For FDA-regulated packaged foods in the United States, read the full ingredient list and any nearby “Contains” statement; then check for voluntary cross-contact warnings such as “may contain.” Ingredient and “Contains” declarations identify major allergens used as ingredients, while advisory wording signals possible unintended presence and is not a quantified measure of risk. Check the package every time you buy it.
Read the ingredient list and “Contains” statement together
- Read the entire ingredient list. An allergen source may appear in parentheses after an ingredient—for example, “lecithin (soy),” “flour (wheat),” or “whey (milk).” Sometimes the ingredient’s common name already identifies its source; “buttermilk,” for instance, identifies milk.
- Look for a nearby “Contains” statement. A manufacturer may identify major allergen sources there instead of repeating each one in parentheses. FDA guidance says that if a company uses this statement, it should include all major allergen sources used as ingredients in the food.
- Check for specificity where required. A “Contains” statement must identify the specific tree nut, fish species, or Crustacean shellfish species—not just the broad category.
- Pay attention to unfamiliar ingredient names. The source may not be obvious from the ingredient’s name alone, so do not rely only on a quick scan for familiar allergen words.
A “Contains” statement is another way to declare allergen sources, not a substitute for reading the ingredient list. FDA consumer guidance and its January 2025 industry guidance describe these labeling routes and requirements.

- Sesame
Sesame became the ninth major food allergen under the FASTER Act, with its labeling requirement taking effect on January 1, 2023. FDA notes that older products may remain in circulation and may not list sesame as an allergen. The agency also expects sesame to be identified when it is part of another ingredient, such as a natural flavor or spice mix.

Understand “may contain” and similar warnings
Statements such as “may contain [allergen]” or “produced in a facility that also uses [allergen]” are voluntary advisory statements. They alert consumers to possible unintended allergen presence caused by cross-contact, such as in shared facilities, equipment, or production lines. They are not declarations that the allergen is an intended ingredient.
FDA says advisory statements must be truthful and not misleading, and they do not replace current good manufacturing practices or food allergen preventive controls. FDA also says it is not appropriate to use an advisory statement for the same major allergen already declared as an ingredient or in a “Contains” statement, because that can mislead consumers.

The cited FDA materials do not establish a standardized scale for comparing phrases such as “may contain” and “made in a facility.” Do not read one wording as a quantified risk rating or assume that a particular phrase means a product is safer than another.
Interpret allergen-free claims cautiously
FDA says there are no regulations defining specific conditions for a product to make a “free” claim for a major allergen. Any voluntary claim must be truthful and not misleading. FDA says a product should not pair an allergen-free claim with an advisory statement for the same allergen—for example, “milk-free” alongside “may contain milk.”

Recheck the package on every purchase
Ingredients can change, so FDA advises checking the label each time you buy a product, even if you have bought it before. Long shelf lives and existing stock can also mean packages reflecting older labeling requirements remain in circulation for a period of time.

This guidance concerns packaged foods regulated by the FDA in the United States. It does not automatically apply to every food, every country, or every product category. FDA notes that poultry, most meats, certain egg products, and most alcoholic beverages are regulated by other federal agencies. Certain foods packaged at the point of purchase after a customer’s order are also outside the described FALCPA requirements. Do not assume restaurant items, other unpackaged foods, or products sold outside the United States follow the same rules.
