How to Read a GST Demand Notice: Amounts, Deadlines and Next Steps (India)

A GST demand notice is not self-explanatory, and a form summary is not proof that the amount is correct. First establish whether you received a proposed demand or a confirmed order. Then reconcile tax, interest, penalty and other amounts with the detailed notice, locate the response or appeal date printed in the operative document, and file the correct response with indexed evidence. Rule 142 uses DRC-06 for replies to covered notices; a DRC-07 summary relates to an order and recovery, not an initial proposal.

1. Identify exactly what you received

Start with the heading, form number, issuing authority, document date, service or communication date, tax period and statutory provision cited. The same subject can appear at several procedural stages, and the next action changes at each stage.

Document or form What it generally represents What you should do
DRC-01 Electronic summary accompanying a specified show-cause notice or demand notice under Rule 142. Read the full notice and annexures, then prepare a point-by-point reply in the form and by the date stated there.
DRC-02 Summary of a statement issued under the specified section 73(3) or 74(3) process. Match every figure and allegation to the underlying statement and tax period.
DRC-06 Reply or representation form for notices covered by Rule 142. Use it when the notice and portal require it; upload the complete response and evidence, not only a short explanation.
DRC-07 Summary of an adjudication order. Rule 142 treats the order summary as a notice for recovery. Check appeal rights and recovery consequences immediately. It is not equivalent to an initial DRC-01 summary.
DRC-01A In covered situations, a pre-notice communication of amounts ascertained by the officer. Part A communicates the amount; Part B permits a submission or partial payment. Determine whether the communication is still pre-notice and whether any payment or response changes the later proceeding.
DRC-03, DRC-04 and DRC-05 DRC-03 intimates payment in the situations covered by the rule; DRC-04 acknowledges it; DRC-05 records conclusion of proceedings in the specified early-payment situation. Keep the payment reference and acknowledgement with the notice file. A form’s presence alone does not establish that liability is final.

Rule 142 also provides for uploading a summary of a specified order in DRC-07. Its wording is explicit: “The order referred to in sub-rule (5) shall be treated as the notice for recovery.” That is why an order requires a different response strategy from a proposed demand.

2. Decide whether the liability is proposed or already adjudicated

Proposed demand or show-cause notice

A show-cause notice explains what the officer proposes to recover and why. You normally respond with facts, documents and legal submissions, and you may request a hearing where appropriate. The amount in a DRC-01 summary is therefore an allegation to be examined, not an automatic admission.

Adjudication order or DRC-07

An order records the officer’s decision after the adjudication process. A DRC-07 summary can trigger recovery treatment. Your immediate task is to verify the appeal forum, statutory period, pre-deposit and filing method from the actual order and the current law. Do not treat the response process for a notice as a substitute for an appeal.

3. Reconcile every rupee in the demand

Create a working schedule before drafting anything. Re-add the components yourself and compare the result with the summary, detailed notice, computation sheet and annexures.

Amount or field Checks to perform
Tax Confirm the tax period, tax head, registration or branch concerned, and whether the allegation is short payment, wrongful input-tax credit, an ineligible refund or another stated ground. Recalculate using the officer’s figures and the underlying returns, invoices or ledgers.
Interest Identify the principal on which interest was calculated, the start and end dates, the rate or legal basis stated, and whether the period overlaps payments or adjustments already made.
Penalty Record the exact provision cited, the conduct alleged and the method used to arrive at the penalty. A penalty is not interchangeable with tax or interest.
Other amount Identify each item separately, such as a fee, recovery cost or another amount expressly stated. Do not fold it into tax without an explanation.
Total Add tax, interest, penalty and other items. Investigate any difference between your total, the DRC summary and the annexures before filing.

Record the source for each number: return period, invoice range, payment reference, ledger entry or annexure page. If an amount cannot be traced, say so specifically in the reply and ask for the missing computation rather than accepting the summary.

4. Read the notice header and legal grounds line by line

The first page often contains the information that determines the rest of your response. Capture these fields in a case sheet:

  • GSTIN, legal name and any trade name shown.
  • Issuing office and proper officer.
  • Notice or order number and the date shown on the document.
  • Date and mode of service or portal communication.
  • Tax period and financial year.
  • Sections, rules, notifications or circulars relied on.
  • Reply date, hearing date, address or portal path for submission.
  • Annexure list, calculation sheets and evidence referred to by the officer.

