Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsUse the least health information an AI app needs, remove direct identifiers, deny unrelated permissions, and verify what happens to prompts after you send them. A “HIPAA compliant” badge is not a universal privacy guarantee: coverage depends on the app’s role and data flows. Consumer apps outside HIPAA may still have obligations under the FTC Act and the Health Breach Notification Rule.
Start with the data, not the marketing claim
Before entering symptoms, uploading a scan, or connecting a health account, assume the information is sensitive and map its path. The useful question is not merely whether an app says it is secure. Ask what it collects, why it collects it, where it sends it, who can see it, how long it keeps it, and how deletion works.

Health information can identify you directly (a name or insurance number) or indirectly (a rare condition combined with an exact date, location, employer, or photograph). Voice recordings, images, device identifiers, IP addresses, and account details can also become part of the record associated with a health question. A prompt that looks anonymous may be identifiable when combined with other data.
The safest default is to use a purpose-built service with clear controls, submit only what is needed for the immediate task, and keep a clinician’s portal as the place for a complete medical record. A general-purpose chatbot is usually the wrong destination for an entire chart unless you have carefully verified its terms, retention, access, and deletion behavior.

Why HIPAA does not answer the whole question
HIPAA applies by role and transaction
In the United States, HIPAA privacy and security rules apply to covered entities, such as many healthcare providers, health plans, and healthcare clearinghouses, and to business associates performing defined services for them. An AI feature embedded in a provider’s workflow may therefore be handled differently from a consumer app that you download and use directly. The same underlying model can receive different legal treatment depending on who operates the service, whose data it handles, and under what agreement.
HHS mobile-health resources, including its Federal Mobile Health Apps Interactive Tool, are designed to help developers and organizations determine how HIPAA protections apply. They are not a consumer-facing certification of every app that mentions health.
Consumer apps can fall outside HIPAA
Many direct-to-consumer symptom checkers, wellness tools, and AI assistants are not HIPAA-covered entities or business associates. That does not make their practices unregulated. The FTC Act can apply when a company makes privacy or security promises and fails to honor them. The FTC has stated that consumers care about the privacy and security of health-related information and that a company’s express or implied privacy promises must match its conduct.
The Health Breach Notification Rule is separate
The FTC’s April 26, 2024 announcement of final changes to the Health Breach Notification Rule clarified that a breach can involve unauthorized acquisition or unauthorized disclosure of identifiable health information. The rule can reach certain health apps and related vendors outside HIPAA. If a qualifying incident occurs, the provider may have notice duties even though no hospital or health plan was involved.
Consequently, “not HIPAA-covered” is not the same as “no legal duties,” and “HIPAA compliant” is not a substitute for a concrete description of collection, sharing, retention, deletion, access, and incident response. The FTC has warned against unsupported labels such as “HIPAA Compliant,” “HIPAA Secure,” or “HIPAA Certified.”
Map an app’s data flow before you use it
Use the app’s privacy policy, consent screens, settings, help pages, and account controls together. Record the answers before submitting anything you would regret exposing. A screenshot of an important setting or promise gives you a dated record if the interface later changes.

| Question | What to verify | Why it matters |
|---|---|---|
| What is collected? | Typed prompts, uploaded files, images, voice, device identifiers, contacts, location, usage logs, and health-platform data | Extra fields increase the number of ways your health information can be linked to you. |
| Where does it come from? | Your manual entry, a connected wearable, a patient portal, a photo library, or another account | A connection can continuously transfer information rather than sending one deliberate prompt. |
| What is the purpose? | Answering your question, safety monitoring, analytics, advertising, product improvement, or model development | A service may use data for purposes beyond the feature you opened. |
| Who receives it? | Affiliates, cloud hosts, analytics providers, advertisers, contractors, clinicians, or other users | Third-party access can create additional retention and breach exposure. |
| How long is it retained? | Chat history, backups, logs, voice files, images, and deactivated-account data | Deleting a visible conversation may not delete every copy. |
| How is it deleted or corrected? | Per-chat deletion, account deletion, export, correction, and any exceptions for legal or security records | You need a practical way to remove or fix information, not just a general promise. |
| Who can review it? | Human reviewers, safety teams, support staff, contractors, or clinicians | Human access may be limited, sampled, or triggered by a support request. |
| What happens after an incident? | Security contact, investigation process, notification commitments, and regulator instructions | A clear response plan reduces uncertainty if data is exposed. |
If a policy uses broad phrases such as “may share with partners” without identifying categories or purposes, treat that ambiguity as a risk. A privacy interface should let you make meaningful choices rather than presenting optional collection as necessary for every feature.

