To check GST on an Indian garment bill, work from the item and HSN to the discounted transaction value, then verify the rate, tax amount and whether the invoice uses CGST plus SGST/UTGST or IGST. The CBIC GST Rates FAQ describes a 5% rate for readymade garments priced at or below ₹1,000 per piece and 12% above ₹1,000, using transaction value rather than retail sale price. Because a rate shown in an FAQ is not proof that the same rule applies to every 2026 supply, confirm the effective notification for the invoice date and the exact HSN before deciding that a charge is correct.

Use this five-minute check first

  1. Confirm the document: establish that it is a tax invoice, not a bill of supply, and record the seller’s legal name, address, GSTIN, invoice number and issue date.
  2. Identify the item: read the full description, HSN and quantity. The word garment by itself is not enough to establish classification.
  3. Find the taxable value: use the transaction value shown after any discount or abatement, and note the per-piece value where the rate threshold is relevant.
  4. Read the tax lines: check the percentage and rupee amount. In an intra-State sale, look for CGST and SGST/UTGST; in an inter-State sale, look for IGST and place-of-supply details.
  5. Recalculate and validate the date: multiply taxable value by the stated rate, allow for invoice rounding, and compare the rate with the notification effective on the supply date for that HSN.

A mismatch is a reason to ask for clarification, not automatic proof that a seller overcharged you. Keep the complete invoice and the classification and date facts together when requesting a correction.

Identify the document and supplier

Tax invoice versus bill of supply

A GST tax invoice is used for a taxable supply and should identify the supplier, the invoice and the taxable line items, together with the applicable rate and tax amount. A bill of supply is used for an exempt supply or by a supplier paying tax under the composition scheme. A bill of supply normally does not show GST as a separately charged amount. If a document is labelled bill of supply but also adds a GST line, ask the seller to explain which document type and tax treatment applies.

Seller and invoice fields

Record the supplier’s name, address and GSTIN exactly as printed. Then note the unique invoice number and issue date. Recipient name, address and GSTIN may appear when the transaction requires them; do not assume that a missing recipient field has the same significance in every retail transaction. Preserve the original PDF or paper bill because a later reprint can change the presentation while the invoice number and date remain the identifiers used in a review.

Why the date matters

Tax rules can change by notification. The date on the invoice is an essential starting point, but the applicable rule must be checked against the effective date of the relevant GST notification and the actual supply circumstances. This is particularly important for invoices issued in 2026, because the CBIC rate pages that state the ₹1,000 threshold do not by themselves establish the effective rate for every 2026 supply date.

Check the garment description and HSN

Read the actual item, not just the category label

Start with the line-item description: for example, a shirt, trousers, knitted sweater, school uniform or another specific article. Note the material or construction information when printed, the quantity and the unit price. A generic entry such as apparel or garments leaves classification questions unresolved and is worth querying if the tax rate depends on the item.

Use the HSN shown on the invoice

The HSN is the classification reference that connects the item to a rate entry. CBIC’s rate table separates knitted or crocheted apparel in chapter 61 from other apparel in chapter 62. That distinction means two clothing lines that look similar to a shopper can fall under different classification entries. Do not replace the invoice HSN with a code found in a generic online list; first ask the supplier why its code was selected and verify the current notification for that code.

Compare two line items separately

If one invoice contains several garments, inspect each line’s description, HSN, quantity and taxable value. Do not apply a single rate to the entire bill merely because all items are sold by a clothing shop. A mixed invoice can contain different classifications or values, and the tax should be traceable to the individual taxable lines.

Find the taxable transaction value

Start with the value after the displayed discount

Locate columns labelled taxable value, assessable value, net value or a similar term. Check whether a line discount, invoice-level discount or other abatement has already been deducted. For a rate threshold expressed per piece, divide the relevant net transaction value by the quantity only when the invoice clearly applies one combined value to identical pieces; otherwise use the per-piece amount shown by the seller. Keep the discount notation because it explains why the tax base differs from a tag or catalogue price.

Do not substitute MRP for transaction value

The CBIC GST Rates FAQ’s answer 33 says that the sale value in the garment entries refers to the transaction value and not the retail sale price of the readymade garment. Thus, a marked retail price is not automatically the figure to which the threshold is applied. Use the value actually charged in the taxable transaction, subject to the valuation and discount details on the invoice.

Check quantity, unit and rounding

Confirm that the quantity is expressed in pieces or another appropriate unit and that the line extension equals quantity multiplied by the unit value after the stated discount. Small differences can result from rounding each line separately or rounding only the invoice total. A difference of a few paise is not the same as applying a different percentage; compare the calculation method before alleging an incorrect rate.

Intra-State supply: CGST plus SGST or UTGST

When the place of supply and the supplier’s location make the sale intra-State, the invoice may split the total GST into Central GST (CGST) and State GST (SGST), or Union Territory GST (UTGST). The two components normally add to the stated total rate. For example, a displayed 5% total may appear as CGST 2.5% and SGST/UTGST 2.5%, with each rupee amount calculated on the same taxable value.

Inter-State supply: IGST

For an inter-State supply, look for an Integrated GST (IGST) line rather than separate CGST and SGST/UTGST lines. CBIC invoice guidance requires the place of supply and the State name or code for an inter-State supply. Check that those details describe where the supply is treated as taking place and that the IGST percentage equals the total rate being applied.

