To determine whether a Georgia data center is allowed at a particular site, analyze two separate approval tracks: the host city or county’s zoning entitlement and the state and federal environmental permits tied to the facility’s equipment, land disturbance, water, wastewater, and emissions. Neither track substitutes for the other. A parcel can be correctly zoned yet lack an air permit, stormwater coverage, or wastewater authorization; it can also have environmental applications underway while its local rezoning is still pending.
The reliable method is to identify the exact parcel, map its land-use rules, reconstruct every local hearing and condition, then match the proposed design to permit records and operating limits. The workflow below is designed for a proposed or existing Georgia facility, including a campus with backup generators, cooling equipment, substations, and large site-improvement work.

1. Start with the exact parcel and decision-makers
Do not begin with a project name or a mailing address. Data-center campuses may span multiple parcels, jurisdictions, or phases. Obtain the street address, county, municipality, parcel identification number, legal description, acreage, and the site plan used in applications. Confirm whether every phase is inside the same city and county; a campus crossing a city limit can have different zoning authorities and hearing records.
Recommended Free Tools
- Host jurisdiction: identify the city or county that controls zoning, site-plan review, building permits, and local noise or operating conditions.
- Parcel status: record current zoning, comprehensive-plan or future-land-use designation, overlay districts, watershed or corridor protections, setbacks, buffers, height limits, parking rules, and floodplain or wetland mapping.
- Project identity: collect the applicant’s legal name, owner, developer, engineering consultant, project name, phase number, and the date of each filing. These details prevent mixing one campus phase with another.
- Agency ownership: list the local planning department, local building and fire officials, Georgia Environmental Protection Division (EPD) program, water or sewer authority, and any federal or regional reviewing body involved.
Georgia’s Department of Community Affairs (DCA) explains that the Zoning Procedures Law gives local governments authority to use zoning to manage development activities. That means the controlling use table, map, ordinance text, and adopted conditions are local documents, not a statewide “data center permit.”

2. Determine the local zoning path
Read the ordinance’s use table and definitions before assuming a data center is industrial. A jurisdiction may list “data center,” “computer center,” “server farm,” “warehouse,” “communications facility,” or a broader industrial or utility category. The same physical use can be treated differently in different districts.
By-right use
A by-right use is permitted in the district if the proposal satisfies dimensional, parking, access, landscaping, building, and operational standards. It still needs site-plan, grading, building, fire, and utility approvals. “By right” does not waive environmental permits or authorize generators, cooling systems, or discharge outside the approved design.
Conditional or special use
A conditional or special use requires a discretionary approval, often from a planning commission, board of zoning appeals, or governing body. Read the ordinance for required findings, public notice, hearing authority, expiration dates, and conditions that can be imposed. Conditions may address hours, generator testing, noise, landscaping, setbacks, lighting, traffic, emergency access, or future expansion.

If the current district does not allow the use, the applicant must seek rezoning. Georgia law establishes a baseline notice period for an applicant-initiated rezoning: notice must be published 15 to 45 days before the hearing and identify the property, current zoning, and proposed zoning. An on-site sign must be posted at least 15 days before the hearing. Local ordinances can add notice, mailing, posting, meeting, or document requirements.
Variance and administrative relief
A variance generally addresses dimensional hardship—such as a setback, buffer, or height requirement—and does not change the underlying use entitlement. Check whether the project needs multiple variances and whether each has separate findings and appeal rights.
3. Read the local record, not just the application summary
Request or download the complete zoning docket. A staff webpage that says “approved” is not enough to establish what was approved or whether conditions were later amended.
- Locate the application, site plan, architectural elevations, landscape plan, traffic study, noise study, utility letters, and any revised submittals.
- Verify the hearing dates and compare them with the statutory 15-to-45-day publication window and the local notice rules.
- Collect newspaper notices, mailed notices, site-sign photographs, staff reports, exhibits, hearing minutes, agendas, motions, and the signed ordinance or resolution.
- Read every condition of approval and identify its responsible party, deadline, trigger, and inspection or enforcement mechanism.
- Check later amendments, extensions, administrative approvals, appeals, and expired entitlements. A preliminary approval may not authorize construction if conditions remain outstanding.
Ask the local authority for written zoning confirmation. A useful example is DeKalb County’s published process: an applicant must provide zoning confirmation and, when rezoning or a special-use permit is required, documentation that the process is active or complete. Treat a zoning-confirmation letter as evidence of the stated entitlement, not as a replacement for environmental or building permits.

