mix and service costs for the same period. Label the period and methodology so future bids compare like with like.

Utah’s control example

Utah Division of Finance policy requires agencies to review processor fees against the state cooperative contract and to record and reconcile card payments and fees monthly. That process illustrates a useful control even where another jurisdiction’s law differs: the contract and actual reports are the starting point.

Agency-side ways to reduce costs without charging residents

1. Use a pooled or state-contracted arrangement when required or advantageous

Central procurement can improve negotiating leverage and simplify compliance, but it is not automatically cheaper for every agency. Utah requires state agencies to use the state-contracted processor. Florida’s 2025 statute generally requires state agencies and the judicial branch to use a contractor selected by the Chief Financial Officer, unless an agency is authorized to use another contractor that is more advantageous.

These are state examples, not a nationwide mandate and not proof of a particular savings amount. Determine whether the agency is eligible, whether participation is mandatory, what exceptions exist, and whether local-government entities are covered. Compare the full contract price and service obligations, including platform, gateway, settlement and support charges.

2. Correct billing and enforce the existing contract

Invoice auditing can recover overcharges without changing the resident experience. Check that the processor applies the negotiated markup, network pass-throughs, minimums, equipment charges and service credits exactly as written. Require a written explanation for new fee codes or rate changes and preserve the supporting statement.

Utah’s policy expressly calls for reviewing fees against the cooperative contract and reconciling them monthly. An agency elsewhere can adopt the same operational discipline if its records, contract and retention rules permit it.

3. Compare all-in cost, not just the processor’s rate

When procurement evaluates an alternative, compare the same transaction types and channels. A lower percentage can be offset by higher fixed fees, a gateway charge, a monthly minimum, implementation work or more expensive dispute handling.

Comparison area Questions to ask
Pricing components What are the percentage, per-transaction, network, gateway, monthly, minimum and chargeback charges? Which are pass-through costs?
Transaction scope Are online, in-person, telephone, recurring, mobile, refund and reversal transactions priced separately?
Contract eligibility Can the agency use the arrangement under its purchasing rules, cooperative contract and delegation limits?
Platform dependence Is a required e-government platform or hosted checkout priced separately? Can the agency retain its existing integration?
Settlement and accounting Are deposits, reports, reconciliation files, refunds and adjustments delivered in the formats the finance system needs?
Security responsibilities Which party handles PCI-related controls, tokenization, fraud tools, incident response and audit support?
Implementation burden What staff time, testing, accessibility review, training and downtime are required?
Service and exit terms What are support hours, response targets, renewal terms, termination rights, data-export provisions and equipment-return obligations?
Public access Will the proposed arrangement preserve language access, disability access, receipt options and reasonable channels for residents who cannot use a particular method?
Legal authority Does the agency have authority to use the arrangement and to impose any fee associated with it?

4. Improve transaction routing and data quality

Ask the processor and procurement team whether the agency’s current setup is causing avoidable downgrades, duplicate authorizations, unnecessary retries or failed settlements. Review address and security-data handling, terminal configuration, recurring-payment tokens and refund workflows only within the agency’s security and privacy requirements. The objective is accurate qualification and fewer failed or duplicated transactions, not simply routing every payment to a cheaper-looking category.

Any change should be tested with representative transaction types and monitored after deployment. A routing change that increases declines, manual work or resident contacts can raise total cost even if the statement rate falls.

5. Evaluate other payment channels as a service decision

ACH, checks, in-person payments or other channels may have different costs, settlement times, fraud exposure and accessibility implications. The available evidence does not establish a universal no-fee method or a standard saving from steering residents away from cards. Analyze each channel using the agency’s actual costs, legal requirements, service levels and resident needs.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Do not make a card channel effectively unavailable to people who need it, and do not add a new channel merely because its provider advertises a lower unit price. Include staffing, returned payments, reconciliation, security, equipment and support in the comparison.

6. Apply a public-benefit test

Florida law directs a cost-benefit methodology for state agencies to consider quantifiable cost reductions, other agency benefits, potential impact on general revenue and nonquantifiable convenience benefits. That framework is useful beyond Florida as an analytical model: a payment option must be assessed for fiscal cost and public access, not for price alone.

Why fee-shifting rules cannot be generalized

Whether a government may impose a convenience fee or surcharge depends on the government level, state law, payment type, channel, card-network rules and the agency’s own authority. The examples below illustrate different approaches; they are not a nationwide legal summary. Obtain current advice from the agency’s counsel, finance office and procurement authority before changing checkout prices.

Jurisdiction or guidance What it says How to use the example
Utah state agencies Utah Division of Finance policy says processor fees and state e-government internet transaction fees “must not be charged to the customer”; agencies pay those expenses from their budgets. A clear state executive-branch example of agency-funded costs. It does not establish a rule for other governments.
Florida A 2025 statute encourages electronic acceptance when agency and public benefits substantiate the cost. State agencies may impose convenience fees under rules, but the total may not exceed agency cost. Specified local governments may surcharge certain statutorily prescribed revenues by an amount sufficient to cover service fees. Authority is conditional and differs between state agencies and specified local governments. Do not transplant it to another jurisdiction.
Louisiana state agencies The Treasury page states that an agency seeking a convenience fee needs a Treasury recommendation and approval by both named legislative committees. The fee must be disclosed and the payer must be allowed to cancel. Confirm current approval requirements and contract status. The page listed a merchant-services contract expiring in October 2026, so vendor details require a current check.
Illinois local governments 50 ILCS 345/25 permits a local governmental entity to impose a convenience fee or surcharge only up to the processing or discount fee incurred and only where the card’s operating rules allow it. The cap and network-condition are specific to this statute and local-government context.
GSA SmartPay guidance GSA guidance says state policies may differ and describes limits tied to a merchant’s negotiated acceptance rate, a maximum of 4%, consistency across networks, clear notice and separate receipt line-item treatment. This is guidance for merchants imposing surcharges in the GSA SmartPay context, not a complete rule for every public agency charging residents.

