UK employers should define a specific purpose, test whether monitoring is necessary and proportionate, complete a data protection impact assessment (DPIA), identify both a UK GDPR lawful basis and an Article 9 condition, explain the system to workers, restrict access and retention, and contractually control the supplier before collecting data.
This guide applies to employers, HR and people teams, privacy officers, procurement staff and worker representatives in the UK. It summarises ICO guidance under the UK GDPR and Data Protection Act 2018; the correct legal analysis depends on the deployment, workforce and decisions involved.

Why an AI wellbeing score may be health data
The label used by a supplier does not determine the legal category of information. The ICO describes “data concerning health” as personal data related to a natural person’s physical or mental health that reveals information about their health status. That includes information about the provision of health care services.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitchesA wellbeing platform might ask workers about anxiety, sleep or pain; read activity or physiological signals from a wearable; analyse messages or survey responses; or infer a person’s emotional or physical state. If the resulting record reveals health information about an identifiable worker, it is health information and special category data under UK GDPR. A generated inference is not automatically ordinary HR analytics just because an algorithm produced it.

- Compatible Model(s): Magicmoon brand filter only for 24 inch -diagonally measured - widescreen monitor - aspect ratio 16:9 - filter size: width: 20 15/16", Height: 11 13/16" (531mm x 298mm)
- Superior Privacy: The computer privacy filter makes the screen appear dark when looking at it from an angle (the angle is about 30 to 60 degree), but bright when looking directly at it. To change the privacy level - simply adjust your monitor’s brightness accordingly
- Eye and Screen Protection: Privacy Filter does not only protect your private life but also protects your eyes by blocking 30% of blue light , blocking the harmful blue light between 380 to 495 nm, it filters out the blue light and relieves eye strain
- Perfect For Open Workspaces: Great for maintaining screen privacy in open work spaces
- Includes Two Options: Option 1 uses clear adhesive strips that securely attach to any computer screen. Option 2 (for computer screens with a raised bezel only) uses slide mount tabs that easily stick to the display frame, allowing you to slide the privacy screen filter on and off as needed
Special category processing needs an Article 6 lawful basis and a separate Article 9 condition. Neither is universal: the appropriate choices depend on the purpose, the organisation’s role, the workforce and the surrounding facts. Obtain advice for the particular use rather than treating a vendor’s template or a worker’s click-through as a complete answer.
Start with the purpose, not the product
Write a short purpose statement before comparing suppliers. It should identify the outcome sought, the people who benefit, the data needed, who can see individual results and what decisions, if any, may follow. “Use AI to improve wellbeing” is too broad to test. A purpose such as identifying themes in an anonymous survey to improve shift design is more specific and easier to assess.
Map every data flow
Document what the tool asks workers to enter, what it collects passively, what it infers, and where each item goes. Include:
- Questionnaires, free-text comments, check-ins and disclosures about mental or physical health.
- Wearable feeds such as heartbeat, movement, sleep or step information.
- Communications, calendar or workstation signals, if the system analyses them.
- Model outputs, confidence indicators, risk categories and recommendations.
- Whether processing happens on a device, in the organisation’s environment or in the supplier’s cloud.
- Which people, dashboards and downstream systems can see identifiable outputs.
- Supplier subprocessors, international transfers, backups and deletion routes.
Mapping the flow often reveals that a supposedly voluntary app is linked to an employee directory, manager dashboard or absence system. That connection can change the privacy impact and the legal analysis.
Test necessity and less intrusive alternatives
The ICO says employers must first consider what they are trying to achieve and whether a less privacy-intrusive way can do it. A tool being available, inexpensive or popular is not evidence that individual monitoring is necessary.
Compare the proposed system with options such as an aggregate survey, a voluntary employee-assistance route, manager training, workload or roster changes, or general workplace improvements. Ask whether the same outcome can be achieved without identifying workers, without passive collection, or with a smaller set of signals. Record why the chosen approach is needed and why the alternatives would not meet the stated purpose.

Complete the legal and impact assessment before launch
Identify both UK GDPR conditions
For worker health information, document the Article 6 lawful basis and the Article 9 special category condition before processing starts. The basis and condition must match the real purpose; do not present consent, legitimate interests, employment-law provisions or another route as automatically correct. If the organisation relies on a condition in UK data-protection law, document the related safeguards and any required policy document.

