Find and replace yours safely.Free scan · under a minuteProtect patient privacy by treating an AI medical scribe as part of your clinical information system—not as a harmless note-taking app. Map every data flow, determine whether the vendor is acting as a business associate, sign an appropriate business associate agreement (BAA) when required, configure access and retention controls, tell patients how the tool works, and review the workflow under the laws and policies that apply to your practice.
What an AI scribe can expose
An ambient or AI medical scribe may capture a conversation, convert audio to a transcript, send prompts or metadata to a cloud service, generate a draft note, and write that note into an electronic health record (EHR). Different products retain different parts of that chain. Some may keep raw audio, transcripts, drafts, logs, or support copies; others may delete selected data after processing. You cannot assess privacy from the label “AI scribe” alone.

Protected health information (PHI) can include identifiable speech, names, diagnoses, medications, appointment details, images, transcripts, generated notes, and identifiers in metadata. Even a note that omits a patient’s name may remain identifiable when combined with the encounter date, specialty, or clinical details.
HHS advises organizations using a cloud provider for electronic PHI (ePHI) to understand the service and perform their own risk analysis. See HHS guidance on HIPAA and cloud computing.

Start with a complete data-flow map
Document the workflow before purchasing, enabling, or expanding the tool. A simple diagram should show the conversation moving through each system and party:
- Capture: Is the microphone or mobile device recording the entire visit, selected portions, or only clinician dictation?
- Transfer: Is audio or text sent to a vendor cloud, and where are the service and backups located?
- Processing: Does the vendor create a transcript, summary, draft note, coding suggestion, or other output?
- Storage: Which inputs and outputs remain after the note is generated, for how long, and in which environments?
- Integration: What is written to the EHR, and can the vendor or its support personnel view the record?
- Subprocessors: Which hosting, speech-recognition, analytics, customer-support, or model providers receive the data?
- Deletion: What is deleted on request, at the end of the contract, or when an account is closed—and what cannot be deleted from backups or legal records?
Include prompts, transcripts, audio, notes, user identifiers, timestamps, device information, error logs, and analytics. Ask whether customer data is used to train or improve a general model, whether that use can be disabled, and whether a separate opt-in is required. If the vendor will not describe these flows clearly, you cannot make a reliable privacy assessment.
Determine whether HIPAA and a BAA apply
HIPAA applies to covered entities and business associates defined by law; it does not automatically cover every consumer app or technology company that handles health-related information. A provider’s workflow, the type of data, and the vendor’s role determine the analysis.
The Tool Desk
Outbyte PC Repair FREERepair Windows errors before they cause bigger problemsFix Now →Outbyte Driver Updater FREEFix the driver behind crashes, sound loss and screen glitchesFind Drivers →A vendor is generally a business associate when it creates, receives, maintains, or transmits PHI on behalf of a covered entity or another business associate. In that situation, HIPAA generally requires an appropriate BAA. The agreement should define permitted uses and disclosures, require safeguards, address reporting and cooperation duties, and set out what happens to PHI when the relationship ends. HHS explains these responsibilities in its cloud-computing guidance.
A signed BAA is necessary in workflows where HIPAA requires one, but it is not a certification that a product is “HIPAA compliant.” It does not replace your security risk analysis, configuration decisions, workforce controls, patient communication, or review of state and other privacy laws. A vendor’s marketing claim or a compliance badge cannot answer those questions for your organization.
Questions to put to the vendor and your contract team
- Will the service sign a BAA for the exact product, account, and integration being used?
- What data does the vendor create, receive, maintain, or transmit?
- What uses and disclosures are allowed, including model training, analytics, support, and product improvement?
- Which subprocessors are involved, in what countries, and under what contractual controls?
- How are data encrypted in transit and at rest, and who manages keys?
- What authentication, role-based access, audit logging, and administrator controls are available?
- How are incidents reported, investigated, and communicated?
- What are the retention periods for audio, transcripts, drafts, notes, logs, and backups?
- Can data be returned or destroyed at termination, and how is destruction verified?
Apply safeguards in layers
The HIPAA Security Rule requires appropriate administrative, physical, and technical safeguards for ePHI. The right controls depend on your risk analysis and environment. HHS’s Privacy Rule guidance and the Office of the National Coordinator’s provider privacy and security resources provide broader implementation context.
Administrative controls
- Assign an owner for the scribe, approve its use for each setting, and document the risk analysis.
- Train clinicians and staff not to place unnecessary sensitive details into free-text prompts or personal accounts.
- Define who may activate recording, correct a draft, export a note, or administer the integration.
- Maintain an incident-response path for a lost device, misdirected note, unauthorized access, or vendor notification.
- Review the tool after a model change, integration change, vendor or subprocessor change, new use case, or change in applicable law.
Technical controls
- Use organization-managed accounts, strong authentication, and single sign-on or multifactor authentication where available.
- Give each workforce member the minimum access needed; separate clinical, support, and administrative roles.
- Enable audit logs and review who accessed recordings, transcripts, drafts, and notes.
- Use managed devices, current operating systems, screen-lock policies, and encrypted connections.
- Restrict downloads, local caching, copy-and-paste, and external sharing when the product supports those controls.
- Require clinician review and correction before an AI-generated draft becomes part of the legal medical record.
Physical and environmental controls
- Place microphones so people outside the encounter cannot hear or be recorded unnecessarily.
- Use private rooms and check for visitors, interpreters, trainees, or other people who should be included in the privacy explanation.
- Secure tablets, phones, laptops, and workstations; do not leave an active recording session unattended.
- Do not use a personal device or consumer account unless your organization has approved and secured it.
HHS notes that customers may seek additional assurance, such as safeguard documentation or audit information, as part of their risk-management process. Ask for evidence that matches your actual deployment rather than accepting a generic security statement.
Set retention and deletion deliberately
There is no universal AI-scribe retention period established by the cited HHS or NHS guidance. The correct period depends on the service, your records policy, clinical and legal requirements, and the data element involved. Do not assume that deleting the final note deletes the audio or transcript.