Then separate the allegations. For example, a notice may combine an output-tax shortfall with an input-tax-credit issue and a penalty. Give each allegation its own heading in the reply; a general denial can leave a calculation or fact unanswered.

5. Check which statutory period applies

Older explanations often describe only sections 73 and 74. The India Code record reflects a 2024 amendment introducing section 74A. Do not assume that a description written for an earlier period governs every later notice. Verify the section printed on your document, the relevant tax period, when the provision commenced and any transition rules.

Section 73 and section 74 references may carry different factual allegations and consequences, while section 74A can affect later periods. The notice’s cited provision and period control the analysis; a form number by itself does not.

6. Find the real deadline—there is no single universal reply date

There is no safe one-size-fits-all reply period for every GST demand notice. The operative deadline is the date and instruction printed in the full notice, read with the section cited, tax period and applicable rules. A summary screen should not replace the complete document.

  1. Locate the paragraph headed “reply,” “representation,” “personal hearing” or similar.
  2. Write down the reply date, hearing date and required submission method separately.
  3. Confirm the date on which the notice was actually served or made available to the taxpayer.
  4. Check whether the document asks for DRC-06, a portal upload, physical filing or another specified method.
  5. Set an internal deadline several working days earlier so that a portal failure or missing annexure does not cause a late filing.

If the document is an order or DRC-07, treat the appeal deadline as urgent. Verify the current statutory period, pre-deposit and forum from that order and the law in force; do not insert a generic number into your calendar.

7. Prepare a defensible reply in DRC-06 where required

For a covered Rule 142 notice, DRC-06 is the designated reply or representation form. The form is only the filing vehicle: the substance should be a numbered response that lets the officer reconcile every allegation.

  1. Identify the case. State the notice number, GSTIN, tax period, date, cited provisions and the DRC summary number.
  2. Classify each allegation. Mark each point as admitted, partly disputed or denied. Explain any admitted amount and distinguish it from disputed components.
  3. Reconcile the figures. Show the return, invoice, ledger, payment or credit calculation that supports your position. Use a table where the notice has several periods or tax heads.
  4. Give the factual explanation. Describe what happened in chronological order, including any correction, reversal, payment or prior correspondence.
  5. Give the legal basis. Address the provision cited by the officer and explain why it does or does not apply to the facts and period.
  6. Index the evidence. Number every attachment and refer to the number in the paragraph where it is used. Keep the files legible and within the portal’s limits.
  7. Request a hearing when appropriate. State the issues that need oral explanation and preserve the request in the filed response.
  8. File and preserve proof. Save the final submitted PDF or exported response, acknowledgement number, upload receipt, payment reference and a screenshot or downloaded status page.

The exact evidence depends on the allegation; this structure is a practical way to make the record complete, not a statutory checklist that fits every case.

8. Assemble evidence by allegation

Output-tax short payment

  • Tax-period return and liability workings.
  • Sales register, sample invoices, debit or credit notes and amendments.
  • E-way bill or other movement records where relevant to the allegation.
  • General ledger and proof of tax already paid.

Input-tax-credit dispute

  • Purchase register and the invoices on which credit was taken.
  • Ledger entries, payment evidence and reversals already posted.
  • Reconciliation to the relevant auto-populated statement or other records relied on in the notice.
  • Supplier correspondence or correction documents where the issue concerns an invoice mismatch.

Refund or export-related demand

  • Refund application, sanction or deficiency communications.
  • Invoices, shipping or export documents and bank-realisation evidence when relevant.
  • Statement reconciling the claimed amount to returns and books.

Interest or penalty calculation

  • Date-wise tax liability and payment schedule.
  • Challans, electronic-liability-ledger entries and prior adjustments.
  • A separate explanation of why the cited penalty provision and computation do or do not apply.

Do not attach a document merely because it is available. Each annexure should answer a stated allegation, and the reply should identify the relevant page or row.

9. Understand pre-notice communications and payments

Where Rule 142 applies, DRC-01A may communicate an amount before a formal notice. Part A contains the officer’s ascertainment; Part B allows a submission or partial payment in the situations covered by the rule. If payment is made, DRC-03 is used to intimate it, DRC-04 is the acknowledgement and DRC-05 records conclusion in the specified early-payment situation.

