First identify the reason for reversal: later payment to a supplier under Rule 37 and a supplier’s later GSTR-3B filing under Rule 37A are different cases. CBIC’s reporting guidance places a qualifying reclaim in GSTR-3B Table 4(A)(5) and also Table 4(D)(1).
Start by identifying why the ITC was reversed
A later event does not make every reversed credit eligible again. CBIC distinguishes conditionally reclaimable reversals from absolute or otherwise non-reclaimable reversals. The latter do not become reclaimable merely because circumstances change. Check the legal basis recorded for the original reversal and whether the applicable condition has been fulfilled before entering a reclaim.

The two common routes covered here have different triggers:
| Issue | Rule 37 | Rule 37A |
|---|---|---|
| Reason for reversal | Recipient did not pay the supplier the supply value plus tax within 180 days from the invoice date. | Supplier furnished invoice or debit-note details in GSTR-1 or through IFF but had not furnished the corresponding GSTR-3B by the rule’s specified checkpoint. |
| Condition for re-availment | Recipient later pays the supplier the value and tax. | Supplier subsequently furnishes the corresponding GSTR-3B. |
| GSTR-3B reporting of a qualifying reclaim | Table 4(A)(5) and also Table 4(D)(1), under CBIC Circular 170/02/2022-GST. | Table 4(A)(5) and also Table 4(D)(1), under CBIC Circular 170/02/2022-GST. |
Reclaim after paying the supplier under Rule 37
Rule 37 applies when a recipient has availed ITC on an inward supply but does not pay the supplier the value of the supply plus tax within 180 days from the invoice date, as referenced in the second proviso to section 16(2) of the CGST Act. The reversal is proportionate to the amount left unpaid; if only part of the amount remains unpaid, the rule does not automatically require reversal of the full invoice credit. The reversal is added to output tax liability, with interest treatment governed by the rule. See CBIC’s CGST Rules.

If you later pay the supplier the value and tax, Rule 37 permits re-availment in a return, subject to the other applicable ITC eligibility conditions and time limits. Reconcile the invoice-level credit originally taken, the amount unpaid, the portion reversed, and the later payment before calculating what you propose to re-avail. Keep records that support those figures and the payment. This is prudent reconciliation practice, not a universal statutory document checklist established by the cited rule.
Reclaim after the supplier files GSTR-3B under Rule 37A
Rule 37A addresses a supplier-return filing issue, not non-payment to the supplier. It applies where the supplier furnished invoice or debit-note details in GSTR-1 or through the Invoice Furnishing Facility (IFF), but had not furnished the corresponding GSTR-3B by 30 September following the end of the financial year in which the recipient availed the ITC.

In that situation, the recipient must reverse the credit in GSTR-3B on or before 30 November following that financial year. If the recipient misses that reversal deadline, the notification provides that the amount is payable with interest under section 50. If the supplier subsequently furnishes the corresponding GSTR-3B, the recipient may re-avail the credit in a later GSTR-3B tax period. The rule was inserted by Notification No. 26/2022-Central Tax.
Do not treat every supplier mismatch as a Rule 37A case: the rule concerns the stated invoice-detail and corresponding-return facts. Check the rule text applicable to the relevant year and confirm that the supplier has filed the corresponding return before reclaiming.

Where to report a reclaim in GSTR-3B
CBIC Circular 170/02/2022-GST, dated 6 July 2022, distinguishes temporary reversals that may be reclaimed after their conditions are met from reversals that are absolute or non-reclaimable. For a conditionally reclaimable reversal, its reporting guidance is:
- When reversing the credit: report the temporary reversal in Table 4(B)(2).
- After the required condition is met: report the reclaim in Table 4(A)(5), and also show all such reclaimed ITC in Table 4(D)(1).
Do not report the reclaim only in Table 4(D)(1), or treat it as a new invoice credit. The circular describes Table 4(B)(1) for absolute or non-reclaimable reversals and ineligible ITC, including examples under Rules 38, 42 and 43 and section 17(5). It describes net ITC available in Table 4(C) as Table 4(A) minus Table 4(B)(1) and Table 4(B)(2). Consult CBIC Circular 170/02/2022-GST and check the current portal instructions and validations for the return period, as the interface may change.

Practical checks before filing
- Confirm the original reversal reason and the rule or provision under which it was made.
- For Rule 37, verify the invoice date, the unpaid amount, the proportion reversed and the later payment of value plus tax.
- For Rule 37A, verify the supplier’s GSTR-1 or IFF invoice details, the applicable financial-year checkpoints and the subsequent filing of the corresponding GSTR-3B.
- Check that the credit remains eligible under the Act and that applicable time limits are satisfied; the rules discussed here do not resolve every possible limitation or fact-specific issue.
- Use the Table 4 reporting distinction for the correct reversal type and period, then review current portal guidance before submission.
If the original reversal was permanent, the supplier filing does not match Rule 37A’s conditions, payment or filing evidence is disputed, or the claim involves another provision, get advice from a qualified GST professional before re-availing credit.