Repair common Windows errors and clear accumulated junk for a smoother, more stable PC - no reinstall needed.Free scan · no reinstallMinimize every prompt and upload
The FTC’s mobile-health best practices put it plainly: “Minimize data.” Data minimization is the strongest protection available before an app receives anything. If a detail is not needed to answer the question, leave it out.
Remove direct identifiers
- Full name and usernames that reveal your identity
- Street address, email address, and phone number
- Medical-record, insurance, prescription, or billing numbers
- Exact birth date; use an age range when age precision is unnecessary
- Exact dates of appointments, procedures, or test results when a relative timeframe works
- Exact location, employer, school, or other uniquely identifying context
- Faces, barcodes, labels, and metadata in photographs
Do not assume that replacing a name with “Patient A” makes a rare case anonymous. A combination of an uncommon diagnosis, small town, exact age, and procedure date may identify one person.
Use the least detailed useful prompt
Suppose you want help understanding a laboratory result. A high-exposure prompt might include a full report, patient header, accession number, date of birth, address, and the physician’s name. A lower-exposure version could say: “For an adult, what can a mildly elevated thyroid-stimulating hormone result mean, and what questions should I ask my clinician?” If interpretation requires the actual value, provide the value and units while removing the header and identifiers.
For an image, crop out labels, wristbands, faces, room numbers, and paperwork. Check whether the file retains location or other metadata before uploading. If the app can answer from typed facts, do not grant access to your entire photo library or health platform.
Know when more detail is justified
Some tasks genuinely depend on age, pregnancy status, medication dose, timing, allergies, or a complete image. Provide those details only when they change the answer, and explain no more than the app needs. An AI response is not a substitute for urgent medical care; do not delay emergency help while trying to make a prompt perfectly private.

Inspect model-training, sharing, and human-review settings
Look specifically for language about prompts, uploads, recordings, and images. A service may distinguish between content stored in your chat history and content used to improve a model. It may offer an opt-out, a temporary mode, or an account type with different defaults. Confirm which control applies to the feature you are using and whether opting out affects future data only or previously submitted material as well.
Model improvement
Find out whether your content is used for model training, evaluation, safety testing, or product improvement. Check whether the setting is on by default, whether human reviewers can see samples, and whether an opt-out is available. “We do not sell your data” does not necessarily mean “we never use your prompts for improvement.”
Third-party sharing
Identify categories of recipients and the purposes for sharing. A cloud provider processing data on the app’s behalf is different from an advertising or data-analytics recipient, but both should be explained. Ask whether a connected health platform receives the AI conversation and whether removing the connection stops future transfers.

Check separate controls for deleting a single chat, clearing history, deleting uploaded files, deleting voice recordings, exporting data, and closing the account. Look for statements about backups, fraud prevention, legal holds, safety logs, and de-identified or aggregated information that may remain after account deletion. If the policy does not state a period, do not infer that data disappears immediately.
Human access
Determine whether employees or contractors may review content, under what circumstances, and how access is logged or limited. A support ticket can expose the text or image you attach, so redact it before asking for help when possible.
Turn off permissions the feature does not need
The FTC’s mobile-health guidance also says to “Limit access and permissions.” Grant only the access required for the specific function, and revisit it after an update.

- Contacts: deny access unless the app’s core function is genuinely contact-based.
- Location: choose “never” or approximate location when a local service is not required.
- Microphone: allow only while recording a deliberate voice prompt; disable background access.
- Camera and photos: use a one-time image selector instead of the entire library when the operating system offers that choice.
- Health-platform connections: connect only the data categories and date ranges needed, then revoke access when finished.
- Advertising and tracking: disable optional personalization or cross-app tracking controls.
On your phone or computer, review the operating system’s privacy dashboard and the app’s own settings. A permission granted months ago can remain active even after you stop using the feature.

Secure the account, device, and recovery path
Privacy controls cannot protect an account that someone else can enter. The FTC’s best practices include “Keep authentication in mind.” Apply these steps before storing sensitive conversations:
- Use a unique, long password that you do not reuse on email, banking, or social accounts.
- Enable multi-factor authentication. Prefer an authenticator app or security key when supported; protect the recovery codes as carefully as the password.
- Review active sessions, remembered devices, and connected applications. Sign out of devices you no longer control and revoke unnecessary integrations.
- Keep the operating system, browser, app, and security software current. Updates often fix vulnerabilities that can expose stored chats or tokens.
- Use a device lock and encrypted storage. Avoid entering health information on a shared or public computer.
- Lock down email and phone-number recovery, because an attacker who takes over either can reset the AI account.
NIST SP 800-66r2, published February 14, 2024, is an implementation guide for organizations safeguarding electronic protected health information under the HIPAA Security Rule. Its themes—risk assessment, authentication, access control, secure transmission and storage, and incident response—also explain the protections a trustworthy service should be able to describe, even though the guide is not a consumer certification.

