How to Protect Your Privacy When Taking Part in Brain-Imaging Research

Before joining a brain-imaging study, read the consent form as a data-use agreement, not just a description of the scan. Ask exactly what will be collected with your images, who can access each form of data, where it will go, how long it will be kept, whether it will be reused, and what happens if the scan suggests a health problem.

A scan labeled “de-identified” is not necessarily anonymous. Structural MRI can contain facial anatomy, and identification may also be possible through image patterns or information linked to the scan. Privacy protection is therefore a series of choices and safeguards across the entire data lifecycle, not a single anonymization step.

What privacy means in a brain-imaging study

Brain-imaging data can include more than a picture of the brain. A study may connect MRI or fMRI files with your name, contact details, medical history, questionnaire answers, genetic or demographic information, visit dates, and study results. Even when names are removed, the combination of the image and associated information can make a person recognizable.

The NIH BRAIN Initiative Neuroethics Working Group states: “Research participants’ confidentiality cannot be guaranteed both because of the risks of unauthorized release of identified data through hacking and the possibilities of re-identification.” That is a warning about limits, not a claim that every study has the same risk. Your practical task is to find out which safeguards a particular protocol uses and what choices its consent form gives you.

Identifiable, coded and de-identified are different

Data form What it generally means Privacy question to ask
Identifiable data Names or other direct identifiers remain attached to the scan or records. Which staff members can see the identity-linked file?
Coded data A code replaces direct identifiers, while a key held by the study or an institution can reconnect the code to you. Who holds the code key, and under what circumstances can it be used?
Defaced or masked images Software or procedures remove or obscure facial features in an anatomical image. What image information is removed, and could that affect the planned analyses?
De-identified files Direct identifiers and selected identifying fields are removed or altered. What residual identification risks remain through the image or linked data?
Controlled-access files Approved users receive data only after a request and agreement about permitted use. How are requesters vetted, and are onward sharing and re-identification prohibited?

These labels do not create a universal legal definition of anonymity. Ask the team to explain its own terminology in plain language and to identify which version of your data each label describes.

How an image can identify you

Anatomical MRI can show the shape of a participant’s face. Removing a name therefore does not remove every identifying feature. Researchers have also discussed re-identification from patterns in defaced images and from combinations of imaging data with clinical or biomedical information.

Facial masking can lower the chance that someone recognizes you from the visible face, but it is a trade-off. Masking may remove image regions needed for a particular analysis, introduce distortions, or reduce the usefulness of the file for future work. A study should explain whether it defaces images, which method it uses, and what information may be lost.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Questions about masking

  • Will every structural image be defaced or masked before it leaves the local study system?
  • Which facial or other anatomical information will the procedure remove?
  • Could masking affect measurements required for this project or later approved projects?
  • Will an unmasked copy be retained, and who can access it?
  • Are functional scans, screenshots, surface models or derived files handled differently from the original MRI?

The right balance depends on the study’s purpose and the risks of later use. A protocol that needs facial anatomy for a legitimate analysis may use a different approach from one that does not.

Follow the data through its entire lifecycle

Privacy questions should cover every point at which information is collected, handled, transferred, stored, analyzed or released. A study can protect one stage well and still expose participants at another.

Collection at the scanner

Ask what is recorded at the appointment besides the image itself. Scanner files may carry technical metadata, dates, visit identifiers or device information. Find out whether the site records your name in the imaging system, when identifiers are replaced with a code, and which staff can see the link between the code and your identity.

Linking with other information

Imaging data become more identifying when combined with health records, questionnaires, genetic information, demographic details or repeated visits. Request a list of the information that will accompany the scan and ask which fields are necessary for the stated aims.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Transfer between sites

Multi-site studies may move files from the scanner to a university server, a coordinating center, a cloud platform or an outside analysis group. Ask what protections apply during each transfer, who is responsible for the transfer, and whether copies are made along the way.

Storage and retention

Ask where identifiable, coded and shared files are stored, how access is granted and reviewed, and how long each category will be retained. “Kept for the study” is not precise enough: request the period or the event that ends retention, and ask what happens to backups and derived files.

Analysis and internal access

Find out which investigators, technicians, students, contractors or information-technology personnel can see each data type. Access should be limited to the role that needs it, but only the study’s governance documents can tell you whether that is how the project operates.

Release, reuse and destruction

Ask whether files will be deposited in a repository, shared with outside academic groups, sent to commercial entities, or used for projects beyond this study. Clarify whether recipients may share the data onward, whether they must sign a data-use agreement, and whether your consent covers future work. Ask how the study handles a request to stop future use and whether data already distributed can be recalled.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Open sharing and controlled access

Some projects make files broadly available; others require each requester to pass an approval process. NIH privacy principles advise investigators and institutions to assess whether controlled access is needed even when data meet technical or legal definitions of de-identification.

Access model What to clarify before consenting Why it matters
Open access Exactly which files and metadata will be public, and whether anyone can download, copy or combine them with other datasets. Broader availability increases the number of people who could attempt identification or reuse.
Controlled access Who approves requests, what identity and project checks are required, and what terms recipients must accept. Access can be limited to justified uses and identifiable requesters.
Limited internal sharing Which institutions and roles can use coded or identifiable files. The practical risk depends on the size of the authorized group and its controls.

A 2024 consensus article on portable MRI recommends protections across the data pipeline, clear consent descriptions of risks and safeguards, and data-use agreements that prohibit attempts to re-identify participants and unapproved further sharing. Those recommendations address portable-MRI settings specifically, but they are useful questions for other imaging studies as well.

