The most reliable protection is to avoid uploading an unpublished manuscript to any service whose current terms, retention rules, human-access policy, or training controls you cannot verify. Keep a controlled master copy, submit only the minimum text needed, obtain written permission before editors or vendors use consumer AI, and negotiate explicit limits on training, data mining, sublicensing, summaries, adaptations, and other AI uses. U.S. copyright protects original writing once it is fixed, but it does not technically prevent a copy from being uploaded, scraped, or processed. Registration can improve enforcement options, while a “no AI training” notice alone is not a proven technical block.
What you can and cannot stop
There is no universal switch that makes an unpublished manuscript invisible to every AI system. Protection is a set of decisions made at three points: before a file leaves your control, in the contracts and workflows of people who handle it, and under the copyright law that applies to the work. Each layer addresses a different risk.

- Service controls determine whether a provider may retain your submission, let people review it, reuse it to improve a service, or include it in model training.
- Contract controls determine what an agent, publisher, editor, translator, proofreader, or marketing vendor is allowed to do with your manuscript and personal information.
- Copyright controls establish ownership and legal remedies, but they do not function as a technical gate that blocks copying or training.
Oxford University Press advises authors not to upload work intended for publication to a tool that does not permit opting out of reuse or training. Elsevier likewise tells authors to verify that a tool does not train on submitted material and to avoid restricted or sensitive content unless confidentiality and terms are clear. Wiley’s guidance also directs authors to examine the safeguards of the particular service. These are publisher-specific policies, not a guarantee that every provider follows the same rules.

Before uploading: a five-minute exposure check
Treat an unpublished manuscript as confidential business information until you have decided otherwise. Do not rely on a product label such as “private,” “secure,” or “enterprise” without reading what those words mean in the current agreement.
- Identify the exact service and account type. Consumer, team, education, and enterprise accounts can have different defaults. Record the plan, region, and date you checked.
- Find the training and service-improvement language. Look for statements about using prompts, uploads, outputs, or usage data to train, fine-tune, evaluate, or improve models. Determine whether an opt-out covers your content, only future content, or only a particular product.
- Check retention and deletion. Find the stated retention period, backup treatment, deletion process, and whether deleted content remains in logs or safety systems. A “delete” button may not mean immediate removal from every copy.
- Check human access and subprocessors. Determine whether staff, contractors, reviewers, or service providers may inspect submissions, and whether information is transferred to other companies or countries.
- Check confidentiality and permitted uses. Read whether the provider may use content for abuse monitoring, analytics, research, advertising, legal compliance, or other purposes beyond answering your request.
- Save evidence of the settings. Keep a dated copy or screenshot of the relevant terms and account controls. This records what you relied on if the wording later changes.
If you cannot answer these questions in plain language, do not submit the manuscript. Ask the provider for a written clarification or use a workflow that keeps the text under your control.
How to compare an AI service for manuscript work
Use the same questions for every tool rather than assuming that a familiar interface has familiar rules.
What’s actually slowing this PC down?

| Question | What to verify | Why it matters |
|---|---|---|
| Training default | Is submitted content used to train, fine-tune, evaluate, or improve models by default? | A default permission can expose text even when you never intended to publish it. |
| Opt-out scope | Can you opt out, and does the control cover past uploads, future uploads, files, prompts, outputs, and account telemetry? | An opt-out may be narrower than the word “content” suggests. |
| Retention | How long are prompts and files stored, including backups, abuse logs, and deleted-account data? | Longer retention creates more opportunities for access or disclosure. |
| Human access | Can employees or contractors review conversations or files, and for what reasons? | Confidentiality depends on more than automated processing. |
| Reuse and disclosure | May the provider share content with affiliates, subprocessors, researchers, or authorities? | Sharing can move the manuscript outside your direct control. |
| Account and region | Which plan, data-center region, and governing terms apply to your account? | Rules can differ by account type and location. |
Record the answers in a simple log: service, account type, terms version or date, training setting, retention statement, deletion method, and the exact text you submitted. The log is a practical record, not proof that a provider complied.

