You generally cannot stop a public-road camera from reading a visible, legally displayed license plate. The most practical privacy protections are limits on how long scan records are kept, who can search or share them, and what they may be used for. Drivers and residents can press local agencies to adopt those limits and check what rules apply where they live.

What do automated license plate readers collect?

Automated license plate readers (ALPRs) capture a plate number along with the date, time, and location of a scan. Depending on the system and its sharing arrangements, records may be available across agencies or jurisdictions. The ACLU explains how scan data can be pooled and retained in its overview of ALPRs.

One scan does not create a complete, live map of a vehicle. The privacy concern grows when many scans are retained and made searchable: over time, they can reveal travel patterns and visits to sensitive places, including for people who are not suspected of a crime. Retention and retrospective search are therefore as important as where cameras are installed.

Can police track my car with license plate readers?

ALPR records can help an authorized user look up where a plate was scanned, if the system retained the record and the user has access. Whether a particular agency can search older scans, share them with others, or combine them with another network depends on its policy, contracts, and applicable law. A reader should not assume that every scan is retained indefinitely—or that it is deleted quickly—without checking the agency’s rules.

Alerts also can be wrong. The Electronic Frontier Foundation (EFF) recounts a 2009 San Francisco incident in which Denise Green’s car was misidentified as stolen and she was subjected to a forceful stop. EFF says the legal ruling related to that incident does not apply everywhere. An ALPR hit should be treated as a lead that requires independent verification, not proof that a particular vehicle or person is involved in wrongdoing. See EFF’s ALPR explanation.

Can I stop a license plate camera from scanning my car?

Usually, no: a vehicle owner generally cannot control whether a public-road camera photographs a visible plate. The reviewed sources do not establish a reliable consumer product that prevents ALPR collection. Do not rely on plate covers, obscuring devices, or camera jammers as privacy protections; their effectiveness and legality are not established here, and obscuring a plate may violate local law.

The useful individual response is accountability rather than concealment: find out which public agencies or private entities operate ALPRs in your area, then scrutinize their policy, contracts, and oversight.

How do I find out if my city shares license plate data?

  1. Identify the operators. Search your city, county, state, and local police websites for “automated license plate reader,” “ALPR,” or “LPR.” Ask the police department or relevant public-safety office whether it operates a system or has access to one run by another agency or a vendor.
  2. Find the policy and contract. Look for an ALPR usage or privacy policy, retention schedule, data-sharing agreement, and vendor contract. If they are not posted, ask the agency how to obtain them. You can also raise the issue at public meetings and request records where local law allows; access rules and exemptions vary by jurisdiction.
  3. Ask specific questions. Find out how long non-hit scans are retained; who may query the system and what reason is required; which outside agencies or private entities may access or receive data; what uses are permitted; and whether searches are logged, audited, and reported.
  4. Check the terms that govern vendor access. Ask whether the agency’s written contract and settings control over vendor defaults, and whether the vendor may reuse or share customer data.

Which ALPR policy safeguards should communities seek?

Retention, access, sharing, use, oversight, and contract controls are policy choices residents can ask officials to adopt; they are not universal legal requirements. The ACLU’s June 29, 2026 community guidance identifies retention, sharing, and use as its three central areas for regulation and negotiation. EFF also points to short retention, specific access rules, audits, and deletion of non-hit scans as safeguards.

Area Questions for an agency or vendor
Retention Are scans that do not match an alert deleted quickly? Is the limit enforceable, with only narrow exceptions?
Access Which staff can search? Must a query be tied to a documented investigation or purpose?
Sharing Can local, state, federal, or private entities query the system or receive data? Is access limited or reciprocal?
Use Are permitted purposes defined and limited? Are sensitive uses expressly prohibited?
Oversight Are searches logged, logs reviewed, audits published, and violations reported?
Contract control Do written contract terms and customer settings override vendor defaults? Can the vendor reuse or share the agency’s data?

These are comparison points for public debate and contract review, not guarantees that a given system follows them. For example, the ACLU’s guidance cites New Hampshire as requiring deletion of non-crime-related plate data within three minutes. That is a state-specific example, not a general U.S. rule. The ACLU also reported on June 29, 2026, that more than 55 localities had ended Flock contracts in the preceding year; that is the organization’s reported figure and timeframe, not an independently audited national count. See the ACLU’s community guidance.

What ALPR laws and agency policies apply?

Rules differ by state, locality, and country, and can change. Check current statutory text and the policy of the agency operating the system rather than assuming that an example from another jurisdiction applies to you.

California

EFF says California’s 2015 SB 34 requires ALPR users to protect data, keep access logs, adopt a usage and privacy policy, and hold public meetings before starting an ALPR program. EFF also describes limits on public-agency data sharing. Check the current California SB 34 text and your agency’s policy to determine what applies.

Ontario

Ontario’s Information and Privacy Commissioner published police ALPR guidance updated December 16, 2024. The commissioner’s page warns that Ontario’s public-sector access and privacy laws changed in 2026 and that the guidance is under review. Treat it as background, not a complete account of the amended law; consult the commissioner’s guidance and current legal requirements.

Virginia litigation and agency policy examples

The ACLU’s Schmidt v. Norfolk case summary describes a Fourth Amendment challenge to ALPR surveillance and said an appeal was ongoing as of April 20, 2026. It also describes Virginia’s 2025 statute as restricting out-of-state and federal sharing while alleging violations and continuing in-state network access. Those statements about violations are allegations in the ACLU’s case summary, not a finding established here; check the current court docket for later developments.

As an example of an agency’s stated rules, the Los Angeles County Sheriff’s Department transparency page says its policy was updated April 22, 2026, permits specified public-safety purposes, and prohibits using ALPR data for civil immigration enforcement. That is LASD policy, not a nationwide rule. Read the LASD ALPR transparency page alongside the policy for your own area.
