You can reduce the personal information you choose to share with a casino, but you cannot assume that declining a loyalty account or wearing a particular item will stop camera surveillance or prevent facial recognition. Practices vary by operator and location, and there is no universal casino opt-out right established by the sources reviewed here. The most useful steps are to check the specific casino’s privacy notice, ask direct questions about biometric data, and limit optional data sharing.
Do casinos use facial recognition?
There is no basis here to say that every casino uses facial recognition, or to estimate how common it is. Casinos’ surveillance and data practices can differ by operator and jurisdiction. Nevada Gaming Control Board materials discuss gaming surveillance and certain patron-information safeguards, but they do not establish that facial recognition is used at every casino—or how often it is used.

That leaves a practical question for each visitor: what does this particular operator do, for what purpose, and under what policy? A camera being present does not, by itself, establish that its images are analyzed with facial-recognition software or retained as biometric data.
What protections do laws and regulators establish?
Nevada: safeguards have defined scope
Nevada Gaming Control Board guidance says licensees must assess the collection, maintenance, and transmission of sensitive patron information and establish documented safeguards. The cited requirement concerns gaming systems approved by the Board’s Technology Division; it should not be treated as a rule covering every camera or data system at every casino.

Nevada Revised Statutes Chapter 603A defines biometric data to include facial imagery and other physiological or behavioral characteristics when capable of identifying a person. The chapter also includes security and consumer privacy provisions, but its scope rules and exceptions matter. Whether a particular casino, data practice, or visitor is covered depends on the facts and the specific provision; the definition alone does not establish a universal right to refuse a scan or demand deletion.
Federal Trade Commission: risk guidance, not a casino-specific ruling
In a May 2023 statement, the FTC warned that biometric technologies raise privacy, data-security, bias, and discrimination concerns. The agency said it may consider factors such as whether a business assessed foreseeable harms, whether collection was unexpected, how it evaluated vendors, and whether it monitored them when examining potentially unfair practices. That is agency guidance and enforcement policy, not a finding about any named casino.

FTC staff’s 2012 facial-recognition report recommended practices that included notice and choice in certain examples. The report distinguishes those recommendations from existing legal requirements; it does not create a legally enforceable, universal opt-out guarantee for casino visitors.

- Find the operator’s current privacy notice. Look on the casino’s official website for its privacy policy or privacy notice. If you are considering a rewards account or app, review the notice that applies to that program too; it may describe additional data practices.
- Look for the details that affect your decision. Check what categories of information the operator collects, why it collects them, who it shares them with, how long it keeps them, and which contact channel handles privacy requests. Notice whether the policy addresses biometric information or facial imagery specifically.
- Ask the privacy contact for information the notice does not provide. Use the contact channel identified in the notice, and keep a copy of your message and the response. Ask about use, retention, sharing, and available choices in clear, specific terms.
- Reassess optional enrollment and settings. Before signing up for a loyalty program, providing optional profile details, connecting accounts, or enabling app-based location and personalization features, decide whether the benefits are worth the additional data sharing described by the operator.
Questions to ask the casino
- Do you use facial recognition or another form of biometric identification at this property?
- Are images analyzed only in real time, or are images or biometric templates retained? If retained, for how long?
- What purposes do you use biometric identification for, and what policy or legal basis do you rely on?
- Is biometric information linked to a loyalty account, payment record, security record, or other patron profile?
- Which service providers or other third parties receive the information, and for what purpose?
- What process, if any, can I use to request access, correction, or deletion, or to opt out of a particular use?
A casino may not answer every question or offer every requested choice. A request is a way to learn the operator’s stated practices—not proof that a particular legal right applies.

What you can control—and what you cannot assume
Limit optional information sharing
You can decide whether to enroll in a rewards program, supply optional profile information, connect accounts, or enable app permissions for location and personalization. Review the relevant notice and settings before making those choices. Declining them can limit the information you provide through those channels, but it does not establish that you will not be recorded by cameras or that surveillance images will not be analyzed.
Do not rely on clothing or gadgets to defeat surveillance
The evidence reviewed does not establish that a mask, hat, camera blocker, or other consumer product reliably prevents casino facial recognition or changes an operator’s collection practices. Do not treat one as a dependable privacy safeguard.

Keep records and seek local guidance when needed
Save the privacy notice in effect when you visit, your questions, and the casino’s response. If you need to make a complaint or determine whether a legal right applies, contact the privacy authority or gaming regulator for the relevant jurisdiction, or consult a qualified local attorney. The appropriate process depends on the location, operator, data involved, and circumstances.
