Protect student privacy by proving exactly what an AI tutor collects, where each item goes, who can access it, and whether it is used for model training before any student information is entered. A school should permit training use only when the instructional purpose, contract, technical settings, security controls, and applicable federal, state, and institutional requirements all support it. A general “privacy-friendly” label or a vendor promise on a marketing page is not enough.
What “training” means in an AI-tutor deployment
Schools use the word training for several different activities. A vendor might use a student’s prompt and the tutor’s answer to improve a general model, fine-tune a model for one district, create analytics, or simply keep conversation history so the tutor can continue a session. Those activities have different data flows and may require different approvals.

Separate two decisions from the start:
- Service delivery: the minimum processing needed to answer a student, authenticate a user, save an approved learning record, or provide teacher reports.
- Model or product improvement: retaining, reviewing, labeling, aggregating, or otherwise using inputs and outputs to improve a model or service beyond the student’s immediate tutoring session.
A vendor may describe both activities with one phrase such as “we do not sell data.” That statement does not tell a school whether prompts are retained, whether humans can review them, or whether they enter a training pipeline. The school must obtain the vendor’s current written terms and product documentation and reconcile them with the intended use. The U.S. Department of Education’s Privacy and Education Technology page directs schools to resources for reviewing online-service practices and terms of service.

Define the instructional purpose before choosing a tutor
Privacy controls are easier to judge when the school can state what the tutor is supposed to accomplish. The Department’s 2026 classroom-technology guidance emphasizes transparency, regular effectiveness review, evidence of learning value, and clear evaluation questions. Read the Department’s 2026 guidance release and write down answers to these questions:

- What learning problem is the tutor intended to solve?
- Which students, educators, courses, and grade levels are in scope?
- When may a student use it, and for how long?
- What human support remains available when the tutor is wrong, unsafe, or unsuitable?
- What evidence will show that the tool improves learning rather than merely increasing activity?
Do not collect sensitive information simply because a model can accept it. If the purpose is practice with algebra, a full name, disability record, or disciplinary history will usually need a separate justification. A narrow purpose also gives procurement staff a measurable basis for rejecting optional data collection.
Inventory every category of information
Make a data inventory before a pilot. Include information typed by students and teachers, information pulled from school systems, and information the vendor derives from use. “The tutor receives only chat messages” is not an inventory if those messages contain names, identifying details, or pasted school records.
| Information category | Examples to look for | Decision to document |
|---|---|---|
| Prompts and attachments | Questions, essays, images, code, uploaded worksheets, voice or video | Which formats are enabled, and what is the minimum needed for the lesson? |
| Responses and feedback | Tutor answers, hints, scores, rubric comments, teacher corrections | Are outputs saved, exported, or reused for improvement? |
| Direct identifiers | Name, student ID, email address, account name, device identifier | Can the service use a school-generated pseudonym instead? |
| School records | Course enrollment, grades, attendance, individualized education information, behavior notes | Is each field necessary for the stated instructional purpose? |
| Technical and usage data | IP address, browser details, timestamps, feature clicks, error logs | How long is it retained, and who can inspect it? |
| Derived information | Skill estimates, proficiency labels, engagement scores, risk flags, inferred interests | Can the vendor create profiles, and may those profiles be used for training or decisions? |
| Human review data | Samples selected for quality review, safety investigations, or annotation | Who may view the content, under what confidentiality rules, and for how long? |
For each field, record its source, purpose, destination, retention period, access group, deletion method, and whether it is optional. Ask the vendor to identify fields it creates after the session; derived data is still part of the school’s privacy review even when the student never typed it.

