If you think someone nearby is recording you, the most effective steps are simple: say clearly that you don’t consent, move away or toward staff if you feel uncomfortable, and keep basic notes if it is safe to do so. A request may not settle the legal question, but it states your boundary. This guide covers phones, body cameras and smart glasses, what the cues can and can’t tell you, and what to do if footage is shared.
What to do in the moment
Most people with a camera are not filming you. Many are taking photos of something else, or are not recording at all. Start from calm, not accusation.

- Make a plain request, if it feels safe. For example: “Please stop recording me. I do not consent.” Keep your tone level and don’t argue about the law on the spot.
- Create distance. Move out of frame, change seats, or leave the area. This is often quicker than any conversation.
- Get help if the person refuses or the situation feels tense. Ask venue staff, security, or someone you trust to step in.
- Don’t touch the device. Don’t grab it, knock it, cover it or damage it. That can put you at risk and can create legal trouble for you.
Meta, which makes widely sold smart glasses, tells wearers: “If you want to capture a photo or video, make sure that you ask for permission from those around you.” Its guidance also asks wearers to avoid sensitive places. Can you tell if you are being recorded?
Not reliably. Cues differ by device, and the absence of a cue proves nothing.

Phones and visible cameras
A raised phone or camera pointed at you is a familiar signal, though even that doesn’t confirm recording or who is in the frame.
Smart glasses
Meta says its AI glasses have a white capture LED that blinks for photos and keeps blinking during video capture. Its July 2026 explainer states “The capture LED has no off switch,” and that captured media stays on the glasses until the wearer imports it to a phone. No evidence supports a product that can confirm whether a particular person is recording you. Privacy screens protect your own screen, not you from someone else’s camera. Devices marketed to block recording aren’t established as effective or lawful, so treat them with caution.

Context changes what is reasonable
Three distinctions help you judge how worried to be. They are context, not legal conclusions.

Sensitive venues
In a workplace, school, health facility or private business, check the venue’s recording policy and ask staff to enforce it. Venues can often set rules that are stricter than the general law.

What the law says (and doesn’t)
There is no single global answer on recording someone without consent. Rules depend on country, state, location, whether audio is captured, and what is done with the recording afterwards.
- United Kingdom: A June 22, 2026 government written answer said “People may lawfully use smart glasses and similar recording technologies in public spaces, in line with rights to freedom of expression as set out in Human Rights law.” That is a high-level statement, not a rule for every place or for later publication. - United States (federal): 18 U.S.C. § 1801 covers intentionally capturing an image of a person’s “private area” without consent where they have a reasonable expectation of privacy, within the statute’s specified jurisdiction. It doesn’t settle ordinary public filming, and it doesn’t replace state rules on recording or audio consent, which vary. Source: 18 U.S.C. § 1801 (2022 edition).
If you are dealing with a specific incident, check your local rules or ask a local legal or victim-support service. Don’t assume that recording in public is always legal or always illegal.

Biometrics are a separate issue
A camera pointed at you is one thing. Software that analyses faces or other biometric traits is another. In May 2023 the FTC warned about privacy, data-security, bias and discrimination risks tied to biometric information. Samuel Levine, director of its Bureau of Consumer Protection, said: “In recent years, biometric surveillance has grown more sophisticated and pervasive, posing new threats to privacy and civil rights.” That is a U.S. consumer protection warning, not evidence that any nearby camera is doing this. If you want to document or report it
Only do this if it is safe and doesn’t escalate things.
- Note the time, place and what happened.
- Record any possible witnesses and where any posted material appeared.
- Don’t collect or forward intimate material yourself, even as “evidence.” Describe where it is and let the platform or authorities handle it.
If footage is posted or used against you
Later sharing can raise separate problems, including image-based abuse and harassment, as the eSafety Commissioner notes. Report the content through the platform’s reporting tools. If you are being threatened, exposed or harassed, contact local support services or law enforcement. Remedies and processes vary by place and circumstance.