4. Build an environmental-permit matrix
Georgia EPD organizes environmental programs into air, land, and watershed branches and uses the GEOS system for electronic applications and reports. Create one row for each approval, then record the project phase, permit number, applicant, status, issuing agency, design limits, monitoring duties, public-comment dates, and expiration or renewal requirements.
| Impact or activity | Records to locate | Questions to answer |
|---|---|---|
| Air emissions | Construction permit, operating permit, PSD permit, Title V application or modification, emissions calculations, permit conditions | Which engines, turbines, boilers, chillers, or other equipment are covered? What fuel, horsepower, emission limits, testing, and operating hours apply? |
| Emergency generators | Generator specifications, air-permit application, fuel-storage documents, testing limits, stack information | How many units are authorized? Are they emergency-only or allowed to operate for maintenance, demand response, or other purposes? What hours and recordkeeping apply? |
| Land disturbance | Notice of intent, erosion and sediment-control plan, local approval, inspection reports, stabilization records | What acreage is disturbed, who is the qualified professional, and what inspection and corrective-action schedule applies? |
| Industrial stormwater | National Pollutant Discharge Elimination System (NPDES) coverage, stormwater pollution-prevention plan, sampling and inspection reports | Which industrial activities and outfalls are covered? Are benchmark or visual-monitoring results available? |
| Wastewater | New-facility form, discharge permit, pretreatment approval, land-application permit, sewer-capacity letter | Is wastewater discharged to a stream, sent to a publicly owned treatment works, or land-applied? What flow, pollutants, monitoring, and limits apply? |
| Water supply | Utility availability letter, withdrawal permit, well records, cooling-water agreement | What is the source, permitted capacity, seasonal restriction, and backup arrangement? |
| Wetlands and streams | Jurisdictional determination, federal or state authorization, stream-buffer variance, mitigation documents | Will roads, pads, outfalls, or utilities affect jurisdictional waters, buffers, or wetlands? |
| Solid or hazardous materials | Fuel-storage registrations, spill plans, waste manifests, chemical inventories, relevant notices | Where are diesel, lubricants, refrigerants, batteries, and other regulated materials stored and managed? |
5. Understand Georgia air permits and PSD records
EPD describes Prevention of Significant Deterioration (PSD) permits as pre-construction permits for large construction or expansion projects in Georgia. A PSD record therefore concerns authorization before qualifying construction or modification, not merely an operating registration after equipment is installed.
Greenfield projects
For a new facility, review the SIP forms and supporting emissions calculations. Confirm that the application covers the full build-out proposed in the site plan, not only the first building. Compare the number and rating of generators, fuel type, stack parameters, hours, controls, and modeled pollutants with the architectural and electrical plans.
Existing Title V sites
Where a project modifies a Title V site, look for the GEOS Title V modification filing and the resulting permit revision. The modification may change emission units, limits, monitoring, reporting, or applicability. A facility’s older permit does not automatically authorize new generator capacity or a new phase.
Application, draft, final, and enforcement status
Label each record precisely:
- Application: the applicant’s proposal; it is not permission to build or operate.
- Draft permit: EPD’s proposed terms, usually subject to public notice and comment; it can change.
- Final permit: the issued authorization and enforceable conditions.
- Modification: a change to an existing authorization; read the revised conditions, not just the cover letter.
- Enforcement record: an alleged or established violation, settlement, penalty, or corrective action; it is separate from the permit itself.
A public advisory announcing a comment period proves that a draft or proposed action was noticed. It does not prove that EPD issued the final permit. Use EPD’s issued-air-permit search and GEOS records to verify issuance and the effective document.
6. Trace water, wastewater, and cooling systems
Cooling design determines which water approvals matter. A closed-loop system may have a different water profile from evaporative cooling, while a campus using municipal supply can create sewer-capacity and peak-demand questions even when it has no direct discharge.
Wastewater and land application
EPD states that a new wastewater facility must submit a new-facility form before the GEOS permit application. Preserve that form, the subsequent application, technical reports, and the final permit as a linked sequence. Determine whether process water, cooling blowdown, sanitary sewage, or treatment residuals are covered, and whether discharge goes to a stream, a sewer system, or a land-application site.