Use the least-data workflow
When an AI tool is appropriate and its terms meet your requirements, reduce the amount of material it receives.
- Keep a clean master manuscript in storage you control. This is sensible file management, not immunity from copying.
- Send only the excerpt needed for the task. A request for line editing rarely requires the entire book.
- Remove unpublished chapters, plot resolutions, personal addresses, phone numbers, source documents, and third-party confidential material that the task does not require.
- Replace names and identifying details with neutral labels when they are not essential to the analysis.
- Use a separate working copy and record which passages were shared, when, and under which account.
- Download the result, then delete the working conversation or file using the provider’s documented process if deletion is part of your risk plan.
Do not describe this workflow as a guarantee. A smaller upload limits exposure; it does not change the provider’s legal rights or prove that no copy remains.
Control editors, agents, and vendors
A manuscript can reach an AI service without you uploading it. Editors, agents, copy editors, translators, proofreaders, audiobook producers, publicists, and software vendors may use their own accounts or subcontractors. Ask before sharing the file and make the answer part of the written record.

- Will you place any part of the manuscript or my personal information into an AI system?
- Which service and account type will you use, and in which country will data be processed?
- For what task will the system be used: editing, translation, summaries, assessment, marketing, narration, or another purpose?
- Does the service retain or train on submissions, and is an opt-out enabled?
- Who can view the submission, including employees, contractors, and subprocessors?
- How will working files, prompts, outputs, and backups be deleted when the task ends?
- Will any output or manuscript data be reused for another client or internal project?
Request a written answer before delivery, not a verbal assurance after the file has been sent. If a participant cannot identify the service, settings, or retention period, treat that uncertainty as a reason to withhold the manuscript or provide a smaller excerpt.
Contract language to review and negotiate
Read both your publishing agreement and any separate agreement with an agent or service provider. A clause that grants broad rights for “all technologies now known or later developed” may be interpreted differently from a clause that names AI training or text and data mining. Do not assume that silence means prohibition or permission; ask for an explicit boundary.
| Contract issue | Questions for the draft | Protective position to request |
|---|---|---|
| Model training and fine-tuning | May the manuscript, excerpts, prompts, or outputs train or improve a model? | Exclude training unless you give separate, written permission; require an opt-out whenever use is permitted. |
| Text and data mining | Does a mining grant cover internal datasets, external partners, or commercial model development? | Define the permitted purpose, materials, recipients, duration, and deletion duties. |
| Internal AI use | Can staff use consumer tools for editing, evaluation, summaries, or workflow automation? | Require approved tools, confidentiality safeguards, and notice or consent before use. |
| Sublicensing and subprocessors | Can the counterparty pass files to affiliates, contractors, or technology vendors? | Require equivalent restrictions, a list or approval process for subprocessors, and responsibility for their acts. |
| Summaries and assessment | May automated systems generate synopses, reader scores, market analyses, or metadata? | Specify whether those uses are allowed, who owns the results, and whether the manuscript is retained. |
| Adaptation, translation, and narration | Does an AI-generated translation, script, voice, or derivative count as an authorized adaptation? | Reserve these rights unless expressly granted, with human review and defined approval procedures. |
| Marketing and publicity | Can promotional systems ingest the full manuscript or author data? | Limit inputs to approved excerpts and prohibit training or unrelated reuse. |
| End of term | What happens to files after publication, rejection, termination, or completion of a task? | Require return or deletion, including reasonable instructions for backups and subcontractors. |
The Authors Guild’s April 2026 model language proposes written permission before consumer AI systems are used on a manuscript or an author’s personal information, together with training opt-outs when that use is permitted. Its model clauses are advocacy and drafting resources, not government rules or a universal contract. Use them to identify issues, then have a qualified professional review the agreement that actually governs your work.
What U.S. copyright protects
Under U.S. law, copyright exists automatically in an original work of authorship once it is fixed in a tangible medium. Writing saved in a file, notebook, or other stable form can therefore be protected without an application. Copyright protects expression, not an unrecorded idea, premise, title, fact, or method.
Automatic protection does not stop someone from uploading a copy to an AI service or scraping a file from a place where it was exposed. Copyright ownership and practical control are different questions. A provider’s terms, a publisher’s contract, confidentiality obligations, and the facts of a particular use may matter alongside copyright.
Rank #4
Whether a specific training activity infringes copyright is a fact- and law-dependent question. Publisher policies do not decide it, and a notice on a manuscript does not establish the outcome. If suspected misuse involves a contract, an international service, or a significant release, obtain advice for the relevant jurisdiction and facts.
Should you register the manuscript?
Registration is separate from the automatic protection that begins at fixation. The U.S. Copyright Office recommends registration because it creates a public record and can provide additional legal benefits. For a U.S. work, registration or refusal is required before bringing an infringement action in federal court. Timely registration can also affect eligibility for certain statutory damages and attorney-fee remedies.
Benefits and trade-offs
| Consideration | What it means |
|---|---|
| Public record | The registration record, including information submitted to the Office, is available online. |
| Publication | Publication is not required for copyright protection or for applying to register an unpublished work. |
| Electronic filing | The Office provides electronic registration through its eCO system. |
| Enforcement timing | Registration or refusal is required before a U.S. infringement suit can be filed; timing can influence available remedies. |
| Confidentiality trade-off | Registration does not keep the submitted record entirely private, so consider what information the application will disclose. |
Registration is a legal and strategic decision, not a technical anti-training measure. It will not prevent a provider from receiving a file, and it does not erase copies already shared. Consider the manuscript’s commercial importance, publication schedule, likelihood of dispute, and the public-record implications before filing.
Does a “no AI training” notice work?
A notice can communicate your position to a person who receives the manuscript and may support a later argument about permission or expectations. The available publisher and government materials do not establish that a notice alone prevents copying, scraping, ingestion, or model training. It is not encryption, an access-control system, or a guaranteed legal remedy.