Write down separate decisions for:
- raw audio;
- machine transcripts and intermediate drafts;
- the clinician-reviewed note in the EHR;
- vendor support records, audit logs, and security telemetry;
- backups and disaster-recovery copies.
Prefer the shortest period that supports the approved clinical and operational purpose. Verify deletion in practice, including what happens to copies held by subprocessors. At contract termination, a BAA should address return or destruction of PHI where feasible; HHS discusses this obligation in its cloud guidance. Preserve the EHR record according to your normal medical-record retention rules rather than treating it like disposable audio.
Tell patients and handle preferences consistently
Patients should know when an AI scribe is being used, what it captures, why it is used, where information goes, and what happens after the visit. Your notice should be understandable, brief enough to use in the room, and consistent with your privacy notice and organizational policy.
Telehealth.HHS.gov recommends informed consent and documentation of privacy preferences in telehealth workflows; see Develop a privacy and security telehealth strategy. NHS England’s guidance similarly emphasizes information governance and directing people to the organization’s privacy notice; see Using AI-enabled ambient scribing products in health and care settings and Guidance on AI-enabled ambient scribing products.
A practical room workflow
- Before recording, identify the tool and explain that it will capture the encounter to help prepare documentation.
- Describe what is retained, who can access it, and whether audio is deleted after processing under your configured policy.
- Invite questions and record the patient’s preference in the approved system.
- If the patient declines, stop recording and use the documented alternative, such as ordinary typing or dictation.
- Check the draft for omissions, invented details, wrong speakers, and inappropriate wording before signing or importing it into the EHR.
U.S. recording-consent statutes vary by state and context, and other countries have different rules. The cited guidance does not create one nationwide consent script. Obtain privacy or legal review for the jurisdiction, specialty, employment arrangement, and care setting in which you operate. HHS’s audio-only telehealth guidance is a useful HIPAA reference but does not resolve every recording-law question.
Build a launch and monitoring playbook
A written procedure turns privacy principles into repeatable behavior. Start with a limited pilot using approved clinicians, devices, rooms, and encounter types. Test a complete visit from activation through EHR filing, including a patient refusal, a dropped connection, an incorrect speaker label, and an account with the least-privileged role. Confirm that recording indicators are visible, that stopping the session actually stops capture, and that the clinician can work without the tool.
Before expansion, have privacy, security, clinical, records-management, and procurement owners sign off on the data-flow map, contract, configuration, patient notice, and fallback process. Keep a versioned record of settings such as audio retention, model-improvement choices, integrations, administrator permissions, and subprocessor lists. Recheck those settings after updates rather than assuming defaults remain unchanged.
Monitor more than system uptime. Review access logs for unusual downloads or support access, sample generated notes for omissions and invented details, confirm that refusals are honored, and track vendor incident notifications. Give staff a clear route to report a suspected disclosure, wrong-patient note, lost device, or unexpected recording. Preserve relevant logs, contain access, notify the responsible privacy or security leader, and follow your organization’s incident and legal-notification procedures.