Stormwater and erosion control
Track construction stormwater, permanent industrial stormwater, drainage outfalls, detention structures, and erosion-and-sediment-control approvals separately. The land-disturbance approval may be local or delegated, while NPDES coverage and monitoring obligations follow state or federal program requirements. Compare the approved drainage plan with actual building pads, substations, access roads, fuel areas, and generator yards.

Water supply and capacity
Obtain written evidence of water source and capacity: utility availability, withdrawal authorization, well records, cooling-water contracts, and sewer-capacity commitments. Check whether the document covers the planned ultimate phase or only an initial building. Identify drought, seasonal, pressure, or emergency restrictions that could affect operations.
7. Evaluate noise, generators, setbacks, and community conditions
Georgia permits and local approvals may address different parts of the same impact. Read zoning conditions, building and fire documents, air-permit limits, and noise studies together.
- Generator operation: compare the permitted unit count, fuel, testing hours, startup and shutdown provisions, and any non-emergency operation with the electrical design.
- Noise: check modeled receptor locations, nighttime assumptions, generator testing, cooling fans, transformers, tonal limits, and post-construction measurement obligations.
- Setbacks and buffers: verify property lines, residential receptors, streams, wetlands, rights-of-way, and required screening from the approved plan.
- Lighting: compare photometric plans and shielding conditions with security-lighting and substation layouts.
- Mitigation commitments: treat promises in a signed approval or enforceable permit as obligations; a presentation or voluntary statement is not equivalent unless incorporated into the approval.
8. Use public databases and preserve a record set
EPD identifies GEOS, its issued-air-permit search, Georgia water-quality data in GOMAS, and EPA ECHO compliance history as useful research tools. Search by facility name, owner, address, permit number, and, where available, geographic coordinates; names can change between application and operation.
Download and date-stamp the records you rely on. Preserve:
- every application version and attachment;
- draft and final permits, including appendices and maps;
- monitoring, inspection, discharge, and emissions reports;
- public advisories, comment deadlines, submitted comments, and agency responses;
- enforcement notices, settlements, and proof of corrective action;
- local agendas, minutes, signed ordinances, site plans, and conditions.
For a public-comment review, record the opening and closing dates, submission method, hearing date, agency contact, and whether the final permit changed in response. A late comment may not be considered, and a comment period for one permit does not automatically cover another permit for the same campus.
9. Check regional review and statewide building codes
Developments of Regional Impact (DRIs) are large-scale developments likely to have effects beyond the local-government jurisdiction where they are located. DRI review improves communication among affected governments, but the host local government retains final decision authority. Determine whether the project meets the applicable DRI thresholds and whether a regional review record exists. Do not treat a DRI finding as zoning approval or an environmental permit.

Georgia’s mandatory statewide construction codes still apply after land-use approval. The required code set includes building, fire, plumbing, mechanical, fuel-gas, electrical, and energy codes. Confirm the code edition adopted for the permit date with the local building official, then track plan review, fire-protection design, certificates of occupancy, and inspections separately from zoning and EPD records.

