Redaction is not simply drawing a black box over a name. Before publishing a government record, first decide which disclosure law and exemption apply, remove only information that may lawfully be withheld, preserve reasonably releasable material, and verify that the exported file contains no hidden copy of the redacted data. The correct workflow depends on jurisdiction: UK GDPR and Freedom of Information practice is different from U.S. federal FOIA processing.

Start with the authority, jurisdiction and disclosure route

Write down the agency, country, record system, disclosure process and intended audience before opening an editing tool. A document posted on a public website may require a different review from a record sent to one requester. Agency policy, court orders, sector-specific secrecy laws and records schedules can add requirements that a general checklist cannot replace.

United Kingdom: ICO guidance is a UK-GDPR-oriented starting point

The Information Commissioner’s Office published guidance on checking documents for hidden personal information before public disclosure on 31 July 2025. It addresses online publication and public-authority Freedom of Information responses, and is written for organisations processing personal information under the UK GDPR. The ICO says the page is under review following the Data (Use and Access) Act and that it does not cover every issue that must be considered before disclosure. Treat it as practical guidance, then check the current law and your authority’s policy before release.

United States: federal FOIA is a separate framework

For a U.S. federal record, use the agency’s FOIA procedures and the federal statute rather than importing UK terminology. The Department of Justice explains that an agency may withhold information only when it reasonably foresees harm to an interest protected by a FOIA exemption or when disclosure is prohibited by law. Agencies should not withhold material merely because it could cause embarrassment or because harm is speculative. The presumption of openness still operates alongside exemptions for personal privacy and other protected interests.

Public posting and an individual response are not identical

Decide whether the file will be placed on an unrestricted website, released to a particular requester, or shared through a controlled portal. The audience, authentication, statutory deadline and applicable exemptions can change the analysis. Do not assume that a record safe for one requester is suitable for unrestricted publication.

Redaction begins with a legal disclosure decision

Identify personal information and other potentially protected content, then determine whether a statute, regulation or valid exemption actually permits or requires withholding it. A blacked-out passage is not evidence that the passage was legally exempt. Record the legal basis for every category you remove.

Apply a specific harm or exemption test

Under U.S. federal FOIA, document the exemption and the reasonably foreseeable harm that disclosure would cause, unless another law prohibits release. A person’s name is not automatically removable: context, sensitivity, the person’s role, the public interest and the applicable privacy exemption matter. Avoid a blanket rule such as “remove every personal detail.”

Preserve reasonably segregable information

Federal FOIA requires agencies to provide reasonably segregable portions after exempt material is deleted. Read each page and field for releasable facts that can stand on their own. Remove a full paragraph only when the remaining words would be meaningless, misleading or still reveal the protected information. Explain in the review record why a larger deletion was necessary.

Separate first-party Privacy Act issues from third-party FOIA requests

FOIA and the Privacy Act are different federal statutes. The DOJ explains that a first-party request for records about the requester may need processing under both laws, while a third-party request for those records is processed under FOIA. The interaction is fact-specific; send unusual cases to the agency’s privacy or disclosure counsel rather than treating the two statutes as interchangeable.