Map the complete data flow
Draw the path from a student’s device to every system that stores, analyzes, or transmits the content. A useful map has more detail than a single arrow to “the cloud.”
- Student or teacher input: list the devices, accounts, integrations, and files that can send information.
- Tutor application: identify the application environment, prompt filters, session memory, logging, and administrative dashboards.
- Model provider: determine whether the application calls a separate model company and whether that provider receives raw prompts, outputs, or identifiers.
- Storage and analytics: locate databases, backups, telemetry systems, reporting tools, and support-ticket systems.
- Subprocessors: list every outside organization that hosts, moderates, annotates, secures, or otherwise handles the information.
- Exports and onward sharing: document teacher downloads, learning-management-system exports, parent reports, and any disclosure to another party.
- Deletion points: mark where a record can be deleted and whether copies remain in backups, logs, caches, or model artifacts.
Require the vendor to confirm this map in writing. If the vendor cannot identify the model provider, subprocessors, storage locations, or deletion path, pause the deployment rather than assuming that the missing detail is harmless.
Separate tutoring from optional model improvement
Ask the vendor to classify each use of student information as required for service delivery, optional product analytics, safety and abuse investigation, or model training. The answer should appear in the contract and in administrator settings, not only in a sales presentation.

| Use | Questions for the vendor | School control |
|---|---|---|
| Answering the current lesson | What data is processed in real time, and is it discarded after the session? | Limit fields and disable unnecessary uploads. |
| Conversation history | Is history on by default? Can administrators set a short retention period? | Choose session-only use when continuity is not necessary. |
| Teacher and administrator reports | Which users can view reports, and do reports contain raw prompts? | Use role-based access and export only what staff need. |
| Quality or safety review | Can employees or contractors read student content? Are reviewers bound by confidentiality? | Require a documented purpose, limited access, and deletion deadline. |
| Model training or fine-tuning | Are inputs, outputs, labels, or metadata used to train any model? Is the use automatic? | Require an explicit opt-in approved by the school, or prohibit the use. |
| Aggregated or de-identified improvement | What method removes or masks identifiers, and can records be reidentified? | Have privacy and legal staff assess whether the method is sufficient for the intended use. |
“De-identified” is not a substitute for an explanation. Ask what identifiers are removed, what combinations could identify a student, whether the vendor keeps a reidentification key, and whether the resulting data is still linked to a school or account.
Questions to put to an AI-tutor vendor
Collection and purpose
- List every data element collected directly, imported through an integration, generated by the system, or obtained from a third party.
- Which elements are required to provide tutoring, and which are optional?
- Can the school use pseudonymous accounts, disable voice or image input, or prevent students from uploading records?
- Does the vendor combine school data with information from other customers?
Training and improvement
- Are prompts, responses, attachments, ratings, corrections, or usage metadata used to train, fine-tune, evaluate, or improve a model?
- Does the answer differ for foundation models, customer-specific models, safety systems, and human quality review?
- Is training use on by default, and can the school verify the setting?
- Will a future terms or model change alter the answer without the school’s affirmative approval?
Retention and deletion
- How long are active records, logs, backups, support tickets, and model-development copies retained?
- Who can request deletion, what is the service-level deadline, and what evidence confirms completion?
- Does deletion remove information from derived profiles, analytics, evaluation sets, and training pipelines, or only from the visible account?
Access and disclosure
- Which vendor employees, contractors, administrators, and subprocessors can access content?
- What authentication, role-based permissions, audit logs, and separation between school tenants are provided?
- Under what circumstances may the vendor disclose information for legal requests, security incidents, support, or business transfers?
Subprocessors and infrastructure
- Provide the current subprocessor list, each party’s function, processing location, and notice process for changes.
- Does a model provider receive the raw prompt, the output, the account identifier, or only an internal token?
- Can the school object to a new subprocessor or terminate before a material change takes effect?
The Department’s education-technology privacy resources include a model terms-of-service checklist. Use it to structure this examination, then require answers specific to the product and edition the school will actually deploy.
Make the contract and administrator settings agree
A written promise is weak if the product’s default setting sends data to training systems. Before launch, capture screenshots or configuration records showing the selected options and retain them with the executed agreement.
- State the approved instructional purpose and the permitted data categories.
- Prohibit training, fine-tuning, human review, or secondary analytics unless each use is expressly authorized.
- Require the vendor to identify all subprocessors and obtain approval or provide a meaningful objection and termination process for changes.
- Set retention periods for sessions, reports, logs, backups, and support records.
- Define a deletion request process, deadlines, verification evidence, and treatment of backup copies.
- Require role-based access, administrator audit logs, incident notification, and cooperation with the school’s investigation.
- Restrict onward disclosure and prohibit using school data to advertise to students or build unrelated profiles.
- Require notice before material changes to the model, data practices, terms, or hosting arrangement.
- Specify return or deletion of information when the pilot ends, the contract expires, or the school requests termination.
An illustrative procurement control might say that school-provided prompts and outputs may be processed only to deliver the identified tutoring service and may not be used to train or improve a model without the school’s prior written authorization. Have counsel adapt any clause to the institution’s requirements; this article is not a contract or legal opinion.
Route the deployment through privacy, security, procurement, and legal review
Federal requirements do not produce one universal answer for every AI-tutor scenario. The relevant students, records, purpose, vendor role, disclosures, and state rules determine which obligations apply. The Department’s Protecting Student Privacy guidance covers Department resources on FERPA and PPRA, while the Student Privacy Policy Office administers and provides technical assistance on federal student-privacy laws. Neither page substitutes for an institution-specific legal analysis.
Use this approval sequence:
- Program owner: document the learning objective, users, duration, data minimization plan, and success measures.
- Privacy officer: review the inventory, data-flow map, contract terms, disclosures, retention, deletion, and family or student notices.
- Security team: assess authentication, permissions, encryption claims, logging, incident response, integrations, and account recovery.
- Procurement: verify the vendor edition, service terms, subprocessor list, renewal terms, change notices, and exit obligations.
- Legal counsel: determine which federal, state, local, and institutional requirements apply to the actual students, records, and training use.
- Approving authority: record the decision, conditions, owner, review date, and evidence required before expansion.
Do not let a successful classroom demonstration bypass this sequence. A demo may use synthetic data while production accounts connect to school records and retain content for much longer.