When evaluating alternatives, score each proposal against the same questions rather than comparing permit counts alone.
| Comparison category | Evidence to compare |
|---|---|
| Zoning entitlement | By-right, conditional, special use, rezoning, variance, hearing status, conditions, and expiration |
| Air profile | Emission units, generator count and fuel, PSD or Title V pathway, limits, monitoring, and operating hours |
| Water pathway | Cooling source, projected demand, wastewater destination, discharge or land-application authorization, and sewer capacity |
| Stormwater and land disturbance | Disturbed acreage, outfalls, NPDES coverage, erosion-control approvals, inspections, and stabilization deadlines |
| Neighbors and operations | Setbacks, receptors, noise controls, lighting, traffic, generator testing, and enforceable mitigation |
| Transparency and timing | Public notices, comment windows, hearing records, permit status, unresolved applications, and appeal or enforcement exposure |
11. Common mistakes and how to correct them
“The parcel is industrial, so the data center is approved.”
Industrial zoning may exclude data centers, require a conditional approval, or impose use-specific standards. Read the definition and use table, then obtain written confirmation.
“A permit application means construction can start.”
An application is a proposal. Confirm the final issued permit, effective date, approved plans, and any construction restrictions before treating it as authorization.
“The public notice is the permit.”
A notice starts or announces a process. Locate the final permit or signed local action and compare it with the noticed proposal.
“One stormwater approval covers the whole campus.”
Phases, outfalls, acreage, and operators can change. Match coverage to the exact phase and site boundary.
“The generator schedule is just an engineering detail.”
Generator count, fuel, stack design, and testing hours can drive air-permit applicability, noise, fire review, and local conditions. Reconcile the electrical one-line, equipment list, air application, and zoning plan.
Best Value
“A 2026 moratorium is already law.”
A 2026 legislative PDF identified as H.B. 1012 contains language defining “data center” and proposing a temporary restriction on local permits, but a signed enactment and effective-date record were not verified. Confirm the current Georgia Code and the signed-legislation record before relying on any moratorium or permit restriction.
12. A field checklist for a defensible conclusion
- Write down the parcel IDs, jurisdiction boundaries, current zoning, comprehensive-plan designation, and overlays.
- Classify the use as by-right, conditional, special, rezoning-dependent, variance-dependent, or prohibited under the local ordinance.
- Reconstruct notices and hearings, including the 15-to-45-day publication baseline and 15-day sign requirement for applicant-initiated rezoning.
- Obtain the signed zoning action, approved plans, conditions, amendments, and expiration information.
- List every environmental approval required for air, generators, land disturbance, stormwater, wastewater, water supply, wetlands, streams, and regulated materials.
- For each item, label application, draft, final, modification, monitoring, and enforcement records separately.
- Compare permit conditions with the actual design: equipment count, fuel, hours, emissions, cooling water, discharge, noise, setbacks, lighting, and mitigation.
- Check DRI status, statewide building-code permits, fire review, utility capacity, and certificates of occupancy.
- Record open comment periods, unresolved conditions, appeals, violations, and the agency or department responsible for the next decision.
You can conclude that a site is presently supportable only when the local entitlement covers the proposed use and design, required environmental permits are issued or clearly identified as prerequisites, and the plans do not exceed the conditions in those approvals. If any item remains an application, draft, missing authorization, or unverified legislative restriction, describe it as pending rather than approved.
Frequently Asked Questions
Does Georgia have one statewide data-center zoning permit?
No. Zoning is controlled by the host city or county under its ordinance, map, use table, and discretionary procedures. State and federal environmental permits are separate approvals.

For an applicant-initiated rezoning, the statutory baseline is publication 15 to 45 days before the hearing, with an on-site sign at least 15 days before the hearing. Local rules may require more.
Where can I verify that an air permit was actually issued?
Use Georgia EPD’s GEOS records and issued-air-permit search. Distinguish the application and draft permit from the final issued permit and any later modification.
What should I do if a project’s design differs from its permit?
Compare the approved plans and permit conditions with the equipment list, generator schedule, cooling system, discharge plans, noise controls, and site layout. Ask the issuing agency whether a modification or new authorization is required.