When choosing between services, score each one using the same questions. “Not stated” is a meaningful result: it tells you the provider has not given enough information to assess the risk.
| Comparison area | Questions to ask |
|---|---|
| Data collected | Does the feature require typed text only, or also images, voice, location, contacts, device identifiers, or health-platform feeds? |
| Training and improvement | Are prompts or uploads used to train or evaluate models? Is the default clear, and can you opt out? |
| Third-party sharing | Which providers, affiliates, advertisers, or contractors receive data, and for what purpose? |
| Retention and deletion | How long are chats, files, recordings, logs, and backups kept? Can you delete, export, or correct them? |
| Human review | Who may inspect content, under what triggers, and with what access controls? |
| Permissions | Can you deny optional contacts, location, microphone, camera, photo, advertising, and health permissions? |
| Security disclosures | Does the provider explain authentication, access control, encryption in transit and at rest, and account recovery? |
| Breach response | Is there a security contact and a clear commitment to investigate and notify affected users? |
| Legal role and geography | Is the service acting for a covered provider, directly for consumers, or in another role, and which country’s rules govern the account? |
| Interface clarity | Can an ordinary user find these answers without interpreting vague legal language? |
Prefer the service that gives specific, consistent answers and usable controls over one that relies on a prominent privacy slogan. Save the policy version or take screenshots when you make the decision.

Use clinician portals for complete records when available
A clinician’s portal or a purpose-built service operating under a healthcare organization may have clearer contractual, access, and retention arrangements for medical records. That does not eliminate risk, and HIPAA coverage still depends on the parties and data flow, but it gives you a more appropriate place for a full chart than a general consumer chatbot. Ask the provider how its AI feature handles prompts, whether the feature is supplied by another company, who can review content, and how records are retained.
Best Value
For a consumer app, treat every uploaded document as a separate disclosure. A complete pathology report, discharge summary, or imaging study can contain identifiers in headers, embedded metadata, and narrative details that are easy to miss. Share a redacted excerpt when that is enough.
What to do if an app reports a breach
Act on the provider’s notice, but do not wait to reduce preventable exposure.
- Read the notice carefully. Record the incident date or period, information involved, affected account, and the provider’s recommended actions. Confirm the notice through the app’s official support channel rather than an unsolicited link.
- Change the app password. If you reused it anywhere, change those accounts too, starting with email and financial services. Do not reuse the replacement password.
- Revoke sessions and connections. Sign out unknown devices and disconnect health platforms, cloud drives, or other apps that no longer need access.
- Enable or strengthen multi-factor authentication. Replace compromised recovery codes and review the recovery email and phone number.
- Check account activity. Look for unfamiliar exports, prompts, profile changes, billing events, or support requests. Preserve relevant records.
- Monitor for follow-on harm. Watch email, financial accounts, insurance activity, and other services for suspicious password resets or identity use. Health information can remain sensitive long after a password is changed.
- Follow regulator and provider instructions. The FTC’s Health Breach Notification Rule may require notices in qualifying cases outside HIPAA. The provider’s notice should identify available assistance and contact points.
- Stop unnecessary collection. Remove old chats and files using the controls available, revoke optional permissions, and pause the service until you understand what happened.
Do not send additional medical records to “verify” your identity through an unsolicited message. Use a known support address and independently confirmed website or phone number.

- A prominent “HIPAA” claim with no explanation of the provider’s legal role or data flow

- No separate controls for chat history, files, recordings, and account deletion
- Required access to contacts, precise location, the entire photo library, or unrelated health categories
- No explanation of human review, contractor access, or support-ticket handling
- No security contact, breach process, or account-session management
- Contradictory answers between the privacy policy, app settings, and consent screen
- Pressure to upload a complete record when a short, redacted prompt would work
Any one issue may have an explanation, but several together justify choosing another service or using a clinician-controlled channel.
A repeatable pre-send checklist
- Write the task in one sentence and identify the minimum facts needed.
- Remove names, contact details, record and insurance numbers, exact dates, exact location, and identifying images.
- Check whether the app needs a file, voice clip, camera, contacts, location, or health-platform connection at all.
- Read the current policy and settings for training, sharing, retention, deletion, export, correction, and human review.
- Disable optional permissions and advertising or personalization controls.
- Confirm a unique password, multi-factor authentication, current software, and a protected recovery path.
- Save screenshots of important privacy choices and promises.
- Send the smallest useful prompt, then delete the conversation or file if the service’s controls and retention terms make that appropriate.
Health apps change their features, defaults, vendors, and policies. Recheck these points after a major update, when enabling a new integration, or before submitting a more sensitive type of record.