Decide whether student data may be used for training
There is no blanket “yes” or “no” answer that applies to every school or vendor. The decision should be conditional:
- Do not approve training use when the vendor cannot describe the data flow, refuses to identify subprocessors, offers no reliable deletion process, makes training automatic, or provides terms that conflict with school policy.
- Consider a narrowly authorized use only when the school has documented the instructional purpose, confirmed the data categories and recipients, obtained appropriate legal and institutional approval, and matched the contract to verified settings.
- Prefer no student content for general model training when the learning objective can be met with synthetic examples, teacher-authored material, or a session-only configuration.
Approval for one pilot does not authorize a later use. A customer-specific fine-tuning project, a vendor-wide model update, and an internal quality-review sample are separate decisions and should be recorded separately.
Tell educators, families, and students what will happen
Transparency should describe the real system rather than repeat a broad privacy slogan. Explain the tutor’s instructional purpose, who may use it, what information it receives, whether conversations are retained, whether humans or outside providers can access them, whether any information is used for model improvement, and how people can ask questions or report a concern.
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
Give educators practical rules: do not paste unnecessary identifiers, medical details, disciplinary records, or information about another child; use approved accounts; verify tutor feedback; and escalate harmful or inaccurate responses. Students need an age-appropriate explanation of what not to share and an alternative way to obtain help if they decline or cannot use the system.
Keep a record of the notice version, delivery date, responsible administrator, and the route for privacy requests. Update the notice when the school changes the tutor, enabled features, data categories, or approved training purpose.
Evaluate learning value and privacy together
A tutor that protects data but does not help students is not a successful deployment. Define evidence before the pilot begins. Possible measures include completion of the intended practice, quality of student explanations, teacher observations, error rates, accessibility, and outcomes for the specific students in scope. The Department’s 2026 guidance calls for regular review of effectiveness and evidence that classroom technology improves learning; use the guidance release as the starting point for that review.