What the Utah quotation does—and does not—mean

Utah Division of Finance policy section F.1 states: “These fees must not be charged to the customer.” In context, the antecedent is processor credit/debit-card fees reviewed against the cooperative contract; the policy separately says internet transaction fees also “must not be charged to the customer.” The sentence should be attributed to the Utah Division of Finance policy, not to a named individual.

If a surcharge is being considered, use a legal gate before a pricing analysis

  1. Identify the exact payer and revenue. Determine whether the payment is a tax, license, fine, permit, court obligation, utility bill, service charge or another category. Statutes may treat each differently.
  2. Confirm the agency’s authority. Obtain a written determination from counsel or the responsible state authority. A processor’s ability to configure a surcharge is not legal authority to impose one.
  3. Check network and contract rules. Review operating rules, merchant agreements, cooperative-contract restrictions and any prohibition on passing through fees.
  4. Calculate the actual allowable amount. If law permits recovery only of incurred processing or discount fees, use documented agency costs—not a round number or a vendor’s maximum.
  5. Design clear disclosure and cancellation. Where required, show the fee before payment, identify it separately on the receipt and provide any required option to cancel.
  6. Test equity and access. Consider residents using mobile devices, assistive technology, limited banking access, language services or in-person assistance. Document alternatives and their costs.
  7. Monitor after launch. Reconcile collected fees to actual costs, review complaints and declines, and stop or adjust the arrangement if it exceeds authority or creates an access problem.

Common mistakes that increase cost or legal risk

  • Using an industry-average rate as the agency’s baseline. Interchange, network and processor components vary by transaction and contract.
  • Comparing only percentages. Fixed fees, gateway charges, minimums and service costs can reverse the apparent ranking.
  • Assuming a state rule covers local government. Utah’s executive-branch policy, Florida’s statute, Louisiana’s approval process and Illinois’s local-government provision have different scopes.
  • Treating a 4% figure as a normal fee or savings target. In GSA SmartPay guidance, 4% is a maximum surcharge limit in the described context, not an average processing cost or measured saving.
  • Calling a vendor configuration a compliance decision. The agency must establish authority before asking a processor to activate a surcharge.
  • Ignoring the platform layer. A processor quote may omit required e-government, gateway or reporting charges.
  • Changing channels without measuring service effects. Returned ACH payments, manual checks, staffing, accessibility support and slower settlement all have costs.
  • Failing to preserve an audit trail. Keep the contract, fee schedule, invoices, calculations, approvals, notices and post-implementation reviews together.

A practical 90-day implementation plan

Days 1–30: establish the baseline

  • Assign finance, procurement, information security, accessibility, legal and program owners.
  • Collect contracts, statements, settlements, platform invoices and transaction data by channel.
  • Build the fee inventory and identify unexplained or noncontract charges.
  • Document current resident-facing prices, notices, refund practices and available payment methods.

Days 31–60: test options

  • Ask the contracting authority whether a pooled or state arrangement is mandatory or available.
  • Request written explanations and credits for billing discrepancies.
  • Model all-in costs for the current arrangement and any eligible alternatives using identical transaction samples.
  • Evaluate routing, integration, settlement, security, accessibility and implementation impacts.
  • Obtain a legal determination before considering any convenience fee or surcharge.

Days 61–90: approve, implement and monitor

  • Select the option that meets procurement, legal, security, accessibility and public-service requirements—not merely the lowest quoted rate.
  • Complete testing, reconciliation, receipt and disclosure review before production.
  • Train staff on refunds, disputes, outages and resident questions.
  • Track fee per transaction, total cost, declines, refunds, settlement exceptions and complaints against the documented baseline.
  • Schedule recurring invoice reviews and a formal contract-performance review.

How to report the result honestly

Report the measured period, transaction volume, payment value, channels, fee categories, one-time implementation costs and recurring service costs. Separate a billing recovery from an ongoing rate reduction. State whether a result came from correcting an invoice, changing a contract, changing transaction mix or reducing service usage.

The available official material does not establish a dependable general savings percentage for switching processors, renegotiating, routing transactions or changing channels. A credible public report should therefore publish the agency’s before-and-after figures and assumptions rather than promise a standard reduction.

Key takeaways for procurement and finance teams

  • Start with the executed agreement and actual statements.
  • Separate interchange, network, processor/acquirer and platform charges.
  • Use pooled procurement where the agency is eligible and the full terms are advantageous.
  • Audit invoices and reconcile monthly or on the schedule required by policy.
  • Compare all-in cost and public-service effects across identical transaction types.
  • Treat ACH, checks and other channels as options for local analysis, not guaranteed savings.
  • Never assume another state’s convenience-fee authority applies to your agency.
  • Remember that a surcharge cap—such as the 4% maximum described in GSA SmartPay guidance—is a legal limit in a particular context, not a savings estimate.