The complete pre-publication workflow

  1. Open a disclosure file. Assign a tracking number, identify the responsible authority and record custodian, note the intended audience and publication date, and list every law, regulation, exemption and agency policy that may apply.
  2. Preserve the original. Make a read-only copy of the source file. Keep its filename, format, creation details and chain of custody. Perform all edits in a working copy so the released version can later be compared with the original.
  3. Inventory every component. List pages, attachments, appendices, images, tables, spreadsheet tabs, embedded objects, comments, tracked revisions, formulas and linked files. A review limited to the visible first page is incomplete.
  4. Find candidate information. Search for names, addresses, telephone numbers, email addresses, identification numbers, signatures, dates of birth, account details, health or employment information and information about vulnerable people. Also inspect free-text notes and images, where a single combination of facts can identify someone even without a name.
  5. Test each candidate against the disclosure rule. For every proposed deletion, write the legal provision, the protected interest, the foreseeable or statutory harm and why release is not allowed. Consider whether consent, an existing public source, an official role or the public interest changes the result.
  6. Design the least-restrictive release. Mark only the characters, cells, rows or pages that must be withheld. Preserve dates, totals, explanations and other non-exempt material that can be understood without the protected part. If a field can be generalized without identifying a person, ask counsel whether that is preferable to deleting the entire field.
  7. Create a secure redaction copy. Use a method that removes the underlying content, not merely its appearance. Work in the format your agency has approved, then export to the approved release format. Do not overwrite the original or rely on a screen view as proof of deletion.
  8. Apply release markings. For U.S. federal FOIA, ordinarily show the amount deleted and the exemption asserted on the released record and, when technically feasible, indicate the deletion at its location. DOJ describes blacking out, brackets, outlining or boxing as possible visible methods. A narrow exception applies when a marking would itself harm a protected interest.
  9. Inspect hidden data and the final file. Close and reopen the exported file in a separate viewer. Search, copy and paste around every redaction; inspect document properties, comments, revision history, hidden rows and columns, formulas, alternate sheets, embedded objects and image layers. Check that an accessibility or text-extraction view does not expose deleted text.
  10. Run an independent quality check. A second reviewer should compare the source, working copy and exact released file, confirm each legal basis, test representative searches and verify that page numbering, attachments and markings are correct. Resolve discrepancies before publication.
  11. Release the exact checked output. Upload or transmit only the verified file. Confirm that the web content-management system has not generated a preview, text transcript or thumbnail from the unredacted original. Remove superseded public copies according to policy.
  12. Retain a defensible review trail. Keep the original, working copy, final released copy, redaction log, legal analysis, reviewer names, quality-check result and publication details under the agency’s records policy. The cited ICO and DOJ materials do not prescribe one universal retention period, so use the schedule and legal-hold rules that govern your authority.

How to check common file types for hidden personal information

Word-processing documents and PDFs

Review comments, footnotes, endnotes, tracked changes, headers, footers, bookmarks, document properties and embedded files. A visible rectangle can leave selectable text beneath it. After producing the release PDF, try selecting and copying text underneath each mark, search for a distinctive redacted phrase, and inspect the file in a text-extraction view. If any hidden text appears, return to the source and create a new release file using the approved secure-redaction process.

Spreadsheets

Check every worksheet, including hidden or very narrow tabs, rows and columns. Inspect formulas, cell comments, named ranges, filtered-out records, pivot-table caches, charts and external links. A cell that looks blank may still contain a value that appears when copied or unhidden. Delete or securely redact the underlying cell content where required, then test the exported workbook or PDF in a separate session.

Scanned pages and images

Inspect the image itself and any OCR text layer. A mark painted over an image may not remove a separate searchable text layer, and an image can contain a handwritten signature or identifying detail outside the obvious paragraph. Re-render and test the final file rather than assuming that flattening a view made the information unrecoverable.

Attachments and generated previews

Open each attachment independently and apply the same review. Check whether a publishing platform creates HTML, CSV, thumbnail or accessibility versions. The version that readers can download, search or copy is the version that must pass the final test.

Marking deletions in a U.S. federal FOIA release

DOJ’s segregation and marking guidance, issued in 2008 and updated 11 June 2025, describes ordinary practices for communicating deletions. The release should ordinarily identify how much material was withheld and which exemption supports the withholding. When technically feasible, show the location of the deletion on the record itself. Blacking out, brackets, outlines and boxes can make the location visible. White-out can obscure how much was removed and where, so it is a poor choice for a release copy.

Do not expose a protected interest merely to explain a deletion. DOJ recognizes a narrow situation in which the marking itself could cause harm; follow current agency instructions and obtain legal advice when that exception may apply. The marking convention is a transparency aid, not a substitute for the exemption analysis or the segregability review.

UK and U.S. federal approaches compared

Issue UK practice described by the ICO U.S. federal FOIA practice described by DOJ
Primary framework UK GDPR-oriented personal-information processing and disclosure practice, including public-authority FOI work Federal FOIA, with separate Privacy Act considerations for records about individuals
Current source status ICO guidance published 31 July 2025; the page says it is under review after the Data (Use and Access) Act Segregation and marking guidance updated 11 June 2025; foreseeable-harm guidance discusses the 2022 Attorney General FOIA Guidelines
Withholding test Determine whether disclosure is lawful under the applicable UK rules and whether personal information must be protected Withhold only when harm to a protected interest is reasonably foreseeable or disclosure is prohibited by law; do not rely on speculation or embarrassment
Partial release Check what can lawfully be disclosed and use an appropriate disclosure format Provide reasonably segregable nonexempt portions after deleting exempt material
Deletion marking The reviewed guidance stresses secure checking and an appropriate format rather than one universal marking label Ordinarily indicate the amount deleted and exemption, and show the location when technically feasible
Hidden-data review Explicitly check documents and spreadsheets for hidden personal information before disclosure Inspect the actual release output and apply agency FOIA procedures, including segregation and marking requirements

These are jurisdiction-specific descriptions, not a combined international checklist. Do not transfer a U.S. exemption label to a UK release or assume that an ICO recommendation supplies authority for a U.S. deletion.

