Define one lawful purpose, collect the least data that can achieve it, test whether biometrics are actually necessary, prefer processing that keeps identifying templates under passenger control, explain the system before capture, and require accountable human review of consequential decisions. A bus, rail operator, metro authority or airport must combine GDPR controls with other applicable privacy, equality, employment, transport-safety and law-enforcement rules.
Why transport AI creates a special privacy risk
Mobility systems can observe where people travel, when they enter a station, how they move through a concourse, what they say to a service assistant and, in some deployments, distinctive biometric characteristics. The European Data Protection Board (EDPB) describes the mobility sector as especially challenging under the GDPR because it may process location and biometric information while relying on automated systems. Its guidance calls for transparency, fairness and accountability alongside strong data-protection measures.

The first design decision is therefore not “which model should we buy?” It is “what specific outcome must this model deliver, and what is the least intrusive way to deliver it?” Counting people to adjust ventilation is a different purpose from identifying a person for fare enforcement. Combining those purposes in one data lake creates a larger legal and security exposure than either use needs.

Keep safety, service operations, customer assistance, fare enforcement, marketing and law-enforcement requests as separate purposes. A video stream collected to detect track trespass cannot automatically be reused to build a marketing audience. A new purpose requires a fresh compatibility and legal assessment, updated notices and, where required, a new impact assessment or consultation.
Identify the legal basis before deployment
Document the controller, processor relationships, legal basis and any sector-specific authority. Public authorities should not rely on consent merely because it is convenient when passengers have no realistic choice. Where a special-category biometric datum is processed, record the additional condition that permits it and the safeguards that make the processing lawful.
Check national rules governing public-space surveillance, employment monitoring, equality, children, accessibility, policing and critical infrastructure. GDPR compliance is necessary but does not displace those rules. A lawful basis is not a blanket permission: the processing must still be necessary, proportionate, fair, secure and transparent.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsKnow what the system really collects
Separate raw observations from derived data
Inventory each source and output:
- Location and journey data, including vehicle, station, gate, timestamp and ticket events.
- Video or still images from platform, vehicle, body-worn or airport cameras.
- Biometric data, such as a face template or voice characteristics used to identify or authenticate an individual.
- Inferred data, including crowd density, behaviour classifications, emotion labels, risk scores or predicted destinations.
- Operational metadata, model version, confidence score, operator action and audit record.
Derived data can remain personal data even when the original image is discarded. A persistent token that lets an operator follow one person between cameras is still an identifier in practical terms. Record how long each category exists, who can access it, where it is processed and whether a supplier can use it for its own model training.
Do not confuse presence detection with biometric identification
Not every transport camera is a biometric system. The EU AI Act Service Desk gives infrared thermal seat-occupancy or people-counting and track-trespass detection as examples that detect human presence without identifying people biometrically. Those systems can still involve personal data and surveillance duties, but their necessity and proportionality analysis is different from matching a face to an identity.

Test whether an aggregate count, a thermal sensor, edge processing or an anonymous one-time token meets the purpose. If the answer is yes, collecting a face, voice or persistent identifier is difficult to justify as necessary.
Run a necessity, proportionality and rights assessment
Document the alternative you rejected
For each proposed biometric or behavioural model, compare less intrusive options: staff observation, a staffed lane, contactless credentials, a passenger-held token, a local device match, a non-biometric sensor or a randomised sample. Explain why the chosen method delivers a benefit that those alternatives cannot deliver at acceptable cost, speed or safety.

EDPB Opinion 11/2024 says controllers should assess impacts on fundamental rights and consider whether less intrusive means can achieve the legitimate purpose. Treat that opinion as a benchmark for the analysis, not as approval for every airport, station or bus deployment.
Measure who bears the risk
Record expected false matches, missed matches and refusal rates in the actual environments where the model will run. Test different lighting, weather, camera angles, mobility aids, face coverings, skin tones, ages and other conditions relevant to the network. Identify groups that could face more scrutiny or denial of access. Define a manual fallback before launch; a person must not lose a journey, benefit or service solely because a model is uncertain.
Give people a way to challenge a result
Set a route for a passenger to contest an incorrect match, risk flag, fare action or access decision. Specify who reviews the evidence, how quickly they respond, what records are preserved and how the person can travel or receive service while the dispute is pending. Include disability-accessible channels and language support used by the network.