Check the legal stage before paying or making a submission. A pre-notice communication is not automatically an adjudicated order, and the presence of DRC-03, DRC-04 or DRC-05 does not by itself answer whether a particular liability is final. Match the payment to the tax head, period and amount stated, and retain the acknowledgement.

10. If you received an order, move to appeal analysis

For an adjudication order or DRC-07, make an “appeal now” file containing the complete order, DRC-07 summary, service proof, annexures, earlier reply, hearing record and payment details. Identify:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • The exact order date and date of communication.
  • The authority and appellate forum named or implied by the applicable provision.
  • The statutory filing period and how it is calculated.
  • Any mandatory pre-deposit or other condition.
  • Which parts are accepted, disputed or mathematically inconsistent.
  • Whether recovery action is already indicated or has begun.

Obtain advice from a GST practitioner or lawyer promptly when the amount is material, the facts are contested or recovery is imminent. An appeal deadline can run separately from the earlier notice-reply process.

11. Check limited section 128A relief carefully

Section 128A relief is not a blanket waiver. CBIC Circular 238/32/2024-GST describes a route for eligible legacy section 73 demands and discusses applications in SPL-01 or SPL-02 for specified case stages. The circular refers to 31 March 2025 as the notified date for the cases it addresses.

Before relying on this route, verify all of the following against the current law and the notice:

  • The demand is from the qualifying legacy section 73 period.
  • The case stage matches the SPL-01 or SPL-02 route described.
  • The statutory conditions, tax-payment requirements and exclusions are satisfied.
  • The filing window and notified date have not been changed by a later notification or instruction.

Do not describe section 128A as available for every GST notice, every section or every tax period.

12. Common mistakes and how to correct them

Treating the summary as the whole notice

Problem: The taxpayer responds only to the amount displayed in DRC-01 or DRC-07.

Correction: Download the full notice or order and every annexure. Build the reconciliation from the detailed computation and grounds.

Assuming a standard deadline

Problem: A calendar reminder uses a reply or appeal period copied from another case.

Correction: Use the date and instruction in the operative document, then verify the cited provision, service date and current law.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Combining tax, interest and penalty

Problem: One lump-sum objection does not show which component is wrong.

Correction: Reconcile each component separately and state the disputed amount under the corresponding heading.

Uploading without preserving proof

Problem: The taxpayer cannot demonstrate what was filed or when.

Correction: Save the submitted response, acknowledgement, reference number and payment or portal status immediately after filing.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Using old section descriptions

Problem: The response assumes that only sections 73 and 74 can apply.

Correction: Read the section cited for the tax period and check the 2024 section 74A amendment and transition rules.

Paying or ignoring without advice

Problem: A taxpayer pays an unexplained amount or misses a hearing while trying to decide what to do.

Correction: Preserve the deadline, request professional review for a material or contested demand, and make any payment only after mapping it to the correct stage, period and tax head.

13. A practical decision map

Question If the answer is “yes” Immediate focus
Is it a DRC-01 or DRC-02 summary attached to a notice or statement? Liability is generally still being proposed or examined. Read grounds, reconcile amounts, prepare the required reply and attend the stated hearing.
Is it DRC-07 or an adjudication order? The officer has issued a decision and recovery treatment may apply. Verify appeal period, forum, pre-deposit and recovery status from the order and current law.
Is it DRC-01A before a formal notice? The communication may be at a pre-notice stage. Check Part A and Part B, assess the amount and understand the effect of any DRC-03 payment.
Does the demand appear to be a qualifying legacy section 73 case? Section 128A relief might be relevant, subject to every condition. Check the SPL route, notified date, eligibility and current filing window before relying on it.

14. Final filing checklist

  • Full notice or order downloaded, including annexures.
  • Form number, authority, date, service date, provision and tax period recorded.
  • Tax, interest, penalty, other amount and total independently reconciled.
  • Each allegation classified as admitted, partly disputed or denied.
  • Evidence indexed and tied to specific paragraphs.
  • Reply, hearing and appeal dates entered in a calendar from the operative document.
  • Correct form and submission channel confirmed.
  • Filed response, acknowledgement and payment records preserved.
  • Professional advice obtained promptly for a material, complex or contested matter.
