Share the minimum data needed for the stated public-health or research purpose, remove or transform identifiers using a method suited to your legal setting, and match access controls to the remaining re-identification risk. A dataset can meet a technical definition of “de-identified” and still reveal a person when unusual details are combined with outside information. Treat privacy as a continuing governance process—covering consent, review, transfer, access, and release—not as a one-time anonymization export.
Start with purpose, recipient and minimum necessary data
Write a short data-sharing brief before extracting records. State the infectious-disease question or public-health activity, the intended recipient, the variables requested, the geographic and time period, and whether the recipient may share onward. The Centers for Disease Control and Prevention (CDC) says public-health data should be acquired, used, disclosed and stored for legitimate public-health purposes, and recommends collecting personally identifiable information only when necessary and using nonidentifiable data whenever possible. See the CDC’s Data Sharing and Collection Principles and Standards (April 23, 2024).

Build a data dictionary before you build the file
List every proposed field and classify what it contributes to the analysis. Keep a variable only when you can explain its necessity to the recipient’s stated objective. For example, an outbreak-trend analysis may need week of specimen collection, age band and county, but not a full date of birth, street address or a medical-record number. A transmission-chain study may require more precise timing or location; document why that precision is essential and what additional controls it triggers.

- Keep a private linkage key only when the study design requires recontact, longitudinal updates or correction. Store it separately with stricter access and a different administrator.
- Define an end date or event for access, deletion, return or archival review. “Indefinite” access should be a deliberate, documented decision rather than a default.
Confirm authority, consent and institutional review
Privacy protections depend on the people, institutions, jurisdictions and data types involved. HIPAA’s Privacy Rule generally covers individually identifiable health information held or transmitted by covered entities and business associates; it does not automatically govern every researcher or every health dataset. HHS explains the scope and public-health provisions in its de-identification guidance, while CDC provides an overview of HIPAA Privacy Rule questions.

Read the consent language literally
Check whether participants were told that data could be shared outside the original study, with whom, for which future uses, for how long and under what safeguards. NIH’s Principles and Best Practices for Protecting Participant Privacy recommends clear consent about future sharing and use. If the proposed recipient or purpose falls outside the consent, ask the institutional review board (IRB), privacy office or equivalent authority whether a new consent, waiver, amendment or restriction is required.
Record the decision in the Data Management and Sharing Plan
NIH expects researchers to describe justified limitations on sharing in their Data Management and Sharing Plans. Keep the approval, consent interpretation, risk assessment and decision-maker’s rationale with the project record. Include any Tribal, state, local, contractual, funder or disease-specific requirements. Cross-border transfers may add data-protection, localization or ethics obligations; obtain project-specific legal review rather than assuming a U.S. framework travels unchanged.
Assess identifiability in context
Ask whether a reasonably informed recipient—or someone with reasonably available outside information—could single out a person, link records to that person or infer sensitive facts. Risk is not determined only by whether a name column is present. A rare infection in a small village, an unusual occupation and an exact admission date can identify someone when joined to a news report or public registry.

| Method | What it requires | When it may fit | Important limitation |
|---|---|---|---|
| Safe Harbor | Remove the specified classes of identifiers and have no actual knowledge that the remaining information could identify an individual. | A repeatable baseline for datasets whose scientific purpose tolerates the prescribed suppression and generalization. | Removing listed fields does not eliminate contextual or linkage risk; rare combinations still require review. |
| Expert Determination | A qualified expert applies generally accepted statistical and scientific principles to determine that the risk of identification is very small for the anticipated recipient, considering reasonably available information. | Studies needing more detail than Safe Harbor permits, or datasets requiring a documented, context-specific risk analysis. | HHS says there is no single numerical threshold that universally satisfies this standard; the conclusion must be justified for the actual release. |
These are HIPAA standards, not a universal definition of anonymity. NIH warns that combinations of otherwise de-identified information can permit identity inference, particularly in qualitative material. Its Notice NOT-OD-22-213 (October 21, 2022) discusses this residual risk and the need to balance privacy with scientific utility.
Handle dates, geography and free text deliberately
- Dates: replace full dates with week, month, season or study-day offsets when exact timing is not essential. For longitudinal analyses, use a consistent offset from an event rather than publishing calendar dates.
- Geography: aggregate small areas into larger regions, suppress cells below a locally justified threshold, or provide coordinates only through a controlled environment. A larger geographic unit can still be identifying when the disease is rare.
- Age: use bands where possible and review extreme ages separately. A precise age paired with a rare condition may be more identifying than expected.
- Free text, images and audio: redact names, addresses, employers, distinctive events and indirect clues. De-identification of narrative and multimedia content requires human review; automated masking alone can miss context.
- Genomic and laboratory data: treat them as potentially identifying when combined with genealogy, clinical or public databases. Share only the resolution needed for the analysis and consider controlled access.
Choose a sharing tier based on residual risk and utility
There is no single best tier for every infectious-disease dataset. Compare options using five questions: how much re-identification risk remains in context; how much scientific utility is lost through transformation; who can access the data; whether consent and law fit the proposed use; and how enforceable recipient and onward-use restrictions are. NIH’s Data Sharing Approaches (updated August 5, 2025) and its privacy best-practices page recommend considering controlled access even when a dataset meets a de-identification definition.
| Tier | Typical contents | Controls | Trade-off |
|---|---|---|---|
| Open, de-identified release | Generalized or aggregated variables with low contextual risk. | Public documentation, prohibition on re-identification and a contact for concerns. | Maximum discoverability and reuse, but the least ability to vet each user or stop onward copying. |
| Controlled-access repository | Detailed individual-level data needed for valid analyses. | Eligibility review, authenticated accounts, approved purposes, audit logs and time-limited access. | Preserves more utility while adding administrative workload and slower access. |
| Restricted enclave or analysis service | Highly detailed, rare, linkable or potentially identifying data. | Analysis inside a monitored environment; export of vetted results only. | Strongest practical control, but limits analytic flexibility and requires sustained infrastructure. |
Use the least restrictive tier that is defensible for the actual variables and recipient. A dataset may move to a stricter tier if a new linkage source appears, an outbreak makes a group easier to identify, or the recipient’s role changes.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Scan for outdated or missing drivers - takes under a minute3Repair Windows errors before they cause bigger problemsDesign the transfer agreement and technical controls
Put enforceable rules in writing
A data-use or sharing agreement should identify the approved purpose, fields, users and duration; prohibit re-identification, contact of participants and unapproved linkage; restrict onward transfer; require incident reporting; describe publication and disclosure review; assign responsibility for access decisions; and state what happens at expiry, withdrawal or breach. NIH recommends agreements that establish oversight, recipient responsibilities and restrictions. CDC advises that partners handling certain shared public-health data meet security standards equivalent to its own.