Choose an architecture that limits exposure
| Approach | Typical purpose fit | Data and storage risk | Key privacy controls | Human and passenger safeguards |
|---|---|---|---|---|
| Non-biometric analytics | Counts, occupancy, queue length, thermal presence or track-trespass alerts | Lower sensitivity when outputs are aggregate and no persistent identifier is created | Process at the edge where feasible; discard frames after the event; retain only the operational result and audit record | Explain the sensor and purpose; provide a contact for questions; review alerts before consequential action |
| Passenger-controlled biometric authentication | Authentication where a passenger actively chooses a biometric credential | Biometric sensitivity remains high, but a local template or a centrally encrypted template with the key solely in the passenger’s hands limits operator access | Keep the template on the passenger’s device where feasible; if central storage is unavoidable, encrypt it and separate the key from the operator | Offer an equivalent non-biometric route; make enrollment and withdrawal clear; require human escalation for failed matches |
| Centralized biometric identification | Searching faces or other biometrics across a shared transport database | Highest exposure because a compromise or misuse can affect many people and enable persistent tracking | Require a documented necessity case, strict purpose limitation, segmentation, access controls, short retention and independent testing | Prominent notice before capture, a real alternative where available, human review of every adverse outcome and a challenge process |
In airport passenger-flow scenarios, the EDPB describes passenger-controlled local templates, or encrypted centralized templates with the decryption key solely in the passenger’s hands, as designs that could in principle satisfy specified GDPR principles when appropriate safeguards are applied. Its described centralized-identification design without that key arrangement failed the privacy-by-design and security tests. That conclusion is tied to the scenario and safeguards; it is not a general approval of facial recognition.

Prefer edge and local processing
Run detection on the camera or station device when the operational purpose permits. Send an anonymous count or alert rather than a continuous stream. If a template must be stored centrally, separate the template database from identity records, encrypt both in transit and at rest, and keep decryption keys under passenger control where the use case allows. Restrict operator access by role, log every retrieval and prevent suppliers from repurposing data.
Set an exit condition
Write the deletion trigger before collecting data: after a count is produced, after an incident is closed, when a ticket journey ends, or when a passenger withdraws an optional credential. Delete biometric templates and associated logs when the stated purpose or lawful basis ends. A system without a retirement trigger tends to become a permanent identity infrastructure.
Can buses, trains, metros or airports use facial recognition legally?
There is no universal yes or no. Legality depends on jurisdiction, purpose, affected people, biometric category, location, operator authority, alternatives and safeguards. A transport operator must satisfy the GDPR and applicable national rules; a deployment that is lawful for voluntary authentication may be unlawful for indiscriminate identification in a public concourse.
Ask these questions before a pilot:
- What precise safety, access or service problem requires identification rather than presence detection or a credential?
- Can a less intrusive method achieve the same result with comparable reliability?
- Is enrollment genuinely voluntary, and is an equivalent non-biometric route available without delay or penalty?
- What is the documented error and bias profile in this network’s real operating conditions?
- Who can see templates, search results and confidence scores, and can a supplier use them for another purpose?
- How long are images, templates, matches and operator decisions retained?
- What human review occurs before denial of boarding, a fare action, police referral or other adverse outcome?
Answering “yes” to a technical capability does not answer the necessity and proportionality question. A pilot should stop if the operational benefit cannot be demonstrated without expanding the purpose or retention period.