Failure modes that expose agencies to avoidable risk

  • Editing before deciding. A reviewer blacks out names first and searches for a legal reason later. Fix: complete the exemption and harm analysis before altering the file.
  • Redacting the screen, not the data. A rectangle, highlight or annotation hides words visually but leaves them selectable. Fix: create a file in which the underlying content has been removed, then test it outside the editing application.
  • Deleting too much. An entire page disappears even though dates, totals and policy explanations were releasable. Fix: apply the reasonably segregable standard where U.S. FOIA governs and document why any larger deletion was necessary.
  • Ignoring spreadsheets and attachments. The main PDF is clean, but a hidden worksheet or original attachment contains names. Fix: inventory every component and test each final download.
  • Relying on white-out. The release does not show the amount or position of the deletion and may still contain recoverable content. Fix: use the agency-approved method and the visible marking approach required for the jurisdiction.
  • Using a generic privacy rule. Every name is removed even when the person acted in an official capacity or the law requires release. Fix: assess context, exemption, foreseeable harm and public interest individually.
  • Publishing a preview generated from the original. A content-management system exposes text in search results or accessibility files. Fix: verify every representation the platform creates, not only the uploaded attachment.
  • Keeping no decision trail. The agency cannot explain why a field was withheld or which copy was released. Fix: retain the legal analysis, redaction log, quality check and exact released file under policy.

A practical release checklist

Before editing

  • Jurisdiction, authority, process and audience are recorded.
  • Applicable disclosure law, exemption and agency policy are identified.
  • The untouched original is preserved.
  • Pages, tabs, attachments, images and embedded objects are inventoried.

During review

  • Each candidate deletion has a documented legal basis.
  • Personal information is distinguished from information that is merely inconvenient or embarrassing.
  • Reasonably releasable material is preserved.
  • Hidden content, metadata and alternate representations are inspected.

Before publication

  • The approved secure-redaction method has removed underlying content.
  • Required exemption and deletion markings are present.
  • A second reviewer has tested search, copy, extraction and download behavior.
  • The exact released file, not the source or working copy, is the file being uploaded.

When to escalate the review

Stop and obtain specialist advice when the record involves children, health information, witness or victim safety, intelligence, national security, an active investigation, conflicting statutory duties, a requester’s own records, or a proposed bulk publication. Escalation is also appropriate when the agency cannot determine whether a field is reasonably segregable or when the publishing system creates uncontrolled copies. The ICO page itself warns that its guidance does not cover every disclosure issue, and U.S. federal agencies apply their own FOIA and Privacy Act procedures.

Keeping the guidance current

Check the current ICO page and your agency policy immediately before publication because the ICO guidance is expressly under review. For U.S. federal work, confirm the latest DOJ instructions, including the 11 June 2025 update to segregation and marking guidance, the 2022 Attorney General foreseeable-harm guidelines discussed by DOJ, and the 15 September 2022 FOIA/Privacy Act interface guidance. A sound procedure is one that is legally current, reproducible by another reviewer and tested against the exact file the public will receive.

Frequently Asked Questions

Can I use a black rectangle to redact a PDF?

Only if your approved process removes the underlying text or image data as well as covering it visually. Reopen the exported file in a separate viewer and test selection, search and text extraction before release.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Should every person’s name be removed from a government record?

No. Whether a name is withheld depends on the governing law, the person’s role, the context, the applicable exemption and the harm from disclosure. A blanket rule can delete information that should remain public.

What should I do when a spreadsheet has hidden tabs?

Treat every tab, hidden row and column, formula, comment, chart and linked object as part of the record. Review and securely remove protected content, then test the exact workbook or converted file that readers will receive.

Does the Privacy Act replace FOIA for a requester’s own records?

No. DOJ explains that a first-party request may require processing under both statutes. The correct route depends on the request and the agency’s procedures, so unusual cases should receive privacy or disclosure counsel review.