Supply treatment Tax lines to expect Details to inspect
Intra-State CGST plus SGST, or CGST plus UTGST Both component rates and amounts; supplier and place-of-supply information
Inter-State IGST IGST rate and amount, place of supply and State name or code

The tax amount must be visible

CBIC’s sectoral FAQ states that showing the tax amount separately on the face of a tax invoice is mandatory under section 33 of the CGST Act, 2017. If a tax invoice provides only a higher total price with no rate or tax amount, ask the seller for a compliant invoice or a written explanation of the document type.

What the CBIC FAQ states

The CBIC GST Rates FAQ cited for garment entries states 5% for readymade garments with a sale value not exceeding ₹1,000 per piece and 12% for a value above ₹1,000 per piece. Its examples use a wholesaler’s ₹950 transaction taxed at 5% and a retailer’s ₹1,100 sale taxed at 12%. The FAQ expressly says that the threshold uses transaction value, not retail sale price.

Transaction value per piece in the FAQ examples FAQ rate Illustrative tax on one piece
₹950 5% ₹47.50
₹1,100 12% ₹132

These figures illustrate the FAQ’s rule and arithmetic. They are not a guarantee that the same rates apply to every later invoice.

Confirm the effective notification for the invoice date

Rate tables and FAQs can remain online after a later notification changes a rate, threshold, exemption or classification. The official rate material available for this guide does not conclusively establish the effective garment threshold and rate for every invoice date in 2026. Before calling a charge right or wrong, check the Gazette or CBIC rate notification that was effective on the supply date, and match the notification’s wording to the invoice HSN and garment description. If you cannot establish both the date and classification, describe the result as provisional rather than definitive.

Do not infer a rate from the shop’s location

The rate percentage and the CGST/SGST or IGST mechanism are separate questions. A change from intra-State to inter-State treatment changes the tax lines, not necessarily the underlying garment rate. Verify classification and the date-specific rate first, then verify the supply treatment.

Recalculate the amount shown

Basic cross-check

Use this calculation for each taxable line:

Taxable value × stated GST rate = expected GST before invoice rounding.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For a ₹950 taxable value at a stated 5% rate, the result is ₹47.50. If the invoice is intra-State, a 2.5% CGST line and a 2.5% SGST/UTGST line would each be ₹23.75 before rounding. For a ₹1,100 taxable value at a stated 12% rate, the result is ₹132; an intra-State split at 6% plus 6% would be ₹66 for each component, while an inter-State invoice would show ₹132 IGST.

Investigate differences systematically

  • Recheck whether you used the taxable value after discount rather than the marked price.
  • Check whether the seller rounded each tax component or only the final total.
  • Confirm that quantity and unit value were not transcribed incorrectly.
  • Check that a surcharge, freight amount or another taxable charge was included in the stated base where the invoice rules require it.
  • Verify that the printed percentage belongs to that line and not to an adjacent item.

The arithmetic confirms whether the printed rate and base produce the printed amount; it does not, by itself, prove that the printed rate is legally applicable. That requires the HSN, transaction date and effective notification.

Compare two garment invoices or line items

When two bills appear to charge different GST, compare the controlling facts side by side rather than comparing only the final totals.

Comparison point Questions to answer Why it can change the result
Item and HSN Are the descriptions and chapter or HSN entries identical? Knitted or crocheted apparel and other apparel are separated in CBIC’s table.
Supply date Which date and effective notification apply to each bill? A later notification may change a rate or threshold.
Value per piece What is the transaction value after discount, and how many pieces are covered? The FAQ threshold is expressed per piece and uses transaction value.
Supply treatment Is each sale intra-State or inter-State, and what place of supply is printed? The tax is split into CGST plus SGST/UTGST or shown as IGST.
Calculation Does taxable value multiplied by the stated rate equal the tax amount after rounding? It identifies arithmetic or presentation errors.

What to do when the charge looks wrong

Ask the seller a fact-specific question

Send the seller the invoice number and date, the exact garment description and HSN, quantity, unit and taxable value, discount details, supplier GSTIN, your supply location, and every CGST, SGST/UTGST or IGST line. Ask which notification and classification support the rate and whether the document is a tax invoice or bill of supply. A precise question is more useful than saying only that the GST percentage seems high.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Request a corrected document when appropriate

If the seller acknowledges a wrong HSN, rate, tax amount or place-of-supply detail, request a revised invoice or other correction document that preserves a clear link to the original invoice. Keep both versions and any written explanation. Do not alter the original bill yourself.

Escalate with the complete record

If the seller cannot explain the discrepancy, give a qualified tax professional the same evidence: original invoice, payment record, product description, photographs of the label if classification is disputed, and correspondence with the seller. The available invoice guidance identifies the fields to inspect; it does not establish one universal remedy for every disagreement.

Common mistakes that produce a false GST complaint

  • Using MRP as the tax base: the CBIC FAQ refers to transaction value, not retail sale price.
  • Applying one rate to a mixed basket: inspect every HSN and line value.
  • Ignoring discounts: use the taxable value actually shown after the invoice’s discount treatment.
  • Confusing IGST with extra tax: IGST is the inter-State mechanism; it is not added on top of CGST and SGST for the same taxable line.
  • Judging a 2026 bill from an old FAQ alone: verify the notification effective on the supply date.
  • Checking only the total: a correct total can conceal a wrong line classification, while a small rounding difference can make a correct calculation look inconsistent.
  • Assuming every clothing item is covered by the same entry: the chapter 61 and chapter 62 distinction shows why the exact apparel type matters.
