A health app is not automatically covered by HIPAA, and deleting an account may not remove laboratory, backup, research or third-party copies. Before sharing DNA data, read the current privacy policy, terms and consent form and record the provider’s answers about access, retention, sharing and deletion.
What counts as genetic data
Genetic privacy involves more than a downloadable DNA report. A service may hold raw sequence or genotype files, interpreted results, family-tree information, family-history details, health questionnaires, contact information, payment records, device identifiers and app telemetry. A laboratory may also retain the physical saliva or other biological sample used for testing.

Genomic information can say something about biological relatives as well as the person who supplied it. Coding or de-identifying records can reduce exposure, but neither method guarantees that re-identification is impossible. A study or company can therefore create privacy consequences for relatives who never opened an account.

Start by listing the minimum information needed for your purpose. If an app can provide a result without a family tree, raw-file upload or continuous device connection, leave those extras disconnected. Do not upload a raw genetic file to another interpretation service merely because it offers additional charts or predictions; first determine what that second service can retain and share.

Which laws protect the information?
HIPAA depends on the organization, not the subject matter
HIPAA’s Privacy and Security Rules generally cover protected health information handled by covered entities, such as most health plans and health-care providers, and by their business associates. In most cases, information that a person enters into an independent app for personal use is outside HIPAA unless the app is provided by, or acting for, a covered entity or business associate. The fact that data came from a doctor, wearable or laboratory does not by itself make the receiving app HIPAA-covered.
That does not mean an independent app has no obligations. The Federal Trade Commission can address unfair or deceptive privacy and security practices, and other federal or state rules may apply depending on the entity, information and function. Treat a label such as “HIPAA compliant” as a narrow claim to investigate: ask which organization is covered, which data are covered and what safeguards the claim actually describes.
GINA is important but limited
The Genetic Information Nondiscrimination Act (GINA) generally addresses genetic-information discrimination in health insurance and employment. It is not a general privacy law and does not prohibit every private company from collecting genetic information. GINA does not apply to life, disability or long-term-care insurance; the National Human Genome Research Institute’s GINA glossary specifically warns that life and long-term-care coverage are outside the law and discusses the disability-insurance limit as well.

State laws may add protections, and rules can differ by insurance product and location. Before giving a result to an insurer, employer or other organization, check the law in your state and the policy or consent language that governs that transaction. Questions to answer before choosing a service
Read the provider’s current privacy policy, terms and any informed-consent document before creating an account or mailing a sample. Save a copy or PDF with the date you accepted it. Seek specific answers to these questions:
What exactly is collected?
- Does the service receive a raw sequence or genotype file, an interpreted report, or both?
- Are family-tree data, family-history answers, contact details, payment information, device identifiers and usage telemetry collected?
- Can you use a pseudonymous account, or must the service verify your legal identity?
What happens to the physical sample?
- Is saliva, blood or another specimen retained after analysis?
- How long is it held, and can you request destruction?
- Are there exceptions for quality control, legal obligations, laboratory records, disputes or already-completed research?
Who can receive the information?
- List affiliated companies, cloud and analytics vendors, laboratories, researchers, commercial partners and law-enforcement disclosures described in the policy.
- Ask whether each recipient receives identifiable, coded or de-identified data and what access controls apply.
- Find out whether the provider licenses data, permits commercial research or transfers information in a merger or sale.
Can the rules change after you consent?
Check whether a material privacy-policy change applies to information already collected. The policy should explain how notice is delivered and whether fresh consent is required. A statement that the provider may revise terms at any time is a reason to ask how existing data will be handled, not a reason to assume the change is harmless.

What does deletion mean?
Look for separate treatment of the login and profile, reports, raw genetic files, backups, laboratory records, research datasets and the biological sample. Ask whether deletion reaches copies held by vendors or collaborators, how long backup copies persist and which records must be retained. If the policy cannot distinguish these categories, request a written explanation before uploading.
Read research consent separately from the app’s privacy summary
A short privacy notice cannot substitute for an informed-consent document. For a research study, identify the project’s purpose, the period of storage, future or unspecified uses, sharing with other researchers, controlled-access repositories, commercial involvement, return of results and the procedure for withdrawing.
Determine whether research participation is an optional, separate choice or bundled into the core service. Ask whether withdrawal stops new analysis only or also removes data and samples already distributed. Some repositories use controlled access and require a secondary study to fit the original consent, but controlled access is not the same as zero risk. A researcher, repository administrator or approved collaborator may still be able to use the coded data for authorized purposes.