Review privacy signals at the same time:
- Were students prompted to enter information outside the approved inventory?
- Did logs or reports expose raw conversations to staff who did not need them?
- Did a vendor change a model, retention period, subprocessor, or default setting?
- Did teachers or families misunderstand what “not used for training” meant?
- Did the tutor produce profiles or risk labels that were not part of the approved purpose?
Stop or redesign the pilot when the answer to a material privacy question changes and the school has not approved the change.

| Comparison axis | Evidence to collect | What a stronger candidate shows |
|---|---|---|
| Data collected and training use | Data inventory, product settings, current terms, model-provider statement | Minimal collection, clear separation of service delivery and training, and an enforceable school choice |
| Retention and deletion | Retention schedule, deletion procedure, backup treatment, completion evidence | Specific periods and a verifiable process covering derived and copied data |
| Access and onward sharing | Role matrix, audit-log description, employee and subprocessor access rules | Least-privilege access, transparent recipients, and usable logs |
| Administration and transparency | Administrator console, notice language, change notifications, export controls | Settings that match the contract and allow the school to explain the system accurately |
| Learning effectiveness and fit | Evidence relevant to the intended students and subject, accessibility information, educator feedback plan | A measurable learning case rather than engagement counts alone |
| Implementation support | Training, incident contacts, documentation, integration limits, exit assistance | Named responsibilities and support that do not require unnecessary student data |
If a value is not documented, mark it as unresolved and treat the uncertainty as a procurement risk. Do not award a privacy advantage based on a vendor’s refusal to answer.
Keep governance active after launch
Privacy review is a continuing control, not a one-time questionnaire. Assign an owner and a review cadence appropriate to the risk, with an immediate review for any material change.
- Recheck terms, model behavior, administrator settings, and the subprocessor list before renewal.
- Review access logs and remove staff or accounts that no longer need access.
- Test deletion with a sample record and retain the vendor’s confirmation.
- Track incidents, inaccurate outputs, student complaints, and requests to stop data use.
- Reassess the inventory when a new feature accepts audio, images, files, location, or additional school-system fields.
- Repeat legal and privacy review when the school changes the purpose, student population, vendor, model, or training arrangement.
The Department’s Artificial Intelligence guidance page is another official starting point for current federal guidance. Treat linked materials as guidance to inform the institution’s process, not as a substitute for advice about a specific deployment.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Clear out junk files and repair common Windows errors3Fix the driver behind crashes, sound loss and screen glitchesCommon failure modes and corrective actions
Relying on a “no data sale” promise
Why it fails: sale language does not answer whether prompts are retained, reviewed, or used for model improvement.
Fix: obtain a written answer for each use, recipient, retention period, and training pathway.

Testing with real student conversations
Why it fails: a pilot can create production records before the school has approved the data flow.
Fix: use synthetic or teacher-authored examples until privacy, security, procurement, and legal reviews are complete.
Ignoring derived profiles
Why it fails: proficiency or engagement labels can affect students even when the original chat is deleted.
Fix: inventory derived data, define its purpose, limit access, and include it in deletion and disclosure terms.
Assuming a toggle is permanent
Why it fails: a model update, new subprocessor, or revised default can change the data flow.
Fix: require change notice, retain configuration evidence, and schedule a review before renewal or expansion.
Measuring usage instead of learning
Why it fails: more sessions do not establish that students learned or that the tutor fits their needs.
Fix: define learning evidence and privacy indicators before the pilot and review both together.
A practical approval record
Keep one decision record that a new administrator can understand without reconstructing the pilot. Include:
- Instructional problem, student population, subject, duration, and human-support plan.
- Approved data inventory and end-to-end flow diagram.
- Vendor answers, current terms, subprocessor list, settings evidence, and model-provider details.
- Retention, deletion, access, incident, export, and contract-exit controls.
- Applicable federal, state, local, and institutional review outcomes.
- Family, student, and educator notice versions and delivery records.
- Learning-success measures, privacy indicators, review owner, and next review date.
- Explicit decision: approved, approved with conditions, deferred pending evidence, or rejected.
The decision rule is simple: if the school cannot explain the tutor’s data flow and enforce the limits it needs, student information should not enter the system for training. If the school can explain and enforce those limits, it should still authorize only the narrow use that serves a documented learning purpose and continue checking the arrangement as the technology changes.