Apply the EU AI Act controls on the correct timetable
Some transport safety components can be high-risk AI under the EU framework. The European Commission’s high-risk requirements include risk assessment and mitigation, high-quality datasets, logging, documentation, deployer information, human oversight, robustness, cybersecurity and accuracy. The listed high-risk obligations start on 2 December 2027. A deployment plan should therefore assign owners, evidence and budget before that date rather than treating compliance as a final paperwork exercise.
Keep an evidence file
- Intended purpose, prohibited uses and operating environment.
- Training, validation and monitoring data provenance, quality checks and known limitations.
- Model and software versions, configuration changes and rollback steps.
- Accuracy, error, bias and drift results from stations, vehicles and terminals in service.
- Access permissions, vendor actions, security incidents and corrective measures.
- Human-oversight instructions, escalation contacts and records of overrides.
Do not let a supplier’s marketing label decide the classification. Map the actual function and the operator’s role, then obtain legal and technical advice for the relevant market.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Make notices understandable before capture
A sign hidden beside a camera is not a usable explanation. Tell passengers before they enter the capture zone or interact with the system:
- That AI is operating and whether it detects presence, classifies behaviour, authenticates a credential or identifies a person.
- What data the system sees and what it produces.
- The exact purpose and legal basis, including any special-category condition for biometrics.
- Retention periods for images, templates, alerts and decisions.
- Who receives data, including processors, other transport bodies or law-enforcement agencies.
- The controller’s contact, data-protection contact and the rights available to passengers.
- How to use a non-biometric alternative, opt out where applicable and challenge a decision.
Use plain language, large-print and screen-reader-friendly formats, and languages commonly used by the network. Put the short notice at the point of interaction and link it to a fuller policy. Staff should be able to explain the system without directing passengers to a legal document.
European Commission Article 50 guidance, published 20 July 2026 and updated 31 July 2026, states that transparency obligations apply from 2 August 2026. Deployers must inform people when they are exposed to emotion-recognition or biometric-categorisation systems; providers must inform people when they interact directly with an AI system. Build those notices and records into procurement and testing now.
Best Value
Build human oversight and contestability into operations
Define what the model may and may not decide
A model can prioritise an inspection queue or raise an alert, but an unreviewed score should not by itself deny access, impose a fare penalty, trigger a safety intervention or refer someone to police. Write the decision boundary in the operating procedure and require a trained reviewer to inspect relevant evidence.
Design a safe fallback
When a camera is obscured, a device is offline or confidence is low, route the passenger to a staffed process or another credential. Do not pressure a person to enroll in biometrics because the alternative lane is deliberately unusable. Record the fallback outcome so operators can detect whether the system is shifting burdens onto particular groups.
Audit people as well as models
Log searches, disclosures, overrides and manual decisions. Review whether staff are treating alerts as proof, searching outside the stated purpose or retaining screenshots. Independent privacy and security reviews should have access to logs and should report findings to a responsible executive or public authority.
Recommended Free Tools
Operate, test and retire the system
- Before launch: approve the purpose statement, legal analysis, rights impact assessment, data map, notice, retention schedule, security design and fallback route.
- During a controlled pilot: limit locations and users, measure false matches and missed detections in real conditions, and keep a manual decision record.
- In production: monitor drift, disparate error patterns, uptime, vendor access, complaints and incidents. Review model, camera, firmware and dataset changes before release.
- After an incident: contain access, preserve relevant logs, assess affected people, notify authorities or passengers when required, and correct the process rather than merely retraining the model.
- At review points: confirm that the original purpose, legal basis and benefit still exist. Narrow, pause or retire the system when they do not.
Weather, lighting, crowding, construction and demographic changes can alter performance after acceptance testing. A model that worked in a quiet terminal may behave differently on a packed platform at night. Continuous monitoring is therefore a privacy control as well as an accuracy control: fewer false alerts mean fewer people subjected to unnecessary scrutiny.
Procure governance, not just a model
Contracts should prohibit secondary use, require prompt deletion and return of data, describe subprocessors, reserve audit rights, specify breach notification, and set measurable support and patch obligations. Require the supplier to document model versions, training-data provenance, known limitations and access by its personnel. Make a change-control process part of the service rather than accepting silent updates.
For a large network, a privacy-impact-assessment and AI-governance platform can help maintain data maps, approvals, risk registers, model inventories, retention rules and audit evidence. Software does not replace the legal analysis, passenger consultation or accountable decision-maker; it only makes those controls easier to operate consistently.
A practical go/no-go checklist
- Purpose: one specific, documented outcome per model and data flow.
- Necessity: alternatives tested, with reasons a less intrusive option cannot meet the goal.
- Data minimisation: no face, voice or persistent identifier where aggregate or presence data is sufficient.
- Architecture: edge processing or passenger-controlled templates preferred; central identification treated as the highest-risk design.
- Rights: impact assessment, bias and error testing, accessible challenge route and equivalent fallback.
- Transparency: notice before capture, clear purpose, retention, sharing, contact and opt-out information.
- Accountability: named controller, trained human reviewers, complete logs and independent audit.
- Security: encryption, segmented systems, least-privilege access, key separation and tested incident response.
- Lifecycle: deletion trigger, periodic necessity review and a documented retirement decision.
If any item is missing, pause deployment or narrow the design until the gap is resolved. Privacy protection is strongest when it is an engineering constraint and an operating rule from the first diagram, not a notice added after installation.