- [Easy Disassemble] Making incidental repairs quick and easy! Very nice, flexible cable
- [Dont Hesite to Order] 24 hours customer services and professional technology team are standing by
Apply least privilege throughout the lifecycle
- Prepare: work from a controlled copy, remove unnecessary fields and record the transformation script or manual decisions.
- Store: encrypt data at rest and in transit, separate linkage keys, restrict administrator privileges and enable logging.
- Approve: verify the recipient’s identity, role, training, institutional approval and accepted agreement before granting access.
- Use: provide only the approved tables or views; prevent bulk export where an enclave is warranted; review unusual downloads and failed login patterns.
- Close: revoke accounts, obtain deletion or return confirmation when required, preserve only the records needed for audit, and reassess any retained copy.
Technical safeguards do not replace legal or ethical review. Conversely, a signed agreement cannot compensate for an unnecessarily detailed public release.
Review outputs before publication or release
Disclosure review must cover not only the row-level dataset but also tables, figures, maps, dashboards, model outputs and narrative examples. CDC’s standards call for preventing public access to raw data or tables that could contain indirectly identifying information and for checking data quality before dissemination. Examine:
- small cells, especially intersections of age, sex, location, occupation and rare disease;
- unique or near-unique combinations that a local person could recognize;
- exact outbreak dates, facility names, travel routes or household descriptions;
- maps whose zoom level exposes a residence, farm or small institution;
- quotes, case histories, photographs, audio or video that retain distinctive details;
- model predictions or outlier records that reveal an individual even after aggregation.
Use suppression, aggregation, top- or bottom-coding, noise addition, category merging or removal of the example. Re-run the review after every material revision and have someone independent of the analysis challenge the release decision.
Communicate limitations to repositories and downstream users
Every release should include a plain-language README describing the population, dates, geography, transformations, missingness, known residual risks, approved uses, prohibited uses and the contact for privacy concerns. State that de-identification reduces risk but does not guarantee anonymity. Explain whether users may link the data to other sources, whether they must destroy derived files, and how to report a suspected identification.

HHS puts the boundary plainly: “Although the risk is very small, it is not zero, and there is a possibility that de-identified data could be linked back to the identity of the patient to which it corresponds.” Read the full HHS Office for Civil Rights guidance for the assumptions behind that statement.

“We deleted names, so it is anonymous.”
Why it fails: dates, small-area geography, rare conditions and free text can identify people by linkage.
Fix: perform a contextual risk assessment, generalize or suppress quasi-identifiers, and select controlled access when the residual risk is not very small for the intended recipient.
“HIPAA permits any research sharing.”
Why it fails: HIPAA applies primarily to covered entities and business associates, and its public-health disclosure permission is for specified activities with authorized public-health authorities—not a blanket research permission.
Best Value
Fix: identify the data holder’s HIPAA role, the recipient’s role, the legal pathway and any stronger state, Tribal, local or institutional rule before transfer.
“Consent is a formality after de-identification.”
Why it fails: participants may have been promised limits on future use or sharing, and re-identification risk can persist.
Fix: compare the proposed use with the consent language, seek IRB or ethics review where needed, and document justified limitations in the sharing plan.

A release checklist for infectious-disease teams
- Purpose, recipient, variables and onward-sharing plan are written and approved.
- Consent, IRB or ethics review, contracts and jurisdiction-specific requirements have been checked.
- Direct identifiers and unnecessary quasi-identifiers are removed or transformed.
- HIPAA Safe Harbor or Expert Determination is used where applicable, with context-specific review.
- Residual risk, scientific utility and the chosen access tier are documented.
- Linkage keys are separated, access is least-privilege, and activity is logged.
- The agreement covers approved uses, prohibited linkage, onward transfer, incidents and data disposition.
- Tables, maps, narratives, images, dashboards and derived outputs have undergone disclosure review.
- README documentation states transformations, limitations, permitted uses and a privacy contact.
- Accounts, retention and re-evaluation dates are scheduled.
Using WHO guidance for international programmes
WHO’s Sharing and reuse of health-related data for research purposes: WHO policy and implementation guidance (April 6, 2022) addresses reuse and onward sharing under WHO technical programmes in emergency and non-emergency contexts. It is a useful policy reference for multinational teams, but it is not a substitute for the national law, institutional approvals, participant consent and contractual controls that govern a particular transfer.
What a defensible decision looks like
A defensible release can show, in one record, why the data are needed, what was removed, how identification risk was assessed for this recipient, why the selected access tier is proportionate, what participants were told, who approved the plan, and how misuse or a new risk will be handled. That record lets a future steward revisit the decision when the outbreak, dataset, law or linkage environment changes—without assuming that yesterday’s de-identification remains sufficient.