Compare services on the workflow, not the slogan
When evaluating two or more products, request written answers for the same encounter and integration. Use this comparison table:
| Dimension | What to verify |
|---|---|
| Audio capture | Whether raw audio is recorded, streamed, cached, or retained; how recording starts and stops. |
| Location and transfers | Storage regions, international transfers, backups, and every subprocessor. |
| Secondary use | Whether prompts, audio, transcripts, notes, or metadata are used for training, analytics, or advertising. |
| Contract | BAA availability where applicable, permitted uses, incident duties, audit rights, and termination terms. |
| Access and auditability | Role-based access, multifactor authentication, logs, administrator controls, and support access. |
| Retention and deletion | Default and configurable periods, deletion evidence, backups, and end-of-contract handling. |
| EHR integration | What enters the record, who can view drafts, and whether clinician approval is required. |
| Patient workflow | How the product supports explanations, consent or preference recording, refusal, and interruption. |
These are evaluation dimensions, not a government certification rubric. A product that performs well on one dimension may still be unsuitable if its retention, contract, or patient workflow does not fit your risk analysis.

Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. Is an AI medical scribe HIPAA compliant?
There is no yes-or-no answer for the category as a whole. A particular deployment may be capable of supporting HIPAA obligations when the vendor relationship, BAA, configuration, safeguards, access controls, retention, and workforce practices are appropriate. The same service can be used in a noncompliant way if it is connected to the wrong account, retains data unexpectedly, lacks required contractual terms, or is used without the organization’s risk analysis and policies.

Does an AI scribe keep the recording?
Some services may retain audio; others may process it transiently or offer configurable deletion. The answer is product- and configuration-specific, and the cited guidance does not establish a universal period. Ask for the lifecycle of audio, transcript, draft, note, logs, and backups, then verify that the configured behavior matches the patient explanation and contract.

Frequently Asked Questions
How do I protect patient privacy when using an AI medical scribe?
Map audio, transcript, note, metadata, storage, transfers, subprocessors, and deletion. Confirm the vendor’s role and BAA needs, perform your own risk analysis, restrict access, set retention, explain the tool to patients, document preferences, and require clinician review before filing notes.
Do I need patient consent to use an AI scribe?
Requirements vary by jurisdiction, care setting, organizational policy, and whether a conversation is recorded. Use a clear explanation, follow your approved consent or preference process, document the patient’s choice, and provide a non-recording alternative when required or requested. Obtain local legal review rather than relying on a universal script.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitchesWhat should a BAA for an AI scribe cover?
It should match the actual product and integration, define permitted uses and disclosures, require safeguards, address incident reporting and cooperation, identify subcontractor responsibilities, and explain return or destruction of PHI at termination where feasible. A BAA does not replace your risk analysis or technical controls.
Can an AI scribe use patient conversations to train its model?
Only if the contract and applicable privacy rules permit that use. Ask whether audio, prompts, transcripts, notes, or metadata are used for training, analytics, advertising, or product improvement; whether the use can be disabled; and whether a separate opt-in applies. Record the chosen configuration.
Who should be allowed to see recordings and drafts?
Use minimum-necessary, role-based access. Separate clinical, support, and administrative permissions, use organization-managed accounts and strong authentication, enable audit logs, and restrict downloads or external sharing when available. Review vendor support access as well as workforce access.
What happens if a patient refuses an AI scribe?
Stop or do not start recording, document the preference in the approved system, and use the designated alternative such as ordinary typing or dictation. Staff should know how to handle refusal without delaying care and how to pause recording when an unexpected participant joins.
How often should privacy controls be reassessed?
Reassess when the vendor, model, subprocessor, integration, data flow, clinical use, organizational policy, or applicable law changes. Also review pilot results, access logs, incidents, and deletion tests. The schedule should be documented and owned by a named person.
The Bottom Line
An AI medical scribe can fit a privacy-protective workflow, but only when you understand every data path and govern it like a clinical system. Verify the vendor role and BAA, apply layered safeguards, limit retention, explain recording to patients, honor refusals, and require clinician review. Recheck the arrangement whenever the product, workflow, or law changes.