If you use a notice, pair it with enforceable access and contract controls: share only with identified recipients, use a written confidentiality agreement where appropriate, and specify that no AI upload, training, mining, or unrelated reuse is authorized without written consent. Keep a dated copy of the notice and the transmission record.
If you suspect your manuscript was used
- Preserve evidence. Save the original manuscript, version history, file metadata, upload records, emails, terms in force at the time, screenshots of settings, and any concerning output. Do not edit or overwrite the only copy.
- Identify the pathway. Determine whether the exposure came from your account, a publisher or vendor, a public link, a compromised device, or an unknown source.
- Read the governing documents. Check the service terms, publishing agreement, confidentiality provisions, and any written permission or opt-out confirmation.
- Limit further exposure. Revoke shared links, rotate credentials, remove unnecessary files, disable training controls where available, and ask the relevant counterparty to preserve and delete data according to the agreement.
- Seek qualified advice. A lawyer or authors’ rights professional can assess copyright, contract, privacy, trade-secret, and cross-border issues. The correct response depends on the jurisdiction, dates, material used, and evidence.
Do not treat a plausible model response as proof that a particular manuscript was used. Similar wording can arise from common language, public sources, or independent generation. Establish the source and chain of access before making an allegation.
A repeatable protection checklist
- Keep an access-controlled master and a separate sharing copy.
- Classify each passage as necessary, optional, or confidential before sending it anywhere.
- Check the current service terms for training, retention, human review, reuse, subprocessors, account type, and region.
- Save dated evidence of the settings and terms you relied on.
- Use the smallest excerpt and least identifying information that can complete the task.
- Ask every editor, agent, contractor, and publisher whether AI will touch the manuscript or your personal information.
- Require written permission, approved tools, no-training settings, and deletion duties in the relevant agreement.
- Review grants involving training, mining, summaries, assessment, marketing, translation, narration, adaptations, and sublicensing.
- Decide whether U.S. registration’s enforcement benefits justify its public-record trade-off.
- Keep a dated record of every upload, recipient, purpose, and deletion request.
- If misuse is suspected, preserve evidence and obtain advice specific to the contract, jurisdiction, and facts.
The practical standard is simple: do not upload what you cannot afford to expose, and do not grant rights that the agreement does not clearly describe. Use technical settings, written permissions, careful file handling, and copyright strategy together rather than expecting any single measure to solve the problem.