Can you opt out of sharing?

There is no universal answer. One consent form may offer separate choices for the main study, future research, or deposition in a repository; another may make data sharing part of participation. Ask the coordinator to show you the exact checkbox, paragraph or withdrawal procedure. If a file has already been sent to an approved recipient, the study may not be able to retrieve every copy, so ask about that limitation before enrolling.

What security questions to ask

Do not settle for “your data are secure.” Ask the team to describe the controls used at collection, transfer, storage and analysis. Depending on the project, useful details may include:

These are questions, not assumptions that every study uses a particular technology. The consent materials should identify the actual safeguards and their limits.

Read the consent form for future use

Consent should state what the scan is for, what risks are foreseeable, who may receive the data and whether later research is permitted. Look for separate language covering confidentiality, MRI or fMRI risks, data sharing and incidental findings. NIH’s consent-language library, Version 18 dated 2026-02-05, contains separate material on those topics; your study’s form determines which provisions apply to you.

Use this consent checklist

  1. Collection: What information will you collect alongside my brain images, and which fields could identify me?
  2. Identifiers: Will you remove names and direct identifiers, replace them with a code, or retain an identity-linked file?
  3. Image processing: Will images be defaced or masked, and what useful information could that remove?
  4. Access: Who can see identifiable data, coded data and shared research files?
  5. Recipients: Will outside researchers, companies, contractors or international partners receive any version?
  6. Access model: Will files be openly shared or released through controlled access? What must a recipient agree to?
  7. Onward sharing: Can recipients pass data to someone else, and are attempts to re-identify participants prohibited?
  8. Security: What protects data during collection, transfer, storage and analysis?
  9. Retention: How long will each type of file, including backups and derived results, be kept?
  10. Future use: Does my permission cover later studies beyond this project, and can I decline that use separately?
  11. Changing your mind: What can I withdraw, whom do I contact, and what happens to data already shared?
  12. Incidental findings: Is the scan intended to diagnose a condition, who reviews it, and what follow-up is available if something unexpected appears?

Write down the answers and keep a copy of the signed consent form. If the team cannot explain a term, ask for a plain-language explanation before you decide.

A research MRI is not automatically a diagnostic scan

A scanner can produce clinically interesting images without the study functioning as a medical examination. NIMH MRI safety and ethics guidance says a protocol should distinguish research scans from clinical scans, state whether a clinician qualified to interpret the images will review them, and describe the response to incidental findings.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What to establish before scanning

  • Whether a qualified clinician reviews all scans, a sample of scans, or none.
  • What threshold triggers a second review or referral.
  • Who contacts you, how quickly, and by what method if a potentially concerning finding is seen.
  • Whether the study provides a report, referral or other follow-up, and who pays for any clinical care.
  • What happens when an image is technically inadequate or the finding is uncertain.

One often-cited figure illustrates why procedures matter: in a 2005 survey by Illes and colleagues, 54 of 66 respondents (82%) reported discovering incidental findings in their MRI studies. The 74 investigators surveyed were not a representative sample of all studies, and the paper found substantial variation in how findings were handled and communicated. Treat the number as that survey’s result, not as a current universal rate.

A practical decision process

1. Get the full documents

Request the complete consent form and any separate data-sharing, imaging or incidental-finding documents before the appointment. Promotional summaries rarely contain the operational details you need.

2. Mark every data-use choice

Circle sections about coding, masking, repositories, future research, commercial recipients, withdrawal and clinical review. If there are optional boxes, ask whether declining one affects participation in the core scan.

3. Ask for a data-flow explanation

Have the team describe the path from scanner to final repository: each handler, storage location, transfer, access tier and planned deletion or retention point. Ask what happens to the original unmasked file.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

4. Test the limits

Ask what happens after a breach, an attempted re-identification, a change of principal investigator, a collaborator leaving the project or a request to use the data for a new purpose. The answers reveal whether the safeguards are specific or merely reassuring language.

5. Decide according to your own risk tolerance

You may accept a study with coded data and controlled access but decline one requiring unrestricted release. You may also participate in scanning while declining optional future use if the protocol permits it. There is no single privacy setting that fits every person or project.

6. Keep contact information

Save the coordinator’s details and the consent contact for privacy questions or incidental findings. If you later change your mind, use the procedure written in the form rather than assuming that deleting an app, email or local copy withdraws your participation.

If the answers are unclear

Ask the study coordinator or principal investigator to point to the exact consent language. Request clarification in writing when possible. If the team cannot tell you who receives the data, whether future use is allowed, or how an incidental finding is handled, pause enrollment until those points are resolved. The protocol, institution and jurisdiction determine the choices available; general privacy labels cannot substitute for study-specific terms.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Key takeaways

  • A brain scan may remain identifying through facial anatomy, image patterns or linked biomedical information.
  • “De-identified” reduces some risks but does not guarantee anonymity or confidentiality.
  • Privacy depends on controls across collection, transfer, storage, analysis, sharing and future reuse.
  • Controlled access, recipient agreements and limits on onward sharing can reduce exposure, but the consent form should state whether they apply.
  • Defacing protects some facial information while potentially removing useful image content.
  • A research scan is not automatically a diagnostic service; ask who reviews it and what happens after an incidental finding.
  • Your actual choices come from the study protocol and consent language, so ask direct questions before the scan.