A free scan shows the junk files, broken settings and background clutter dragging Windows down - then fixes them in one click.Free scan · Windows 10 & 11Carry out a DPIA
The ICO expects a DPIA before health monitoring begins. Describe the processing, necessity and proportionality, risks to workers, and measures that reduce those risks. Invite worker or representative input where appropriate and keep a record of the reasoning, not just the final approval.
Revisit the DPIA when the purpose, model behaviour, data sources, supplier, retention period or access model changes. A new feature that analyses messages or adds physiological data is a material change, not a routine software update.
Check automated-decision rules
If the system makes a solely automated decision with legal or similarly significant effects, assess the additional UK GDPR Article 22 restrictions. The ICO states that worker health information cannot be used for such automated decision-making unless the applicable exception, including explicit consent or a substantial public-interest route, is met. A human who merely accepts an algorithmic recommendation may not provide meaningful human involvement. Identify who reviews an output, what they can change, and how a worker can challenge an outcome.
Tell workers what is happening
Give clear privacy information before collection and at the point of use where that helps understanding. Explain:
Free tools Windows power users keep installed

- the specific purpose and the categories of information collected;
- whether the system infers health, emotional state or sensitive conditions;
- whether participation is voluntary, what “voluntary” means in practice and what happens if someone declines;
- who can see identifiable information, including managers, HR, occupational-health staff and supplier personnel;
- how outputs are used, and whether they can influence absence, performance, promotion, discipline or job security;
- the supplier’s involvement, international transfers and relevant subprocessors;
- the retention period or the criteria used to set it;
- workers’ rights and the internal route for questions, access requests or complaints.
Use examples that reflect the actual interface. If a “stress risk” label is inferred from sleep and activity data, say so; do not describe the system merely as a feedback survey. Covertly gathering worker health information is unlikely to be justifiable under the ICO’s monitoring guidance.

Do not assume consent solves the employment imbalance
Workers may feel unable to refuse a request from their employer, even when a screen says “I agree”. The ICO says consent is not usually appropriate for employment monitoring because of that power imbalance. A consent mechanism does not remove the need for necessity, proportionality, a valid Article 6 basis and an Article 9 condition.
If participation is described as voluntary, ensure that declining does not result in disadvantage, that managers cannot pressure workers informally, and that an equivalent non-monitoring route exists where appropriate. Explain any consequences of withdrawal, including what happens to information already collected.
Separate wellbeing support from employment scoring
A support tool can undermine trust if its outputs later become evidence in performance management, promotion, discipline, absence handling or redundancy decisions. State up front whether managers receive individual-level results and whether any employment decision follows. If the purpose changes, reassess compatibility, transparency, legal conditions and the DPIA before using the information for the new purpose.

Where an employment decision could significantly affect someone, provide meaningful human review, a way to contest inaccurate information and a record of the factors actually relied upon.
The International Labour Organization’s 30 April 2026 analysis links intrusive surveillance, work intensification, reduced autonomy and privacy concerns with psychosocial risks. That is contextual evidence, not a UK legal rule, but it is a practical reason to examine whether the monitoring itself could harm the wellbeing it is intended to support.
Control access, retention and secondary use
Give people only the access they need
Use role-based access and separate health information from routine personnel records where appropriate. A manager who needs aggregate themes generally should not receive named responses. Define access roles for HR, occupational health, administrators, supplier support and security teams; log and review privileged access; and remove access when a person changes role.

Hurry up and place an order, own a privacy screen for a computer monitor 24 inch, and protect your monitor screen and your eyes.
Set and enforce a retention period
Keep information only for as long as the stated purpose requires, subject to applicable recordkeeping duties. Define the period for raw responses, identifiable outputs, aggregate reports, audit logs and backups separately when necessary. Document the rule, review it, and erase or anonymise information when it is no longer needed. Ask the supplier to explain deletion from live systems, replicas and backups rather than accepting a generic “delete” button.
Prevent incompatible reuse
Do not repurpose health information for a new objective unless the new use is compatible, the worker gives specific consent, or a clear legal obligation or function applies. A dashboard built for service improvement should not silently become an absence-scoring system. Update privacy information and reassess the legal conditions before a compatible new use begins.
Make the supplier answerable
The organisation usually determines why and how worker monitoring occurs and is therefore the controller. A supplier acting only on the organisation’s documented instructions may be a processor. Establish the roles before processing, including for analytics, support and model improvement; a contract label alone does not decide the issue.
Questions for procurement and privacy teams
- What exact inputs, derived features and inferences are produced, and which are optional?
- Can the service operate with aggregate or pseudonymous data instead of named records?
- Are customer data used to train or improve a general model? If so, on what instructions and under what controls?
- Where are processing, support, backups and subprocessors located, and what transfer mechanism applies?
- What security controls protect data in transit, at rest and during administrative access?
- How are access requests, correction, deletion, objections and incidents handled, and within what agreed times?
- What are the retention and verified-deletion procedures for live data, replicas and backups?
- Can the employer export records in a usable format and remove them at contract end?
- How are model changes, new data sources and material changes in outputs notified and assessed?
- Can the supplier explain an individual output well enough for a human reviewer to understand its limits?
Put responsibilities, instructions, confidentiality, security, subprocessor approval, assistance with rights, breach notification, deletion and audit information in a written contract or service agreement. Procurement does not outsource the employer’s accountability: the employer must obtain enough information to perform its own DPIA, transparency and security duties.