Genetic information can reveal relatives’ ancestry or health-related traits. That family dimension should appear in the consent discussion. Re-identification cannot be ruled out with certainty, even when a study removes direct identifiers. This is a limitation to understand, not proof that every study is unsafe.
Minimize exposure before you upload
- Use only the fields and connections required for the result you want.
- Do not connect a full medical-record account, contacts list or location history when a narrower permission will work.
- Keep raw genetic files in your own encrypted storage if you need a backup; do not scatter copies across interpretation sites, email accounts and shared drives.
- Consider whether a clinical provider or a research setting can meet the same objective with clearer governance or clinical oversight.
- Ask whether results are medically validated and whether a qualified professional is available to explain them. A consumer interpretation is not automatically a diagnosis.
Secure the account and the device
Account hygiene cannot control what a provider does with data after receiving it, but it reduces the chance that someone else will enter your account.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minute- Create a unique password. Use a long password that has never been used on another site. A password manager can generate and store it.
- Turn on multifactor authentication. Prefer an authenticator app or security key when the service supports it. A FIDO2-compatible key works only with compatible sign-in systems; it protects the login step, not provider-side databases or copies shared with laboratories.
- Review active sessions and linked accounts. Sign out unknown devices, remove old social-login connections and revoke integrations you no longer need.
- Limit app permissions. On the phone’s privacy settings, allow only the camera, files, Bluetooth, location or contacts access that the feature genuinely requires.
- Update software. Install current operating-system and app updates, and keep a screen lock enabled. Avoid managing genetic results on a rooted, jailbroken or shared device.
- Protect downloaded files. Store reports in an encrypted folder, avoid unencrypted removable drives and do not attach raw data to ordinary email unless you understand the recipient’s security.
The FTC’s developer guidance emphasizes authentication, restricting access, building security into design, collecting less data and deleting information when it is no longer needed. Those practices are useful benchmarks when you evaluate a provider’s security description, but a marketing summary is not an independent security audit.

How to request deletion of DNA data and a sample
Submit a request through the provider’s stated privacy or account-deletion channel, then keep the ticket number and a copy of your message. Be explicit that you are asking about both digital information and the physical specimen.
- Identify the account. Provide the login email, kit or order identifier and any verification the provider requires. Do not send a new copy of your raw DNA file just to prove ownership.
- Name every category. Request deletion of the profile, reports, raw sequence or genotype data, family-tree information, health questionnaires, analytics records and device identifiers associated with the account.
- Address the sample. Request destruction of the stored biological specimen and ask when destruction will occur.
- Ask about copies. Require an explanation of backups, laboratory systems, cloud vendors, research datasets, controlled-access repositories and third-party recipients. Ask which copies can be deleted and which must be retained, with the reason and retention period.
- Withdraw optional research consent. State whether you withdraw from future studies and ask whether withdrawal affects data or samples already used, distributed or incorporated into an analysis.
- Request confirmation. Ask for written confirmation of the actions completed, categories retained and the date of completion.
Account closure may remove your login while leaving laboratory records, legal-retention records, backups or research copies. Do not treat a disappearing dashboard as proof that every genetic record and sample has been destroyed.
What the FTC’s 1Health case illustrates
In 2023 allegations involving 1Health.io, formerly Vitagene, the FTC described unsecured health and genetic information, deletion representations it considered misleading and a material expansion of the privacy policy affecting previously collected data without adequate notice and consent. The agency’s release described reports exposed for nearly 2,400 consumers and raw genetic data for at least 227 others. Those are figures from that enforcement matter, not an estimate of the risk across all genetic services.
FTC Bureau of Consumer Protection Director Samuel Levine said, “Companies that try to change the rules of the game by re-writing their privacy policy are on notice. The FTC Act prohibits companies from unilaterally applying material privacy policy changes to previously collected data.” The practical lesson is to verify deletion and policy-change claims in the actual terms, preserve the version you accepted and ask how previously collected data will be treated.
Consumer app or clinical/research setting?
Neither route is automatically safer. Compare the actual entity, consent, retention schedule and controls before deciding.
| Question | Consumer app or direct-to-consumer service | Clinical or research setting |
|---|---|---|
| Who holds the data? | An independent company may hold the account, genetic files, reports and telemetry; HIPAA may not apply. | A covered provider or business associate may handle protected health information, while a study’s institution and repository follow the consent and governance terms. |
| Is research optional? | Check whether research, commercial use or data licensing is separate from core service terms. | Read the informed-consent document for future use, secondary studies, commercial involvement and controlled-access sharing. |
| What can be deleted? | Ask separately about profile, reports, raw files, backups, vendor copies and the biological sample. | Ask what withdrawal can remove after data or samples have entered a study, repository or completed analysis. |
| How are results explained? | Interpretation and clinical oversight vary; a consumer report is not automatically a diagnosis. | Ask about clinician or genetic-counselor involvement, return of results and procedures for medically significant findings. |
| Which protections apply? | FTC, state privacy and other rules may apply according to the entity and conduct. | HIPAA may apply when a covered entity or business associate is involved; research-specific consent and institutional rules also matter. |
If you suspect misuse, a breach or an unexpected policy change
- Change the service password and any reused password immediately; enable multifactor authentication.
- Revoke linked apps, download an account-activity record if available and preserve notices, emails and policy versions.
- Ask the provider which data, samples and recipients are involved, when the event occurred and what containment steps were taken.
- Submit a targeted deletion or research-withdrawal request rather than relying on a generic account closure.
- Report suspected deceptive privacy or security practices to the Federal Trade Commission and consider your state attorney general or privacy regulator.
- If an insurance or employment decision appears to involve genetic information, obtain advice specific to your state, the product and the facts.
A practical decision rule
Proceed only when you can answer four questions in plain language: what is collected, who can receive it, how long each copy and sample remains, and what withdrawal or deletion actually accomplishes. If the provider cannot answer, narrow the data you share, choose a service with clearer terms or use a clinical or research route whose consent and oversight fit your purpose. Revisit the policy periodically because features, ownership, recipients and legal requirements can change.