The following framework is an editorial way to compare products against the ICO duties; it is not an ICO scoring scheme. Record evidence for each candidate and reject a feature that cannot be justified by the stated purpose.
| Comparison area | Questions to document |
|---|---|
| Data minimisation | Does the tool need individual-level data, passive collection or every available signal? |
| Inference and sensitivity | What health or emotional states are inferred, and how sensitive or uncertain are the outputs? |
| Notice and choice | Can workers understand the system, participate without pressure and decline without disadvantage? |
| Identifiable access | Who can see named results, and do managers receive them by default? |
| Purpose controls | Can outputs be blocked from performance, absence or disciplinary workflows? |
| Retention and deletion | Are periods configurable, and can deletion be verified across replicas and backups? |
| Security | Are role-based permissions, administrative controls, logging and incident processes documented? |
| Supplier arrangements | Are controller or processor roles, subprocessors, transfers and contract duties clear? |
| Explainability and review | Can a reviewer understand an output’s basis, uncertainty and limits and correct errors? |
| Less intrusive design | Could an aggregate report, voluntary route or non-monitoring intervention meet the same goal? |
Common failure modes and corrections
“It is wellness data, not health data”
Failure: treating a mood score or stress inference as ordinary engagement information.
Correction: classify information by what it reveals about an identifiable person, including inferred physical or mental health, then apply the special category analysis.

“Everyone clicked accept”
Failure: relying on a consent banner in a relationship where workers may feel they cannot refuse.
Correction: examine a context-appropriate legal basis and Article 9 condition, provide a genuine choice where participation is optional, and document safeguards.
“The vendor handles compliance”
Failure: accepting a supplier’s certification without understanding data flows, access or deletion.
Correction: establish roles, obtain evidence, complete the employer’s DPIA and write enforceable responsibilities into the contract.
“We can use the data later”
Failure: moving wellbeing outputs into performance or absence decisions without a new assessment.
Correction: define prohibited and permitted uses at launch and reassess compatibility, transparency, legal conditions and human review before any change.
“Aggregate” means anonymous
Failure: publishing small-group results that allow a person to be inferred, or retaining the underlying named records indefinitely.
Correction: assess whether people can reasonably be reidentified, limit reporting groups and apply the same retention and access discipline to source data.
A launch checklist for UK employers
- Describe the exact purpose, decisions and intended beneficiaries.
- Map inputs, passive signals, inferences, locations, recipients and downstream systems.
- Compare aggregate, voluntary and non-monitoring alternatives and document necessity.
- Identify the Article 6 lawful basis and Article 9 condition for the actual context.
- Complete and approve a DPIA before collection; consult workers or representatives as appropriate.
- Assess Article 22 and human-review requirements for any solely automated significant decision.
- Publish clear worker information covering data, inferences, access, uses, retention, supplier involvement and rights.
- Configure minimisation, role-based access, separation of records, retention and deletion before inviting participation.
- Establish controller or processor roles, review subprocessors and transfers, and sign the required contract.
- Test a worker’s ability to understand, challenge and correct an output.
- Monitor access, incidents, complaints and unexpected effects on autonomy or workload.
- Revisit the DPIA and privacy information whenever a feature, model, purpose or data flow changes.
What responsible use looks like
Responsible deployment is narrower than “collect everything and let the model find patterns”. It uses the least intrusive data that can achieve a defined purpose, keeps named health information away from routine management where possible, gives workers an honest choice, and prevents a support service from becoming a hidden scoring system. The World Health Organization’s 2021 guidance on AI for health expresses the broader principle that AI technologies “must put ethics and human rights at the heart of its design, deployment, and use.” In an employment setting, that principle is implemented through UK GDPR conditions, transparency, proportionality, security and accountability.
The ICO’s monitoring-workers guidance was current as accessed on 13 October 2026 and states that it is under review following changes made by the Data (Use and Access) Act. Check the current ICO material and obtain advice on the specific deployment before processing begins.
